Shirley Raffensperger , Councilwoman EASTERN HEIGHTS ( KING' S LANE ) - -PARK AREAS i The Board discussed the options available with respect to acceptance of various areas in Eastern Heights for park land . The Supervisor reminded the Board that , according to Town Law , once an area is accepted as a park it is almost impossible ever to use it for any other purpose , or even dispose of it . Mrs . Holcomb said it had ` been suggested that the Town might take the land in question in two separate deeds - - one area to be designated as park land and the other to be undesignated . The undesignated land could in the future be designated as park land , if the Board so desired . It will be necessary to look into the legality of the Town taking land in a development for an un - designated use . There was considerable discussion about whether the Town should take the approximately 7 acres ( Tax Map Parcel Nos . 57 - 1 - 8 . 74 through 57 - 1 - 8 . 83 and 57 - 1 - 8 . 90 through 57 - 1 - 9 . 96 ) or the 13 acres ( all the parcels in the 7 acres plus Tax Map Parcels 57 - 1 - 8 ° 130 through 57 - 1 - 8 . 137 and . 57 - 1 - 8 . 84 through 57 - 1 - 8 . 89 ) . After considerable discussion it was agreed that the Board favored an exchange of one of the alternative areas ( 7 acres or 13 acres ) for the original 5 acres proposed to be deeded to the Town . This would satisfy one of the stated original requirements for the approval of the Eastern Heights Subdivision . The Board left open the question of whether it would 'accept the approximately 7 acres or the 13 acres as park land , or 'whether it would accept 7 acres as park land ( in one deed ) and accept the remaining portion ( in another deed ) for an undesignated use . The Town Attorney will render an opinion on whether the Town can accept a parcel for an undesignated use . Mrs Fabbroni suggested a further possibility - - that the Town might take the approximately 7 acres , plus the par - eels extending to the west to Nancy Street ( Parcels 57 - 1 - 8 . 130 , 57 - 1 - 8 . 131 , 57 - 1 - 8 . 1321 57 - 1 - 8 . 133 and 57 - 1 - 8 . 88 and 57 - 1 - 8 . 89f , all as park land . The Town will talk about these park areas again after they have Mr . Buyoucos ' legal opinion and after they have a recommendation from the Planning Board after its meeting on May 4 , 1976 . Town Board Minutes - 2 May - 3 , 1976 During the general discussion some concerns surfaced '. ( 1 ) Just how desirable is the area for park larid7 ( 2 ) Does the Town really want all the land that is available for park . land ? ( 3 ) Should the land be taken off the tax rolls ? How big a prob - lem will care , maintenance , and policing be ? How much expense would be involved in improving the road so the park area is usable ? How will the Town handle the drainage problem? \\ Mrs . Holcomb noted that as a result of the exchange the Town will also acquire a 2 . 2 acre area fo : y�:d�_ 3b purposes in the northeast corner of Parcel 61 - 1 � 8 . 1 < HIGHWAY BARN SITES AND FACILITIES The Supervisor noted that if the Town were ' to buy a new parcel .of land and construct a highwy barn facility , the Town would have available between $ 80 , 000 and $ 901000 of revenue sharing money and about $ 100 , 000 to $ 120 , 000 • fair market value of the present facility . The Supervisor asked the Board to consider selling the present facility at public auction . This method makes it possible to have wider publicity than merely an ad in the legal notices of the newspaper . The auctioneer is not so restricted . He could give an auction wide publicity . An auction would be more likely to pro - duce " top dollar " than sealed bids . The auctioneer receives 2 % of the . sale price * The Town would reserve the option to set a minimum price on the facility below which it will not be sold . Whether sold or not the auctioneer receives the 2 % commission on the established minimum or the sale price . It was noted that an auction .would receive publicity outside the Ithaca area ( perhaps Syracuse , Binghamton , etc . ) There was again brief discussion of the two available sites - - Five Mile Drive and Seven Mile Drive . The Board re -affirmed its preference for the Seven Mile Drive site . The Town has options on . both sites , which options expire June 30 . Other sites were discus - sed but seemed impractical for various reasons . It was agreed , since the auction is scheduled for June 28 , that the Board could make a decision about exercising the option on the Seven Mile Drive site after it has an estimate of what might be realized from the sale of the present site and facilities . A remote possibility was to let the options expire and retain the present facility . However , there did not appear to be any desire on the part of the Board to let the option expire . Councilman Del Rosso said the land and facilities would only cost - considerably more in the future . Mr . Fabbroni provided the Board with material to review covering site selection , facilities planning , engineering , disposal of existing facility , proposed timetable . There was some differ - ence of opinion whether the new facility should be designed by an architect or an engineer . It was recommended that in addition to Thomas G . Miller , Engineer and Surveyor , and Victor J . Bagnardi , Architect , suggested by Mr . Fabbroni , that proposals should be solicited from Egner & Niederkorn Associates , Inc . , Architects , Tallman & Tallman , Architects , and John S . MacNeil , Engineer. Mr . Fabbroni ° s time table was acceptable except that the contract termination dated was extnded tq ' February 1 , 1977 . Councilman Del Rosso recommended that the Supervisor should have the real estate consultant make an estimate of a realistic price for the present site and facility and also discuss with Clarence Gravelding , Auctioneer , what the upset price should be . Town -Board Minutes - 3 - May 3 , 1976 Motion by Councilman Desch ; seconded by Councilman Powers , RESOLVEDo that the Supervisor is !' hereby authorized to contract on behalf of the Town of Ithaca with Clarence Gravelding , Auction ° eer , to hold a public auction on ,, June 28 , 1976 for the sale of the Town Highway Barn site and facility on Elmira Road . Unanimously carried . CITY OF ITHACA RESOLUTION AND NOTICE The Supervisor read the following resolution adopted by the City of Ithaca on April 14 , 19760 RESOLVED , That the City Clerk be directed to notify the Towns of Ithaca , Dryden and Lansing , and the Villages of Lansing and Cayuga Heights that the city intends to discontinue water ser - vice to their jurisdictions under existing con - tracts within 90 days from the date of notice : IT IS FURTHER RESOLVED , That the Water & Sewer Committee be authorized to enter into negotiations with the Town of Ithaca for a new contract providing for water service to that portion of the Town of4Ithaca lying westerly of Cayuga Inlet . The Supervisor also read a notice of the City of Ithaca dated May 1 , 1976 that any new water service other than within the City , Coy Glen , Buttermilk , and Trumansburg Road Water Districts will not be furnished a City Water Meter . The notice states that this does not mean that water service will `' be refused . It means that . the plumber will install a straight through connection or a meter fur - nished by other than the City - - !' whichever the Town or Water Dis - trict wishes to require . City water will be furnished on an esti - mated use charge up to the day of change over to the new service jurisdiction . The notice suggests that a new customer be handled exactly as they are now for every part of his service - - request for service through the water district , owners card and request through City Chamberlain , plumbing permit and inspection by the City , tap in the main by the City . The single exception is that either a meter or a straight through connection will - be furnished by other than the City . CITY OF ITHACA SETIAGE DISPOSAL PLANT - EXPANSION AND MODERNIZATION The Supervisor distributed a proposed resolution drafted by Ethel Nichols , City of Ithaca„ Common Council , regarding intent Of City of Ithaca and Town of Ithaca to cooperate in expanding and modernizing the City of Ithaca sewage disposal plant . With a minor revision the Board found the resolution satisfactory and acted as follows : Motion by Supervisor Schwanfe seconded by Councilwoman Valentino , WHEREAS , at a joint meeting on April 27 , 1976 , the Ithaca Town Board and the City of Ithaca Common Council agreed to indicate to all involved state and federal agencies their intention to pro - ceed as promptly as possible to expedite the planning and engineer - ing work to improve and expand sewer service for the entire metro - politan district, and WHEREAS , the expansion and improvement of the existing City of Ithaca sewage treatment plant is a matter of urgent con - cern to both the City and the Town of Ithaca , and i Town Board Minutes - 4 May 3 , 1976 WHEREAS , members of the City of Ithaca Board of public Works and representatives of Cornell University were present at the meeting and indicated their support of the proposed expansion and modernization of the City of Ithaca sewage disposal plant , NOW , THEREFORE : BE IT RESOLVED , that the , City of Ithacc and the Town of Ithaca hereby declare their intention to cooperate with each other in modernizing and expanding the City of Ithaca sewage disposal plant to serve the needs of both ' the City and Town of Ithaca . Unanimously carried . CONTRACT - CITY OF ITHACA/TOWN OF ITHACA (WATER FOR WEST HILL AND OTHER AREAS ) The Supervisor distributed to Board members a list of items to be considered in connection with a proposed contract between the City - of Ithaca and the Town of Ithaca for water for West Hill and other areas ( Trumansburg Rdad , Glenside , ]elm Street , Haller Boule - vard , Buttermilk Falls area ) . Board members were asked to give these items careful thought in preparation for negotiations with the City of Ithaca . VACUUM CLEANER FOR TOWN OFFICES Councilmen Desch and McElwee recommended the Hoover JB- 102 2 H . P . Vacuum Cleaner , Dry and Wet Pick Up , as the best for the price of $ 312 . 00 . This is for use in the Town Offices . Motion by Councilman Desch ; seconded by Councilman McElwee , RESOLVED , that the Town Board of the Town of Ithaca hereby author - izes the purchase of a Hoover JB- 102 , 2 H .
