I ,. l 135 1 Town Board Minutes June 11 , 2001 TOWN OF DANBY TOWN BOARD MINUTES JUNE 11 , 2001 Regular Meeting PRESENT : Supervisor Edward Inman Councilpersons : Joel Gagnon, Norbert Nolte , Naomi Strichartz Excused : Gladys Varona-Lacey Others Present : Susan Beeners - Code Enforcement Officer Frank Proto - County Representative Members of the Public : Robert Roe , Ames Brown, Pam Arsenault, George Arsenault, Elizabeth Roe , Kevin Cain, Eileen Wright and Ginny Gartlein . Supervisor Inman called the meeting to order at 7 : 02PM and led all present to the Pledge of Allegiance to the American flag . Discussed rearranging Agenda PRIVILEGE OF THE FLOOR: Councilperson Strichartz gave Linda Dorn' s report on the Water Resources Council . Aquifer study is not in Counties interest presently. Susan Beeners mentioned Town Clerk, Carol Sczepanski submitted a report to the Board on the April NYSTCA Conference she attended . Ames Brown wants the Town to have Moratorium on zoning changes . He asked the Board to not rush into changes and to work on it for another six months . George Arsenault said he is not opposed to two acre lot sizes but is opposed to 200 feet minimum road frontage . He has limited frontage and a lot of acreage . Has several kids who will need a house . Supervisor Inman had a similar problem with lack of frontage but did get Town approval for a 60 (sixty) foot right of way with three additional lots . Board is requesting the Planning Board after the completion of the Comprehensive Plan revisit the whole zoning picture and the land density . Councilperson Gagnon said that maybe Town should more encourage private roads . Kevin Cain asked why it was necessary for the frontage requirement increase . He said he thinks this will be an economic hardship and decrease in taxes . Frontage is most valuable asset for some landowners . More discussion on Zoning changes . Liz Roe Said that there is two or three issues here, the one that Kevin Cain brings up which I think is very valid and the second is that all land is not the same as so therefore in the Arsenault' s case . She said she believes it is not like your land is steep . It makes a huge difference if it is steep land . The real fallacy here is that the two acre two hundred foot lot versus a one hundred fifty two acre lot, the one hundred fifty will provide you with more open space, I don' t know were you get the idea that it is going to be more suburban . It ' s going to be locked land behind the two hundred feet that at some point it will have to have a subdivision on it. If you have a hundred and fifty feet and if you go back three hundred to four hundred feet you are maintaining the whole open space behind it . Its looks a lot less suburban. The other issue is Joel Gagnon ' s issue, who has the money to maintain a 158 2 Town Board Minutes June 11 , 2001 private road? Bob Roe said there is a change in wording of the target area to restrict it to the commercial and high density residential zones . Obviously you are getting rid of all the high density residential zones in Danby . One third of the existing properties will be non conforming. D iscussion on high density zones . Councilperson Strichartz People moved Danby because we have Zoning . Our two public hearings showed this is what the majority wants . E ileen Wright stated she was at both public hearings and the vast majority wanted the zoning changed . Kevin Cain is concerned about the economic value . E ileen Wright said she lives on a Town Road that is privately maintained . Supervisor Inman reported the results from the hearings for the zoning changes as 16 for and 6 against Councilperson Strichartz reported that there were 20 for and 7 against the change for removing the target area in medium density zones . Pam Arsenault concerned about aspects of private roads . B ob Roe will have an influence people without much money . L iz Roe : same Code Enforcement Officer Susan Beeners mentioned that clustering could provide for smaller lots . Approval of Supervisor' s Report A motion was made by Councilperson Strichartz and seconded by Councilperson Nolte that the Town B oard of the Town of Danby accept the Supervisor' s Report as submitted . There will be a hearing on June 13 , 2001 . 2 - The County budget is around $ 5 ,000 ,000 . short . The Budget Committee is trying to get department heads to reduce their budget requests for next year. 3 - The Water Resources Council is still advocating a County Aquifer Study . It is getting publicity on this out to other municipalities . 4 - The Department of Public Works estimates for new buildings on Bostwick Road came in over budget . The matter is withdrawn at this time . 5 - Solar panels at the Library, when unveiled started popping because of "too much sunlight" . 6 - Alternatives to Incarceration by some rearrangement, are now getting some State and Federal reimbursement. 7 - New York State Archives Grant submitted by the Town Clerk has been confirmed in the amount of $4 , 069 . 8 - Draft on the use of New York State Department of Conservation for Region 7 New York State Forest Land is completed and is in Albany . Bob Roe will call Dave Forness of the NYSDEC Forestry . 9 - Cell Towers : Representative Proto suggested why not have the nine (9) Towns form a federation , build the towers , and the County could lease them. (Just another option) . EMC Report : Robert Roe thanked the Town Board for the Resolution on the remediation of the Cornell University hazardous dump site . The EMC is revisiting certain aspects of the Lake Source Cooling project . Tompkins County Planning are to collaborate on reviewing valuation of open lands including Unique 1300 4 Town Board Minutes June 11 , 2001 Natural Areas . Zoning Report : Grant Application - The Town has applied for $7 , 500 . 00 from the Tompkins County Commercial Revitalization Grant Program for work at the Town Hall . Planning Board Report: The summer intern is working with Susan Beeners on the comprehensive plan . Danby Community Council : Eileen Wright reported that the Danby Fair will be held on July 28th at the Danby Fire Station. Councilperson Strichartz reported that a clarinet/piano concert held here at the Town Hall was well attended and that the acoustics were good . COMMUNICATIONS : Supervisor Inman reported that he has received confirmation that the State denied the Community Park Grant . OLD BUSINESS : PROPOSED ZONING AMENDMENT LOCAL LAW NO. 1 OF 2001 RESOLUTION NO . 59 OF 2001 RESOLUTION ADOPTING THE LOCAL LAW AMENDING THE ZONING ORDINANCE AND ZONING MAP TO REMOVE PROVISIONS THAT PRESENTLY REDUCE LOT SIZES , FRONTAGE DIMENSIONS, AND SETBACKS IN MEDIUM AND LOW DENSITY RESIDENTIAL ZONES ALONG EXISTING ROADS SHOWN AS A SOLID LINE ON THE ZONING MAP ; AND TO MODIFY CERTAIN PROVISIONS RELATED TO PRE- EXISTING LOTS AND NONCONFORMING LOTS OF RECORD By Councilperson Gagnon: Seconded by Councilperson Strichartz WHEREAS, a resolution was duly adopted by the Town Board of the Town of Danby for a public hearing to be held by said Town on May 30, 2001 , to hear all interested parties on a proposed local law entitled "A LOCAL LAW AMENDING THE ZONING ORDINANCE AND ZONING MAP TO REMOVE PROVISIONS THAT PRESENTLY REDUCE LOT SIZES , FRONTAGE DIMENSIONS , AND SETBACKS IN MEDIUM AND LOW DENSITY RESIDENTIAL ZONES ALONG EXISTING ROADS SHOWN AS A SOLID LINE ON THE ZONING MAP ; AND TO MODIFY CERTAIN PROVISIONS RELATED TO PRE-EXISTING LOTS AND NONCONFORMING LOTS OF RECORD" ; and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and WHEREAS, said public hearing was duly held on said date and at the time specified in the notice of hearing at the Town Hall of the Town of Danby and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof; and WHEREAS , pursuant to Part 16 of the Implementing Regulations pertaining to Article 8 of the Environmental Conservation Law of the State of New York (State Environmental Quality Review Act [" SEQR"] ) it was determined that adoption of this local law was an unlisted action, that the Town of Danby Town Board was lead agency in considering the environmental significance of the proposed local law, and that the Town of Danby Planning Board and the Tompkins County Planning Department were involved agencies ; and WHEREAS , the Town Planning Board on April 30 , 2001 , after consideration of the various application materials, by Resolution No . 2 of April 30, 2001 , recommended the enactment of the proposed local law limited in its applicability to Low Density Residential Zones and leaving in place the current provisions for reduced lot sizes, etc . along existing roads in Medium Density Residential Zones, and defeated a resolution (Resolution No . 3 of April 30 , 2001 ) recommending the adoption of an identical local law removing the lot size reduction and related provisions as they pertained to Medium Density Residential Zones; and 1 I I' I I { i Iill . I ' 1361 5 Proposed Resolution No 1 June 11 , 2001 WHEREAS, the Tompkins County Planning Department, having reviewed the proposed local law pursuant to General Municipal Law Sections 239-1 and 239-m has indicated by letter that the local law would have no adverse impacts on County or regional interests and that the Town is free to act without prejudice ; and WHEREAS , the Town Board has reviewed the Short Environmental Assessment Form and the recommendation that a negative determination of environmental significance to be made for this local law; and WHEREAS , the Town Board finds it is in the best interests of the Town and its citizens to adopt this local law; NOW, THEREFORE, be it RESOLVED, that the Town Board of the Town of Danby, for the reasons set forth by the reviewer in the Short Environmental Assessment Form, determines that the adoption of the referenced local law will not have any significant adverse impacts on the environment; and it is further RESOLVED, that the Town Board of the Town of Danby hereby adopts said local law entitled "A LOCAL LAW AMENDING THE ZONING ORDINANCE AND ZONING MAP TO REMOVE PROVISIONS THAT PRESENTLY REDUCE LOT SIZES , FRONTAGE DIMENSIONS , AND SETBACKS IN MEDIUM AND LOW DENSITY RESIDENTIAL ZONES ALONG EXISTING ROADS SHOWN AS A SOLID LINE ON THE ZONING MAP ; AND TO MODIFY CERTAIN PROVISIONS RELATED TO PRE-EXISTING LOTS AND NONCONFORMING LOTS OF RECORD", a copy of which is attached hereto and made a part of this resolution ; and it is further RESOLVED, that the Town Clerk be and she hereby is directed to enter said local law in the minutes of this meeting and in the Local Law book of the Town of Danby, and to give due notice of the adoption of said local law by publication of such local law or an abstract or summary thereof in the Ithaca Journal and by filing a copy of said local law with the Secretary of State of the State of New York. A LOCAL LAW AMENDING THE ZONING ORDINANCE AND ZONING MAP TO REMOVE PROVISIONS THAT PRESENTLY REDUCE LOT SIZES, FRONTAGE DIMENSIONS , AND SETBACKS IN MEDIUM AND LOW DENSITY RESIDENTIAL ZONES ALONG EXISTING ROADS SHOWN AS A SOLID LINE ON THE ZONING MAP ; AND TO MODIFY CERTAIN PROVISIONS RELATED TO PRE-EXISTING LOTS AND NONCONFORMING LOTS OF RECORD Be it enacted by the Town Board of the Town of Danby as follows : Section 1 . The Zoning Ordinance of the Town of Danby adopted December 11 , 1991 , as subsequently amended from time to time, be and the same hereby is further amended as set forth in the following sections . Section 2 . Article V, Section 505 entitled "PRE-EXISTING LOTS " is hereby amended to read as follows : " Section 505 — PRE-EXISTING LOTS . A small lot, which was a legal building lot before adoption of this Ordinance (or adoption of an amendment to this Ordinance changing the lot to a non-conforming lot) and which does not meet the minimum requirements of this Ordinance for the zone in which it is located after the time the Ordinance was adopted (or so amended), may be used for any use permitted within said zone provided that all structures on said lot otherwise comply with the terms of this Ordinance . A building already constructed on such a lot may be altered or enlarged provided that the proposed alteration or enlargement otherwise complies with the terms of this Ordinance in effect at the time of such alteration or enlargement" Section 3 . Article VI, Section 600 entitled "LOW DENSITY RESIDENTIAL 1362 6 Proposed Resolution No 1 June 11 , 2001 ZONE" , subparagraph 4 entitled "REQUIRED LOT AREA" is hereby amended to read as follows : "4 . REQUIRED LOT AREA. Lot area shall be not less than two acres with frontage of not less than two hundred feet, and a lot depth of not less than three hundred feet. " Section 4 . Article VI, Section 600 , subparagraph 5 entitled "YARDS " , sub- subparagraph (b) is hereby amended to read as follows : "(b) Minimum side yard width — fifty feet. " Section 5 . Article VI, Section 600 , is hereby amended by deleting in its entirety subparagraph 6 entitled "REDUCTION OF LOT AREA, FRONTAGE, AND SIDE YARDS ALONG STREETS " and by renumbering the succeeding subparagraphs 7 (entitled " SIGNS ") , 8 (entitled "HEIGHT' ) , and 9 (entitled "BUILDING AREA") to be subparagraphs 6 , 7 , and 8 , respectively . Section 6. Article VI, Section 601 entitled "MEDIUM DENSITY RESIDENTIAL ZONE" , subparagraph 4 entitled "REQUIRED LOT AREA" is hereby amended to read as follows : "4 . REQUIRED LOT AREA. Lot area shall be not less than one and one-half acres with frontage of not less than one hundred fifty feet, and a lot depth of not less than two hundred feet." Section 7 . Article VI, Section 601 , subparagraph 5 entitled "YARDS" , sub- subparagraph (b) is hereby amended to read as follows : "(b) Minimum side yard width — thirty-five feet. " Section 8. Article VI, Section 601 , is hereby amended by deleting in its entirety subparagraph 6 entitled "REDUCTION OF LOT AREA AND SIDE YARDS ALONG STREETS" and by renumbering the succeeding subparagraphs 7 (entitled " SIGNS") , 8 (entitled " HEIGHT ' ) , and 9 (entitled "BUILDING AREA") to be subparagraphs 6 , 7 , and 8 , respectively . Section 9. Article X, Section 1000 entitled "NONCONFORMING LOTS OF RECORD" is hereby amended to read as follows : " Section 1000 - NONCONFORMING LOTS OF RECORD . In any Zone in which one single- or two-family dwelling is permitted, a single- or two- family dwelling and customary accessory buildings may be erected on any single lot of record at the effective date of adoption of this Ordinance (or adoption of an amendment to this Ordinance changing the lot to a non- conforming lot) , provided such lot was a valid, lawfully existing lot at the time the Ordinance was adopted (or so amended) . No minimum yard dimensions on any such nonconforming lot shall , however, be reduced, and no height restrictions or parking requirements may be changed without a variance . " Section 10 . The Zoning Map of the Town of Danby, approved by the Town Board on December 11 , 1991 and subsequently amended from time to time, is hereby amended by deleting the following note in the map margin : "NOTES : as In opposed D Zones, areas within ashed line , are areas00whereof line the centerline of roads depicted with a Solid pp osed to reduction in Lot Size, Yards, and/or Frontage is permitted per the terms of the Zoning Ordinance" . Section 11 . If any provision of this local law is found to be invalid by any court of competent jurisdiction, such invalidity shall not affect any other provisions of this local law. RESOLUTION NO . 60 OF 2001 ADOPTION OF A LOCAL LAW AMENDING THE ZONING ORDINANCE TO ELIMINATE MEDIUM DENSITY RESIDENTIAL ZONES FROM THE COMMERCIAL TARGET AREA Be it enacted by the Town Board of the Town of Danby as follows : Section 1 . The Zoning Ordinance of the Town of Danby adopted December 11 , 1991 , as subsequently amended from time to time, be and the same hereby is further amended as set forth in the following section. Section 2 . Article VI, Section 603 , subparagraph 1 entitled "LOCATION OF COMMERCIAL TARGET AREA" is hereby amended to read as follows : " 1 . LOCATION OF COMMERCIAL TARGET AREA. The areas shown on the f t Town of Danby Zoning Map designated High Density Residential Zones are the Commercial Target Area. " Section 3 . Article IV , Section 401 , entitled "MAP" is hereby amended to read as follows : "Section 401 - MAP. Said zones, except for the Commercial Target Area and Mobile Home Park Zones , are bounded as shown on a map entitled "Zoning Map Town of Danby" adopted December 11 , 1991 , and signed by the Town Clerk. Details of existing Commercial Zones and Planned Development Zones are shown in the Supplement to Town of Danby Zoning Map Showing Details of Commercial Zones and Planned Development Zones" dated December 11 , 1991 accompanying the Zoning Map . Said map, map supplement, and all explanatory matter thereon and amendments thereto are hereby made a part of this Ordinance . The Commercial Target Area consists of all the Commercial Zones and all of the High Density Residential Zones shown on said map . Certain existing Planned Development Zones (formerly known as Planned Development Districts) are shown on said map . New Commercial Zones, Planned Development Zones , and Mobile Home Park Zones may be created as set forth in this Ordinance . " Section 4. If any provision of this local law is found to be invalid by any court of competent jurisdiction, such invalidity shall not affect any other p rovisions of this local law . Section 5. It 1_..._._.I - . .� 9 Proposed Resolution No . 2 June 11 , 2001 Inman Aye Carried Unanimously RESOLUTION NO. 61 OF 2001 - POLICY RELATED TO FUTURE PLANNING By Councilperson Gagnon : Seconded by Councilperson Strichartz WHEREAS, The Town Board of the Town of Danby has on June 11 , 2001 enacted amendments to the Zoning Ordinance to make distinctions related to lot size and dimension in the varied residential zones, and to focus commercial development in areas presently zoned for such use and in areas zoned for high density development, and WHEREAS, the Planning Board is presently preparing a draft updated Comprehensive Plan for review and consideration of adoption by the Town Board; now, therefore, it is RESOLVED, that it is a policy of the Town Board, as the updated Comprehensive Plan is completed, to encourage businesses and high density residential development in areas zoned for and otherwise appropriate for such use, and it is further RESOLVED, that it is a policy of the Town Board, as the updated Comprehensive Plan is completed, and with the assistance of the Planning Board, to plan for and make changes to the Zoning Ordinance and Map to provide for high density residential development in appropriate locations, and to encourage appropriate business development of varying types and scales, including community commercial and professional uses that enhance the Town ' s traditional hamlets .
