Following public hearing for an application for a minor subdivision of a property located at 1. 568 Coddington Road of a one ( 1 ) acre lot from a 13 . 74 acre +/- parcel owned by Beverly Burgess and submitted by Gary Burgess, the Board passed the following resolutions : RESOLUTION NO 10. OF THE YEAR 2000 SEAR RESOLUTION - BURGESS MINOR SUBDIVISION. By Robert Roe : Seconded by Nancy Weitzel WHEREAS, this action is the Consideration of Subdivision Approval for the proposed subdivision of a one ( 1 ) acre lot containing an existing house and accessory buildings located at 1568 Coddington Road , near East Miller Road, from Town of Danby Tax parcel No . 6 . - 1 -28 , 13 . 7 +/- acres total , Beverly J . Burgess , owner, Gary L . Burgess, applicant; and WHEREAS, this is an Unlisted Action for which the Town of Danby Planning Board is acting as Lead Agency for environmental review, and for which the Tompkins County Department of Planning is an involved agency ; and WHEREAS, the Planning Board has reviewed the application materials and the recommendation that a negative determination of environmental significance be made for this action ; now, therefore , it is RESOLVED , that the Planning Board hereby makes a negative determination of environmental significance for this action, with the following condition : That the applicant obtain verification of any permitting requirements related to the N . Y . S . State Protected Streams Law before the issuance of any building permits for the 12 . 7 +/- acre lot. A roll call vote on the resolution resulted as follows : Farrell Aye Hansen Aye Klein Aye Roe Aye Weitzel Aye Gilbert Aye 626 2 Planning Board Minutes Special Meeting May 31 , 2000 Carried Unanimously RESOLUTION NO. 11 OF THE YEAR 2000 APPROVAL OF MINOR SUBDIVISION - BURGESS APPLICATION By Robert Roe : Seconded by Nancy Weitzel WHEREAS, this action is the Consideration of Subdivision Approval for the proposed subdivision I ;, of a one ( 1 ) acre lot containing an existing house and accessory buildings located at 1568 Coddington road, near East Miller road, from Town of Danby Tax parcel. No . 6 .- 1 -28 , 13 . 7 +/- acres total , Beverly J . Burgess, owner, Gary L . Burgess applicant; and WHEREAS, this is an Unlisted Action for which the Town of Danby Planning Board, acting a Lead Agency for environmental review, on May 31 , 2000 has made a conditional negative determination of environmental significance ; and WHEREAS, the Planning Board grants Preliminary and Final Subdivision Approval to the subdivision as proposed, conditional on the following : That the applicant obtain verification of any permitting requirements related to the N . Y . State Protected Streams Law before the issuance of any building permits for the 12 . 7 +/- acre lot .
