Unanimously carried . PERSONS TO BE HEARD Mr . Andrew Milnor , 106 Skyvue Road , requested that the Town Board , before accepting deed or deeds to park land in East - ern Heights Subdivision , allow him to purchase 30 ft . by 150 ft . from Mr . Goldberg . Mr . Milnor wanted the land for a garden and some expansion . Mr . Fabbroni said this would not affect the Town ' s plans with respect to park lands in Eastern Heights . The Board agreed the deed could go back to 4r . Goldberg and be re -drawn eliminating the 30 ft . by 150 ft which Mr . Goldberg could then sell to Mr . Milnor . The revised ! deed would then be furnished to the Town . In regard to the Town ' s problem in accepting park land and other land in Eastern Heights Subdivision , the Supervisor noted again that , according to Town Law , if the Town accepts property dedicated to it for park purposes , it is inviolateo there is no way the Town can dispose of it , and it must be used for park purposes . Where land is not so dedicated , the Town may hold it and at some tine in the future decide what to do with it . Unanimously carried . REPORT OF COUNTY REPRESENTATIVE Mrs . Livesay reported that the hospital project is making progress . It will be ready to be bid by the end of June and it is hoped construction will be under way by the middle of August . Mrs . Livesay did not know if bonds would be sold prior to construc - tion . Bids have been accepted for the South Hill property which was foreclosed ( on Pennsylvania Avenue ) on a tax sale . The CETA program may run through October or may end June 30 , as originally set up . It appears conflicting reports are being received . Renovation of the Old Court House is progressing . It is planned for dedication in June . This is Senior Citizens month and Wednesday , May 12 , is Senior Citizens Day on the Commons . Town Board Minutes - 3 - May 10 , 1976 The paid parking ;proposal at • the Airport has for the moment been defeated . The Ad Hoc Youth and Recreation Committee of Tompkins County is approaching a decision on the County Youth Bureau . Mrs . Livesay suggested this would be a good time for the Town to re- examihe its relationship with the Ci. ty of Ithaca on . the Youth Bureau and the possibility of a contractual arrangement . PUBLIC HEARING - WATER. AND .SEWER BENEFIT FORMULA UTILITY RIGHT OF WAYS Proof of posting and publication of notice of pg8lic hearing having been._ presented by the Town Clerk , the Supervisor opened the hearing with regard to amending the Water and Sewer Benefit Formula with respect to utility right of ways . No per - son or persons appearedd to speak for or against the proposed amendment . Therefore , the Supervisor closed the hearing and the Board acted as foilowso Motion by Supervisor Schwan ! seconded by Councilman Del Rosso , RESOLVED , that the Town of Ithaca Water and Sewer Benefit Formula be amended by adding the following ° utility Right of Ways . . Where a right of way for any utility - line crosses a parcel , one half . of the acreage comprised in said right of way shall be deducted for the purpose of computing , the acreage upon which water and sewer benefit charges are based . Unanimously carried . PUBLIC HEARING - LOCAL LAW NO . 1 - 1976 - DOG CONTROL LATI Proof of posting and publication of notice of public hearing having been presented by the Town Clerk , the Supervisor opened the hearing to consider Local Law No . 1 - 1976 , Dog Con - trol Law . The Supervisor read the proposed local lava in full . Per . and krs . Baldwin of 213 Sheffield Road spoke in favor of the proposed law . firs . Livesay raised the question of whether a complaint can be filed if the owner of the dog is not known . Supervisor Schwan read the section of the law which covers the point . It was noted there is obvious difficulty if the name of the owner is not known . Pgrs . Livesay also asked if there are any arrangements with the SPCA or a peace officer for seizing dogs which are creating a nuisance or harassing persons , if the owner is not known . Super - visor Schwan said there is no provision for seizing or sheltering or boarding dogs in the law because it would be too expensive for the Town to administer . The Supervisor suggested , however , that if the name of the owner is not known , the Towr_ ' Justice' could be authorized to send the SPCA to try and find the dog and pick it up . Mrs . R affensperger indicated that under the County contract untagged and unlicensed dogs may be picked up . Mr . Buyoucos agreed this was so under State law . Mrs . Raffensperger said that the ° gap " exists for tagged and licensed dogs . Pars . Livesay said this could be covertid by a simple contract with the SPCA . It was genej. cA ly agreed to wait and see what happens for a while under the proposed law , and then decide whether a contract with the SPCA is practical , Town Board Minutes - 4 May 10 , 1976 A4o Alan Personius also spoke in favor of the proposed law . No other person appeared who wished . to speak for or against the proposed law . Therefore , the Supervisor closed the hearing , and the Board acted as followso Motion by Councilman Pbwerso seconded by Councilman Del Rosso , A LOCAL LAW REGULATING AND . CONTROLLING THE ACTIVITIES OF DOGS IN THE TOWN OF ITHACA , TO BE KNOWN AS THE " DOG CONTROL LKIo " BE IT ENACTED by the Town Board of the Town of Ithaca as follows ° Section. : l ., . The purpose of the law is, to promote the public health , safety , and welfare of the community , including the protection and preservation of the property of residents of the Town and its . inhabitants , and . of the peace and good , order therein , � by regulating and controlling activities � of dogs within the Town of Ithaca and providing for enforcement thereof . Section 2 . Any owner of a dog or any other person who harbors any dog in the To-�vn of Ithaca shall be in violation of this law if such dog , whether or not tagged or licensed and whether or not muzzled ° a . is not restrained by an adequate collar and leash when not on the property of the owner , or any other person harboring or having custody or control of the dog , bo engages in such habitual or continued barking , howling , or whining that causes a person ' s rest to be broken , his sleep to be interrupted , or the reasonable use and enjoyment of his home or property to be otherwise interfered with , disturbed or diminished or that causes a person to be otherwise , harassed , annoyed or dis - turbed . ce causes damage or destruction to property , or defecates , urinates or otherwise commits a nuisance other than on the premises of the person owning or harboring such dog * d > except when restrained by an adequate collar and leash on the property of the owner or other person harboring or having custody or control of the dog , attacks , bites or otherwise injures a person or chases or otherwise harasses any person in such manner as reasonably to cause intimidation to such person , or to put such person in reasonable apprehension of bodily harm or injury . ea except when restrained by an adequate collar and leash on the property of the owner or other person harboring or having custody or control of the dog , chases , barks at , leaps on or other - wise attacks any ( 1 ) bicycle , motorcycle , motor wagon , carriage , or any other vehicle or device used by persons for travel or as a conveyance , or any riders or occupants thereof , or ( ii ) any horse or other animal including any rider thereon . Section 3 . The dog warden of the Town , or any other person or persons , who are or may be lawfully authorized by the Town , shall , and all peace officers may , administer and enforce the pro- visions of this law . Section A . a . Any person who observes a dog ( 1 ) causing damage or destruction to property of a person other than its owner , or ( ii ) running at large without a tag or license , or unleashed , upon the premises of a person other than its owner or ( iii ) haras - sing any person , or ( iv ) which is otherwise committing an act in Town Board Minutes - 5 - May 10 , 1976 violation of this law may file a signed complaint ; under oath , with a Town Justice of the Town of Ithaca specifying the objec - tionable conduct of the dog , the date thereof , the damage caused or the acts constituting , violation of this law and including the place or places where such conduct occurred and the name and resi - dence , if known , of the owner or other person . harboring such dog . b . Upon receipt by the Town Justice of any such complaint against the conduct of or acts by any par+� icular dog , or the owner thereof or other person harboring such dog , . the Town Justice may issue a written summons directing the alleged . owrier or other per - son harboring said dog to appear in person before him ; if such person does not appear , the Town Justice may issue a warrant for the arrest of ' such person based upon any complaint or information previously filed . Section 5 . 4 It is hereby provided , pursuant to - the authori - ty granted , by Chapter 374 of the ' Laws of New York of 1975 ( amend - ing Section 126 of the Agriculture and Markets Law ) that an appear - ance ticket may be issued pursuant to the . provisions of the Crimi - nal Procedure Law for any violation of , this law . Such appearance ticket may be issued by any police officer , or the dog warden or other person authorized pursuant to Section 120 of the Agriculture and Markets Law to perform the duties and exercise the powers of a dog warden . a • Any person to whom such appearance ticket has been issued 'hall answer such appearance ticket in accordance with the procedures provided for in Section 2a of Section 126 of the Agri - culture and Markets Law as amended by Chapter 374 of the Laws of New Mork of 1975 . b • All subsequent procedures , including the provision for the , filing of an answer as hereinabove provided , and the pay- ment of any penalties , shall be in accordance with the provisions of Section 126 of the Agriculture and Markets Law as amended by Chapter 374 of the Laws of New York of 1975 . c • The Town Board shall adopt by municipal regulation , local law , or ordinance , such forms as are authorized by Section 126 , subdivision 2b , of the Agriculture and Markets Law . Section 6 . If any dog in violation of this law is owned by a person under 18 years of age , the head of the household in which said person resides shall be deemed _to be the owner or per - son harboring such dog and shall be responsible for the acts of said dog for purposes of this law , Section 7 . The fact that a dog is at large in the Town of Ithaca elsewhere than on the premises of the owner or person har= boring such dog shall be presumptive evidence that the dog has been permitted to be at large with the knowledge of the owner or person harboring the dog . Section 8 . The dog warden , peace officer , or other per - son lawfully authorized to administer or enforce the provisions of this law shall keep a record and description of each complaint filed by him with respect to a violation of this law , or any dog seized , and shall set forth the disposition of the complaint and shall contain such other information as this Board or the Town Attorney shall require , or as may otherwise be required by law . Nothing herein contained shall be deemed to relieve any Town Justice from keeping records required of him by law , Section 9 . No person shall hinder , resist , or oppose the dog warden , peace officer , or other person authorized to administer or enforce the provisions of this law of the Town of Ithaca in the performance of his duties under this law . Town Board Minutes - 6 - May 10 , 1976 Section 10 . A violation of this law shall constitute a violation as defined in the Penal Law of the State of New York , and shall be punishable by a penalty of not more than $ 25 . 00 for the first violation , not more than $ 50 . 00 for the second violation ; and not more than $ 75900 for the third and all subsequent violations or by imprisonment for a term not to exceed five days for each vio - lation . These penalties shall be in addition to any other penalty provided by law . Section 11 . If any section , paragraph , subdivision , clause , phrase , or provision of this law shall . be judged invalid or held unconstitutional , it shall nbt : a.ffect the validity of this law as a whole or any part or provision . therebf other than the part so decided to be invalid or unconstitutional . Section 12 . This law shall take effect immediately . Unanimously carried . BEAUJOLAIS RESTAURANT - PARKING ' Mr . ' Robert O ' Malley , owner of the Beaujolais Restaurant , appeared before the Board and explained that Mr . Joseph Vasilli , the local Health Department official , does not have authority to approve or disapprove parking over the septic system . He said Mr . Vasilli ventured the opinion the State will not reverse its o decision n this matter . 1r . O ' Malley discovered , when discussing his parking problem with Millbrook Bread , that he owns additional land . He owns the whole mound of dirt in front of the old historic tree , and half of it on the back . The additional land makes it possible now for him to have a total of 30 parking spaces which , he says , is more than adequate for a restaurant with a seating capacity of 60 . He said the work involved in the new parking arrangement could be completed by the end of July . He said if he can get the work done sooner he will try to do so , but did not want to make a promise he might not be able to keep . The Board generally found the end of July completion date satisfactory . SIGN APPLICATIONS Mr . Robert Bonnell presented a list of businesses which have made applications for a sign permit . After a review of sketches and photographs of the various signs , the Board favored approval of the applications of Wonderland Motels , Inc . , Ideman , Morse Chain Company , Massachusetts Mutual Life Insurance Co . ; and on East Hill Plaza the applications of Norgetown Laundry and Dry Cleaning , Expressions Unlimited , and What ' s Your Beef . Regarding the Ellis Hollow Road Apartments , the Board discussed granting a variance . With respect to this sign the recommendation of the Planning Board to the Town Board is that their Sian , in the location indicated on the application , and for the purpose intended , is perfectly appropriate. Motion by Councilman Desch ; seconded by Councilman Powers , RESOLVED , that based upon the recommendation of the Planning Board that the Ellis Hollow Road Apartment sign , in the location indicated on the application , and for the purpose intended , is perfectly appropriate , the Town Board hereby grants a variance to Ellis Hollow Road Apartments for the signed applied for , as indicated on the submitted application . Unanimously carried . Town Board minutes 7 - May 10 , 1976 It was agreed that Mr . Bonnell would research the minutes of the Zoning Board of Appeals with respect to the Turback ° s sign to determine under what conditions the sign Might be found accept table . The application of Rite -Aid was denied . They will be so notified and will have to submit an application for a legal sign . Motion by Councilman Deschr seconded by Supervisor Schwan , RESOLVED , that sign applications for Tgo4nderland Motels , . Inc . , Ideman , Morse Chain Company , Massachusetts Mutual Life insurance Co . . ( a legal non -conforming use ) , Norgetown Laundry and Dry Clean - ing , Expressions Unlimited , and What ' s Your Beef are hereby approv � ed . Unanimously carried . The legal signs will be put in place within a reasonable time . Mr . Fabbroni and Mr . Bonnell will follow tip on this and make a report in June . Mrs . Raffensperger suggested that when the " second wave " of applications for signs comes , it would be useful to have a list of those which fall within the sign ordinance and those which will require a variance . This procedure will be followed . PROPOSED STORAGE BUILDING FOR WONDERLAND HOTELS , INC . Mrs . Holcomb reported that Wonderland Motels , Inc . request for a storage building falls within the requirements of the Zoning Ordinance and that the Planning Board recommends approval . Motion by Supervisor Schwan :* seconded by Councilman Desch , RESOLVED , that the Town Board , upon the recommendation of the Planning Board , and the opinion of the Town Engineer that the proposed pole - type storage barn meets all requirements of the Zoning Ordinance as to yard requirements , hereby approves the said storage building situated on the Elmira Road as an addition to the Wonderland Motels , Inc . buildings . Unanimously carried . PROPOSED PHOTO EXPRESS BUILDING EAST HILL PLAZA , JUDD FALLS ROAD Mr . Fabbroni recommended tabling this item until further information is received from Mr . Stewart Knowlton , manager of the East Hill Plaza . SUMMER HOURS There was brief discussion of summer hour's for the Town of Ithaca Offices at 126 East Seneca Street , which have , tradi - tionally been 8 : 30 a . m . to 4000 p . m . , Monday through Friday , with an hour for lunch , during the months of June , July and August . Supervisor Schwan did not feel these summer hours should prevail this year , since when the lunch hour is taken out , there are only 35 working hours in the week . This year , as a result of the Bol - ton Point project the Town of Ithaca office staff will be collect- ing water bills and will be working on the billing procedure under the new system . It was agreed , therefore , to retain the usual summer hours , except that the lunch periodP:.u71 be a half hour . Town Board Minutes _ 8 e May 10 , 1976 Motion by Councilman McElwee , seconded by Councilman Powers , RESOLVED , that during the months of June , July and August , 1976 , the Town Offices will open: at 8 : 30 a . m . and close at 4 * 00 p . m . , with a half hour for lunch . Unanimously carried . PROPOSED LOCAL LAW ON i DEMOLITION OF DANGEROUS BUILDINGS Mr . Fabbroni read a proposed local law providing for the removal or repair of buildings in business , industrial and resi - dential sections that , from any cause , may now be or shall here ° after become dangerous or unsafe to the public . Mr . Buyoucos noted that this local law provides a method of procedure after a violation . Since this resolution is of some length and requires some revision by the Town Attorney and further study by the Board members , it was tabled . REPORTS OF TOWN OFFICIALS Mr . Fabbroni reported on the following matters ° New Highway Barn Facility . A scope of work analysis for construction of a new . h ghway barn facility on Seven Mile Drive , prepared by Mro Fabbroni , was reviewed by the Board . This scope Of work proposal will be sent to the five firms noted in the min - utes of May 3 , 1976 . Mr . Fabbroni requested comments on the out - line (which is attached to and made a part of these minutes ) . Councilman Desch suggested that the material should be introduced with a paragraph of intent ( to house highway and maintenance per - sonnel ) . There was discussion of whether water is available at the location , and that this should be investigated before someone is commissioned to do a design . It was agreed the Town would attempt to get permission to drill a few holes to see what the water situation is . Councilman McElwee also suggested having the Health Department do some soil tests . The Board felt the scope of work proposal should include the building for storage of salt , sand , and other materials , and a pole barn for cold storage . When the proposal has been refined the meeting will be reconvened to consider it again , and the Board will be able to take action . Biesdorf Property on Coddington Road . This sewer job will be advertised for bids this wee F . Student Volunteer . A Cornell University student has volunteered to work for the Town in the summer , without pay , to get some engineering experience . He is in the Civil Engineering School . The Tovm Board had no objection to accepting this volun - teer work if t1r . Fabbroni felt it could be useful and it did not involve loss of his ( Fabbroni ' s ) time . Mr . Buyoucos was concerned about problems having to do with workmen ' s compensation . Super - visor Schwan did not think this should be a concern since work- men ' s compensation is based on payroll and this student would not be on the payroll . 1,11rs . Raffensperger said she thought that in last year ' s minutes there was a statement by Mr . Boothroyd of the Boothroyd Insurance Agency , that volunteers would be covered . After some discussion , it was agreed this would be checked out with the Town ' s insurance agent who would advise the Town Attorney on the matter . Town Board. Minutes - 9 - I-lay 10 ; 1976 Bolton Point Water Linea An agreement has been made with the Soil Conservation Service to seed and bank the Bolton Point water ' . line that comes up from the lake to the road . The Town will furnish lime , fertilizer and mulch , and the Soil Conservation Service will provide seed and they will monitor it for ten years . The billing for this will be rendered to the Bolton Point Water Commission . Councilman ' Desch said the work planned to be done appears to be satisfactory as long as it does not disturb the stability of the bank . Mre Fabbroni did not think this would be a problem . Transportation Survey . The results of the survey in terms of numbers and percentages will be available next month . The sur - vey covers all the Town except Forest Home , the Northeast part of Ithaca east of Warren Road and north of Hanshaw Road , and the part of Eastern Heights from which returns were received last year , Zoning Ordinance ° There will be additional revisions to the Zoning Ordinance based on a meeting of the Zoning Ordinance committee . The committee will prepare a new draft and have it ready for the June meeting of the Town Board . Mrs . Holcomb reported on the following matters ° Hilker Subdivisiono The Planning Board at its last meet - ing gave final approval - of the first phase of the Hilker Subdivision , 21 of a total of 43 lots , located on Snyder Hill Road in the Eastern Heights Subdivision , with the following conditions : ( 1 ) Health De - partment approval , ( 2 ) a sewer agreement with the City of Ithaca , and ( 3 ) delivery of deed to 2 > 2 - acre park . Snyder Hill Roado There was great concern voiced at the Planning Board meeting over the condition of Snyder Hill Road , The Planning Board at its Play 4 , 1976 meeting adopted the follow- ing resolution .* " RESOLVED , that the Planning Board of the Town of Ithaca propose and hereby does propose that the Town Board of the Town of Ithaca seriously consider what improvements said Town of Ithaca is going to make in Snyder Hill Road before grant - ing approval for future and further development in the Town of Ithaca in the Snyder Hill Road development area , and that there be a time table for the improvement of Snyder Hill Road to guide the Planning Board in future consideration of approvals for residential areas in this neighbor - hood . " Mre Fabbroni said this is a matter of priorities and that there are three problems which rank ahead of the improvement of Snyder Hill Road - - ( 1 ) Forest Home Drive , ( 2 ) Stone Quarry Road , and ( 3 ) Burns Road . The Board recommended that Mro Fabbroni pre - pare a priorities list so that they may make a decision * The list should indicate the name of the road , what the problem is , and an estimate of the cost of improvement . Town Board Minutes 10 M.ay 10 , 1976 , I Longhouse Development . The Planning Board approved the second phase of , the Longhouse Development on Elm Street . This is cluster; housing with four buildings , 3 units per building , a total of 12 units on about 11 acres of land . Phase I ( one struc - ture containing 3 dwelling units ) is already built . Phase II ( one structure containing 3 dwelling units ) has received final approval from the Planning Board . The County Health Department has required that the development be serviced by a community water supply system rather than individual wells . Park Areas !, There was a presentation of site plan pro - posals for two small parks in Northeast Ithaca , that is , Tareyton Drive site , Salem Drive site , prepared by two graduate students in Planning at Cornell University . The Northeast Civic Associa - tion had indicated their desire , for these two parks . There was also a presentation of site plan alternatives and 'recommendations for Coy Glen prepared ` and presented by Dennis Colliton , graduate student in Landscape Architecture at Cornell University . There was a discussion - of Eastern Heights park request , the Northview Road West park request , and the East Ithaca bikeway request . Next week the Planning , Board will look at these proposals and prepare a priority list for the Town Board . COMMUNICATIONS Supervisor Schwan read a letter dated May 7 , 1976 from Ellis E . Erdman regarding the Beacon Hills project . Per . Erdman ' indicated this development will be reactivated if- the developers and lendors and their counsel are permitted to " effect all docu- ments which might be deemed both appropriate and necessary to expedite resuming construction and -assure proper completion there ° of . " HAVEN HILLS SUBDIVISION ( Willis S . Hilker ) Mr . T ?illis S . Hilker advised the Board that the Board of Public Works of the City of Ithaca had requested that the Town Board of the Town of Ithaca adopt a resolution authorizing water and sewer extensions to his Haven Hills Subdivision . Mr . Hilker said such a resolution would facilitate his dealings with the City of Ithaca . Motion by Councilman Powers ° seconded by Councilman Desch , RESOLVED , that the Town Board of the Town of Ithaca hereby author - izes water and sewer extensions into Haven Hills Subdivision ( Willis S . Hilker ) , off Snyder Hill Road , as requested by the Board of Public Works of the City of Ithaca . Unanimously carried . APPROVAL OF WARRANTS ( Town of Ithaca ) Motion by Councilman Desch ?* seconded by Councilman Powers , RESOLVED , that the Town of Ithaca warrants , . dated May 10 , 1976 , be approved in the following amounts ° General Fund . . . . . . . . $ 33 , 638 . 68 Highway Fund . . . . . . . 7 858 . 87 Water and Sewer Fund . . . 8 , 626 . 86 it being understood that the Village of Cayuga Heights warrant for .fire protection will be paid only on the condition that the Town Board Minutes - 11 = May 10 , 1976 Village of Cayuga Heights budget for fire protection ( which the Town of Ithaca pays its proportionate share of ) does not include the hydrant charge to the City of Ithaca* 9. further that the war - rant for aerial photographs will be withheld pending receipt of prints . Unanimously carried . i *Note ; It was determined after the meeting that the Village budget does not include the hydrant charge to the City of Ithaca , there - fore the warrant will be paid . BOLTON POINT WARRANTS Motion by Councilman Desch , seconded b Supervisor Schwan , RESOLVED , that the Bolton Point warrants , dated May 10 , 1976 , after review by the Town board , and upon the recommendation of the South- ern Cayuga Lake Intermunicipal Water Commission that the said war - rants are in order for payment , are hereby approved for payment in the amount of $ 569 , 232 . 49 . Unanimously carried . SPEED LIMIT ON HANSH..AW ROAD Supervisor Schwan read a letter received from Sally G . Nation , dated May 6 , 1976 ( together with petition with 25 signa - tures ) on behalf of residents of the Northeast community , request - ing reduction in speed limit on Hanshaw Road from 40 miles per hour to 30 miles per hour from Community Corners to the boundary of the Town of Dryden . Supervisor Schwan said such a request has already been made to the Department of Transportation in the past and has been denied on the basis that- in their view the develop- ment along Hanshaw Road in relation to the speed at which traffic moved did not justify such reduction . Since that time there has been no significant change in development along Hanshaw Road . The Board agreed , however , to consider this matter again at the August meeting of the Board , and in all probability will again make a re - quest to the Department of Transportation for an area speed limit . To ask for it now would be counter -productive since Ithaca College is out of session and Cornell University soon will be . The traf - fic , therefore , at this time is not typical . The test should be made in the fall when the students return . The Clerk was instructed to write a letter to Sally G . Nation advising her of the Board ' s discussion and decision .
