HomeMy WebLinkAbout2001-04-25 _ 346 1 Town Board Minutes Special Meeting April 25, 2001 TOWN BOARD MINUTES SPECIAL MEETING APRIL 25, 2001 PRESENT : Supervisor Edward Inman Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz, Gladys Varona-Lacey Others Present: Code Enforcement Officer - Susan Beeners Supervisor Inman opened the special meeting at 7 : 00 p . m . Supervisor Inman reported that the Towns of Danby, Lansing, Dryden and Ulysses are interested in joining together to present a draft legal notice to the Tompkins County Board of Representatives . He asked the Town Board for support of the resolution to include the Town of Danby in the legal process . Our Town Attorney is asking for certified copies of the Town of Danby Tellecommunications Local Law and the Town of Danby Zoning Ordinance . The cost to the Town could be approximately $ 500 . 00 per township . No township is obligated to be included if it is neccessary to take the issue to the the Court of Appeals as it could cost townships a combined total of approximately $20, 000 . 00 . Supervisor Inman said that the problem is that the County is very concerned about the possible loss of power. This is a first time that all townships will be affected by a County decision and that they would like to take a stand to be included in the decision making. This legal action will set a presedent and will get a court decision. Councilperson Gagnon said that he thinks that the only way me might resolve this without litigation would be if the County would agree to a consentual framework. He has contacted several members of the Board of Representatives with a consensus approach with the townships . He does not object to the process but is concerned with how we resolve the objection. Councilperson Strichartz said that this resolution is an objection to the process . Six townships have indicated that they want to be included in the process . She thinks that as we represent the people in Danby that this is in our best interest to put this issue to the test, go ahead with it and hope that we win it . There was discussion by the Board members on where our County Representative stands on this issues and why the County has not been working with the community even though they have given us assurances that they will . Also discussed was the issue that the town was not consulted about the location for the proposed towers in Danby. Susan Beeners explained to the Board the process that must be followed for agencies making application for telecommunication towers . RESOLUTION NO. 50 OF 2001 By Councilperson Strichartz : Seconded by Councilperson Nolte OBJECTING TO THE PROCESS WITH WHICH THE TOMPKINS COUNTY BOARD OF REPRESENTATIVES HAS CHOSEN TO USE FOR PLACEMENT OF TOWERS FOR THE NEW 911 TOWERS COMMUNICATIONS SYSTEM, TO APPROVE THE DANBY TOWN BOARD TO JOIN THE TOWN OF ITHACA AND SURROUNDING MUNICIPALITIES IN LEGAL ACTION TO FULLY RECOGNIZE THE TOWNS ROLE IN THIS PROCEEDINGS. By Councilperson Strichartz : Seconded by Councilperson Varona-Lacey WHEREAS , the Town of Danby recognizes the need for a new 911 Communication System, and WHEREAS, the Tompkins County Board of Representatives has failed to recognize the Town of Danby Rights, Regulations and Town Laws with the PROCESS , and 1 1 ■ i i 1111 1 ' , ,' I 1 i I9� ; E r I F 1 l d. . . _ i 1 1 4. _a, a 134 2 Town Board Minutes Special Meeting April 25 , 2001 WHEREAS, the Town of Danby Town Board agrees to take ACTION against the Tompkins County Board of Representatives to protect the rights of the Town and its people , now therefore, it is RESOLVED , that the Town of Danby will enter into an agreement with the Town of Ithaca and surrounding municipalities to share costs and to proceed with LEGAL ACTION against the Tompkins County Board of Representatives to correct the PROCESS used for placement of towers for the new 911 Towers Communications .
