TOWN BOARD MINUTES
SPECIAL MEETING
JANUARY 22 , 1999 - 9 : 00 A.M.
PRESENT :
Supervisor Kenneth Horst
Councilpersons : Joel Gagnon, Edward Inman, Howard Steiner, Naomi Strichartz
Others Present :
Carol Sczepanski, Town Clerk

Members of the Public :
Pat Woodworth, Dan Klein, Linda Howe, Jim Houghton, Mary Oltz, Ester Dotson, Judy
VanDermark, Faith Chase
Supervisor Kenneth Horst called the Special Meeting of the Board to order at 9 : 02 A.M. He reported
that this meeting was requested by three members of the Board, Councilpersons Gagnon, Inman, and
Strichartz due to the publication of a January 1999 issue of the Danby Area News .
Councilperson Inman said that he had specific questions from the Danby Area News Committee that
the Attorney was asked to answer in writing for the Board .
Communications :
1 ) Letter Dated December 22 , 1998 to Attorney John Barney from Councilperson Inman.
2) Opinion of the NYS Comptroller
3 ) Response from Attorney John Barney of meeting with Councilpersons
The committee has yet to develop policy of acquiring an editor through interviews, set term limits
and develop a contract.
RESOLUTION NO. 23 OF 1999
DESIGNATE DANBY COMMUNITY COUNCIL AS THE OWNER AND PRIME USER OF
THE TOWN OF DANBY BULK MAILING PERMIT
By Councilperson Inman: Seconded by Councilperson Strichartz
RESOLVED, that Bulk Mailing Postal Permit No . 352 , and full control of its use belongs to Danby
Community Council .
Discussion followed regarding the fact that Community Council has not received non-profit status
as they have not applied for a 5013C status although funds were allotted in 1998 for that purpose .
A roll call vote on the resolution resulted as follows :

RESOLUTION NO 24 OF 1999
AUTHORIZE THE DANBY COMMUNITY COUNCIL TO PUBLISH A NEWSLETTER
WITH TOWN FUNDS
By Councilperson Inman : Seconded by Councilperson Gagnon
RESOLVED, that the Town of Danby Town Board Authorizes the Danby Community Council to
select an editor and staff of their choice and to publish a newsletter that will comply with applicable
Town Laws.

RESOLUTION NO. 25 OF 1999
TRANSFER OF FUNDS
By Councilperson Inman : Seconded by Councilperson
RESOLVED, that the Town of Danby Town Board transfer $ 1500 . 00 from A1650 . 400 to
A7149 .400 to provide for additional expense of publishing a community newsletter by Community
Council .
A vote on the resolution resulted as follows :

President of Community Council Dan Klein asked that the Board send a letter to the Danby
Community Council that states that they are the holders of the bulk mailing permit and that states
who can use it for them to present to the Unites States Post Office .
RESOLUTION NO. 26 OF 1999
DESIGNATE THE USE OF BULK MAILING PERMIT
By Councilperson Strichartz : Seconded by Councilperson Inman
RESOLVED, that the Town Board of the Town of Danby designates that the president of the Danby
Community Council Dan Klein and Vice President of the Danby Community Council Judy
VanDermark have sole authority to use or delegate use of this stamp .
A vote on the resolution resulted as follows :

Other Business :
The Town Clerk distributed the Draft Local Law received from Comi Telecommunications for the
Town Board to review.
