HomeMy WebLinkAbout2000-04-19 616 1 Planning Board Minutes April 19, 2000 TOWN OF DANBY PLANNING BOARD MINUTES APRIL 19, 2000 PRESENT : Chairperson Laurene Gilbert Planning Board Members : William Farrell, Linda Hansen, Daniel Klein, Robert Roe, Olivia Vent, Nancy Weitzel Others Present : Code Enforcement Officer - Susan Beeners Secretary - Carol Sczepanski Members of the Public : Carol Swan, Phil Zach, Liz Griffin, Sabine Lessmeister Chairperson Laurene Gilbert called the meeting to order at 7 : 03 p.m. Communications Received : 1 ) Frog Haven - 239-m review 2) Notes from Purchase of Development Rights (PDR) Workshop from Dan Klein Reports : Olivia Vent reported that the Town submitted a grant proposal to the New York State Council of the Arts last year to do an in-depth study of agricultural buildings in the Town. The grant was not awarded for the project . We can resubmit again this year and the deadline is May 1 , 2000 and she said that she thinks that she can pull together a proposal . RESOLUTION NO. 8 OF 2000 APPROVAL TO SUBMIT GRANT APPLICATION FOR NYSCA GRANT By Olivia Vent : Seconded by Robert Roe RESOLVED, that the Planning Board of the Town of Danby supports the re-submission of a grant application to NYSCA/Preservation League of NYS for a more in-depth survey of the historic agricultural resources in the Town of Danby A roll call vote on the resolution resulted as follows : Farrell Aye Hansen Aye Klein Aye Roe Aye Vent Aye Weitzel Aye Gilbert Aye Carried Unanimously Dan Klein reported that he attended a workshop that is sponsored by the Cooperative Extension and the Farmland Protection Board regarding purchasing development rights and distributed his notes to the Board to review for the May meeting. Municipal Officers Association Report Bob Roe reported that at the Municipal Officers Association met this month and the most significant thing in terms of planning for Tompkins County is the rural revaluation issue. TCOMA members are disappointed in the approach that the County has taken . Residents and land owners are being encouraged to go to their Town Board of Assessment Review (Grievance Day) and grieve their tax assessment. Tompkins County Division of Assessment will be invited back to a TCOMA meeting to give a report . Susan Beeners said that the County has access to a map of Danby that shows the land uses in the Town including forest land and wetlands . Meeting with DEC Representatives : Chairperson Gilbert reported that she and Bob Roe met with David Sinclair and Mary Kay Allen, representatives of the DEC to discuss the Master Recreational Plan for State Forests . She has prepared a short report from that meeting and a cover letter to be sent to Senator John Kuhl with copies to the DEC , Representative Proto , District 7 , Regional Director, Finger Lakes State Parks, 6i 2 Planning Board Minutes April 19, 2000 and members of the Town Board, Planning Board, and Assemblymen M . Luster. Susan Beeners said that the Town should include in he comprehensive plan to pursue State modification of the wildlife management practices and State lands within the Town . Frog Haven Request for Special Permit Elizabeth Griffin and Sabine Lessmeister have submitted a request for a Special Permit for a proposed use of an existing residence as a bed and breakfast dwelling, located at 578 West King Road, town of Danby Tax Parcel No . 1 . - 1 - 12 .2 . It is a Type II action under SEQR and the State Building Code classifies a bed and breakfast dwelling as a single-family dwelling. The Code Enforcement Officer reported that she has been to the property and will return and do a siting section of a few improvements that have to be made for code which relate to smoke detectors, evacuation signs and doors . She suggested that the Board consider that the proposal is ready to schedule a public hearing and recommended that there be a provision included with this project (and routinely) that all parking be provided on site where Special Permits are issued. Elizabeth Griffin reported to the Board that she and Sabine Lessmeister have contacted many of the neighbors and the residents with information of the proposal and have asked for letters of support . The surrounding neighborhood consists of mostly rental housing. Motion to Set Public Hearing Date for Frog Haven Special Permit A motion was made by Nancy Weitzel and seconded by Olivia Vent that the Planning Board of the Town of Danby set Wednesday, May 17 , 2000 at 7 : 00 p. m. for a public hearing to Consider a request for a Special Permit for the proposed use of an existing residence as a bed and breakfast dwelling, located at 578 West King Road, Town of Danby Tax Parcel No . 1 . - 1 - 12 . 2 , Elizabeth Griffin and Sabine Lessmeister, owners . A vote on the motion resulted as follows : Carried Unanimously Motion to Hold Special Work Session for Comprehensive Plan A motion was made by Nancy Weitzel and seconded by Bob Roe to hold a special work session of the Planning Board to work on the comprehensive plan only. A vote on the motion resulted as follows : Carried Unanimously Amendments of March 15, 2000 Minutes : Amendments to Minutes of March 15 , 2000 . (Brackets means delete Underline means insert 1 ) Header date (March 14, 2000) March 15 , 2000 2) Page 3 - under Comprehensive Plan Vision Statement ( 1978) 1989 Motion to Approve March 15, 2000 Minutes as Corrected : A motion was made by Nancy Weitzel and seconded by Robert Roe to approve the March 15 , 2000 Planning Board Minutes as corrected . A roll call vote on the motion resulted as follows . Farrell Aye Hansen Aye Klein Aye Roe Aye Vent Aye Weitzel Aye Gilbert Aye Carried Unanimously VISION STATEMENT FOR COMPREHENSIVE PLAN APPROVED A motion was made by Chairperson Gilbert and seconded by Nancy Weitzel that the Planning Board of the Town of Danby vote to adopt the Vision Statement for the Town of Danby Comprehensive Plan dated March 15 , 2000 as formulated by the Planning Board . VISION STATEMENT As the Town of Danby enters the 21st century we seek to plan for: 618 3 Planning Board Minutes April 19, 2000 * An economically viable and socially diverse community that provides for, and values, a variety of lifestyles, interests, and opportunities . * Orderly growth that will not unduly or unreasonably disrupt neighborhoods . * A community that provides experiences, education, and facilities that promote a sense of community and cooperation for all its residents . * A community that encourages innovative and responsible uses of its historic and natural resources, in order to enhance both environmental protection and economic development . A vote on the motion resulted as follows : Carried Unanimously Comprehensive Plan Contract Agreement for Circuit Rider Chairperson Gilbert read a communication that she sent to the Town Supervisor regarding the Circuit Rider Contract with Tompkins County Planning and update of services received to date . The contract agreement addendum has expired and has not been renewed . The original agreement was reviewed and it was determined by the Board and the Code Enforcement Officer that the services were not provided in full according to their contract . The Board discussed whether we need County Services. Information transmitted by the County has been duplicated due to three circuit riders reviewing, editing and repeating sections of the comprehensive plan. Sue Beeners said that she was disappointed as Jim Hanson did not know what maps and information that had been produced or supplied by the County for our comprehensive plan . He assumed that she was working as a consultant for the Town. The file that was produced by Tom Chifalo was lost when the County changed computer systems as well as the disk containing materials in our comprehensive plan notebooks . The Board discussed how to finish individual sections of the comprehensive plan and how much County involvement will be needed. Olivia Vent offered to edit the draft material of the sections that are incomplete . Susan Beeners said that she plans to approach the Town Board and request an additional eight ( 8 ) hours per week to devote to extra work including consultations necessary for the comprehensive plan. She has lacked the time to act as a liaison with the County, assisting with the reviewing and editing of drafts and coordinating meetings. Chairperson Gilbert reported that she will notify the Town Supervisor that the Planning Board feels that they do not need the services of the County in the form of a Circuit Rider for the reasons that she previously discussed in an e-mail communication. Bob Roe said that the notification to the Town Supervisor should include that the remaining funds should be used to contract for individual services as required .
