Town Board Minutes 2 - September 13 , 1976

RESOLVED , that the Toren- Justices are hereby authoriryed to attend
the New York State Magistrates Conference , Septem:� � . 1922 , 19iG ,
expenses to be paid by the Town of Ithaca .

NETA7 YORK STATE . PttMBING CODE
Supervisor Schwan noted it appeared there is some con
fusion as to whether the Town of Ithaca , at its meeting of August
23 , 1976 , legally adopted the Niew York State Plumbing Code . There
is further confusion about whether , when the Town on January 7 ,
1960 adopted the State Building Construction Code also adopted
the State Plumbing Code at that time . Town Attorney Buyoucos
will look into this matter and make a recommendation to the Town
Board . He said it appears at this time that the Town of Ithaca
has adopted the State Plnigbing Code , which is included in the
State Building Construction Code since McKinney ' s Consolidated
Laws of New York indicates that the Town of Ithaca adopted the
State Building Construction Code , in its entirety . :However , final
determination in this„ matter will have to await !er . Buyoucos ' s
inquiry .
FALL CLEAN° UP DAY
Supervisor Schwan reported the Town has been receiving
requests for a fall clean -up day in addition to the spring cleans
up day . After discussion it appeared that October 18 , would be
the most appropriate time .

day at this time might jeopardize timely accomplishment of neces ®
sary road work .
The Town Clerk was instructed to place a box ad in the
Ithaca Journal at the appropriate time to advise Town residents

SHARING USE REPORT
The Supervisor said the current 'Revenue Sharing Use Report
has been prepared in accordance with the Board ' s previous resolu-
tion that a portion of revenue sharing funds be used for the Town
Highway Barn after the Town Hall was paid for . The total amount
of Revenue Sharing money to be received by the Town of Ithaca is
$ 83 , 658 . 00 . Of that mount , $ 37 , 053 . 93 was used for the Town
Nall , the balance of $ 46 , 604 . 07 being allocated to the Town High-
way Earn .

Brian 11.o-w , 117 Oak Hill Road . Expressed concern over
traffic c0ii'T ivris at Elie iritarsection of Tlarren and Hanshaw Roads .
He suggested that the Town have a traffic light installed at the
intersection , stating this is an unusually dangerous corner . He
also recomended that the mown proceed with request for a lower
speed limit on Fanshaw Road ( and, take the chance that the speed
limit might be increased . ) He also recommended that the Town

set up a special committee to devote time to a special study of
the area to determine !� what is feasible and what can be accomplished
to prevent loss of life and property . In this connection , Super ®
visor Schwan referred 'ito a letter dated September 13 , 1976 frem
Councilman Desch ( who °, was not present at this mee +' inq ) indicating
his feeling that a traffic light is justified at this intersection
and that the Board should officially request the County to install
such` a light . Ile urged that the Toe'm ' s County Representatives take
up the matter at their next board meeting and sui.ggested that mem-
bers , of the Town Board might appear before the County Board if it
would help the CountyPBoard to reach a pronpt decision .
Dar . How ' s comml eats and Mlt . Desch ' s letter led to a Long
discussion of 4 �-way stop ;signs , 4 -way red blinking light ,, and
traffic control device ( lights ) . During the discussion L11r . Fabbroni.
noted that his studies indicate that the traffic volumes at this
intersection do not meet the warrants established for traffic lights,
by the State and Fede r," al governmentso and that a request for a
traffic control device would probably not be granted by the Depart-
ment of Transportation . Councilwoman Raffensperger noted that part
of the problem at this intersection as that the present speed lim-
its are not enforced , ', according to comments she has heard . County
Representative Livesay also citsz:.f! the riecd for more law enforce--
ment at the intersect-ion until people get used to the 4 -way stop
signs . She also suggested a " Stow Ahead " sign for Hanshaw Road .
County Representative ' Theisen noted that traffic lights are ren -
dered ineffective atce:rtain tides . of day because of the sun ' s
glare . It was noted that this is a problem in many areas through-
out the County .

Letter be- irritten to the Tompkins County Sheriff ' s Office and to
the State Police requesting that they patrol the intersection of
Manshaw and Warren Roads until it is established that the travel -
ing public is aware of the new traffice regulations at that inter-

County Representatives Livesay and Theisen will assist
in discussions with the County Highway Department regarding in-
stallation of the 4aml blinking red light . Supervisor Schwan
will write to the Sherlff ' s Office and the State Police and Mr .
Fabbroni will work with the County Highway Department on the 4 -way

Town Board Minutes n A September 13 , 1976
Councilman McElwee suggested , based on comments by I :ir
Brian Now , that some traffic signs might be anpropriate on Roat
Street and Blackstone Avenue .
John Turner , 240 Stone Quarry. P.oad . ' fro Turner said he
found it disturbing that the Town 136ard has a pr_ oblen:� getting
through to the State on the Tocm ° s problems in regay7s. to reduction
of speed limits o He cited that the Town ° s request for a lotrlered
speed limit on Stone Quarry Road has been denied , �l"hP Supervisor
noted that when the Town applies for a lowered speed limit the re -
quest to the Department of Transportation first goes to the County
Highway Superintendent '' who forwards the renuest to the DOT with
his comments and recomsaend. ations o Then the Town is advised of the
decision by the DOT.
Mr . Turner inquired about the cost of bringing water service
to the Stone Quar =ry Road by increasing the benefit rate ToceI� d.e .
Supervisor Schwan said , Tiro Fabbroni would have the figures ready
at the next Board meet ' ngo He said ` the figures would cover Stone
Quarry Road and the fire proposed sewer extensions
Dr_ . Harold Lo Purdy , 1350 Ellis Holloia Road . Dr . Purdy
appeared to be heard on the matter of the deveS&n ent of a dental °°
medical building on East Hill Plaza . The Board examined a drawing
of the proposal. Mrs . t-1olcomb remarked that Dr . Purdy had come be °
fore the Planning Board last Thursday on an informal basis . She
said the proposal raises very feipr problems from the standaolnt of
zonings She said it would be useful to have the Town Board ° s re °
action at this time . T,he Planning Board will then have a public
hearing and the Town Board could schedule a public hearing on the
matter . The building 140uld be located north of the Page Book Bind -
ery , between the proposed road and the existing Parking lot ( east
of the old Family Bargain Center . ) Dr . Purdy said he intended to

RESOLVED , that the Town, Board of the Town of Ithaca will hold a

Proposed site plan of Dr . Harold L . Purdy for a dental - medical
building to be located on the East Hill Plaza , north of Page Book
Bindery and east of thee,; former Family Bargain Center .

SPCA CONTRACT
Mrs . Livesay noted she Baas working on the SPCA contract
for next year , and she Wondered what the situation is for the Town
of Ith"aca as regards SPIQA service . In that connection she asked

The people do not want;; the inconvenience of making a formal com-
plaint . They just warit the dogs picked up and the SPCA appears to
be do''ing its job . 5hel!, said , however , her feedback is that people
would like a contract with the SPCAo

Supervisor Schwan read Mr . Walter Carman ° s note in reply
to the Town ' s form letter billing hirm for work on Campbell Avenue
( his share ) . Mro Carman said he has no intention of paying for the
work , contending that the Town has not lived up to its original
agreement as to how the work would be performed . It was agreed
that members of the Torn Board would visit the Carmans on the
premises and discuss the problem . L
COURT;, CLERK FOR TO1,RN JUSTICES
Supervisor Schwan read Justice Blye ° s letter requesting a
Court Clerk for 30 hours a month at $ 3000 an hour in order to catch
up with a backlog of paper work . Councilwoman Raffensnerger recom-
mended hiring a clerk for both justices , the time to be divided be °°
tween them in proportion to their case load . There was discussion
of the case load of ea''ch justice based on fines collected and other
considerations . mxs . tackle noted that case load could not easily
be determined on the basis of fines collected , saying she had a cer -
tain number of fee ® less cases . Because of the difficulty in deter -
mining the case load of each justice , the Board felt that 30 hours
should be made available , to be shared as needed by the two justices .

RESOLVED , that the request for a Court Clerk for 30 hours a month
at S3o00 an hour is hereby approved , , the said 30 hours to be shared
by the tt�Yo Town Justices as needed .

DRAINAGE PROBLEHS
Supervisor Schwan referred to letter from Earl Lo T�7uetterties
complaining of flooding conditions on Christopher Lane and letter
of David L . Grunes complaining of flooding conditions on Salem Drive ,
Town Engineer Fabbroni " said the problems outlined in these letters
will be covered in the '' overall plan to improve drainage in the area ,
including increased culvert sizes and the building of holding ponds .

The Town .Attorney requested the Town Board to hold a public
hearing on the adoption of an administrative law for the enforcement
of the State Plumbing Code:.
Motion by Supervisor Schwan ° seconded by Councilman HcElwee ,
RESOLVED , that the Town Board of the Town. of Ithaca will hold a
public hearing on October 11 , 1976 at 7c10 p . m . to consider the
adoption of an administrative law for the enforcement of the State

spent in rental eaull7trient and what amounts of $ 15 , 000 of Town time
to date cleaning up as ", a result of the flood . Over 50 % of the pro -
jects ' have been completed within the time required to make the Town

Town Board Minutes - 6 - September 13 , 1976
Mre Fabbroni at;; this time made a long presentation , using
aerial photos , colored maps and charts outlining his long °range
plan for relieving the flood and drainage problems in the Town of
Ithaca . He noted that the Eastern Heights area had been studied in
detail . He illustrated:, on maps the trouble areas which have been
under discussion for a long time . The entire watershed has been
studied . He pointed out plans to direct water in reays intended to
alleviate present problems . He pointed out the situation as it
existed prior to the July 11 flood , why there is flooding and the
problems involved - ® the clay soil , the rock , the rer:ioval of cover
due to developments , ho,w various properties have been affected
( Hewitts , Naflers , Sapps , Ewings , and others ) , increased velocity
of run ° off , lacklof holding or draining capacity below the surface
of the ground , and the ,part: % cularly saturated soil at the time of
the July 11 flood , loss of definition in creeks because of growth
of underbrush and accumulation of leaves creating increased sheet -
ing action .
Fir * Fabbroni said his objective now is to balance flows in
the trouble areas . An additional water crossing will be provided
to cut off the Dryden area which now flows into the Town . There
is under consideration the installation of safety pipes , the con -
struction of a series of drop structures like check dams to Provide
an adequate holding area , a larger dam between two properties to
catch debris so that it will be accessible for clean -out , which
will markedly decrease the velocity of the water and cave - ins which
now occur ° Estimated cost of contemplated rtlork is $ 15 , 000 .
1. ro Fabbroni noted that the work contemplated would require
easements from various ' landowners (Plarion , Sapp , . Frandsen ) . Mrs .
Hafler inquired about a time - table for the work to be performed ,
particularly in the area affecting her property . Mr . Fabbroni said
that would be determined after talking to the property oiAmerso In
any event , as far as construction is concerned the Town is tied to
October 20th because of the Federal regulations . It was noted it
would be almost impossible to accomplish anything in the way of
acquiring easements by „ October 20 . Councilman 214cElwee recommended
that all necessary materials should be bought so they may be in -
stalled immediately the easement is acquired . Mr . Fabbroni will
discuss with property owners the problems involved and see what
portion of the work can be accomplished with their cooperation .

Proof of posting and publication of notice of public hearm
ing having been presented by the Town Clerk , to consider re - zoning
of the Ridgecrest Road. area from R- 30 to R- 15 , the Supervisor open -
ed the hearing and asked if anyone wished to speak for or against
the proposed re - zoning . Since it appeared no one wished to be
heard , the Supervisor closed the hearing and the Board acted as

Town Board Minutes Septembber 13 , 1976
It was reco!�mended that a letter be sent from the Town
Board, to all employees of the Town of Ithaca - explaining that based
on information presented to the Town Board at this meeting that
the, Board is sly pathetic with TMZr .o iCay vrooc? ° s particular pro:�lezt and
with the sick leave problem of employees generally , but that the
resolution adopted :ray be rescinded by the Town roarol at any time ,
and the Town Board reserves the right to adopt such rules and renu °
lations to provide for the administration of , sick leave police as
it may deem proper . The Town Attorney said he would draft letter .

The Supervisor reported on his trip to New York on Septem-
ber 9 , 1976 to sign bonds of Toi4m of Ithaca for $ 1 , 967 , 000 and to
deposit proceeds omf' said bond sale to the account of the Town of
Ithaca , He reported further that the Bolton Point project had re °
ceived a $ 1 , 0001000 grant from the Farmers Home Administration .
The Southern Cayuga Lake Intermunicipal Ttlater Commission intends
to sell $ 7 , 000 , 000 serial bonds , 20 "year term , by the end. of Novem-
ber The bond market has improved considerably ( City of Ithaca
having just sold $ 51OdO , 000 bonds at 505 % interest ) . The Commis -
sion is hoping for an interest rate below 6 % for its sale . ' If this
happens it may be possible to reduce the Bolton Point water rate
increase from an 35 % increase to a 55 % increase .

up on the natter of an emergency phone for the Highway Department ,
