At an Adjourned FsTeeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town of Ithaaca Offices at 126 East Seneca Street, Ithaca , New York , on the 26th day, cf July , 1976 , at 500 p . m . , there were PRESENTo Walter J . GHWAY 15AINTENANCE F.A(jILImY Supervisor Schwan reported m!ro Tomlinson would sell his land can Bostwick Road for $ 10 , 000 an. acre ; that if the Town Board were to initiate a condemnation proceeding he would vigorously oppose 1 o The Boc:rc, again discussed the advantages and disadvantages of various sites - Q Seven Mile Drive, Five Mile Drive , property on Bostwick Road ( Tomlinson ) , and County pro^ertyo Councilman McElwee felt that if the Tomlinson '' property were the best site for the facility , the purchase, price or the expense of condemnation might not be excessive considering the length of time the facility will be in use . Councilwoman Raffensperger said she did not under - stand all the implications of a condemnation proceeding . At this point ToiAm Attorney Buyoucos recommended that the Board go into executive session . E11ECUTIVE SESSION Wighway 14aintenance Facility ) In executive session 11ro Buyoucos explained what is involv- ed I a condex:_nation , land appraisal , consequential damages , legal costa , public relations , etc . After the executive session the Board re - convened in regular session and acted as followso RESOLUTION ION OT,? TOMLINSON PROPERTY ( Rescinding ) Motion by Supervisor Schwan; seconded by Councilwoman Valentino , RESOLVED , that the resolution adonted on July 12 , 1976 to investi. gate the Tomlinson property on the Bostwick Road be rescinded on the basis that the asking price is , too high ( $ 10 , 000 per acre ) and that a condemnation proceeding might be too costly and involve con- siderable delay . After some aiscussion as to whether it was necessary to rescind the resolution of July 12 , 1976 . Councilman Powers sug- gested that a Boarc? Might adopt resolutions to buy any number of properties without having to rescind any of them , and still have the option to buy another property if that seemed the best thing to do . No immediate agreement was reach on this matter and the Board temporarily tabled the motion . ' ri Town : Board Minutes - 2 - July 26 , 1976 Councilman Desch noted that the motion of July 12 , 1976 put forward by Councilman Powers was a motion " to locate " . Coen° Gilman Powers said his intention in the motion was "' -Co purclie� a �> " . He said he did not know how you " locate " without " .purchasing " . H:t only reservation at that time , he said , was that h could not SPCC I, fy how much land should be purchased or exactly wh e on the Tomtr linson property the site should be located . Councilwoman Raffensperger inquired on what hasis it was determined that six acres were required . She said if the Board was faced with a $ 10 , 000 an acre price , the number of acres needed was an important consideration . Mr . Fabbroni said the number of acres required is based on the space needed for a building taking into consideration seteback from the road for the. facility , the required uses in terms of storage; of materials and expansion of those uses . Councilman Desch said anything less than six acres would cause an environmental problem . Councilwoman Raffensperger said she remembered a 'discussion of " usable acreage " on Seven Pile Drive and inquired what the usable acreage is cn that site . 14r . Fabbroni said it is about seven to eight acres if the land across the brook is included The motion to rescin� the , resolution of July 12 , 1976 was placed upon the table again and was duly adopted . Following this , the Board acted as follows ° Motion by Supervisor Schwan ,, seconded by Council"Man Desch , RESOLVED , that the Tooyn' of Ithaca ';, shal. l exercise its option to purchase the Seven Ma. a;e Drive property ( 10 . 8 acres ) as a site for the construction of a highway maintenance facility , for the sum of $ 13 , 342r P FURTHER R.ESOLVI.-O . that the Town Silipervisor is authorized to execute any and all papers necessary to carry out the terms of the optpapers on . A roll call vote was taken which resulted as follows .o Councilwoman` Valentinoe voting Aye Supervisor Schwan , voting Aye Councilman Desch , voting Aye Councilman Del Rosso , voting Aye Councilwoman Raffensperger , voting Aye Councilman Powers , voting Nay Councilman McElwee , voting Nay The motion wasllthereupon duly adopted . Motion by Supervisor Schwan ° seconded by Councilman Deschg RESOLVED , that Lawrence, P . Fabbron':i P . E . , Town Engineer , is here - by authorized to execute for and in behalf of the Town of Ithaca , a public entity established under the laws of the State of New York , an application and to file it in the appropriate State office for the purpose of obtaining certain Federal financibl assistance under the Disaster Relief ?pct ( Public Law 288 , 93rd Congress ) or other ® wise available frori the;, President@s Disaster Relief Fund , and is I w i Town Board Minutes - 3 - July 26 , 1976 hereby authcrizec3 to provide to the State and to Federal Disaster Assistance Administration ( FDAA ) , Department of Housing and Urbr4 n Development ( MID ) for all matters '' pertaining to such Federal &L. � aster assisttan e the assurances and agreements Printed (-MAI . �- verse side of Form HUD ' 483 , and the Toren Supervisor I? s Gnu thori'zed to execute statement so designating the Toirn Engineer .
