Sczepanski - Town Clerk Frank Proto - County Representative Members of the Public : Ames Brown, Eileen Wright, Willard Daetsch, Roy Casterline, Laurene Gilbert Supervisor Edward Inman called the meeting to order at 7 : 00 p . m . and led all present to the Pledge of Allegiance to the American flag . ADDITIONS TO THE AGENDA : 1 ) Appointment to Tompkins County Resources Council - New Business 2) Association of Towns Dues - Discussion - New Business 3 ) Proposed Traffic Ordinance - discussion - possible resolution PRIVILEGE OF THE FLOOR: The Town Clerk reported that the counter in the Clerk ' s office is being repaired and modified . The Code Enforcement Officer suggested that the Town Board appoint a person in charge of the establishment of the Parks Commission . Members of the Public: Ames Brown of 1840 Danby Road addressed the Board and suggested that the Board thank Senator Kuhl for his help in obtaining $ 50 ,000 in funding for the Ithaca City School District proposal to develop an Agriculture School proposed for the Danby School property. He also asked for an update on the heating system modifications for the Town Hall . COMMUNICATIONS : 1 ) Response to Senator Kuhl ' s from NYS Department of Transportation - regarding speed limit on NYS Rte . 96B . 2) Letter to Town Board regarding Proposed Traffic Ordinance from Dawson Trucking 3 ) Resolution from the Planning Board - Recommendation for appointment . 4) Letter from Linda Hansen - interest in re-appointment to the Planning Board. REPORTS : Highway Department - November 2000 received . Code Enforcement and Zoning Report Code Enforcement Officer Susan Beeners reported that the office has been very busy in November . There has been questions on fees , they responded to a couple of rental property problems , and attended Code Classes in Corning . The intern working with the Planning Board on the comprehensive plan presented them with all the topical chapters of the draft plan . Planning Board Report: Chairperson Laurene Gilbert reported that the Planning Board has received a draft of the entire comprehensive plan with the exception of one chapter (or statement) on the land use section . The Planning Board is planning a panel or discussion on rural character to be held on Thursday, February 1 , 2000 . The Town Board and community are invited to attend. She asked the Board to wait until after the panel discussion before making changes to the ordinance as it may help in making decisions . 1283 2 Town Board Minutes December 11 , 2000 Community Council Report: Willard Daetsch reported that a the Community Council in December held a concert and a Holiday Party at the Town Hall . A capacity crowd attended the concert. An application has been submitted to the Community Arts Partnership for a renewed grant to provide concerts for next year. The Community Council penny drive has been going well at the Danby General Store . The Council hopes to hold a meeting at the Danby School with a tour and presentation of what is planned for the school . Senior Citizens Supervisor Inman reported that he was a guest at the Senior Citizens Christmas Dinner at the • Common Ground on December 7 , 2000 . There were approximately 42 seniors and guests in attendance . Dog Control Report - SPCA report for October 2000 received . Recreation Partnership : Supervisor Inman thanked Councilperson Gagnon for the work that he did on the Recreation Partnership Committee . He has received many pleasing comments from other participants on the committee . County Representative Report : Representative Proto reported the following items of interest to the Town. 1 ) SARA grants available for and encouraged the Town Clerk to apply . 2) Cell Towers - as a result of all the comments from residents regarding the proposed communication towers , the County is taking another look at the project . 3) Danby School - The Ithaca City School District has received confirmation of receipt of $ 50, 000 . 00 for the agricultural school project study and may receive another $ 50,000 . 00 . Committees are being developed for the planning phase for the Agricultural School Project. 4) Water Resources Council recommendation from the Town of Danby needs to be re-confirmed for Danby' s designated seat. 5 ) Proposed Room Tax Increase - is concerned that an increase may drive business to surrounding areas . 6) Board of Representative increase in salaries was approved . OLD BUSINESS : Heating System Modification Quotes - Town Hall Councilperson Gagnon reported that he has obtained revised quotes from the contractors who submitted quotes for providing modifications to the Town Hall heating system . Wheatons revised quote : $ 19 ,900 HSC Associates revised quote $ 19 , 500 RESOLUTION NO. 84 OF 2000 AWARD OF QUOTE TO HSC FOR HEATING SYSTEM MODIFICATION AT THE TOWN HALL By Councilperson Gagnon : Seconded by Councilperson Strichartz • WHEREAS, the Town Board of the Town of Danby has on November 13 , 2000 received quotes for providing modification to the Town Hall heating system , and WHEREAS , the Town has received revised quotes for the revised scope of work from the contractors who submitted quotes for the project, now be it RESOLVED, that the Town Board of the Town of Danby accepts the revised quote of $ 19 , 500 . 00 from H . S . C . Associates of 317 Meadow Street, Ithaca, New York for the revised scope of work. for the modifications to the Town Hall heating system . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye 128 4 3 Town Board Minutes December 11 , 2000 Strichartz Aye Varona-Lacey Aye Carried Unanimously Inman Aye Quotes on Town Hall Insulation - Discussion Councilperson Gagnon reported that the quotes received for providing additional insulation to the Town Hall Meeting Room were high and outside of the scope of the budget. He said that it is not clear that additional insulation is needed as perimeter insulation has been installed. He recommended that the temperature in the crawl space under the room be monitored over the winter with the vents closed to determine whether additional insulation is necessary. The engineer recommended that the floor be insulated . Councilperson Nolte reported that the quotes received for providing insulation were very different and over the budgeted amount . Motion to Reject Insulation Quotes A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte to reject the quotes received for providing insulation in the Town Hall Meeting Room . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Carried Unanimously Inman Aye The Code Enforcement Officer suggested that the Building Committee investigate firms who might be able to do additional heat loss studies on the meeting room this winter . Proposed Amendments to Zoning Ordinance Supervisor Inman reported that the Board is considering amendments to the Danby Zoning Ordinance for medium and low density road frontage requirements . Councilperson Gagnon said that in order to continue with the proposed changes the Board must do an environmental review. The Code Enforcement Officer posted maps and asked the Board to look at the zoning map and compare the zoning map and the one that shows areas that won' t be developed or shouldn' t be developed . With respect to the SEQR, the commercial area it is a Type I and the proposed change is change in use affecting a lot of acreage . The four hundred foot strip proposed change is unlisted . She requested that the Board attend the Planning Board land use regulations forum on February 1 , 2001 and authorize her to order maps from Tompkins that are needed specific to the review of the target area for the proposed zoning changes . There are acreage calculations Type I review. She reported that there was a communication from the Planning Board sent to the Town Board requesting additional information before they could further review or make recommendations on the proposed zoning changes . The request was for information related to impacts in taxes , property values, analyses on tax land values, community diversity and the urgency of the changes . Councilperson Strichartz said that she is favorable for the Code Enforcement Officer to begin compiling the information for the environmental looking if a review is have necessary .a cess ry . Supervisor Inman will make an attempt to answer some of the questions raised by the Planning Board concerning the 400 foot strip along the roadways and the commercial zones as a target area in the low, medium and low density areas . Motion to Approve Expenditure to Obtain Maps A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby approves the expenditure of an amount not to exceed $250 . 00 • to obtain maps from Tompkins County Planning for the environmental review for the proposed zoning changes . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Motion to Re-adopt Resolution No. 78 of 2000 A motion was made by Councilperson Strichartz and seconded by Councilperson Nolte that the Town Board of the Town of Danby entitled : "Resolution Authorizing the Acquisition of Lands for Expansion of the Town Highway Barn and Authorizing the Expenditures of Funds From the Town Building Reserve Fund for Such Purpose" . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Proposed Traffic Ordinance Discussion Supervisor Inman requested for the record that on the morning of December 9 , 2000 between 9 : 30 and 10 : 00 a. m . he passed or was motioned by K & H Concrete , driven by the owner Kim Whetzel as he drove up Steven Town Hill . He was on his way to make a delivery . This was also witnessed by Dave Benson. The road is posted for a maximum weight of five (5 ) ton. No Board Member objected . NEW BUSINESS • RESOLUTION No , 85 of 2000 TRANSFER OF HIGHWAY DEPARTMENT FUNDS By Councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED , that the Town Board of the Town of Danby transfers funds in the amount of $3 ,752 . 29 from account DA5130 . 200 to account DA5130 . 400 to cover expenditures for repair bills incurred this year.
