Public Hearing Declared Open
Supervisor Horst declared the public hearing open and read the following "Notice of Publication" :
PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of
Danby on Monday March 8 , 1999 at 7 : 00 P .M . , at the Danby Town Hall , 1830 Danby Road, Ithaca,
New York to consider the adoption of a local law of the Town of Danby entitled : "A LOCAL LAW
EXTENDING FOR AN ADDITIONAL ONE HUNDRED TWENTY ( 120) DAYS A
MORATORIUM FOR THE CONSTRUCTION OF TELECOMMUNICATIONS TOWERS" .
Any resident of the Town of Danby is entitled to be heard upon said proposed Local Law at such
public hearing either in person or in writing. Copies of proposed Local Law are available for review
at the Town Clerk' s Office at 1830 Danby Road Ithaca, New York during regular office hours .
A Special Meeting of the Town of Danby Town Board will follow the public hearing.

Supervisor Horst asked for public comment related to extending the Telecommunications
Moratorium for One Hundred Twenty ( 120) Days . He reported that the Town has a Draft
Telecommunications Ordinance from Comi Telecommunications whom we have hired as a
consultant. Our Town Attorney has reviewed the draft and made comments . Our Town Attorney 1 i
has drafted a temporary ordinance that we could put in effect as another option.
No public comment was received.

Supervisor Horst called the meeting to order at 7 : 05 P . M . and led all present to the Pledge of
Allegiance to the American flag.
ADDITIONS TO THE AGENDA :
1 ) Councilperson Gagnon asked for an addition to the agenda for discussion of minutes
PRIVILEGE OF THE FLOOR:
Members of the Public :
Roy Casterline - 439 Brown Road - said that he personally wanted to thank the Highway
Superintendent and the highway men for the good job they did in West Danby during the past snow
storm. He knows they worked around the clock to keep the roads clear.
Edward M. Roberts - Voting Machine Custodian --asked permission to attend a Town and City
Clerks and Custodian Training Class . It is an eight hour seminar by Sequoia Pacific .
Motion to Approve Voting Machine Custodian Training
A motion was made by Councilperson Inman and seconded by Councilperson Steiner to approve the
registration fee in the amount of $ 100 . 00 from Account A1450 . 400 for Voting Machine Custodian
Edward M. Roberts to attend a voting machine custodian training seminar.

Judy VanDermark - Community Council Vice President - addressed the Board and public in
response to the letter from Lorraine Bard that was read into the minutes of the February 8 , 1999
meeting. She addressed the concern regarding rumors, division of the community, process for the
Community Council Annual Election procedure and how the election was conducted. Community
Council is a very diverse group of volunteers and all members of the Danby community are
welcome . Every opinion matters and in order to build a sense of community and personal agenda
must be a thing of the past and progress a part of the future .
A copy of Judy VanDermark' s letter is on file in the Clerk ' s office .
Margaret Shepard - 441 Comfort Road = she understands that Councilperson Strichartz is interested

in loaning a piano to the Town for the use of Community Council programs here at the Town Hall .
A Playground Festival (Design Day) is to be held here on April 17 , 1999 and everyone is encouraged
to attend. On May 8 , 1999 there will be a Contra Dance at the Montessori School on King Road.
Ames Brown - 1840 Danby Road - reported that he thinks that letters from Madam VanDermark
and Lorraine Bard' s appear verbatim in the Town Board minutes and that there should not be a fee
for the use of the meeting room for not for profit organizations .
REPORTS :
Community Council - Judy VanDermark reported that a meeting was held on February 11 , 1999 .
A presentation was made to the council by representatives from the Tompkins County Youth Bureau
and Cooperative Extension. The following committees were established and all committees are open
to any member of the Danby community and residents are encouraged to join .

Danby Community Center Site Committee - Mary Oltz Chair
Youth/Adult Programing Committee - Judy VanDermark Chair

Interviews for the Danby Area News are scheduled and the first issue of 1999 is to be published and
received by residents by March 25 .
Several events sponsored by the Danby Community Council are scheduled for March and April
1999 .

Highway Report: t
Highway Superintendent William Hall reported that the department has been very busy keeping the
roads plowed and cindered during the recent bad weather and repairing equipment . He asked the
Board to approve the purchase a new three-quarter ton pickup truck with plow for the Town under
State bid for $20 , 159 .00 . The 1984 and 1988 pickups are in very poor shape and should be replaced.
Senior Citizens Report :
Edward M. Roberts reported that the March meeting was canceled due to a snow storm. The officers
have met and programs are scheduled . A travel committee will be appointed at the next meeting .
Zoning Report:
Code Enforcement Officer Susan Beeners reported that the monthly report for February 1999 has
been submitted . She is looking into the problems with the Town Hall heating system and some
repairs that must be made . Susan is researching information from other municipalities related to
noise ordinances, noisy event permit process and enforcement provisions related to noisy permits .
Dog Control - January 1999 SPCA Report - filed
Planning Board Report :
Code Enforcement Officer reported that persons involved in farming and other agriculture activities
in Danby are invited to an informal discussion about farming at the March 17th meeting. An
informal public information meeting on comprehensive planning is scheduled for Wednesday, April j?
28 , 1999 and will include discussion on the survey results and what is happening now.
County Representative Report :
County Representative Frank Proto was unable to attend the meeting but asked Supervisor Horst to
report the following: that he did not support raising the charge of thirty-five ($ .35) cents to one dollar
($ 1 . 00) on telephone service to cover the charge for the E911 as in his opinion there was not
justification to support a large increase. He is quite willing to change his mind if there is community
support for this increase .

Better Housing Rehabilitation Project
Supervisor Horst reported that at the last Better Housing Rehabilitation meeting and two (2)
applications for rehabilitations and repairs were considered and approved.
Recreation Partnership
Councilperson Gagnon reported that there is a committee that will be meeting every two weeks to
decide the future of the Recreational Partnership that the Town of Danby is a part of that allows
Town of Danby children to participate in the recreational resources of the City of Ithaca at a
reasonable price. The Recreation Partnership was a temporary arrangement and the committee will
not be looking at programming in detail but at what is being provided, what the costs are and
statistics on usage as a basis for who benefits from the programs . What is being proposed is
establishing a recreational fund or pool that all participating municipalities would contribute with
costs being determined and charged to the pool . At the next meeting the committee will review the
existing contract.
OLD BUSINESS
Reappointment to the BZA
Supervisor Horst reported that he has contacted Alex Specker and he is quite willing to continue to
serve as a member of the Board of Zoning Appeals .
Motion to Reappoint Alex Specker Board of Zoning Appeals
A motion was made by Councilperson Steiner and seconded by Councilperson Inman that the Town
of Danby Town Board reappoint Alex Specker of 9 East Miller Road, Ithaca, New York to a five
(5 ) year term on the Town of Zoning Appeals and that the term of appointment is to begin
immediately and will expire on December 31 , 2003 .

Senior Citizens Agreement with the Town of Danby
A motion was made by Councilperson Gagnon and Seconded by Councilperson Strichartz to
authorize the Town Supervisor to sign the attached Senior Citizens Agreement as approved by the
Town of Danby Town Board.
AGREEMENT
DANBY SENIOR CITIZENS 1999
THIS AGREEMENT is made this 8th Day of March 1999, between the TOWN OF DANBY
with offices at 1830 Danby Road, Ithaca, N . Y. 14850 (hereinafter referred to as the "Town") and the
DANBY SENIOR CITIZENS, whose address is c/o Edward M . Roberts, 47 Bald Hill Road,
Spencer, N . Y . 14883 (hereinafter referred to as the "Contractor") .
The Town and Contractor agree as follows :
1 . Services to be Performed . Contractor agrees to perform the following services for
the Town:
(a) Provide programs, including bus trips and other entertainment, for senior citizens .
(b) Provide liability insurance for programs
2 . Fees. The Contractor shall be paid the following sum for these services : The cost
of the services up to a maximum of One Thousand Five Hundred ($ 1 , 500 . 00) Dollars for the
calender year.

3 . Term of Agreement. The term of this Agreement shall be from January 1 , 1999 to
December 31 , 1999 , unless earlier terminated by either party. Notwithstanding the term set forth
above, this Agreement may be terminated in part or in whole by either party at any time for any
reason or for no reason upon three days prior notice to the other party. This Agreement may be
terminated immediately by either party upon the breach of any of its terms by the other party. In the
event of termination by the Town, the Town shall pay for those portions of the services rendered
prior to the date of termination. I
4 . Quality of Work. The services shall be performed diligently and in a proficient and
efficient manner. Contractor will provide responsible and knowledgeable personnel to perform
Contractor' s services to the Town. To the extent the reimbursement for services pursuant to this
contract is based upon hourly rates for Contractor' s employees or providers, Contractor certifies that
the time expended shall be reasonable for the services performed and the Town shall not be billed
for any time that is not productively used to accomplish the work for the Town.
5 . Payment for Services . Payment for services shall be submitted on the standard Town
voucher which will list the services and activities, the dates on which performed or supplied, and,
if applicable, the time spent on each indicated date for which the town is being billed. Unless
otherwise agreed, the vouchers shall be submitted monthly on the first of each month covering
services for the preceding month, and the Town will review same and, if acceptable, pay for the
services after submission of the vouchers to the Town board and approval of same by the Board.
6 . Relationship . The Contractor is, for purposes of this contract (including, without
limitation, withholding of income tax, payment of workman ' s compensation, and payment of FICA
taxes) an independent contractor and no employer-employee relationship is intended, implied or
created by this Agreement. Contractor shall determine the times and manner of performance of any
services for the Town hereunder consistent with the overall obligations for the work contemplated
by this Agreement. Contractor shall be free to devote such portions of its time not required for the f
performance of services to the Town in such manner as Contractor sees fit and for other such s
persons, firms, or entities as Contractor deems advisable provided that such other services do not
constitute a conflict of interest with the interests of the Town.
7 . Contractor' s Insurance . Contractor shall have provided by the Tompkins County Senior
Citizens Association insurance coverage for public liability covering Contractor and the Town, its
officers, agents , and employees, from and against all suits, claims, loss, liability, or expense
(including costs and reasonable attorney' s fees) by reason of any liability imposed upon the Town
or any or all of the foregoing persons for damages because of any injury to persons, including bodily
injury and death, or because of any property damage, including loss of use thereof, resulting from
any conditions of the premises for which reimbursement is being made to the Contractor under this
agreement. The amount of the policy shall be at least $ 500 ,000 aggregate limits or in such other
amounts as the Town may reasonably require . The policy may, at the Town' s option, be reviewed
by the Town' s insurance counsel to determine whether it adequately protects the Town and the
Contractor shall comply with any reasonable requirement of the insurance counsel . It is understood
and agreed that the Contractor shall primarily liable, and Contractor' s insurance comply shall be the
first to respond, in the event of any personal injury, property damage, or loss of life arising out of the
negligence or willful wrongful act of Contractor, or in any way arising out of, or related to , any
activities or services by Contractor under this contract.
8 . Contractor May Not Assign. This Agreement may not be assigned by the Contractor ' h
without the previous written consent to such assignment from the town, which consent may be
withheld entirely at the discretion of the Town, it being understood that the Town is making this
Agreement personally with the Contractor and is not intending that it be performed by any other
person or entity.
9 . Binding Nature of Agreement . This Agreement is binding upon the parties, their
respective successors and, when assignment is permitted, assigns .
10 . Governing Law Jurisdiction and Enforcement. This Agreement is made in New York,

and shall be construed under the laws of the State of New York. Both parties consent that if any
action is brought to enforce this Agreement, it shall be brought in Supreme Court in Tompkins
County, New York, and both parties consent to the jurisdiction of such court .
11 . Notices . Any notices or other communications given under or in relation to this
Agreement shall be deemed duly given if served personally upon the other party at the address set
forth above, or, if the mails are operating, mailed by certified or registered mail to the other party at
the address set forth above . Either party may change the address to which notices are sent by giving
notice of such change in the manner set forth above to the other party.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the day and year
above written.

West Danby Art Church Project
Councilperson Gagnon reported that there was some concern raised by the propriety of allocating
public funds to rent the West Danby Church for a proposed art project. Cornell University has an
outreach program that makes this kind of programming available. There is not a functioning heating
system or plumbing in the building and very limited parking space available . The proposed programs
would take place over a period of two (2) months .
Motion to Approve Rental Agreement for the West Danby Church
A motion was made by Councilperson Gagnon and seconded by Councilperson Inman that the Town
Board of the Town of Danby authorize the Town Supervisor to sign an agreement with the Church
Officials to rent the West Danby Church building for a two month period, preferably April and May
of the year 1999 in order to allow the proposed art program to take place for a cost not to exceed
$ 500 . 00 .

Proposed Preservation Grant
Code Enforcement Officer reported that Olivia Vent has been in contact with the Preservation
League and would like permission to submit an application on behalf of the Town of Danby to
review remaining agricultural buildings . Olivia is willing to prepare a draft outline of the grant
application for the Board to review at the April Agenda Meeting for consideration of Board
endorsement.

OF TELECOMMUNICATIONS TOWERS

WHEREAS, a resolution was duly adopted by the Town board of the Town of Danby for a public
hearing to be held by said Town on March 8 , 1999 to hear all interested parties on a proposed local
law entitled "A LOCAL LAW EXTENDING FOR AN ADDITIONAL ONE HUNDRED TWENTY
( 120) DAYS A MORATORIUM FOR THE CONSTRUCTION OF TELECOMMUNICATIONS
TOWERS : , and
WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal, and
WHEREAS, said public hearing was duly held on said date and time at the Town Hall of the Town
of Danby and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law, or any part thereof; and
WHEREAS, pursuant to Part 617 of the Implementing Regulations pertaining to Article 8 (State
Environmental Quality Review Act) it has been determined by the Town Board that adoption of said
proposed local law is a Type II action and therefore not subject to environmental review under
SEQR;
NOW, THEREFORE, be it
RESOLVED, that the Town Board of the Town of Danby hereby adopts said local law entitled "A
LOCAL LAW EXTENDING FOR AN ADDITIONAL ONE HUNDRED TWENTY ( 120) DAYS
A MORATORIUM FOR THE CONSTRUCTION OF TELECOMMUNICATIONS TOWERS",
a copy of which is attached hereto and made part of this resolution; and it is further
RESOLVED, that the local law or an abstract or summary of same be published in the Ithaca
Journal as soon as practicable after its adoption; and it is further
RESOLVED, that the Town Clerk is hereby authorized and directed to file said local law with the
Secretary of State as required by law.

LOCAL LAW NO . 1 OF THE YEAR 1999
A LOCAL LAW EXTENDING FOR AN ADDITIONAL ONE HUNDRED TWENTY
( 120) DAYS A MORATORIUM FOR THE CONSTRUCTION OF
TELECOMMUNICATIONS TOWERS
Be it enacted by the Town Board of the Town of Danby as follows :
Section 1 . Findings and Purpose . The Town Board of the Town of Danby finds :
1 . The Town of Danby adopted Local Law No . 2 of the Year 1998 providing for a
moratorium of one hundred eighty ( 180) days on the construction in the Town of Danby of
telecommunications towers as defined in such local law. By Town of Danby Local Law No . 3 of the
Year 1998 the moratorium was extended an additional 180 days .
2 . Since April 13 , 1998 , the date the Town Board voted to adopt the initial moratorium,
the Town has investigated the types of regulations it might wish to have in the Town, has explored
the possibility of hiring a consultant for assistance in drafting such legislation, has continued to work
with the only known applicant who is presently interested in installing a new telecommunications [ �
antenna in the Town by co-locating such antenna on an existing telecommunications tower, and in
general has made progress towards identifying the need for regulations and the possible manner of
proceeding on enacting same .
3 . Since the adoption of the local law extending the moratorium the Town has
contracted with a consultant to prepare a draft telecommunications facility local law, a draft has been
prepared, and the draft has been reviewed by the Town Board and the Attorney for the Town. Based
on such review, there are several matters to be resolved, including the manner in which the proposed
local law is to be integrated with the Town' s Zoning Ordinance, the completion of which will take

several additional months .
4 . It is anticipated draft legislation may be completed to the Town Board ' s satisfaction
within the next several weeks and upon such completion, the draft will be referred to the Planning
Board as required by New York State law for review and recommendation to the Town Board. Upon
completion of the Planning Board ' s review it is anticipated that the legislation will be referred to the
Town Board for final action.
5 . It is anticipated that this process of completing the legislation, review by the various
Town bodies and final action can be completed within one hundred twenty ( 120) days of the
expiration of the one hundred eighty ( 180) day extension of the original one hundred eighty ( 180)
day moratorium.
6 . The purposes of any new legislation would be significantly subverted if a new
telecommunications facilities were to be constructed before appropriate legislation could be carefully
studied and, if found desirable, enacted.
7 . Accordingly, in order to maintain the status quo relative to such telecommunications
facilities during the limited additional time the Town needs to review and adopt any appropriate
legislation, it is necessary to extend the previously adopted one hundred eighty ( 180) day moratorium
for an additional period of one hundred twenty ( 120) days .
Section 2 . Amendment of Local Law No . 2 of the Year 1998 . The Local Law No . 2 of
the Year 1998 as amended by Local Law No . 3 of the Year 1998 , is further amended to extend the
moratorium set forth in such Local Law by deleting wherever it appears in said Local Law the phrase
or phrases " 180 days" , "one hundred eighty days", and "one hundred eighty day" and inserting in
place of such phrases the phrases "480 days", "four hundred eighty days" and "four hundred eighty
day" .
Section 3 . Applicability. This local law shall apply to all areas of the Town of Danby.
Section 4 . Partial Invalidity. If any provision of this law is found invalid by any court
of competent jurisdiction, such invalidity shall not affect any other provisions of this local law which
shall remain in full force and effect.
Section 5 . This local law shall take effect ten days after publication of this local law or
an abstract or summary of same in the Ithaca Journal .

Extension of the moratorium local law expires on July 31 , 1999 .
A draft local law was submitted by the Town Attorney for review for the Town to consider as a
temporary interim local law. The draft local law was reviewed by the Planning Board at their
February meeting.
Supervisor Horst reported that we are paying a consultant to develop a local law for the construction
of telecommunication towers . We have received comments from our Town Attorney on the draft
provided by Comi Telecommunications . The consultant has requested that we send the comments
from our Town Attorney and a copy of our present laws that are in place he will attempt to retrofit
them into our local law. The Board was asked to submit their comments to him to forward to the
consultant for modification on the draft.

Motion for Town to Continue With Comi Telecommunications for a Local Law Regulating
Telecommunication Towers in the Town of Danby
A motion was made by Councilperson Strichartz and seconded by Councilperson Inman that the
Town of Danby continue working with Comi Telecommunications for the development of a local
law regulating telecommunication towers in the Town of Danby and to have a local law in place as
soon as possible .

A motion was made by Councilperson Steiner and Seconded by Councilperson Gagnon that the
Town of Danby Ordinance be written so that the Town of Danby Planning Board be the agency to
approve applications for the construction of telecommunications facilities .

Consideration of Participation of Cooperative Purchase for Electric Power
RESOLUTION NO. 32 OF 1999
PURCHASE OF ELECTRIC POWER UNDER CONTRACT WITH NYSEG SOLUTIONS,
INC.
By Councilperson Steiner: Seconded by Councilperson Inman
WHEREAS, the County of Tompkins and the County of Tioga entered into an agreement for the
purchase of electric power with NYSEG Solutions, Inc . ; and
WHEREAS, the contract provides that political subdivisions within the counties may obtain electric
power under the contract; and
WHEREAS, the Tompkins County Board of Representatives adopted a resolution providing that
political subdivisions within the County shall be included in such cooperative purchasing agreement
upon the submission of a resolution approved by its governing body to the County Department of
Finance, now therefore be it
RESOLVED, that the Town. of Danby shall participate in the cooperative purchase agreement and
may, thereby, purchase electric power under the contract with NYSEG Solutions, Inc . ; and be it
further

Town Board Minutes
9 March 8, 1999
Concert Series
Judy VanDermark reported that the Programming Committee for Community Council and are
planning a concert series. They have requested use of the Town Hall Building but have not
scheduled dates for the events at this time .
Councilperson Strichartz reported that the first concert will be held on Saturday, May 15 , 1999 at
7 : 00 p.m. It is planned that the Devon String Quartet will perform .
Authorization for Use of Town Hall for Playground Design Day
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the
Town Board of the Town of Danby authorizes the use of the Town Hall Facility on April 17 , 1999
for the Playground Design Day and that a request in writing and a valid Certificate of Insurance will
be filed with the Town Clerk.

Supervisor Horst appointed Councilperson Steiner and Councilperson Gagnon to act as liaison to
the Highway Department. A local resident may be contacted as an additional outside person to work
with the liaisons .
Ithaca College Community Service
The Clerk reported that she has received a request from Ben Hogben for Ithaca College students and
staff to provide duties for the Ithaca College Community Service Day on Friday, March 26, 1999 for
four (4) persons for four (4) hours .
Motion to Approve Community Service Workers - Community Services
A motion was made by Councilperson Inman and Councilperson Strichartz that the Town of Danby
Town Board approve the use of Ithaca College Community Service request pending proof of
Liability Insurance coverage .

Tompkins County Community Service
Tompkins County Community Service can be used to do some of the work on the Town Hall that
was approved through a Revitalization Project Grant. The Town must provide the supplies and
equipment necessary for the work to be performed . Supervisor Horst will contact the supervisors
of the community service programs and request that the Town be placed on their schedule to wash
and paint the building and possible other maintenance work of the Town Hall Facilities .
Request of Town Clerk to Attend the Annual NYSTCA Conference
Motion to Approve the Town Clerk to Attend the New York State Town Clerk' s Association
Annual Conference
A motion was made by Councilperson Gagnon and Seconded by Councilperson Inman that the Town
Board of the Town of Danby authorize the Town Clerk to attend the New York State Town Clerk' s
Association Conference on April 25 - 28 .

Highway Department Request for Pickup Truck
Highway Superintendent William Hall has requested authorization of the Town Board to purchase
a three quarter ton pickup (3/4) truck for the highway department through New York State Contract.
The purchase of a new pickup truck will be deferred until the liaison group has the opportunity to
look into the need for this equipment purchase .
Approval of Town Supervisor' s Reports - January 1999 and February 1999
A motion was made by Councilperson Steiner and seconded by Councilperson Gagnon to approve
the Town Supervisor' s January 1999 and February 1999 monthly reports as submitted.
