At an Adjourned Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East r Seneca Street , Ithaca , New York , on the 5th day of March , 1979 , at 5 : 30 p . m . , there were PRESENT : Noel Desch , Supervisor Robert N . Powers , Councilman Catherine Valentino , Councilwoman Shirley Raffensperger , Councilwoman Gust L . Freeman , Councilman ALSO PRESENT : James V . Buyoucos , Town Attorney Lawrence P . Fabbroni , Town Engineer / Building Inspector Edward W . King , Attorney , ( Zoning Board of Appeals , Town of Ithaca ) Representative of the Media : Joel Tallmadge , WTKO ABSENT : Andrew W . McElwee , Councilman Victor Del Rosso , Councilman BIDS ON WATER TANKS Mr . Fabbroni , Town Engineer , reported that bids on painting the Sapsucker Woods Road and the Danby Road water tanks were received from five companies . The bids were opened on March 1 , 1979 . The low bidder was Broome Industrial Paint Co . , Inc . with a bid of $ 29 , 419 . Mr . Fabbroni , based on his review and a review by Lozier Engineers , recommended that the Board accept the bid . After discussion , the Board acted as follows : RESOLUTION NO . 37 - 1979 AWARD OF CONTRACT TO BROOME INDUSTRIAL PAINT CO . , INC . - PAINTING WATER TANKS Motion by Supervisor Desch , seconded by Councilman Powers , WHEREAS , on March 1 , 1979 bids were received for the repainting of two 500 , 000 gallon steel water storage tanks on Sapsucker Woods Road and Danby Road for the Town of Ithaca , WHEREAS , the Town Board has carefully considered the Engineer ' s Report on these bids ; AND WHEREAS , it is determined that the best interests of the Town of Ithaca will be served by using Basic Items 401S , 40lD , 402S , 402D , 403 , 404 and 405 , r6 � Town Board Minutes - 2 - March 5 , 1979 NOW , THEREFORE , BE IT RESOLVED : That award be made of contracts for repainting of two 500 , 000 gallon steel water storage tanks on Sapsucker Woods Road and Danby . Road , to the following : BROOME -INDUSTRIAL PAINTING CO . , INC . at an estimated contract sum of $ 29 , 419 . 00 . ( Powers , Freeman , Valentino , Raffensperger , and Desch voting Aye . Nays - none ) The Town Engineer was directed by the Board to obtain proposals for cathodic protection for these tanks . About $ 18 , 700 of anti - recession funds are to be used for Sapsucker Woods standpipe , the remainder to come from water surcharge budget items . Supervisor Desch noted there is $ 50 , 000 available in the budget for tank painting and repairs to pump stations . In addi - tion to the approximately $ 10 , 000 left in the budget for pump station repairs , there will be additional funds available by the time such repairs become necessary . Mr . Fabbroni reported that Lozier Engineers will shortly furnish a written recommendation with respect to the bids and contracts . Mr . Buyoucos will ascertain whether the proposed contracts comply with the provisions of Section 769 of the Laws of 1978 . It was agreed by the Board that Mr . Buyoucos should study the contracts to make sure that they do so comply . CERACCHE TELEVISION CABLE SERVICE TO POOLE ROAD Councilwoman Valentino reported that at a recent meeting of the County Cable Commission , Mr . David Lee ( Ceracche TV-ATC ) was present . She said he specifically stated that they will begin the Poole Road installation sometime this summer with an expected completion date in the late fall . Councilwoman Valentino said this commitment is a part of the minutes of that Cable Commission meeting . APPEARANCE TICKETS AS RELATED TO ZONING VIOLATIONS Edward W . King , attorney , and member of the Town of Ithaca Zoning Board of Appeals , said he had noted the Town ' s legal notice on March 2 , 1979 with regard to a proposed local law to consider the issuance of appearance tickets by the various jurisdictions of enforcement in the Town of Ithaca . He said he was heartily in favor of the issuance of such appearance tickets . With respect to the Town ' s dog control law , he said he had some concern over the accumu - lation of fines provided for in one of the sections thereof . He said in the case of a violation which has existed for some time it might be impossible to prosecute , based on the accumulation of fines running to thousands of dollars . Mr . Buyoucos said such provision was inserted , subject to shepherdizing a case in point . This clause will receive further scrutiny . EXECUTIVE SESSION - RESOLUTION NO . 38 - 1979 Motion by Supervisor Desch , seconded by Councilman Powers , RESOLVED , that this Town Board will now retire into Executive Session to discuss certain zoning violations and to interview candidates for the Town Clerk position . ( Raffensperger , Freeman , Powers , Valentino , and Desch voting Aye . Nays - none ) After the executive session , the Board duly reconvened in open session . IBS, Town Board Minutes - 3 - March 5 , 1979 STATE ENVIRONMENTAL QUALITY REVIEW ACT There was discussion with regard to the Town of . Ithaca local procedures with respect to the State Environmental Quality Review Act , as adopted , by resolution , on March 31 , 1977 . It was agreed that consideration should be given to the possible amendment of these procedures , as well as to the matter of adopting a local law to authorize the use of the short form Environmental Assessment Form , and the holding of a public hearing thereon . It was agreed that at the Board ' s regular meeting on March 12 , 1979 a public hear - ing will be scheduled on this matter . AMENDMENT OF DOG CONTROL LAW It was agreed that at the regular meeting of the Board on March 12 , 1979 , the Board will consider scheduling a public hearing to consider amending the present Town of Ithaca Dog Control Law .
