Supervisor Desch reporter' that on January 13 , 1973 three bids were received on this project , and that the lore bidder ( Hazard , Auburn , No Ye ) was 53 % over the Engineers ° Mozier ) estimate . Fie reported that meetings have been held with the bidders and with Lo "iar Engineers {, Inc . in Rochester . Supervisor Desch said the bids, came in hic?h for the follor,ting reasons ( among others ) n ( 1 ) !Upstate New York construction market has beeh heavily floodeA. Truth Federally funded construction vuork ,, ( 2 ) the project seen-S to be of the size that is really no longer considered a large ;project in the present context of work , and it is , therefore , difficult to dram bias from contractors from a broader regional area ; ( 3 ) there are a numller of things in the bid docuvments which discouragers contractors from getting involveQ in the project ( complexity of the bin documents , construcm tion scheduler &rLbiguity ii-aith regard to road crossings ,: that is , open cut or bore ) ,. ( a ) concern over r►aneuverability in the densely popu . lated Forest I°ome area and traffic problems there . The Board then discussed at considerable length the options availa�� le ° ( 1 ) accent the low bic? as is ( 2 ) reject all ?yids , and then mod. ifv , re -= classify and simplify the bid documents ( in the hope Of setting a r"Ore competitive bi:" or hills ° ( 2 ) re� hid leaving out laterals and paving . Supervisor Desch recoTrn,ended that the project be rebid ,, even thoucTh there is no guarantee that a lower. 'tid will be received . Councilman Del Rosso felt this was nothing more , however , than taking money out of a different pocket , and was not in any c�,7ay a .solution ° Supervisor Desch said estimated deduction for paving is S103 , 400 and $ 69 , 700 for the latera ? so Laterals are not an TPA aid item ° EPA will pay for 75 % of the navinge ' y6 Town Board minutes 2 February 7 , 1978 Councilman McElwee made the following statement ° " I was told at our meeting on Thursday with Tarry Fabbroni ( Town Engineer ) , Len Bower ( Lozier Engineers , Inc . ) , Walter Bradley ( Lozier Engineers , Inc . ) and two representatives of Hazard ( Contras ° tor ) , that using the revised figures woulO.. bring the heneTit charges within our budget . I question whether rebidding would cone out an`► differently than what we have experienced in the first bidding , either in dollar amounts or the number of bidders . Lozier engineers , I unJer �- stand , have received about five bids in the past week ( on other jobs ) , all of which were way over budget , and in some cases , with only one bidder . EPA has allotted New York State $ 300 , 000 , 000 for this type of contract . With all of the contracts coming in over budget . still the well be dry by the time our application gets there ? The contractor indicated that he would complete the job in approximately three months . This would cut down our inspections costs , our borrowed money costs , and would also get us into the bond market early . I believe that our bond position would be better earlier in the bond market than it would be later with more people applying for bonds . on the rebid , we don ' t fare as well as we did with the rejected bids , our aid is based on the low rejected laid, . " Consideration might be given to the possibility of future sewer connections , starting at the main or slightly outside of the main with the owner dedicated, to,- the Town what is within the right ° ] of �way and the Town would maintain that portion within the right ®ofp way . Or , as Walt Schwan suggested , with the elimination of the laterals from the contract we might borrow approximately $ 30 , 000 in addition to our construction costs and use these monies as the re � quest for sewer laterals come to the Town Board . '5 Supervisor Desch recommended that the local share be limited to $ 500 , 000 . He said it is estimated that rebidding will cost about $ 2000 to $ 3 , 000 . The bid docimients T.-could have to be changed very little m - some footnotes and three or four pages of specifications to be modified . Councilwoman Raffensperger suggested that extension of the construction period would entail some extra expenses for the Town . Councilman Powers felt the Town would be better off with a smaller contractor . Supervisor Desch noted that if the paving and laterals are deducted , the mown would only be about $ 4 , 000 over the proposed local share of $ 500000 . Councilman Powers asked why , if the Town is within $ 4 , 000 of an acceptable local share , would the Town spend $ 2 , 000 to $ 3 , 000 to rebid . Supervisor Desch said there is a reason ° able judgment that the price *gay be cut at least $ 100 , 000 and pr4obab ° ly $ 200 , 000 . If , however , the Town does get a price $ 200000 lower , the EPA will reduce its share . Councilman Del Rosso said he didf not subscribe to deleting laterals and paving . He said that does nom solve the problem since the work will eventually have to be done an3 it will fall , in any event , on the taxpayer to pay for it . Super - visor Desch said if the low bid_ were accepted " as is " the benefit rate would have to be raised . If the low bid is accepted , the local share will be $ 610 , 000 . Tkith the laterals and paving removed , the local share would be $ 504 , 000 . Supervisor Desch said there were a number of bidders who , for one reason or another ( vacations , other jobs , etc . ) did not bid , would now bid if the job is rebid . Motion by Supervisor DeschF seconded by Councilman Freeman , P.£ SOLVED , that all bias received for the proposed 5 - area sewer projec t in the Town of Ithaca are hereby rejected. ( contingent upon United States Environmental Protection Agency approval of such rejection ) and Lozier Engineers , Inc . are hereby directed to re °bid the project modifying the bid documents to provide ( 1 ) more bid flexibility , ( 2 ) extension of the construction period , and ( 3 ) more specifics with regard to road crossings ( open cut or bored ) , and including bidding of the laterals and paving as separate and optional items . ( Del Rosso , Raffensperger , Powers , Valentino , Freeman and Desch voting Aye . ?McElwee Nay . ) Town Board 11inutes - 3 m Pebruary 7 , 1373 FLOODI^TG ED-JERGETTCY Supervisor Desch reported that Richard Barber , Superintenm dent of Schools , Ithaca City School District , has asked the Town of Ithaca to declare School District property in the T- own of It'saca a disaster area so that steps may be taken to apply for State an :' Federal funding . The City of Ithaca has declared their portion a disaster area and the. State Civil Defense Agencies have been con° tacted . Supervisor Desch reported that the culvert under Route 13 near Boynton Junior High School is simply unable to take the flotu from the main channel of Fall Creek because the level is very high at Fall Creek and , therefore , access is becoriing increasingly dif- ficult to Boynton . The Town of Ithaca t,-.?as also askeO' to stand by in terms of providing manpower to build a dike or rho some sandbag - Bing to keep the water below floor level of the School building . Mr . Fabbroni and Mr . Parkin have been advised. that the Town of Ithaca will provide , it it reasonably can , help in this emergency . He ( Desch ) recommended compliance with 11r . Backer ' s request . The Board as a whole was inclined to comply with .71r . Backer -,- s request . Councilman Powers asked if there were any criteria for declaring an area a disaster area * Councilwoman taffensperger thought the City of Ithaca would not have declared it a disaster area had it not qualified as such * Supervisor Desch assured the Board it did qualify as a disaster area . Motion by Councilwoman Raffenspergeto. seconded by Councilwoman Valentino , WHEREAS , the Ithaca area has been hit by repetitive snow storms and freezing conditions , causing extensive flooding , particu larly in the Cayuga Lake Flood Plain area of the Town , and MHEREAS , said conditions have worsened to as to create an emergency situation as a result of a natural disaster , MOB^7 , THEREFORE , BE IT aESOLVE'D AS FOLLOt•), ; That a natural disaster and emergency condition has existed since January 14 , 1973 in the Cayuga ' .Lake Flood Plain area of the Town due to flooding resulting from the snow and ice conditions ° That , in particular , this Board wishes to call attention to flooding conditions affecting Ithaca City School District property in the Town of Ithaca , specifically the Boynton Junior Figh. School property ;; That the Supervisor be and he hereby is authorized to use and employ any and all facilities , equipment , supplies , personnel , and resources of the Town of Ithaca in such manner as may be neces ® sar_y and/or appropriate to cope with said natural disaster and the emergency consequences thereof pursuant to the poi,:yers conferred by Section 209 -o of the General 111unicipal Law , and That the Supervisor be and he hereby is authorized to re- quest and/or apply for any and all appropriate assistance and co- operation as may be available from other governmental sources . C . of Boner . 11eer York,7have as ?ced Chisanntha , the contractor , to coma to Ithaca when trie weather per - wits to have a look at the leaks in the roof of the Fetighl ipray Facility . n-Ir . Fabbroni reported that the major leaks are in the skylight open ings . He said the amount of the holdback at this tire is $ 10 , 515 . He felt , in light of the problem with the leaks , that that much of a holdback is too much . It was agreed that TIr . Fabbroni s. rould esti ° mate the cost to repair the leaks and make a reco^Umendation with respect to an appropriate holdback Jollar amount at the next_ Board. meeting . REFUND - STEIN BUILDERS , Ij-TC . 106 CIRCLE LAME Supervisor Desch reported he hael received a request from Schwab & Hudanich , attorneys for Stein :Builders , Inc . , f_ or a refund of $ 93 . 00 for water benefit and sewer benefit at 106 Circle Lane . They contended that the premises are not serve' by eater or sewer . Supervisor Desch and Mr . Fabbroni had looked into this matter and deterMlined . that based on the location of the parcel and in accord - ance with the Town formula for assessing water and sewer benefit charges , the unit charge for this parcel should be reduced from 1 . 0 units to 0 . 105 units . Therefore , the Board acted as follows Motion by Councilman Powers ; seconded by Councilwoman Valentino . RESOLVED , that on the basis of Torn Board review , and upon recommen- dation of the Town Engineer , this Town Board authorizes a refund in the amount of $ 37 . 71 to Stein. Luilders , Inc . , based on a reduction from 1 . 0 unit of water and sewer benefit to 0 . 105 unit of water and sewer benefit , in recognition of the distance to the nearest water and sewer lines in accordance with the water and sewer benefit for - mula used throughout the Town of Ithaca . PEARSAT4L PLACE A!dD SHELDMI ROAD PUi7P STATIOIS Supervisor Desch reco:timended that the Town Board should consider abandoning the electric service to the East State Street , Pearsall Place , and Sheldon Road pump stations which noT.>> serve no purpose since the construction of the Bolton Point water system . Discussion raised some questions with regard to abandoning the Pearsall Place pump station ( possible City of Ithaca emergency on South Hill ) and the Sheldon Road pump station (Northeast emergency ) . 140tion by Supervisor Desch ; seconded by Councilman Powers , that the Town of Ithaca proceed with the abandonment of electric service to the East State Street pump station and defer judgment on the abandonment of electric service to the Pearsall Place and Sheldon Road pump stations . RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A FEDERAL GRANT FOR THE CONSTRUCTION OF NECESSARY SEWAGE TREATMENT WORKS , UNDER THE FEDERAL WATER POLLUTION CONTROL ACT AMENDMENTS OF 1972 ( PL 92 - 500 ) WHEREAS , the Town of Ithaca , Tompkins County , New York , herein called the "Applicant " , after thorough consideration of the various aspects of the problem and study of available data , has hereby determined that the construction of certain works , required for the treatment of sewage , generally described as Sanitary Sewer Extensions to the Town of Ithaca Sanitary Sewer System , and identified as Project Number C- 36 -1104 , herein called the " Project " , is desirable and in the public interest , and to that end it is necessary that action preliminary to the construction of said Project be taken immediately ; and WHEREAS , under the Federal - Water Pollution Control Act Amendments of 1972 ( PL 92 -500 ) ,, -the United States -of America has authorized the making of grants _ to aid in .financing the - . cost of construction of necessary treatment works to prevent the discharge of untreated or inadequately_ treated sewage or other waste into any waters and for the purpose of reports , plans , and specifications in connection therewith ; and WHEREAS , the Applicant has examined and duly considered said Act , ( PL 92 - 500 ) and the Applicant deems it to be in the public interest and to the public benefit to file - an -_application - under this Act and to - authorize other action -in _ connection _ therewithv ` NOW , THEREFORE ; BE - IT RESOLVED - .BY =the-=Town Board of the - Town --of- ithaca , - the governing body of said Applicant , as follows : 10 That the construction of said Project is essential to and is in the I best interests of the Applicant , and to the end that said project maybe � ) constructed as promptly as practicable it is desirable that action pre - liminary to the construction . thereof be undertaken immedintelyf i 2 .
