Supervisor Morey opened the meeting and indicated that there were several items needing resolutions before the Board proceeded with the Organizational Items. RESOLUTION #11-001 - APPROVE 2010 GADABOUT CONTRACT MOVED by Supervisor Morey, seconded by Councilman Scheffler Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the 2010 Contract between the Town of Groton and Gadabout Transportation Service, Inc in the amount of $5,100.00. RESOLUTION #11- 002 - APPROVE 2011 HIGHWAY CONTRACT MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the 2011 Contract between the Town of Groton and the Town of Groton Highway Association. RESOLUTION #11- 003 - APPROVE 2011 RAISE FOR ELIZABETH BRENNAN MOVED by Supervisor Morey, seconded by Councilman Ayes - Sovocool, Scheffler, Gamel, Clark, Morey WHEREAS, during the 2011 Budget process, the Bookkeeper/Highway Clerk, Elizabeth Brennan, was not given a raise in hourly wage, be it RESOLVED, that the Town Board hereby approves a 40-cent per hour increase in wage for Elizabeth Brennan, matching raises given across the board to other employees. RESOLVED, that the First National Bank of Groton be designated as the depository for all monies coming into the hands of the Supervisor and Town Clerk of the Town of Groton. RESOLVED, that the Groton Independent be designated as the official newspaper of the Town of Groton with notices also to be published in the Freeville Shopper. RESOLVED, that the law firm of Pomeroy, Armstrong, Casullo & Monty be retained as Attorneys for the Town of Groton. Item 4 - Zoning Officer - MOVED by Supervisor Morey, seconded by Councilman Sovocool. Ayes -Sovocool, Scheffler, Gamel, Clark, Morey. RESOLVED, that Gary Coats be appointed Zoning Officer and Building and Fire Code Enforcement Officer for the Town of Groton. RESOLVED, that the Town Board does hereby approve the 2011 contract with the Country Acres Pet Services for the purpose of dog control in the Town of Groton at a fee of $17,400.00 ($1450.00 per month). RESOLUTION #11-007 - AUTHORIZATION TO PARTICIPATE IN COOPERATIVE PURCHASING OF HIGHWAY SERVICES WITH TOMPKINS COUNTY MOVED by Supervisor Morey, seconded by Councilman Clark. Gary Coats, Code/Fire Enforcement Officer - Submitted 2010 Year End report. It was a pretty good year overall. Two things that had been on the agenda for a long time and are now cleared up are, 1. The property at 101 Brown Road now has a nice home on it and a Certificate of Occupancy has been issued. 2. The property at 924 Lick Street has been renovated into a really nice home and the people have moved in. Mr. Coats talked to the Board about the Bishop Sheen program that helps low income people renovate their homes and asked if the Board would want to consider waiving building permit fees for this organization as they have in the past. RESOLUTION #11-011 - WAIVE BUILDING PERMIT FEES FOR NON-PROFIT AGENCIES MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby waives the building permit fees for non-profit agencies involved in home repair projects for low income people in the Town of Groton. RESOLUTION #11-012 - CODE ENFORCEMENT OFFICE TO ATTEND CONFERENCE MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the payment of expenses for the Code Enforcement Officer, Gary Coats, to attend the New York State Building Officials Conference, April 5-8, 2011 in Syracuse, NY. Town Board Minutes Page 10 January 11, 2011 April L. Scheffler, RMC, Town Clerk/Tax Collector - Submitted monthly Town Clerk, Tax Collector, Country Acres reports and 2010 Annual Report. We received a letter notifying us that we received a $500 grant for this year's photo show. It's not as much as last year, but will still be an immense help with our advertising expenses. The new dog licensing has been going smoothly so far and we have been issuing the Town of Groton tags to replace existing NYS dog tags. I will be working on reformatting our appearance tickets for dog violations to reflect our new law that went into effect on January 1 . We've been busy with tax collection and everything is running smoothly there too. The notice that we put in with the bills about senior exemptions has sparked a lot of questions and inquiries from people who are not sure whether or not they have the exemption and also how to apply for the exemption. I am also running additional ads clarifying who qualifies for the extension to pay taxes. Received notice that Monica Todd, owner of the Roman Village has applied to renew her liquor license, and you will need to have a consensus as to whether you have any objections to that. Consensus of the Board was that they had no objection to the renewal of the liquor license for Monica Todd. RESOLUTION #11-013 - ENCUMBER REMAINING 2010 TOWN CLERK FUNDS MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby encumbers the remaining 2010 funds left in the Town Clerk's accounts, A1410.4 Contractual, A1410.41 Restore Records and A1410.42 Records Management, in the amount of $2,053.47 to be placed in the A1410.2 Equipment account for the purchase of office chairs for the Town Clerk and Deputy Clerk with any remaining money used for additional office equipment. John Norman and A. D. Dawson, Town Justices - Were not present. They had submitted their monthly and year end reports as well as a report pertaining to security issues, which will be discussed at a later date when they are able to be here. Councilman Donald Scheffler, as Recreation Coordinator - Winterfest is set for January 29 at the Elementary School from 10:00 am to 4:00 pm. We're going to have dog sled rides again this year and the recycled toboggan contest along with some new events including a dance recital. Some events have been cut out, so it's different than it's been. Everyone please come and have a good time. There is a $6.00 entry fee for the toboggan contest and three cans of food for the food pantry. All the proceeds go to the Groton food pantry. Supervisor Morey - There will be a depository for anyone who brings food also. Brian Robinson, County Legislator - I appreciate being asked to come and what I need is to get something back, and I do get it. I know, throughout my first year, it has been quite a learning experience for me. April, obviously, had a big issue dealing with dog licenses and that sort of stuff and it sounds like that has reached a successful conclusion Town Board Minutes Page 11 January 11, 2011 and everything is fine. The one thing I did learn about I guess, in dealing with a whole bunch of other folks in government, is that when a group of town clerks or the Town Clerks Association gets together, you don't cross them. You do what they want. The other one was the rural youth services, which has a real direct connection with Groton. That didn't look good from the start. I heard from constituents and heard loud, clear and often and so did the rest of the representatives of the Legislature. I think we've worked it out through TCCOG. It was a real hot button item and it was done on purpose, I know it was, by the County Administrator. We had some real serious budget issues and so why not hit a hot button item to begin that discussion and he did; he knew what he was doing. But that came to a successful conclusion. To me, it's kind of good to get some of this back on the towns so that they have more of a reason to do some evaluation of programs. I've since talked with Viola and she's talked about looking into some grant applications and that sort of thing, where she didn't really need to before. We will continue to work with you, because needed, especially for the Town of Groton and probably for more than any other town in the County. Your rural youth services is very important. There's really not much for kids otherwise. Looking ahead to this year, I've got, preliminarily, committee assignments that I had last year which were Budget & Capital and Public Safety. As you probably know we just got a new Sheriff after about 12 years. Although he's very much a veteran officer there are going to be some growing pains, so I asked that I stay on that committee to try to help him through the first year as kind of a liaison type thing. We're still going to have some very serious budget problems again this year, not the least of which could be a local tax cap. I don't know what your opinion is of that but we have some serious problems with it because it comes with a whole bunch of mandated costs to us that we have no control over. As an example, if they want to cap local taxes, yours, the County's, school districts, if they wanted to cap the County at 2% the rise in pension costs alone, which is one of nine mandated costs to the County, the rise of that alone is projected as over 3.5% of our budget for next year. So, we would already be behind the game with no say as to Medicaid costs and everything else. We are lobbying against that cap unless the State takes back its mandates because 90% of the County budget takes care of those nine State mandates. What you've go left you can fix roads, have a Sheriff patrol, rural youth services and all these other things that you want to do, but 90% of it is what the State tells you that you have to do. There has been a lot of talk about gas hydro-fracking. I don't know if you Supervisor Morey - Yes, but it's been quiet for the past six or eight months. TCCOG has been very active, as you know, but we are still waiting for the DEC to make a ruling of what they are going to do. Mr. Robison - In the meantime, we have some folks, as you well know, who are on the Legislature that take that issue very much to heart and they can't wait for the DEC study. So, now they're on to other things, which may actually come into play out in Groton. As an example, recently we've dealt with a resolution banning construction vehicles over "X" amount of weight. I know they're trying to not have these hydro- fracking vehicles and trucks, but sometimes agricultural vehicles, which we have a lot of, fit into that same category. Supervisor Morey - Also a bus weighs up to 4500 pounds. We're just sitting back and waiting to see what they come up with. Rosemarie Tucker, Town Historian - Submitted her annual report for the Board's review. The report has also been provided to the County and State Historians. I've itemized and given descriptions of my projects on my written report and I'd like to also add that I am very grateful to have had the opportunity to work with April Scheffler, our Groton Town Clerk, on the presentation she and I did on Verne Morton. My report shows that we presented it three times this past year, one of which was at the Conference on New York State History which was held at Ithaca College. I also enjoyed working with those from the Village of Groton in planning the Village Sesquicentennial Celebration. If you have any questions, at any time, please do not hesitate to ask. I found out that I do have a balance of $342.49 in my line item A7510.4 and I am requesting to encumber that so I can attend the Conference on New York State History again, in Cooperstown this year. I usually go to the Association of Public Historians Conference with my expense line and I'd like to use this little bit towards the other conference. Supervisor Morey - I thought we allowed you to go to just the one conference a year. Ms. Tucker- It's never been stated. Supervisor Morey - I know, but we've had claims just for that one conference? Ms. Tucker - Which is out of my $750.00, and I did go to that one conference and this is left over in that account. Supervisor Morey - Okay, the total in the account was $750... RESOLUTION #11-014 - ENCUMBER TOWN HISTORIAN FUNDS MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby encumbers the remaining funds in the Town Historian A7510.4, Contractual Account in the amount of $342.49 to be used towards expenses at the 2011 Conference on New York State History. Supervisor Morey asked when the Town's 200t" anniversary celebration was going to be and Ms. Tucker said that she thought it should begin at the end of 2017 and end during 2018. The Board and Attorney Casullo discussed that they would probably set another public hearing in March for the purposes of the State Environmental Quality Review (SEQR) on the proposed Code, which would give the Board ample time to consider any comments made at the public hearing in February.
