HomeMy WebLinkAbout2008-08-11 TOWN OF DANBY TOWN BOARD MINUTES AUGUST 11, 2008 PRESENT: Supervisor Fredric Dietrich Councilpersons: Eugene Beavers, Leslie Connors, Daniel Klein, Joseph Salino Others Present: Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Roy Casterline - West Danby Water District Superintendent Laura Shawley-Bookkeeper Members of the Public: Ames Brown, Ronda Roaring Supervisor Dietrich called to order at 6:45 p.m. and led all present to the Pledge of Allegiance to the American flag. Privilege of the Floor The Town Clerk reported problems with computer internet service and network here at the Town Hall. There is a problem with persons not closing the interior doors and checking to see that the windows are locked. Ronda Roaring - made a formal request to the board that they respond in writing to formal letters she sent via e-mail to them. There are problems with fireworks over the state forest lands and she would like a letter from the board. Supervisor Dietrich said that he sent a letter to her neighbor regarding fireworks. A valid fireworks permit was issued to a private club in the area. REPORTS: County Representative Report County Legislator Frank Proto reported on the following meetings: T-Cat - has asked for extended hours. There is a request for extended service and rates. There is a bus stop on Green Street. County and Town Meting-with Highway. County looking at roads in Danby. Planning Board. Robert Roe reported on the Hamlet Planning Revitalization Project and the schedule of meetings. Recreation Partnership Supervisor Dietrich reported that the focus of the Recreation Partnerships will be on a projected 3% increase. DEMPC Councilperson Beavers reported that DEMPC had a tent at the Danby Fun Days. He is still having side meetings with the Fire Department and Highway Department. Community Council Councilperson Klein reported that the scholarship funds of $1200 is nearly depleted. They should get an additional $300 dollars. There is still an ongoing problem with the distribution of the Danby Area News and they are working on it. The project on the trail at Jennings Pond has been completed. OLD BUSINESS Time Warner Cable -No Action NEW BUSINESS RESOLUTION NO. 58 OF 2008 RESOLUTION, URGING DEPARTMENT OF ENVIRONMENTAL CONSERVATION COMMISSIONER GRANNIS TO PROMULGATE REGULATIONS REQUIRING THAT LOCAL GOVERNMENTS BE DESIGNATED AS INVOLVED AGENCIES FOR STATE ENVIRONMENTAL QUALITY REVIEW ACT PROCEEDINGS RELATING TO NATURAL GAS PERMIT APPLICATIONS FOR PROPOSED SITES WITHIN THE BOUNDARIES OF THE LOCAL GOVERNMENTS; AND THAT LOCAL GOVERNMENTS' VIEWS BE SOUGHT AND GIVEN SIGNIFICANT WEIGHT WHEN DETERMINATIONS RELATING TO NATURAL GAS PERMIT APPLICATIONS ARE MADE Moved by Councilperson Klein: Seconded by Supervisor Dietrich WHEREAS, It is estimated that the geologic rock bed known as Marcellus Shale may contain up to several trillion cubic of natural gas; WHEREAS, Dramatic increases in the price of crude oil and the corresponding need to reduce our nation's dependence on foreign oil have resulted in a tremendous increase in interest and activity relating to natural gas exploration and drilling; WHEREAS, Municipalities in which natural gas drilling is proposed should be consulted regarding natural gas permit applications and the comments of municipalities should be considered and given significant weight when determinations relating to natural gas permit applications are made; Town Board Minutes 3 August 11, 2008 NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Danby requests that the Department of Environmental Conservation promulgate regulations to require that local governments be designated as involved agencies for State Environmental Quality Review Act (SEQRA) proceedings relating to natural gas permit applications for proposed sites within the boundaries of the local governments and that local governments' views be solicited and given significant weight when determinations relating to natural gas permit applications are made; and be it further RESOLVED, that copies of this resolution shall be forwarded to: Governor David Paterson, Senator James Seward and Assemblywoman Barbara Lifton, and Commissioner Alexander B. Grannis,New York State Department of Environmental Conservation. A vote on the resolution resulted as follows: Beavers Nay Connors Aye Klein Aye Salino Nay Dietrich Aye Carried Painting of Town Hall Building Supervisor Deitrich reported that he has received only one estimate on the cost of painting the north side of the Town Hall. Motion to Approve Paintingof a Portion of the Town Hall Building A motion was made by Supervisor Dietrich and seconded by Councilperson Klein that the Town Board of the Town of Danby approves the estimate of Tony Catlin to scrape and paint the north side including a safe proper management way of collecting and disposing scrapings of the Town Hall for the amount quoted of$400.00. Request for Water Resources Council Resources -No Action Motion to Table Items 3 and 4 on Agenda A motion was made by Supervisor Dietrich and seconded by Councilperson Connors that the Town Board Minutes 4 August 11, 2008 Town Board of the Town of Danby table the Draft amendment to the Local Law Emergency Towing of Vehicles and the request for representation on the Water Resources Council. A vote on the motion resulted as follows: Beavers Aye Connors Aye Klein Aye Salino Aye Dietrich Aye Carried Unanimously Motion to Schedule September Agenda Meeting A motion was made by Supervisor Dietrich and seconded by Councilperson Klein that the Town Board of the Town of Danby schedule the September Agenda Meeting for Wednesday, September 3, 2008 at 6:30 P.M. A vote on the motion resulted as follows: Beavers Aye Connors Aye Klein Aye Salino Aye Dietrich Aye Carried Unanimously RESOLUTION NO 59 OF 2008 ACKNOWLEDGMENT THAT THE REQUIRED EXAMINATION WAS CONDUCTED ON THE JUSTICE DEPARTMENTS ACCOUNTING RECORDS By Councilperson Klein: Seconded by Supervisor Dietrich RESOLVED, that the Town Board of the Town of Danby acknowledges that the required examination has been conducted of the Justice Departments accounting records by the Bookkeeper of the Town of Danby. The records have been found to be accurate and up-to-date and the proper examination has been done to accurately answer all questions presented by the State of New York. A vote on the motion resulted as follows: Beavers Aye Connors Aye Klein Aye Salino Aye Dietrich Aye Carried Unanimously Town Board Minutes 5 August 11, 2008 September 17th Meeting Scheduled-Bio-fuels A motion was made by Supervisor Dietrich and seconded by Councilperson Salino that the Town Board of the Town of Danby schedule a public meeting on September 17th at 7:00 p.m. for information on bio-fuels. A vote on the motion resulted as follows: Beavers Aye Connors Aye Klein Aye Salino Aye Dietrich Aye Carried Unanimously Supervisor's Monthly Report-July 2008 The Supervisor's Monthly Report was deferred until the September Meeting. Town Clerk's July 2008 Report The Town Clerk reported that the new dog licencing fees will go into effect on September 1St Renewals that are due before September 1st will be charged the previous fees. She is also requesting permission to conduct a dog eneumeration in the Town of Danby. A motion was made by Councilperson Beavers and seconded by Councilperson Connors that the Town Board of the Town of Danby approves the Town Clerk's monthly report for July 2008 as submitted.
