HomeMy WebLinkAbout2000-02-16 600 I Planning Board Minutes February 16, 2000 TOWN OF DANBY PLANNING BOARD MINUTES FEBRUARY 16, 2000 Regular Meeting: PRESENT : Chairperson Laurene Gilbert Planning Board Members : William Farrell, Linda Hansen, Robert Roe, Nancy Weitzel ABSENT : Olivia Vent Others Present : Code Enforcement Officer - Susan Beeners Secretary - Carol Sczepanski John Kingsley - Proposal Applicant Members of the Public : Students - Kelly Howland and Eric Sincebaugh Chairperson Laurene Gilbert called the meeting to order at 7 : 00 p . m . Code Enforcement Officer reported that she has laid on the table additional proposed items to be added to the Agenda. 1 ) Would like to request consideration of the Miller Road names be added to the Agenda. 2) Additional information for the Kingsley proposal . This is a re-zoning issue and the Planning Board would be expected to make a recommendation to the Town Board for a re-zoning . The project for approval will require a sketch plan review, Planning Board public hearing, Town Board Public Hearing and Planning Board public hearing . 3 ) Unity House letter of intent to have a Unity House Community Residence in the Town of Danby to be located on Nelson Road. The proposal will require a building permit . 4) Frog Haven - proposal for a Bread and Breakfast at 578 West King Road. Request for Re-Zoning - West Danby Methodist Church Property John. Kingsley addressed the Board with his proposal to put in a wood working studio in the former West Danby Methodist Church. The building would be used as his primary studio for John Kingsley Furniture. He is a fine art furniture maker, the sole proprietor, and has no employees . He reported. that his intentions are to make necessary improvements to bring the building up to code and set up a design studio . He does not own the building at this time and purchase in contingent upon permission to use the building for his intended use . The project as proposed is as follows : Phase I - Installation of a heating system - Reglaze and paint of windows - Caulk of paint exterior - Insulate where appropriate Phase II - Spring 2001 as time and money permit - Complete Insulation - Construct finishing room - Create bench room area a. o 6 '10 2 Planning Board Minutes February 16, 2000 Phase III - Awaiting designs before scheduling - Install a septic system currently being designed by the Health Department - Install bathroom with low flush toilet and sink - Bring in water from West Danby Water District The Planning Board reviewed the sketch plan as submitted by the applicant . Code Enforcement. Officer Susan Beeners reported that the applicant must obtain a building permit for the complete renovation. Septic approval from the health department must be in place before a Certificate of Occupancy can be issued . An architect will have to be involved in certain matters related to structural and public safety . There may be an administrative variance required from the Department of State related to the distance from the material lot lines . She said that the building is adequate for this use . The building permit will include looking into the future and all three (3 ) phases of the proposal . John Kingsley reported to the Board his l seller may be able to contingent hold the purchase offer and necessary approvals . If they extend out Y asked if the Board could schedule a public hearing as soon as possible expedite the process . Motion to set Public Hearing A motion was made by Nancy Weitzel and seconded by Linda Hansen that the Planning Board of the Town of Danby set the date of Monday, February 28 , 2000 at 7 : 00 p.m for the Kingsley Proposal and that a Special Meeting of the Planning Board follow the public hearing to Consider a Recommendation to the Town Board with respect to a Proposed Amendment to the Zoning Ordinance adding Cottage Industries to Commercial Zone "A" Permitted Uses by Special Permit ; and Proposed Amendment to the Zoning Ordinance and Map Establishing a New Commercial Zone "A" being the former West Danby Methodist Church property . A vote on the motion resulted as follows : Farrell Aye Hansen Aye Roe Aye Weitzel Aye Carried Unanimously Gilbert Aye Concern was expressed by the he Plannin Board that the Town Board needs to be made aware that there are times that the Planning Board must schedule iitespecial d 1Due to thesadvert song hearings Wednesdays when most of the Board members requirements it is difficult to schedule special meetings especially for items to be recommended or transmitted to the Board after hearings . There is often a conflict for use of the building when trying to schedule special meetings . Chairperson Gilbert reported that the Planning Board often receives ins oketch plan the time sof meetings . She requested that items for the Planning Board g e plan reviews and materials be received by the Board at least three (3 ) days in advance . Pro osed Uni House Communi Residence as a Unity Ho se Susan Beeners reported that a residence located at 121 NRden e will with m 1Ldly Community Residence . The facility will be a six (6) bed re retardation and developmental disabilities and does not require approvals of any approvals . Property Owner Brian Grouse reported to the Board that he has obtained a five (5 ) year lease form Unity House Community Residence for a residence on located at 121 N l tneR tadioo f the existing Unity House Community Residence . There will be minor modifications building and no additions have been planned . • 6 1 3 Planning Board Minutes February 16 , 2000 Tompkins County Planning Federation Report : Linda Hansen reported on a draft "Proposed Tompkins me ideas of items that would benefit our our Program. She said that this is a rough draft and would welcome Town from our Board members . At the last Planning Federation Meeting it was recommended that it is desirable to keep the planning issues and the Town Board issues separate. Town Boards should be delegating the planning issues to Planning Boards as they make political decisions and the Planning Board makes planning decisions . It is not the job of the Planning Boards to draft legislation. A list of the County 239 reviews of site plan reviews for special permits were presented and the Federation discussed the Salino/McGill project as it had a significant finding. The significant finding discussed was the projects proximity to possible wet lands on the west side of NYS Rte . 96B . Salino/McGill Proposal - Gas Station/Convenience Store Susan Beeners reported that the applicants for the Salino/McGill property will be scheduled for a Final Site Plan Review soon. She is waiting for the completed lighting details for the over-all site . Frog Haven Proposal for Bed & Breakfast Susan Beeners reported to the Board that the Frog Haven Proposal was received today and is a proposal for a four (4) person bed and breakfast proposed to be located at 578 West King Road. The proposal will be placed on the March or April Agenda for sketch plan review. Miller Road East & Miller Road West Request for Road Name Change. Susan Beeners reported that the County Emergency Service (E-911 ) data base for addressing will not accept Miller Road and Miller Road West in their system. It is necessary to re-name the roads to East Miller Road and West Miller Road. This change is necessary for public safety and would be officially changed on the County Maps . RESOLUTION NO . 4 OF 2000 Recommendation to the Town Board for Road Name Change - Miller Road East and Miller Road West A motion was made by Bob Roe and seconded by William Farrell that the Planning Board of the Town of Danby adopts the following resolution : RESOLVED, that the Planning Board of Road and Miller Road West be changed to West Miller Miller Road East be changed to East Mille Road and that the 1978 Town Map on file with the County be updated to reflect this change . A roll call vote on the motion resulted as follows : Farrell Aye Hansen Aye Roe Aye Weitzel Aye Gilbert Aye Carried Unanimously Susan Beeners authorized her to work with the Town Board Highway liaisons and the Highway Superintendent to look at the development of low maintenance roads . Approval of January 26, 2000 Planning Board Minutes A motion was made by Nancy Weitzel and seconded by William Farrell to approve the January 29 , 2000 Planning Board Minutes of the Planning Board as corrected. A roll call vote on the motion resulted as follows : Farrell Aye Hansen Aye Roe Aye Weitzel Aye 612 4 Planning Board Minutes February 16, 2000 Gilbert Aye Carried Unanimously Comprehensive Plan - Discussion Robert Roe reported that the meeting scheduled with members of the Planning Board and representatives from the DEC that has been re-scheduled for March 21st . regarding the New York State Forest Master Plan. Bob reported than in the Economy section draft of the comprehensive plan that the Town is primarily a residential community with pockets of commercial activity and that the Economy and Resources are closely related . The only resources we will have are the ones we can make . The Board reviewed the sections of the comprehensive plan that have been drafted to date . Drafts that have been completed have been sent to the Tompkins County Circuit Rider for her to review and to begin writing sections of the document . After discussion the Board was in agreement that it is time to develop a Vision Statement that should include a clear idea of what our vision is for the next ten ( 10) years . Susan Beeners reported that she is working on getting the County Planning to extend the Agreement for the Comprehensive Plan through June 30 , 2000 . On a motion the meeting adjourned at 9 :25 . Sczep . /i, /tecretary min-2- 16-00 RESOLUTION NO.5 OF 2000 RECOMMENDATION TO TOWN BOARD — PROPOSED AMENDMENT TO ZONING ORDINANCE RELATED TO COTTAGE INDUSTRY WHEREAS, this action is the Consideration of a Recommendation to the Town Board of the Town of Danby with respect to the proposed Amendment of the Town of Danby Zoning Ordinance, which amendment would add Cottage Industry to Commercial "A" Zone Permitted Uses by Special Permit, and which would add a Definition of Cottage Industry ; and WHEREAS , the matter is an Unlisted Action for which the Town Board of the Town of Danby is acting as Lead Agency for environmental review, and for which the Planning Board of the Town of Danby and the Tompkins County Planning Department are involved agencies ; and WHEREAS, the Tompkins County Planning Department has been notified of this action for purposes of review under General Municipal Law 239-m ; and WHEREAS, the Planning Board has, at the following public hearing on February 28 , 2000 has reviewed the proposed local law related to this action, and the Short Environmental Assessment Form with the recommended review by the Code Enforcement Officer that a negative determination of environmental significance be made for this action ; NOW, THEREFORE, IT IS RESOLVED , that the Planning Board of the Town of Danby recommends to the Town of Danby Town Board that a negative determination of environmental significance be made for this action ; and it is FURTHER RESOLVED, that the Planning Board recommends to the Town Board that a Local Law to Amend the Zoning Ordinance to Add Cottage Industry to Commercial Zone "A" Permitted Uses by Special Permit, and to Add the Definition of Cottage Industry be adopted, with such proposed Local Law recommended to read as follows :
