At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 7 : 00 p . m . on May 2 , 1978 , there were PRESENT : Noel Desch , Supervisor Andrew W . McElwee , Councilman Victor Del Rosso , Councilman Robert N . Powers , Councilman Shirley Raffensperger , Councilwoman Gust L . Freeman , Jr . , Councilman ALSO PRESENT : Lawrence P . Fabbroni , Town Engineer and Building Inspector Robert Bonnell , Assistant to Town Engineer Liese Bronfenbrenner , Planning Board Chairwoman ABSENT : Catherine Valentino , Councilwoman PHOTO - KIOSK AND SELF - SERVICE GAS ISLAND - EAST HILL PLAZA Supervisor Desch distributed to Board members draft of a resolution with regard to revised site plan for a photo - kiosk and self - service gas island on East Hill Plaza . The Board studied the resolution and acted as follows . Motion by Supervisor Desch ; seconded by Councilman McElwee , WHEREAS , the Town Board at a regular meeting on September 9 , 1968 approved the rezoning of 2 . 65 acres of land at the intersection of Judd Falls Road and and Ellis Hollow Road to a Business " D " zone upon recommendation of the Town of Ithaca Planning Board , and WHEREAS , the aforementioned rezoning recognized the need for a full service gas station in this area of the Town , and WHEREAS , the Town Board on August 23 , 1976 rejected a site plan presented by Ms . Betty Friedlander on behalf of Mr . Morris Angell because no ingress and egress was provided through the existing East Hill Plaza parking lot ; and WHEREAS , further proposals involving two gas stations ( Knowlton and Goldfarb ) were subsequently considered and set aside , and WHEREAS , it continues to be the judgment of the Town Board that the only satisfactory overall solution to the traffic circula - tion problem in this area involves the construction of the by - pass road which will connect Pine Tree Road directly to Rt . 366 , and the Town pledges to continue its efforts to achieve this solution ; and WHEREAS , the developer has considered all of the suggestions of the Planning Board and the Town Board in summarizing the impact of the traffic ingress and egress which would result from the con - struction , and V Town Board Minutes - 2 - May 2 , 1978 WHEREAS , the proposed site plan involves a small photo - kiosk building and a self - service gas island which will have a far better visual impact on the site than any previous proposal , NOW , THEREFORE , BE IT RESOLVED , that the revised site plan # 7844 - 6 dated April 24 , 1978 represents the best possible solution to the visual and traffic safety concerns of the area and is hereby approved with the following conditions . ( 1 ) The entrance / exit from Ellis Hollow Road is subject to relocation when the proposal for development of the Business " C " land east of the Business " D " land is presented for review . ( 2 ) Any sale of the land in the Business " D " zone will include an arrangement for the continued access from Ellis Hollow Road as approved on site plan 7844 - 6 subject to modifications to the overall area which can be shown to be in the best interest of the Town . ( 3 ) The Town reserves the right to modify the alignment of Ellis Hollow Road and/or Judd Falls Road in concert with the County . ( 4 ) The Town of Ithaca has no objection to the 61inina - tion of the entrance/ exit on either Judd Falls Road and/or Ellis Hollow Road should lack of usage occur at any time . ( 5 ) The entrance/ exit from the East Hill Plaza parking lot shall not be further modified without specific site plan approval by the Planning Board and/or Town Board as the Zoning Ordinance prescribes at the time such change is requested . Councilwoman Raffensperger asked Mr . Fabbroni for his opinion with respect to traffic flow based on the revised proposal . He said the project and the entrances and exits are now located about as well as possible . It will still be necessary , he said , for drivers to look carefully up and down Ellis Hollow Road . Councilwoman Raffensperger was still concerned over the traffic this project will generate and the problems likely to arise with the entrance and exit on Ellis Hollow Road . A vote on the motion resulted as follows . Supervisor Desch voting Aye . Councilman Freeman voting Aye . Councilman Powers voting Aye . Councilman McElwee voting Aye . Councilwoman Raffensperger voting Nay . Councilman Del Rosso , although present later in the meet - ing , was not present at the time this vote was taken . Based on the foregoing vote , the resolution was declared duly adopted . SECOND TOMT OF ITHACA NEWSLETTER The Supervisor distributed draft of second Town of Ithaca Newsletter and asked Board members to provide him with comments as soon as possible . 87 \X Town Board Minutes - 3 - May 2 , 1978 FIVE -AREA SEWER PROJECT BERNARD P . DONEGAN , INC . PROPOSAL The Supervisor distributed copies of Bernard Donegan , Inc . proposal in connection with temporary and permanent financing for the Town ' s proposed five - area sewer project . The proposal is dated April 20 , 1978 . Supervisor Desch asked the Board to study the proposal and be prepared with comment as soon as possible . SCHOOL BOARD REORGANIZATION AND POSSIBLE SCHOOL CLOSINGS ITT TOWN OF ITHACA Supervisor Desch asked the Board for comments and recom- mendations regarding the School Board reorganization and possible closing of schools in the Town of Ithaca . He circulated letter he proposed to send to Dr . Richard Backer , Superintendent of Schools , regarding this matter . The sense of the Board was that it should not take an official position in this matter at this time . Super - visor ' s Desch ' s letter to Dr . Backer indicated that a transfer of wonership of school property in the Town of Ithaca from the public sector to the private sector would subject the new owner to zoning restrictions which applied to the property prior to its acquisition by the School District , and that the same would be true if the facilities should be leased for non - school purposes . The Board agreed that the Supervisor should send the proposed letter to Dr . Backer . SUMMER HELP AVAILABLE UNDER CORNELL UNIVERSITY WORK STUDY PROGRAM Mr . Fabbroni reported that he has been approached by a Cornell University student , a mechanical engineer , who has been pursuing a planning program at Cornell . He is available for employment under a work study program . His services would cost the Town only $ 300 and Cornell University would pay $ 1 , 200 . This would be for a 10 -week period during the summer . He could perform for the Town planning and engineering tasks . The Town has a great deal of work he can do . Mr . Fabbroni requested authorization to arrange for his employment . Motion by Supervisor Desch ; seconded by Councilman Freeman , RESOLVED , that the Town Engineer is hereby authorized to arrange for the employment of Mr . Mark Jozwicki , a Cornell University student , under a Cornell University Work Study Program , said Mark Jozwicki to be employed by the Town of Ithaca for a 10 -week period during the summer of 1978 at a total cost to the Town of Ithaca of $ 300 . ( Desch , Freeman , Powers , Raffensperger , McElwee , and DelRosso voting Aye . Nays - none ) TRAFFIC COUNTERS Councilman Freeman inquired about the status of the proposed traffic counts in the Town of Ithaca . Mr . Fabbroni reported that nothing has been done to date on this project due to the press of other matters . After some discussion , Mr . Fab - broni was authorized to arrange for adding two days a week to Mr . Ocello ' s employment in order to accomplish the traffic counts . Mr . Ocello is working three days a week at this time . Mr . Fabbroni estimated the work would require two men working five full days . Mr . Ocello and Mr . Bonnell will work together taking the proposed traffic counts . Town Board Minutes 4 May 2 , 1978 IMPROVEMENTS TO PENNSYLVANIA AND KENDALL AVENUES Supervisor Desch distributed draft of proposed letter to property owners on Pennsylvania Avenue and Kendall Avenue regarding the Town ' s interest in improving the drainage and the roadways in the area . With minor revisions , the Town Board agreed that such a letter should be sent out . ADJOURNMENT The meeting was duly adjourned at 7 : 40 p . m . Edward L . Bergen Town Clerk
