Daetsch, Eileen Wright, Edward M. Roberts , John R. Henderson, Genny Kozak Supervisor Edward Inman called the meeting to order at 7 : 06 p . m . and led all present to the Pledge of Allegiance to the American flag. The new Councilpersons were introduced to the public . PRIVILEGE OF THE FLOOR: Councilperson Strichartz reported that Danby Community Council would like to reserve the Town Hall Meeting Room for a concert on Saturday, February 6, 2000 . The concert will be Judith Kellogg singing classical songs . She reported that a grant was awarded for $ 1 ,790 . 00 between Community Council and the Community Arts Partnership Ithaca Centralization Grant for six (6) concerts and this would be the first. Town Clerk Carol Sczepanski reported for the record that she has received her SARA Certification for Indexing Training and is now in the process of preparing a grant for indexing out minutes . For clarification she reported that the Town Clerk has not applied for two (2) previous grants . It was not possible to apply for SARA grants as we did not have a records storage space or a vault during the construction of the Town Hall . Members of the Public : Ames Brown - 1840 Danby Road - reported that he was not aware that there was a Special Meeting was scheduled for January 5 ,2000 . Kevin Cain - 100 Gunderman Road - reported he is unhappy with how taxpayer money is spent for code enforcement and our attorney fees related to a claim that is presently in litigation. County Representative Report: County Representative Frank Proto reported on the following : SARA - quarterly meeting was held with the State Representatives . Representative Proto has been asked to join the New York State Commission on Archives . Cayuga Lake Watershed Draft Preliminary Watershed Characterization : This is not a plan but a draft copy and is on file with all the municipalities and libraries in Tompkins County and at Tompkins County Planning Department for interested persons to review. There are three (3 ) meetings scheduled to hear public comment . Representative Proto ' s Committee Assignments - 2000 Vice Chair of the Budget Committee, Economic and Workforce Development Committee , Library Committee, Chair of the Census Committee HUD Funding - Ken Horst and Don Barber from Caroline requested a special meeting to determine what happened to the HUD Grants submitted by Danby and Caroline . Both towns are reconsidering new applications for 2000 cycle . E Rate - keep checking phone bills for charges for Internet access for hospitals, libraries, schools and others that cannot afford to connect to the Internet as part of the long distance charges . Old Library - Options are being explored for use of the building. West Danby Water District Annual 1999 Report: Supervisor Inman read the West Danby Water District 1999 Report . ( 119 � � ! r 1161 2 Town Board Minutes January 10, 2000 EMC (Environmental Management Council) - Robert Roe reported that the EMC when it meets in January will have nine (9) new members , six (6) municipal members and three (3 ) at large members . Susan Bock will be the new Chair of the EMC . Tompkins County Cell Towers Upgrade Plan and the proposed tower for Hill Road has attracted some attention. Tompkins County Representatives will be addressing the EMC at the February 9, 2000 meeting at 7 : 00 p .m. Interested residents and Board members may attend. The Town of Danby has eleven ( 11 ) Unique Natural Areas (UNA ' a) either totally or partially within its boundaries . He will bring the County Maps to the Planning Board meeting in January. Highway Department Report - Written report received January 5 , 2000 Code Enforcement Office Report - Written report received January 10, 2000 Due to the many questions regarding buildings damaged or destroyed by fire, Code Enforcement Officer Susan Beeners reported that in the event of damage by fire our ordinance requires that a building be demolished within one ( 1 ) year unless repairs have commenced . Presently Benjamin ' s One Stop has boarded the windows and will install snow fence for a protective measure very soon. Planning Board Report : Robert Roe reported that at the December 15 , 2000 meeting the Planning Board received a report on the progress of the Community Council Building Committee . A presentation on the Application for Special Permit for a proposed convenience store/restaurant with gas station proposed to be located at the intersection of New York State Rte . 96B and Brown Lane . A public hearing on the proposal will be held on January 26, 2000 at 7 : 00 p.m . . A work session on the comprehensive plan followed the presentation. Community Council Report: Pat Woodworth reported that the Community Council Annual Meeting will be held on Thursday, January 13 , 2000 at 7 : 00 p.m. Willard Daetsch reported that the Council has just received word that they have received a grant in the amount of $ 1 , 790 . 00 for providing concerts . Senior Citizens Report: Edward Roberts reported that the Senior Citizens at the January 6, 2000 meeting held election of officers . President - Gerry Catlin Temporary Vice President - Edward M . Roberts Secretary - Carol Sczepanski Treasurer - Nancy Weitzel A benefit supper will be held at the Danby Federated Church on Saturday, January 22 , 2000 at 4 : 30 p . m . for Betty DeWolf who lost her home due to fire in December. Noise Ordinance Committee Update Councilperson Strichartz reported that the Noise Ordinance Committee met on Monday January 3rd and are reviewing ordinances from other municipalities for ideas that would both protect the quality of life here and people who have businesses here . They are hoping to be able to draft something soon to present that is enforceable and will enhance the quality of life here . Bicentennial Committee Report: Susan Hautala reported that a very small group of people worked very hard to raise funds to build a bandstand here at the Town Hall . We applied for a grant from Tompkins County for matching funds to build a bandstand . The grant was received last week in the amount of $2, 987 . 25 . The bicentennial committee now has funds to landscape around the bandstand and put in benches . The bandstand is now Town property for public use . NEW BUSINESS : RESOLUTION NO. 20 OF 2000 EQUIPMENT, LABOR AND MATERIALS SHARING By Councilperson Strichartz : Seconded by Councilperson Gagnon RESOLVED, that the Town Board of the Town of Danby approves that the Town of Danby Highway Department may participate in the exchange of equipment, labor and materials with other municipalities as deemed appropriate by the Town of Danby Highway superintendent. 1162 3 Town Board Minutes January 10 , 2000 A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO . 21 OF 2000 PARTICIPATION IN COUNTY BID PROCESS By Councilperson Varona-Lacey : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby approves that the Town of Danby Highway Department may participate in the Tompkins County Bid Process for materials and services . Clinton Perkins to serve as Chair of the Town of Danby Board of Zoning Appeals for the year 2000 . A roll call vote on the resolution resulted as follows : 1163 4 Town Board Minutes January 10, 2000 Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO. 25 OF 2000 AMENDING RESOLUTION NO . 62 OF 1999 WITH RESPECT TO DETERMINING VARIOUS FEE RATES FOR THE REVIEW OF CERTAIN DEVELOPMENT APPLICATIONS. By Councilperson Gagnon : Seconded by Councilperson Nolte WHEREAS, Resolution no . 72 of 1991 , "Establishing Fees for Building Code, Zoning Ordinance , Subdivision Regulation, and Other Code Enforcement Activities" provides that certain fees may be charged by the Town to cover part of the cost of professional services, including, but not limited to , engineering, planning, legal, and other expenses incurred by the Town in its review of application materials for various development proposals and for its inspection of various development projects if those projects are approved; and WHEREAS, said resolution also provides that the hourly rates to be charged for Town staff (Code Enforcement Officer, Planning, Legal , Highway Superintendent and others) may be determined from time to time by the Town Board ; and WHEREAS, Resolution No . 62 of 1999 was the most recent determination of equivalent hourly rates for the Code enforcement Officer and the Highway Superintendent and is in need of amendment; now, therefore , it is RESOLVED, that the Town Board of the Town of Danby hereby determines that the hourly rates for the Town Code Enforcement Officer and the Town Highway Superintendent shall be calculated by adding FICA, Medicare, and health insurance to the annual salary for the respective position, and then dividing that amount by the scheduled hours of work to calculate an equivalent hourly amount; and it is further RESOLVED, that for fiscal year 2000, the Town Board of the Town of Danby hereby determines the following : 1 . That the current equivalent hourly rate for the Town Code Enforcement Officer is $21 . 69 and 2 . That the current equivalent hourly rate for the Town Highway Superintendent is $23 . 17 . A1420. 400 (Attorney) . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously RESOLUTION NO . 28 OF 2000 RECOMMENDATION FOR APPOINTMENT TO HILLVIEW LANDFILL CITIZEN ' S ADVISORY COMMITTEE By Councilperson Strichartz : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby recommends to Tompkins County Board of Representatives the re-appointment of Ric Dietrich of 100 South Danby Road, Willseyville , New York to the Hillview Landfill Citizen ' s Advisory Committee . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Motion to Authorize Community Council to use the Town Hall Meeting Room for Concert A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby authorize Community Council to use the Town Hall Meeting Room on February 5 , 2000 for a concert . A vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Use of Town Hall Facility - Discussion Councilperson Gagnon reported that he put through a request to use the Town Hall for a meeting of an out-of-town group . There were questions raised about liability and the request was not approved . He suggested that a committee be developed to work out a proposal for use of the building . r : t 4 ,ti E 1 //64S- 6 Town Board Minutes January 10, 2000 Councilperson Strichartz said that she would like to see the Town have a policy that regulates what kind of activities the facility may be used for. Councilperson Gagnon suggested that a facilities use committee be created to develop a policy for use of the Town Hall Facility and that the committee be authorized to consult with our Town Attorney. Danby Area News Councilperson Gagnon reported that there is confusion about how information is submitted for publication in the Danby Area News . He suggested a committee be developed to explore how best to get Town information out to the public . The Town Clerk, Jim Houghton and, Councilpersons Gagnon and Strichartz will serve on the committee and report to the Board . Policies for Appointments to Committees and Boards Supervisor Inman submitted a draft policy regarding how the Board makes appointments to committees and boards . Motion to Approve a Policy for Appointments to Committees and Boards A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon to adopt the following policy entitled "Policy for Town of Danby Town Board Appointments" . TOWN OF DANBY POLICY FOR TOWN OF DANBY BOARD APPOINTMENTS 1 ) Prior to the expiration of a position on the Planning Board or the Zoning Board of Appeals , the holder of that position shall be contracted to verify the person ' s interest or lack of interest to continuing . 2) The position shall be advertised as vacant and interviews will be conducted for any interested Iapplicants to include the present holder of that position, if interested . 3 ) Interviews will be held by the present Town Board members and or the newly elected Town Board members and the Chairperson of the board involved with the vacancy. 4) The vacant position or positions will be filled and a chair person will be appointed at the annual "Organizational Meeting" of the Board in January . 5 ) If a Board member resigns, the advertising and interview process will begin immediately and the appointment made as soon as possible . 6) Committees may be formed to interview and make recommendations to the Board for appointments to positions other than Planning Board or Board of Zoning Appeals . A roll call vote on the motion resulted as follows : Gagnon Aye ' Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously //6 7 Town Board Minutes January 10, 2000 Dates for Interviews for Planning Board Vacancy Set A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board set Monday, January 17, 2000 at 7 : 00 p . m . for interviews of candidates interested in appointment to the Town of Danby Planning Board and the Water Resources Council with times for interviews to be scheduled by the Supervisor. A vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Inman Aye Carried Unanimously Noise Ordinance Committee Meeting : Councilperson Strichartz reported that the Noise Ordinance Committee will meet on Monday, January 24 , 2000 at 7 : 00 p . m . at the Town Hall . Approval of Town Clerk' s December 1999 Report A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz to approve the Town Clerk ' s December 1999 report as submitted .
