Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Edw. Abruzzo - NYS Police Officer Members of the Public : Esther Dotson, Eileen Wright Supervisor Edward Inman called the meeting to order at 7 : 36 p . m . and introduced Sgt. Edward Abruzzo to the Board and public . Sgt . Abruzzo reported that he is a supervisor at the New York State Police Barracks in Ithaca and that they periodically attend Town Board Meetings to introduce themselves . They are a resource to the Town and residents can call on them with questions and concerns related to law enforcement . The Board asked if a local noise ordinance would help in terms of enforcement for unreasonable sound . Sgt. Abruzzo said that he is a supervisor in a three county area and is unfamiliar with any townships that have a noise ordinance . He is familiar with the New York State Penal Law disorderly conduct section and they have to prove that a person intended to cause public inconvenience , annoyance or alarm to enforce that section. He does not believe that a Town ordinance would give the law enforcement agencies any more teeth than what the already have . They do not have a way to measure noise level and tolerance to noise varies from person to person. The question is at what point do you make that a violation? Getting the police involved does not always resolve a situation and people may be afraid of retribution when complaints are investigated . Councilperson Stricharti said that our intent was to have a noise ordinance that addressed summer parties that go on into the late nighttime hours . When complaints are received residents should be encouraged to call the police agencies and that they will investigate . Supervisor Inman reported that the Town is trying to put together information to send to the State a request to extend the 45 m. p . h. speed limit on NYS Rte . 96B the intersection of the East Miller SRoad and West Miller Roads . Sgt. Abruzzo said that there are resources available that will investigate speeding traffic when there are complaints in certain areas at specified times and other traffic related problems such as dangerous intersections . ADDITIONS TO THE AGENDA : The Code Enforcement 'Officer requested the addition to the Agenda of a resolution related to Code Enforcement. Communications : 1 ) Preservation League of New York State - How to Publicize Grant Award for Agricultural Survey. 1248 2 Town Board Minutes Continued Board Meeting September 13 , 2000 2) Letter to Board from Highway Department - stating error in a CSEA article published in Ithaca Journal stating that the Town did not have a contract. The Town of Danby has a contract and is successfully negotiating a new three year contract. REPORTS : Highway Department Report - August Received Dog Control - SPCA - July Report Received Zoning - Code Enforcement - August Report Received Planning Board Report The Planning Board will have a public hearing on Wednesday, September 20 , 2000 at 7 : 00 p . m . to hear the Ungers request for an additional building on their property on Makarainen Road. Community Council Report: Eileen Wright reported that the Community Council Meeting will be at the Danby Fire Station on Wednesday, September 20, 2000 . The Grand Opening for the Danby Playground will be on October 8 , 2000 and the tentative time is from 2 -4 p . m . Senior Citizens : Carol Sczepanski reported that the monthly meeting was held on September 7 , 2000 at 6 : 30 p . m . The Honorable Frank Proto was our guest for the meeting . A committee is working on a fall or early winter day trip . Water Resources Council The Clerk reported that she has sent a the Certified Resolution of Recommendation for Linda Dorn to be a representative for the Town of Danby on the Water Resources Council to the Tompkins County Board of Representatives and to Representative Proto . To date there has been no confirmation of appointment received from the County . Proposed Local Laws Amending the Zoning Ordinance Susan Beeners said that the Board had asked that she and the Clerk put together the language of the proposed local laws for the changes in the Danby Zoning Ordinance and this has not been completed at this time . A Type I SEQR needs to be done on the local law that deals with the target area. Supervisor Inman said that the Commercial Target Area Proposed Local Law was supposed to be sent to the Planning Board . Councilperson Gagnon said that the Board is asking the Planning Board to make a specific recommendation on the local laws . Supervisor Inman said that the local law amending the Danby Zoning Ordinance concerning density and lot sizes was referred on August 28 , 2000 to the Planning Board . The Town Clerk reported to the Town Board that the Planning Board has not met since August 28 , 2000 and that the referral of the proposed local law entitled "Motion to Refer the Proposed Local Law A Local Law Amending the Zoning Ordinance to Eliminate the Commercial Target Area From Medium Density Residential Zones" to the Planning Board for Review_would be sent to the Planning Board for their September meeting . Proposed Traffic Ordinance : The Clerk transmitted a Draft Proposed Traffic Ordinance for the Town Board to consider. The Board will set a public hearing date to consider the proposed local law at their next meeting . Committee for Speed Limits Supervisor Inman said that he has two people interested in working on speed limits on Town of Danby Roads , N . Y . S . Supervisor Inman will write an article for the Danby Area News requesting interested persons to contact the Town. Motion to Change the Time of the October Board Meeting A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to change the time for the October 9, 2000 Town Board Meeting from 7 : 00 p .m . to 7 : 30 p . m. • A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Motion to Set Budget Workshops for Town of Danby Budget for Fiscal Year 2001 A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz to set the following workshops for the Town of Danby Budget for Fiscal Year 2001 . Thursday - October 21 ,2000 at 4 : 30 p .m . - Highway Department Monday - October 25 , 2000 at 7 : 00 p . m . - Planning, Zoning, Clerk, Court Wednesday - October 4 , 2000 at 7 : 00 p . m . - Community Council , Pond, Seniors A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO. 66 OF 2000 LEGISLATION RELATED TO STATE ASSISTANCE FOR CODE ENFORCEMENT By Councilperson Strichartz : Seconded by Councilperson Gagnon RESOLVED , that the Town Board of the Town of Danby urges Governor George Pataki to sign the legislation currently under his consideration for the reinstatement of financial assistance to local governments for code enforcement . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Carried Unanimously 1250 4 Town Board Minutes Continued Board Meeting September 13 , 2000 Approval of the Town Clerk' s August 2000 Report A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to approve the Town Clerk' s August 2000 Report as submitted . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Grant Application for Matching Funds The Code Enforcement Officer asked the Town Board to approve of a grant application for additional monies from Tompkins County for the Town Hall Building. The original grant project has not been completed . After discussion there was no action on the request. Comprehensive Plan Update - Request for Additional Funds Susan Beeners reported that she transmitted information to the Board on Monday, October 11 , 2000 regarding a request for an additional $ 600 to be transferred to the comprehensive plan account and an additional $ 625 to cover an additional 50 (fifty) hours for the circuit rider . RESOLUTION NO . 67 OF 2000 By Councilperson Gagnon : Seconded by Councilperson RESOLVED, that the Town of Danby Town Board approves the retaining the County Circuit Rider for an additional 50 (fifty) hours for $ 625 . 00 and the expenditure of an additional $ 600 . 00 for the Comprehensive Plan for mapping to be transferred from the contingency fund . . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Statement from Town Attorney Councilperson Strichartz read the following statement from the Town Attorney : "In speaking with Naomi Strichartz earlier today she was concerned that the latest draft of the Noise Ordinance did not contain an exemption for noise emanating from farm machinery . She was under the impression that earlier drafts of the ordinance had such an exemption and was concerned that it had been deleted somewhere in the process . In going through the successive drafts I find where it was in fact deleted albeit inadvertently . " Motion to Adjourn to Executive Session A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz at 10 : 10 p . m . that the Town Board of the Town of Danby adjourn to Executive Session to brief the Town Board on labor negotiations with the Highway Department .
