( � i ..a. -° � ICI u. � . . �� � t , , ,... 1415 1 Town Board Minutes December 10, 2001 TOWN OF DANBY TOWN BOARD MINUTES DECEMBER 10 , 2001 PRESENT : Supervisor Edward Inman Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz, Gladys Varona-Lacey Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer William Hall - Highway Superintendent Members of the Public : Roy Casterline , Phil Rafferty, Eileen Wright, Willard Daetsch, Ames Brown, Sue Howe, Roger Casterline Supervisor Edward Inman called the meeting to order at 7 : 00 p . m . and led all present to the Pledge of Allegiance to the American Flag . ADDITIONS TO THE AGENDA : 1 ) Supervisor Inman requested that the Award of Bid for the highway department truck be added to the Agenda under new business . 2) Supervisor Inman requested that the Recreation Partnership Agreement discussion be added under new business . 3 ) Councilperson Gagnon requested that scheduling interviews of applicants for Planning Board and Board of Zoning Appeals be added to the agenda . No board member objected . PRIVILEGE OF THE FLOOR Carol Sczepanski reported to the Board that it is necessary that the Town hire a service or person to clear the Town Hall walks of snow and ice . It is necessary that the walks be cleared by 9 : 00 a. m . weekdays when the Town Offices are open . E ileen Wright - thanked the Board for how they have conducted business this year. AWARD OF BID FOR HIGHWAY DEPARTMENT TRUCK Supervisor Inman reported that the low bid for the highway department truck was received form Pete B arbis of Burr Truck & Trailer Sales, Inc . 2901 Vestal Road Vestal , New York 13850 The net B id Price was $ 114 ,696 . 00 . Highway Superintendent William Hall reported that the bid from Burr Truck & Trailer Sales was for a Volvo and that if there was a problem there is a local sub dealer who can do warranty work and other repairs . Supervisor Inman reported that he would like to have someone obtain information for financing the purchase of the new truck . The Board has discussed about using half of the cost of purchase from the Capital Reserve Fund and leasing or bonding for the remainder. Councilperson Gagnon asked if we could award the bid and decide about the funding before we take possession. RESOLUTION TO AWARD BID FOR HIGHWAY DEPARTMENT TRUCK RESOLUTION NO. 97 OF 2001 By Councilperson Strichartz : Seconded by Councilperson Nolte WHEREAS, The Town Highway Department on November 21 , 2001 advertized a request for sealed 1416 2 Town Board Minutes December 10 , 2001 bids to supply a new 10-Wheel Dump Truck with Plow, Wing, and Dump/Spreader Box for the Town of Danby Highway Department, and WHEREAS, the Town Board of the Town of Danby opened the bids on Wednesday, December 5 , 2001 at 7 : 00 p . m . , and WHEREAS, Pete Barbis of Burr Truck & Trailer Sales, Inc . 2901 Vestal Road Vestal , New York 13850 submitted the low bid of $ 114 ,696 . 00 , now be it RESOLVED, that the Town Board of the Town of Danby awards the bid for one ( 1 ) new 10- Wheel Dump Truck with Plow, Wing, and Dump/Spreader Box for their low bid of $ 114 . 696 . A roll Call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona- Lacey Aye Inman Aye Carried Unanimously County Representative Report State Archives Grants - encouraged the Town Clerk to submit a grant for this year as a holding phase . Room Tax - innkeepers and bed and breakfasts do not support a raise in room tax at this time . Public Libraries - Directors and Special Planning Committee want to do a study of the reading centers . They are concerned that the Public Library is not receiving full funding and the operation of the reading centers is costly. Danby School Status Report - The sub-committee on financing and funding have a report that was approved at the steering committee meeting . The report will be presented to Senator Kuhl to secure the second payment of $ 50 , 000 . 00 . BOCES and other school districts are very supportive of the program . The plan is to have a program up and running by September 2003 . There are classes being held at the Danby School now. They want to have three (3 ) other pilot programs next year. REPORTS Highway Report - November 2001 received Zoning - Code Enforcement Office Report - received Dog Control - SPCA Report Received Zoning - Susan Beeners reported that Benjamin ' s One Stop is scheduled to be demolished this Friday, December 14, 2001 . She has contacted Dick Comi and has received a letter in defense of his $4 ,400 . 00 bill . Documentation on the bill will be sent to the telecommunication tower applicant . Makarainen Road Turn-around - Supervisor Inman has consulted the Town Attorney and asked him to proceed with the Makarainen Road turn around . Planning Board Report - Susan Beeners reported that the Planning Board will not hold a regular meeting in December. December 17 ,2001 will be a work session of the Planning Board to work on the comprehensive plan draft. Susan submitted a summary of the Planning Board recommendations related to the regulation of Public Utilities, dated December 10 , 2001 . The Planning Board would like some direction on whether the regulation of public utilities should be a priority item and some research be done to draft legislation. The Board postponed decision on whether to pursue the regulation of public utilities to January 2002 . Water Resource Council Councilperson Strichartz read a report to the Town Board from Linda Dorn who is the Town of Danby representative on the Water Recourse Council . She would like to continue on the Water Resource Council . The report was not filed with the Clerk. Recreation Partnership Draft Contract 1417 3 Town Board Minutes December 10, 2001 Councilperson Strichartz reported that the Recreation Partnership Committee has a contract that the draft contract is in the process of being reviewed and amended . Much of the discussion is on what to call the partnership . Community Council Eileen Wright reported that the Danby Community Council will not meet until later this week. They had a successful concert with standing room only . The Town Clerk reported that she had received a report from a handicapped individual of the misuse of the handicapped parking space . The car in the handicapped did not have a handicapped permit or handicapped plates . Senior Citizens Carol Sczepanski reported that the Danby Senior Citizens Annual Christmas Dinner was held at the Common Ground and attended by fifty one ( 51 ) seniors . Entertainment was provided by our local Bob Turk and his band . A trip to the Cider Mill Playhouse is scheduled for Thursday, December 13th. COMMUNICATIONS : 1 ) Letter from Rhonda Roaring - requesting Town to post its lands to discourage hunting . 2 ) Letter from Carl Seamon - re : interest in reappointment as a West Danby Water Commissioner . 3 ) West Danby Water Commissioners Annual Report Year End Meeting of the Board Scheduled RESOLUTION NO. 93 OF 2001 YEAR END MEETING OF THE BOARD FOR 2001 By councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby sets the Year End Meeting of the Board for Thursday, - rte' 27, 2001 at 7 : 00 p . m . JereMBeY A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO. 94 OF 2001 RETENTION REQUIRED OF BOARD OF ZONING APPEALS TAPES By Councilperson Gagnon : Seconded by Councilperson Strichartz WHEREAS, the Chairman of the Board of Zoning Appeals reported to the Board that he needs for his reference the Board of Zoning Appeals tapes recorded at hearings and meetings , and WHEREAS, the secretary of the Board of Zoning Appeals does not retain all tapes after they have been transcribed, now be it RESOLVED, that the Town Board of the Town of Danby requires the Town Clerk retain the tapes of all Board of Zoning Appeals hearings and meetings for a minimum of five (five) years . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously 1418 4 Town Board Minutes December 10, 2001 RESOLUTION No. 95 of 2001 AUTHORIZING MINOR CHANGE ORDERS - BENJAMIN ' S ONE STOP DEMOLITION PROJECT By Councilperson Strichartz : Seconded by Councilperson Gagnon WHEREAS, unforeseen circumstances related to bringing the former Benjamin' s One Stop Building into compliance with the Town ' s unsafe buildings law might arise during the course of demolition, whereby a change order might need to be made by the Town ; now therefore it is RESOLVED , that the Town Board of the Town of Danby authorizes the Town Supervisor to execute change orders when in his judgement the change orders are necessary and are in compliance with the Town' s unsafe buildings law and related codes and regulations , with the maximum cost of the work under such change orders not to exceed $2 ,000 (two thousand dollars) and to be subject to review and ratification by the Town Board at their next meeting . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO 96 OF 2001 HIGHWAY DEPARTMENT TRANSFER OF FUNDS By Councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby authorizes the transfer of $4 , 000 (four- thousand dollars) from Account No . DA5110 . 400 to DA5142 . 400 to cover expected expenditures in the Snow Contractual account for the months of November and December 2001 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Short Road - Discussion The Town has received a proposal for the subdivision of a lot located on the corner of NYS Rte . 34/96 and Short Road in West Danby. The proposal was submitted by Roger Casterline . Susan Beeners reported that Roger Casterline is proceeding with going to the Planning Board with a plan that will show a proposed phase 1 (one) lot for a phase 1 (one) driveway from NYS Rte . 34/96 . Proposed for Phase 2(two) development which would be additional lots on Short Road and improvement of Short Road for year around access . It is necessary to get approval from the Planning Board for Phase 1 with appropriate commitments related to Phase 2 in the improvement of the road . Roger Casterline will consult with the Highway Superintendent about up- grading of the road and access to water lines . Recreation Partnership Agreement The Board has reviewed the Recreation Partnership Agreement between Tompkins County and Municipalities and and the request by the City of Ithaca to use in-kind services in lieu of financial payment . Councilperson Strichartz said that there has been a lot of discussion about the City of Ithaca request for their share of the cost to be in-kind service in lieu of financial payment. That issue of in-kind has not been resolved . e r y I 149 5 Town Board Minutes December 10, 2001 Schedule for Interviews for Planning Board and Board of Zoning Appeals Candidates The Board scheduled interviews for the Planning Board and the Board of Zoning Appeals candidates for Thursday, December 27 , 2001 at 6 : 30 p . m . Snow Removal at Town Hall A person is still needed to clear the walks at the Town Hall . A notice will be placed in the Danby Area News . Appointment to the Water Resource Council A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to recommend the reappoint Linda Dorn to the Tompkins County Water Resource Council to represent the Town of Danby .
