Lee - Secretary Pro Tern Susan Beeners - Code Enforcement Officer Edward and Donna Inman - Applicants Members of the Public : Sarah Hollyday, Debbie Benson, Kali Benson, Erika Benson, Gloria Benson, Dave Benson Public Hearing Declared Open Chairperson Laurene Gilbert declared the public hearing open at 6 : 45 p .m. and read the following publication : " PLEASE TAKE NOTICE, that the Planning Board of the Town of Danby will hold a public hearing on Wednesday, July 19 , 2000 at 6 :45 p.m. , 1830 Danby Road, Ithaca, New York to Consider Approval of the proposed subdivision of Town of Danby Tax parcel No . 10- 1 -21 . 121 into a 3 . 1 +/- acre lot with 15 feet of frontage, a 4 . 4 +/- acre lot with 15 feet of frontage, and a 117 +/- acre lot with 30+/- feet of frontage, for which variance of the minimum 150-foot frontage requirement was granted by the Zoning Board of Appeals on May 18, 2000, and further, to consider ratifying the June 17, 1998 Planning Board approval of the subdivision of said tax parcel into a 2 . 05 +/- acre lot with 170 feet of frontage and a 126 +/- acre lot with 60 feet of frontage. The subject lands are located the north side of Bald Hill Road between Danby Road and Jennings Pond Road . Edward L . And Donna B . Inman, owners . Sczepanski, Town Clerk Published : July 13 , 2000 " Susan Beeners said that her recommendation is, that based on the hypothetical map presented for sketch plan review that she requests the Board to consider it generally meeting the criteria of a clustered subdivision. Members of the Public : Sarah Hollyday - 58 Bald Hill Road - asked Susan to clarify what she had just stated relating to cluster subdivision. Susan Beeners explained to the public that there is a mechanism in the subdivision regulations where you can show hypothetically that you might be able to divide the land into the conventional form of 150' or 250' minimum frontage . That establishes how many lots you might be able to place on that property . That permits the Planning Board to consider approving an alternative plat where the frontage might be less than 150' . 8 Debbie Benson - 58 Bald Hill Road - was confused by the hypothetical map as it is not the issue on the table tonight . Following a public hearing for a minor subdivision of Town of Danby Tax Parcel No . 10 . - 1 -21 . 12 consisting of 124+/- acres into a 3 . 1 +/- acre lot with 15 ' of frontage, a 4 .4+/- acre lot with 15 ' of frontage and a 117+/- acre lot with 30+/- feet of frontage owned by Edward and Donna Inman and submitted by the same , the Board passed the following resolutions : RESOLUTION NO. 12 OF 2000 DETERMINATION OF ENVIRONMENTAL SIGNIFICANCE (SEAR) INMAN SUBDIVISION - Approved By Robert Roe : Seconded by Chairperson Gilbert WHEREAS, this action is the Consideration of Approval of the proposed subdivision of Town of Danby Tax parcel No . 10 . - 1 -21 - 121 , a.k. a. 10 . - 1 -21 . 12 , into a e . 1 +/- acre lot with 15 feet of frontage, a 4 .4 +/- acre lot with 15 feet of frontage, and a 117 +/- acre lot with 30+/- feet of frontage , for which variance of the minimum 150 foot frontage requirement was granted by the Zoning Board of Appeals on May 18 , 2000, and further, to consider ratifying the June 17 , 1998 Planning Board approval of the subdivision of said tax parcel into a 2 . 05 +/- acre lot with 170 feet of frontage and a 126 +/- acre lot with 60 feet of frontage ; and WHEREAS, the Town of Danby Planning Board on July 19, 2000 has held a public hearing on this action; and WHEREAS, the Planning Board has reviewed the Short Environmental Assessment Form and the recommendation that a negative determination of environmental significance be made, subject to the condition that documentation related to access arrangements and maintenance of such access be approved by the Town as a condition of any final subdivision approval ; now, therefore, it is RESOLVED , that the Town of Danby Planning Board hereby makes a negative determination of environmental significance for this Unlisted action, subject to the condition that documentation related to access arrangements and maintenance of such access be approved by the Town as a condition of any final subdivision approval . A roll call vote on the resolution resulted as follows : Farrell Aye Hansen Aye Klein Aye Roe Aye Vent Aye Weitzel Aye 630 2 Planning Board Minutes July 19 , 2000 Gilbert Aye Carried Unanimously RESOLUTION NO. 13 OF 2000 APPROVAL OF INMAN SUBDIVISION By Nancy Weitzel : Seconded by William Farrell WHEREAS, this action is the Consideration of Approval of the proposed subdivision of Town of Danby Tax parcel No . 10 . - 1 -21 - 121 , a. k . a. 10 . - 1 -21 - 12 , into a 3 . 1 +/- acre lot with 15 feet of frontage, a 4 . 4 +/- acre lot with 15 feet of frontage , and a 117 +/- acre lot with 30 +/- feet of frontage, for which variance of the minimum 150-foot frontage requirement was granted by the Zoning Board of Appeals on May 18 , 2000 , and further, to consider ratifying the June 17 , 1998 Planning Board approval of the subdivision of said tax parcel into a 2 . 05 +/- acre lot with 170 feet of frontage and a 126 +/- acre lot with 60 feet of frontage ; and WHEREAS, the Town of Danby Planning Board on July 19, 2000 has held a public hearing on this action; and WHEREAS , the Planning Board on July 19 , 2000 has made a negative determination of environmental significance for this Unlisted action, subject to the condition that documentation related to access arrangements and maintenance of such access be approved by the Town as a condition of any final subdivision approval ; now, therefore , it is RESOLVED, that the Planning Board, having reviewed the "Hypothetical Future Subdivision" plan dated May 1 , 1998 , finds that the subject parcel could be hypothetically subdivided at least into the number of lots presently proposed, which number is three (3 ) plus the 2 . 05 +/- acre lot approved by the Planning Board on June 17 , 1998 , for a total of four (4) lots presently proposed ; and it is FURTHER RESOLVED, that the Planning board finds that the density and the frontage modifications as currently proposed would meet the general criteria established for Clustered Subdivisions as provided in the Town of Danby Subdivision Regulations ; and it is FURTHER RESOLVED, that the Planning Board hereby grants Preliminary and Final Subdivision Approval to the proposed subdivision, being the subdivision of said tax parcel into a 3 . 1 +/- acre lot with 15 feet of frontage, a 4 .4 +/- lot with 15 feet of frontage, and a 117 +/- acre lot with 30 +/- feet of frontage, for which variance of the minimum 150 foot frontage requirement was granted by the Zoning Board of Appeals on May 18 , 2000 , and further, hereby ratifies the June 17 , 1998 Planning Board approval of the subdivision of said tax parcel into a 2 . 05 +/- acre lot with 170 feet of frontage and a 126 +/- acre lot with 60 feet of frontage, which latter 126 +/- acre lot is presently proposed to be re-subdivided into the lots described above, subject to the following conditions : 1 . Submission of a final survey map, suitable for filing, for approval by the Planning Board Chairperson . 2 . Submission of and approval by the Town Planning Board Chairperson and Town Attorney of documentation related to access arrangements and maintenance of such access . 3 . The provision of a 40 foot perimeter buffer setback around the perimeter of the subdivision, as provided for Clustered Subdivisions in the Subdivision Regulations . Discussion: Dan Klein said that the three conditions stated in the resolution apply to a future hypothetical subdivision not to the three (3 ) lots that we are asked to approve at this time . Susan Beeners said that the 40 foot perimeter requirement pertains to the entire property . If the property came before the Board for a conventional subdivision the Board would still have the availability to do a substantial review of the plan and additional conditions and restrictions could be imposed if necessary. 631 3 Planning Board Minutes July 19, 2000 A roll call vote on the resolution resulted as follows : Farrell Aye Hansen Aye Klein Aye Roe Aye Vent Aye Weitzel Aye Gilbert Aye Carried Unanimously Olivia Vent made the following comment that with a new subdivision you have an awful lot of regulations in place that allow the Planning Board to work with owners to be creative about how you organize or design them. It' s not the subdivisions that are the problem as there are regulations and they are very restrictive .
