Chairperson Laurene Gilbert declared the public hearing open at 7 : 05 p . m. and the following Notice
of Publication was read :
"PLEASE TAKE NOTICE, that the Planning Board of the Town of Danby will hold a public
hearing on Thursday, November 15 , 2001 at 7 : 00 p . m . at 1830 Danby Road, Ithaca, New York to
consider an application for a Special Permit for the proposed construction of a 11 ,050+/- square foot
addition to the First Baptist Church of West Danby, for a gymnasium and classrooms , located at
2219 West Danby Road, Town of Danby Tax Parcel 16 . - 1 - 18 . 1 . Bruce A . Scott, Pastor, Applicant.

Chairperson Laurene called the meeting of the Planning Board to order at 7 : 10 p . m . following a
public hearing to consider an application for a Special Permit for the proposed construction of an
addition to the First Baptist Church of West Danby .
RESOLUTION NO. 11 OF 2001
NEGATIVE DETERMINATION OF ENVIRONMENTAL SIGNIFICANCE

WHEREAS, this action is the Consideration of an Application for a Special Permit for the proposed
construction of an 11 ,050 +/- square foot addition to the First Baptist Church of West Danby, for a
gymnasium and classrooms , located at 2219 West Danby Road, Town of Danby Tax Parcel
16 . - 1 - 18 . 1 ; and
WHEREAS, this is an Unlisted action for which the Town of Danby Planning Board is acting as
Lead Agency, and of which the Tompkins County Department of Planning has been notified for
purposes of General Municipal Law 239-m review ; and
WHEREAS, the Town of Danby Code Enforcement Officer has recommended that a negative
determination of environmental significance be made for this action ; now, therefore, it is
RESOLVED, that the Town of Danby Planning Board, acting as Lead Agency in environmental
review of this Unlisted action , makes a negative determination of environmental significance .
A roll call vote on the resolution resulted as follows :

RESOLUTION NO. 12 OF 2001.
SPECIAL PERMIT FOR ADDITION TO FIRST BAPTIST CHURCH OF WEST DANBY -
APPROVAL

WHEREAS, this action is the Consideration of an Application for a Special Permit for the proposed

WHEREAS,this is an Unlisted action for which the Town of Danby Planning Board on November
15 , 2001 has made a negative determination of environmental significance ; and
WHEREAS, the Town of Danby Planning Board on November 15 , 2001 has held a public hearing
on this action ; now therefore, it is
RESOLVED, that the Town of Danby Planning Board grants a Special Permit to the First Baptist
Church of West Danby for the addition and related site work as proposed.

Reports :
Robert Roe reported that the Draft Proposal for Purchase of Development Rights by the County is
available and is a 73 pages .
Privilege of the Floor
Phil Rafferty from Seneca County reported to the Planning Board that he is considering the purchase
of a piece of property in the Town of Danby. The property is a corner lot on. Short Road and NYS
Rte . 34/96 . The Code Enforcement Officer said there may be problems with accessibility to the
property from the Short Road side of the property . He asked the Board what he needs to do to get
permission to put a driveway on Short Road for access to the lot. The property to be subdivided is
a 7 . 85 acre parcel and he plans to purchase two (2) acres on the corner of the parcel to construct a
residential home . Short Road is a seasonally maintained road. The driveway needs to be placed
approximately 300 feet along Short Road . He described the area and the difficulty of placing a
driveway on NYS Rte . 34/96 . He said he has not purchased the property at this time .
Subdivision of this lot would need Planning Board approval because the property has frontage on
a dashed line on the zoning map . If you have frontage on a seasonal road for any part of a parcel
Planning Board approval is needed. New York State Town Law 280(a) says that no building permit
shall be issued for a structure unless the street or highway giving access to the structure has been
suitably improved to the satisfaction of the Town Board and found adequate for public safety.
The Planning Board reviewed the map of the property and the area of the seasonal road . The
proposed lot is located in the West Danby Water District and is located in a high density zoning area.
The proposed subdivision of the lot will need to come to the Planning Board for approval .
Susan said that the issues are :
What is the adequate access that is needed on the 300 feet?
Who is going to pay for improving it?
Is the Town willing to chance the road from seasonal to year-round for 300 feet to maintain
access?
There is also more land there that may be sold and then there would be an improvement cost and a
long range maintenance cost.
Chairperson Gilbert said that as a Planning Board that the only thing we can do is say that it is in
compliance with our comprehensive plan and that it is recognized that it is in a high density area .

We are encouraging development in those particular areas . The proposed new lot is in the water
district .
Mr. Rafferty reported that he would drill a well as to have the water line extended would cost in
excess of $3 ,000 .
Miscellaneous Reports :
Bob Roe reported that the Draft Purchase of Development Rights for Tompkins County is available.
Transportation - a letter to Tompkins County Planning Department from Elizabeth Keokowsky
regarding public transportation was discussed . It was suggested that maybe the Board could ask
Betsy Keokowsky to come to a meeting and describe what this could do for our community.
Public Utilities - update
The Board reviewed and discussed a memo update for a proposed Public Utilities Zoning
Amendment dated November 15 , 2001 .
Bob Roe said that all changes in DEC regulations take place in Albany. The fast track for changing
DEC regulations is a minimum of three(3 ) years . A drilling unit in this area is 640 contiguous acres
so there is not many places drilling could occur.
Bill Farrell said that we are covered by the DEC regulations .
Laurene Gilbert said that usually things are done on a case by case basis until it becomes too much
of an overload and then an ordinance is inacted .
Laurene will write a response to the Town Board from the Planning Board. She will circulate it to
the Planning Board members to review and approve the content and to report to the Town Board at
their next meeting .
Laurene will report to the Town Board that there is a notification mechanism, and on the DEC permit
it is required that the company must notify the Town . A policy could be developed by the Town that
when notification to the Town has been made that a permit has been issued neighbors in the
immediate area will be notified .
Motion to Schedule Work Session for Comprehensive Plan
A motion was made by Bob Roe and seconded by Bill Farrell that the Planning Board of the Town
of Danby will not hold a regular meeting in December and schedule a work session of the Board for
Monday, December 17 , 2001 at 7 : 00 p . m . to work on the comprehensive plan .

Approval of Minutes :
A motion was made by Robert Roe and seconded by Nancy Weitzel that the Planning Board of the
Town of Danby approves the October 23 , 2001 minutes of the Planning Board be aproved as
submitted.
