Morey, Supervisor Ellard L. Sovocool, Councilman Donald F. Scheffler, Councilman Richard B. Gamel, Councilman Sheldon C. Clark, Councilman Victoria Monty, Attorney for the Town Also present: Renee King, Donald Palmer, Nick Babel, Dale Kinney, Dewey Dawson, Gary Coats, Elizabeth Brennan, Richard C. Case, Jr., April Scheffler. MOVED by Councilman Sovocool, seconded by Councilman Scheffler, to approve the minutes of the October 13, 2009 meeting as presented. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. MOVED by Councilman Gamel, seconded by Councilman Clark, to approve the minutes of the October 20, 2009 Work Session as presented. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. Claim Numbers 326-359 of the General Fund in the amount of $22,066.90 were presented for audit. MOVED by Councilman Sovocool, seconded by Councilman Scheffler, to approve the General Bills for payment. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. Claim Numbers 193-214 of the Highway Fund in the amount of$46,834.07 were presented for audit. MOVED by Councilman Clark, seconded by Councilman Sovocool, to approve the Highway Bills for payment. Town Board Minutes Page 2 November 10, 2009 Supervisor Morey offered Privilege of the Floor: Donald Palmer asked about the availability of minutes and said that he had tried to find them on the website but all that came up was the first page of the site and there were no buttons to take you to any other pages. Clerk Scheffler explained that this happens with the newest version of Internet Explorer but she did not know why it happens. She said that if Mr. Palmer used a previous version of Explorer or Mozilla Firefox, that the website works fine. Mr. Palmer said he would like to look at some of the older minutes and Clerk Scheffler said she could email them to him or he could come in and look at them. Mr. Palmer asked when draft minutes were available, stating that he thought it was required to have them available in 7-10 days. Clerk Scheffler explained that it is required to have them available in two weeks and they are usually completed in that timeframe and available at the Town Clerk's Office. Mr. Palmer asked about the petition presented in September about public performances. Supervisor Morey explained that Section 377, pertaining to Mass Gatherings, has been added to the Draft Code. He said that Clerk Scheffler could provide him with a copy if he would like to see it. Monthly Reports: Elizabeth Brennan, Bookkeeper/Highway Clerk - Submitted monthly reports for the Board's review and request budget transfers. RESOLUTION#09-071 - 2010 BUDGET TRANSFER MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED,that the Town Board hereby approves the following 2009 Budget Transfer: General Fund- Town Wide: From: Justice, Contractual A1110.4 $141.79 To: Justice, Equipment A1110.2 141.79 RESOLUTION#09-072 - 2010 BUDGET TRANSFER MOVED by Supervisor Morey, seconded by Councilman Scheffler Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED,that the Town Board hereby approves the following 2009 Budget Transfer: General Fund- Town Wide: From: Town Clerk, Contractual A1410.4.....$172.97 To: Town Clerk, Equipment A1410.2 172.97 Town Board Minutes Page 3 November 10, 2009 RESOLUTION#09-073 - 2010 BUDGET TRANSFER MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED,that the Town Board hereby approves the following 2009 Budget Transfer: General Fund- Town Wide: From: Historian, Contractual A7510.4 $242.98 To: Historian, Equipment A7510.2 ..242.98 RESOLUTION#09-074- 2010 BUDGET TRANSFER MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the following 2009 Budget Transfer: General Fund- Town Wide: From: Contingency A1990.4 $200.00 To: Audit A1320.4 200.00 Gary Coats, Code/Fire Enforcement Officer - Submitted monthly reports for the Board's review. The highlight for the month was that the Perkins family has moved into their new home after having their house burn quite a while ago. Richard C. Case, Jr., Highway Superintendent - The transition from summer to winter for the plowing equipment is going smoothly. Deicing sand and salt have been stockpiled. The Highway Crew has undertaken an extensive drainage and road widening project on Elm Street Extension from Lafayette Road to Route 222. PESH visited our facility once again in October. After their inspection, everything was found in compliance without any more action taken at this time. On October 30, 2009, at 1:00 PM, the bid opening for the rubber-tired tractor loader/broom combination took place. After Dale Kinney and I reviewed the bids and specifications submitted, it was concluded that the equipment package from Cazenovia Equipment Co. was acceptable for the Town's needs. It is my recommendation that the bid be awarded to them. RESOLUTION #09-075 -AWARD TRACTOR BID TO CAZENOVIA EQUIPMENT CO. MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED,that the Town Board hereby awards the bid to Cazenovia Equipment Company for one John Deere 6330 Tractor with John Deere 673 Loader and 21109 LA Sweepster/Broom for a total cost of$93,944.96. Town Board Minutes Page 4 November 10, 2009 Supervisor Morey asked about signs for Odgen Road. Mr. Case said that the sign account is depleted at this time but after January 1st they will be installing suggested speed limit signs of 35 mph, school bus stop signs, and handicap area signs. April L. Scheffler, Town Clerk/Tax Collector - Submitted monthly report and Country Acres report. She had provided Board with notice about increased limits for tax exemptions for senior citizens and people with disabilities on limited incomes. If the Board wants to do this they will need to update the local law prior to March 1st Victoria Monty, Attorney for the Town - Had nothing to report. Councilman Sovocool asked if there was anything new about Diversified and she said there was not. A. D. Dawson, Town Justice - Submitted monthly reports for himself and Judge Norman. He had nothing else to report. RESOLUTION#09-076 - RENEW CONTRACT WITH HESS CORPORATION MOVED by Councilman Sovocool, seconded by Councilman Scheffler Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves renewing the contract for purchasing natural gas with Hess Corporation through the Municipal Electric and Gas Association. RESOLUTION#09-077 -WAIVE BUILDING PERMIT FEE FOR DISABILITY RAMPS MOVED by Supervisor Morey, seconded by Councilman Scheffler Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby waives the building permit fee for disability ramps built within the Town of Groton. RESOLUTION #09-078 - APPROVE 2009 GADABOUT CONTRACT MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the 2009 Contract with Gadabout Transportation Services, Inc., in the amount of$5,100.00.
