Supervisor Sch'ifiran reported that , bids on Town of Ithaca
serial bonds in the amount of $ 1 , 967 , 004 will be received in New
York !City on Thursdayel11' August 19 , 1976 at ll � 00 z aDlo It was agreed
that the Supervisor will , if necessary , make a call to Ithaca .
after the bids are received to consult with toard members on accep -
tance of the low bide
WATE1•: RATE SCI,TEA RULE
The Board reviewed proposed local law with respect to the
adoption of a revised water rate schedule ,
. Town Attorney Buyoucos
noted that no provision had been made as yet for the surcharge
section of Schedule " A,il' o The Board agreed to set the water sur -
charge at 5 % and the Town &Attorney will prepare appropriate lan -
guage . A public hearing on this matter is scheduled for August 23 ,
19760
It was agreed 'also that the sewer surcharge will remain
at 2 % 110 Therefore , no ;revision of the sewer ordinance will be re �
quireda
PLUMBING CODE
The Board reviewed proposed local law , prepared by Town
Attorney Buyoucosj for ,; the adoption of a plumbing code and for the
control of cross -- conneotionso This material and the prepared mate ...
rial on cross connection control was accepted by the Board " as is "
( in view of the ircnediate need for a plumbing code and cross -
connections control ) with the intention that after some experience
11 1 th it , it could be amended , if necessary . A, public hearing on
this matter is scheduled for 'August 23 , 1976 °

Town Attorney Buyoucos read letter dated August 16 , 1976
addressed by hire to Supervisor Schwan on this matter . His letter
notes that not later than August 30 , 1976 the Town of Ithaca and
the City of Ithaca must publish a notice that a joint hearing must
be held not sooner than 20 days nor more than 40 days after the
publication of the notice , He suggested October 3 , 1976 as the
hearing date . He recommended that each member of the Town Board
should submit a list of arguments in support of the contention that
the proposed annexation is not in the over - all public interest of
the Town .

purchasing for the ' highway. maintenance : facilityo On this leased
portion PTr a Brink 'has 'planted a corn field o Mr .o Buyoucos noted
that the Town ° s option',' to purchase the . land. did riot include any
agreement to take titlo .to the property subject . to any lease or
agreement. with anyone 'else ° It was aIgreed . a letter to Mr . Brink
would - be drafted in anefort to settle this matter . amicably with
Mr , Brink . Mro Brink will be asked to harvest his corn , if pos °
sible before Augu6t, 25 '!, 1976 ° The . Town has no alternative con-
sidering its need to take possession of the site in ' order to have
the facilities ready by the time it vacates its present premises ,
FRESHWATER d<1ETLANDS
Flr a Fabbr6hi reported that the Town ' Iias received a model
law/ordinance for the Arotection of freshwater wetlands prepared
by the 14ew York . State Department of EnVirohn' ental Consdrvation ,
with a request to bring it to the attention of the Town Board . In
Order to protect the remaining wetlands in New York State , . the
State,, Legislature adopted the Freshwater tHetlands Act , Article 24 ,
of th'e Environmental Conservation Law , effective September 1 , 19750
It appears there is some confusion as to whether the Town ( or any
municipality ) is required to adopt its oirm wetlands' legislation
by September 1 , 19760 In any event , any local legislation would
not be effective until ,', the Department of Environmental Conservation
furnishes freshwater wetlands maps .
The Town . Board 'P after brief discussion , acted as follows :
Motion by Councilman Desch ,, seconded by Councilman Powers ,
RESOLVED , that the Town Board of the Town of Ithaca shall hold a
public hearing on August 23 , 1976 at 6 .* 00 pomo at the Town Offices
to consider the adoption of a local law for the protection of fresh-
water wetlands in accordance with a model law prepared by the De -
partment of Environmental Conservation .
Unanimously carried .
REZONING RIDGECREST ROAD AREA
Mr . Fabbroni , as indicated at the meeting of August 9 ,
1976 , presented a map of the area proposed to be re - zoned . This
is an area west of Ridgecrest Road , east of the Chase property ,
"ild south of East King !; Roado The intent is to re- zone all the
a cea which is not R� 15 to R�- 15 ( from R-- 30 ) o Mr . Fabbroni asked
tae Town Board to schedule a public hearing to re - zone this land
1>>>hich is served with water and sewer since the R- 30 category is
no longer required for proper drainage . The Planning Board has
recommended such re ° zoning °
Motion by Councilman Desch ° seconded by Supervisor Schwan ,
RESOLVED , that the Town Board of the Town of Ithaca shall hold a
public hearing on September 13 , 1976 at 7o00 pomo at the Town
Offices to consider rezoning from R- 30 to R� 15 the following area .
all the land west of Ridgecrest Road , east of the Chase property ,
and south of East King ' Roado
Unanimously carried .
Councilman Del ' Rosso noted that the Ridgecrest Road area
is becoming a blightedJlarea and that if this is the result of any
lack of enforcement o .f ', the Zoning Ordinance , the Town should look
into the matter very carefully . Councilman Powers noted that the

blighted . appearance is at . least in part due to the type of house
construction in the area and that these houses now are beginning
to show signs of deterioration .
VARIETY STORE AND MINI -GAS STATION
DEVELOPMENT m MORRIS ANGELL
Councilwoman Raffensperger said it was her understanding
that ; the Town Board was going to hold a public hearing on August
23 , 1976 in regard to the variety store and rani ®gas station which
is proposed for the corner of Judd falls Road and Ellis Hollow Road
by Morris Angell , one ' of the reasons for the holding of a hearing
being that the Planning Board held an improperly advertised public
hearing on this mattero Since there , was still some disagreement
as to whether • a public hearing is a legal requirement in this case
( since the use applied for . is a legal use in the area ) , . it was
agreed that . a special advertisement ( not a legal notice ) would be
placed in the .. Ithaca Journal notifying the 7bwn residents that a
public information meeting will be held on August 23 , 1976 on the
proposed development .
STATUS OF BUILDING PLANS FOR
HIGHWAY MAIA1TFNADICE FACILITIES
Mro Fabbroni presented three schematic site plans for the
proposed Town of Ithaca highway maintenance facility on Seven Mile
Drive and schematics for the ultimate use of . the building prepared
by John So MacNeill , Jr . , P . C . ( Consulting Engineer & Land Surveyor ) ,
including topographical survey . Costs were variously estimated at
$ 246 , 000 , $ 1950000 , and $ 170 , 000 . The Board reviewed with Mr . Fab °
broni the three alternatives , and discarded the two higher estimates
for economic reasons , and reviewed more closely the $ 170 , 000 pro
postal , a pre engineered metal building of about 9 , 180 square feet .
Tiro Fabbroni and the Board made various suggestions modifying the
schematics , particularly recommending location of a part of the
proposed facilities on a second floor ,
