Mr . Robert Schwarting inquired about the status of park
development in Eastern Heights and construction schedules for
additions to the 2 -acre park on Park Lane and Tudor Road . Mrs .
Holcomb indicall:ed this would be part of her report at this meeting .
Mr . Schwarting said last fall there had been discussion of furnish-
ing four picnic tables and the construction of two fireplaces and
other incidentals in the Eastern Heights park area , plus the clear -
ing of brush in the 2 -acre park . Supervisor Schwan and Councilman
Del Rosso indicated that no commitment was made but to make it an
open recreation area , although there was discussion of picnic table
and fireplaces . Councilwoman Valentino and Town Engineer Fabbroni
cited hard work of the people in Eastern Heights over the last
eight years in clearing the area of bushes and shrubs to make the
area usable . Mrs . Valentino said the area is beginning to be over -
grown and soon all the hard work of the people in the area will be
lost . She felt they are entitled to picnic tables and fireplaces
and some help with the clearing of the area in view of the efforts
they have made over the years .
There was discussion of vandalism , cleaning up refuse ,
removal of stumps , regulation of hours of use of the park , and
general maintenance . It appeared the Town will remove stumps and
mow the area and that the people in Eastern Heights will assume
the responsibility for refuse clean -up and general policing of
the area .

Motion by Councilwoman Raffenspergera seconded by Councilwoman
Valentino ,
RESOLVED , that the, Town of Ithaca shall provide the park area in
Eastern Heights , at Tudor Road , with two picnic tables , benches .
for same , and one outdoor fireplaces .further that the Town Highway
Department will furnish equipment necessary foIr removal of stumps
and will remove said stumps and ,will mow the area where feasible ,
it being understood that the residents of Eastern Heights will be
responsible for removal of refuse and for general policing of the
park area .

Mre Schwarting inquired what the status of the improve -
ment of Snyder Hill Road was so ' far as burying the water pipes
in the culvert in the vicinity of Sugar Bush lane ( east on Snyder
Hill Road ) , in terms of the Town ' s overall priorities . He said it
was his understanding that Mro Fabbroni would make a list of priori ,
ty projects . He said he was concerned about the blind crest be °•
tween Sugar Bush Larne and Snyder Hill Road and the filling in of
the ditch . Mr , Fabbroni said there is no priority list except
the Highway Department ' s pavinjIlpriorities . He said that the
Town did stone and oil Snyc'.erl Hill Road which has improved the
traction . Mr . Fabbroni said that the ir4:..arovement of Snyder Hill
Road contemplated by Mr . Schwartiftg would he an expensive project .
It would cost at least $ 8 . 00 a foot to fill in the ditch and ano -
ther $ 7 to $ 10 to repave the section in question . It would be
a sizeable capital improvement . Pogr . Schwarting said he would be
mollified if he were to see a capital road improvement plan that
would indicate the items which over the next three to five years
are considered higher priority items than the things which the
people in Eastern Heights are suggesting . Supervisor Schwan noted
that one of the reasons for hiring Mr . Fabbroni was to do a study
of the roads and prepare an analysis and priority list . However ,
Mr . Fabbroni ' s experience and expertise and time have been used
in a number of different areas . It is the Town ' s intent that this
analysis and priority list will be prepared , but the fact remains
that Mr . Fabbroni - has not yet had time to do it , considering his
preoccupation with other Town responsibilities .
With regard ' to priorities - generally , . Tir . Fabbroni said ,
there are higher priorities in the :Tovin than Suyder Hill Road ,
particularly in, -.the BlackstOne ', Kay and Roat Street . areas in terms
of re -paving needs .
Air . Schwarting inquired as to the status of bikeways in
the Town of Ithaca.. He said there is renewed interest in bikeways
on East Hill , particularly for the safety features . Supervisor
Schwan said that no money has been budgeted by the Town for bike -
ways . A study has been done by landscape architects at Cornell
University . Mr . Schwarting wondered if any attempt was being made
to get study funds of any sort . ,, Mr . Fabbroni said there are no
study funds available for bikeways , because there is a requirement
that the money must be spent for highway construction and for buses
or build bikeways , and bikeways are eliminated as the lower priori -
ty . He said the only real source of funding a bikeway is through
parks and the Bureau of Outdoor Recreation , that is , by tying a
bikeway into a park, or community recreation area .
WILLIAMS GLEN ROAD
Since the construction of Williams Glen Road has been
completed and the Town has received deed to same , which deed has
been recorded , and since the road has never been formally accepted
as a Town road , the Board acted as follows .o
Town Board Minutes - 3 - April 12 , 1976
Motion by Councilman McElwee ; seconded by Supervisor Schwan ,
RESOLVED , that based upon . the completion of Williams Glen Road
to Town of Ithaca . specifications and to the satisfaction of the
property owners along said road and the fact that the Town has
received deed to same , which deed has been recorded , the Town
Board hereby accepts Williams Glen Road as a Town road .

LOCAL LAW REGARDING, TOWN PARKS
Reverting to the matter of parks and park land - in the Town
of Ithaca , Attorney Buyoucos noted that the Town ' s ability to prose -
cute persons effectively for abuse . of the 'ark areas will be very
much limited in the absence of local lec} islation . It will eventu-
ally be necessary to consider a limit on hours the parks are open
to the public and to consider the formulation of rues and regula -
tions for the use of the parks , and to codify all this in a local
law .
REVISION OF WATER ` AND SEWER BENEFIT
FOPAMULA , UTILITY RIGHT OF WAYS
Supervisor Schwan recommended that a public hearing be
scheduled to consider revision of the Town ' s water and sewer bene -
fit formula with respect to utility right of ways .
Motion by Supervisor Schwant seconded by Councilwoman Valentino ,
RESOLVED , that the Town Board of the Town of Ithaca shall hold a
public hearing on May 10 , 1976 at 7045 p . m . to consider revision
of the Town of Ithaca water and sewer benefit formula , particularly
with regard to utility right of ways ,

SALINO ELECTRIC MOTORS ADDITION
Mr . Fabbroni reported that Salino Electric Motors have
requested an addition to their plant for storage space , which
requires approval of the Planning Board and the Town Board . This
addition was approved by the Planning Board on April 6 , 19769 The
addition is needed primarily for storage space for equipment that
is repaired . The addition complies with the Zoning Ordinance .
Motion by Councilman McElwee ; seconded by Councilman Del Rosso ,
RESOLVED , that this Town Board hereby approves the requested
addition to Salino Electric Motors for storage space , together
with sign modification , based on Planning Board prior approval of
same and upon recommendation of the Town Engineer .
Unanimously carried .
BEAUJOLAIS RESTAURANT PARKING
Supervisor Schwan read a letter dated March 10 , 1976 from
Mr . Robert E . 0 ° Malley , owner of Beaujolais Restaurant , in which
he proposes limiting all parking across the road from the restaur -
ant to employees or have an attendant park the cars there for cus -
tomers .
Supervisor Schwan noted that at the last meeting Mr .
O ' Malley was instructed to consult with Mr . Joseph Vasilli , Pro -
fessional Engineer of the Tompkins County Health Department in an
attempt to get a more favorable ruling on parking over the septic

system . It appears M.r . O ' Malley did ..not do that . Councilwoman
Valentino noted again also that Pair . O ' r2alley said he would try to
work out something with Millbrook Bread next door where there
appears to be plenty of room for parking , It does not seem that
Mr . O ' Malley has made any great effort in that direction . The
sense of the Board is � that Mr a O ' Malley ° s propose1 is not accept°
able and that Dire 0 .°. Malley must come to the next meeting of the
Board with an acceptable solution . Supervisor Schvian will write

DOG CONTROL LAW
The Supervisor read draft of Dog Control Law prepared by
the Town Attorney . , . After the reading it was agreed that a public
hearing should be held on this matter .
Motion by Supervisor Schwan , seconded by Councilman McElwee ,
RESOLVED , that the Town Board of the Town of Ithaca shall hold
a public hearing on May 10 , 1976 at 8000 Pam * to consider the
adoption of Local Law No . 1 - 1976 , Dog Control Law , and to hear
all persons for or against the adoption of such local law .
Unanimously carried .
Mr . Batt inquired if it were written in the draft that
a dog shall be seized if he is causing a nuisance in the Town .
Mr . Buyoucos said it is not written in the draft but that such
a dog may be picked up under State law . ter . Buyoucos said the
' draft has been written in such a way as to avoid as much as pos -
sible the seizure and impoundment of dogs because of the expense
to the Town which would be involved . Supervisor Schwan noted that
even the fines collected for the most part go to the State .
Mr . Schwarting asked if there might not be some extension
to other animals which create a nuisance . He noted that persons
have been parading or exercising horses . The sense of the Board
was that these are isolated incidents which might be handled by
getting in touch directly with the people involved if it can be
determined who they are .
EXTENSION OF SEWER LINE ° BIESDORF PROPERTY
Mr . Fabbroni reported that with regard to the Biesdorf
property on Coddington Road that Mr . Paul E . Tubbs , builder , has
obtained permit to build a home on the lot adjacent to and north
of the home on the northwest corner of Coddington Road and North-
view Road . He is requesting sewer lines be extended to this lot
and two others south of the creek . The Town Board has agreed and
the general policy is to extend water and sewer services at the

time they are needed . Mr . Fabbroni asked for authorization to re -
quest prices from several contractors to extend sewer to the north
line of the middle lot ( in accordance with plan of J . Dougherty ) .
It will be necessary to prepare specifications . The reason for
the extension is that inadvertently this line was not included
when the area was originally sewered .
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,
RESOLVED , that the Town Engineer 'is hereby authorized to prepare
specifications for the extension of a sewer line some 350 feet on
Biesdorf property on Coddington Road , together with one manhole ,
and to let bids on same .

Town Board Minutes - 5 - April 12 , 1976
PURCHASE OF COMMERCIAL VACUU4
CLEANER FOR towN OF ITHACA OFFICES
Councilman . McElwee agreed to look into the matter of the
purchase of a commercial vacuum cleaner for use in the Town offices
and will make a recommendation to the Board at the next regular
meeting .
CLEAN-UP DAY
Robert E . Parkin , Highway Superintendent , advised that
clean-up day for the . Town of Ithaca will be Monday ' May 3 , 1976 ,
and that all tied or bundled trash and brush that can be handled
by two men will be picked up at residents ' homes . A notice will
be placed in the Ithaca Journal and with other media .
REPORT OF COUNTY REPRESENTATIVE
Mrs . Livesay reported that the County .Board of Representa -
tives came one vote short of over - turning the original resolution
to demolish Boardman House .
Mrs . Livesay reported there will be a public hearing two
weeks from today to consider an ordinance for parking at the , Air -
port . Paid parking will come up at the same time . The public hear -
ing will have to do with rules and regulations for the parking at
the Airport . It appears the public hearing on this matter will be
independent of the paid parking matter .
Mrs . Livesay reported there will be a hearing to consider
an agricultural district for the Town of Danby .
REPORTS OF TOUN OFFICIALS
Town Attorney Buyoucos reported on the following matters :
Munchmeyer Appeal . A reply to the Munchmeyer appeal has
been filed . It was scheduled to be argued on a certain day last
March , and that was adjourned at the request of Munchmeyer . His
appeal has now been withdrawn . They are no longer interested in
the site .
Franciamone . Mr . Franciamone is appealing from Judge Yesa -
wich ° s second decision . The Town has answered the appeal brief
and the case is now in the hands of the Appellate Division .
( Councilman Del Rosso reported that there is construction
going on at the Franciamone property right now . Mr . Fabbroni said
Mrs Franciamone is building an g x 12 storage shed which is next
to his other two storage sheds . He has not applied for a building
permit . A letter will be sent by registered mail at once to Mr .
Franciamone . )
follows : Barbara Holcomb , Planning Board Chairwoman , reported as
Easter,i weights Subdivision ( King ' s Lane ) - Parks . A
5 - acre park on the north side of Snyder Hill Road had been pro -
posed to be deeded to the Town , but it has never been acquired
by the Town .
Town Board Minutes - 6 - April 12 , 1976
Mrs . Holcomb said an alternate proposal is now being pre -
sented in conjunction with Willis Hilker ° s proposed development
of that parcel of land on the north side of Snyder Hill Road
( Parcel 61 - 1 - 8 . 1 ) , where the intent was that the 5 � acre park was
to be located . This proposal is , that instead of a 5 -acre park
on the north side of Snyder Hill Road a 7 - acre park on the south
side of Snyder Hill Road within the confines of Phase 2 Eastern
Heights development be deeded . The Planning Board has already
approved the concept , of trading the proposed 5 acres for this now
proposed 7 acres . The 7 acres is not the traditional kind of foot -
ball field type of recreation area or park land , but it would make
an excellent slide hill in the winter time . This morning a new
alternate has been proposed and that is , in addition to the already
discussed 7 acres on the south side of Snyder Hill Road, Eastern
Heights or its successors have now 'indicated that they would be
willing to deed to the Town approximately 13 acres on the south
side of Snyder Hill Road by combining the originally proposed 7
acres with other undeveloped land surrounding it . The Town Board
agreed to look at the 13 - acre parcel prior to May 3 when they will
have a special Board meeting to make a decision as to whether the
Town is interested in accepting all 13 acres . The Town ' s decision
will be available to the Planning Board for its meeting on May 4 .
If the Town accepts an alternate, for the originally proposed 5 -acre
park on the north side of Snyder Hill Road , then Mr . Hilker proposes
to develop that parcel of land on the north side of Snyder Hill Road
for 43 single family dwellings and he will deed to the Town a par -
cel 2 . 2 acres in the northeast corner of this parcel ( 61 - 1 - 8 . 1 ) for
park land for this development . A water line easement to the Hun -
gerford Hill tank runs through this 2 , 2 -acre parcel . This is the
flattest piece of land in this particular area . It would be served
by a proposed road .
The 7 acres comprises Tax Map Parcel Nos . 57 - 1 - 8 . &$
througl 57 - 1 - 8 . 83 and 57 - 1 - 8 . 90 through 57 - 1 - 8 . 96 , and the 13
acres comprises these parcels plus Tax Map Parcels 57 - 1 - 8 . 130
through 57 - 1 - 8 , 137and 57 - 1 - 8 . 84 through 57 - 1 - 8 . 89 .
It was noted at the meeting that if the area is taken by
the Town for park purposes it is almost impossible to ever do any-
thing with it other than use it for park land . Therefore , the
Town will have to be very sure that it wants this area for park
purposes . If the Town Board should approve taking the area for a
park , then the Planning Board will be able to accept this area as
a park on a conditional basis .
Mr . Schwarting was advised that public in-put on this
matter would be welcomed at the Town Board meeting of May 3 and .
the Planning Board meeting of May 4 .
matters . rZr . Fabbroni , Town Engineer , reported on the following
Beacon Hills . Mr . Fabbroni asked the Board to adopt a
resolution sanctioning a method of procedure outlined in his
letter dated P-?arch 29 , 1976 to Mr . Ellis E . Erdman regarding the
Beacon Hills project . Mr . Fabbroni read the letter to the Board .
He has had no reply to the letter . Mr . Fabbroni furnished the
Board with a conr of the results ° of his inspection of the Beacon
Hills project , indicating the condition of the various buildings
and recommended action . The inspection was made on April 5 , 1976 .
(Attorney Buyoucos indicated he would make comments on this matter
in executive session . )
Town Board Minutes -- 7 - April 12 , 1976
Motion by Supervisor Schwan ; seconded . by Councilman Del Rosso ,
RESOLVED , that this Town Board hereby authorizes the Town Engineer
to pursue the general procedures , as he has outlined them in his
letter � of March 29 , 1976 to Mr . Eiiis E . Erdman with regard to the
Beacon Hills project ; further , the Board hereby refers the matter
to the Town Attorney for his domments and' a report from him on his
recommendations . for whatever legal action may be appropriate at
this time .

Summer Interns . Mr . Fabbroni asked for authorization to
have two summer interns hired who have planning and engineering
background , under the Summer Intern Program which Cornell University
administers with Federal monies . This is a ten week program in
which students work for $ 120 . 00 per week with the local share being
$ 24 . 00 per . week or $ 240 . 00 per week per student for the ten week
period . This would ; . therefore , cost the Tovm $ 480 . 00 for the , 10 �
week period . Mr . Fabbroni noted " . that this program was very successor
ful last year when John McQueen did valuable work for the Town in
legal matters and Miss Susan Blumenthal prepared the Park and Open
Space Plan .
Motion by Councilman McElwee # seconded by Supervisor Schwan ,
RESOLVED , that the Town Engineer is. hereby authorized to arrange
. for the employment of two summer interns with planning or engineer -
ing background under the Summer Intern Program administered by
Cornell University with Federal 'funds .
Unanimously carried .
Construction Transit . Mr . Fabbroni reported he has pur -
chased a Gurley Model 100A Construction Transit , with adjustable
tripod , for $ 770 . 00 and has already found it valuable on a number
of small jobs .
Aerial Photographs , 11r , Fabbroni reported he had solicited
prices from four engineering firms regarding the taking of aerial
photographs of the Town . Three replies were received and the job
was given to Greenborne & O ' Mara , No Huntington , Pennsylvania ( the
lowest price was $ 1 , 312 . 00 ) . The photographs were flown on March 23
and will be available by July 1st . Cronaflex 400 ft , to the inch
has been requested .
Coy Glen Park Site Plan . Mr . Fabbroni reported that Mr .
Dennis Colliton , Cornell University student in Landscape Architec -
ture , is working on a park site plan for the Coy Glen area which
is included in the Town ' s park development study . The Planning
Board has approved the expenditure of $ 200 . 00 for art work repro -
duction costs . Mr . Fabbroni said Mr . Colliton ' s work , in specific
terms , goes beyond what a consultant would do . This type of study
provides most of the data necessary for a Bureau of Outdoor Recrea -
ation grant . Tht.r study covers all the physical aspects necessary
to analyze a site . 11he Town Board saw no objection to the expendie
ture of $ 200 . 00 for the art work reproductions in connection with
Mr . Colliton ' s analysis of the Coy Glen area .
Town Board Minutes - 8 April 121 1976
Motion by Councilman McElwee ; seconded by Councilwoman Valentino ,
RESOLVED , that $ 200 . 00 of the Planning Board budget may be ex -
pended for art work reproductions in connection with the analysis
of the Coy Glen area .
Unanimously carried .
Sign Violations . Mr . Robert Bonnell , assistant to the
Town Engineer , has done a complete survey of all signs . ' the
Town and the changes which have , taken place since the 1972 survey
made by the former Town Zoning Officer . Notices of violations
have been sent to 50 - 60 businesses or landowners in the Town and
the response has been good . Some have come in to ; apply for per -
mits or have removed the offending . signs . There will be many sign
applications coming before the Planning Board at the May 4th meet-
ing , and they will then come before the Town Board at the May 10th
meeting . It is the Town Board which will hear requests for a vari -
ance .
Town Highway Barn . There are two sites available for a
Town Highway Barn facility , one on 5 Mile Drive ( 5 - 1 /2 acres ) and
one on 7 Mile Drive ( 10 . 8 acres ) . The Town has an appraisal of
in excess of $ 1001000 for the present . facility , with estimate of
about $ 90 , 000 for its improvement , It would appear at this time
to make sense to build a more functional facility on one of the
alternate sites available . Mr . Fabbroni presented to the Board
for review , comparison , and discussion a schematic of the present
facility and the two alternate sites . There is a problem with the
51Mile Drive site since it is basically on a fill site and , further ,
it is directly across from the Old Hundred house which has historic
value . It is also located within one of the five alternates for
future Rt . 13 , Mr . Fabbroni recommended the 7 Mile Drive site as
the preferable one . It affords more space and more setback for
the building . It is in a sparse area and readily accessible to
Rt . 13 . Councilman Del Rosso felt it would be wise to sell the
present site and purchase and build on the 7 Mile Drive site .
Mr . Fabbroni recommended a building 100 ' x 100 ' and sug -
gested a design similar to the City of Ithaca ' s new facility . He
suggested 4 ft . concrete wall and aluminum all -purpose type of
building , built on a steel frame which would support an overhead
crane and cut down on roof truss costs .
In view of the fact that the proposed Town sites are so
close to the County facility , Councilwoman Raffensperger asked
if Town activities could not be ''coordinated with the County
activities at the County facility , particularly for the storage
and use of materials . She said the County has fine storage bins
already built . This would make it unnecessary for the Town of
Ithaca to expend money building storage facilities . Councilman
McElwee suggested that the County probably had built what they
estimated they would need and that the Town would not be able to
use their bins . Mr . Parkin noted there would be difficulties with
Town and County employees working out of the same bins . He did
not think it would work . Councilwoman Valentino thought there
might be a prorlem . . with keeping track of °° who took • what " .
Supervisor Schwan said that in order to discuss the avail -
able parcels in public , it had been necessary for the Town to
obtain an option on both of the sites at a specified purchase
price for a 90 day period .
Town Board Minutes 9 - April 12 , 1976
The sense of the Board was that the 7 Mile Drive .site is
preferable . The Town Engineer will prepare estimates of building
costs and alternative designs . The specifications will be prepared
by an engineer and the final design will . be done by an engineer .

regular meeting of the Board (May 10 ) 0

The highest bid was received from the Grounds nivis0on , Department
of Physical Plant Operations , Cornell University , in the amount of
$ 456 . 000
Motion by Supervisor Schwan . seconded by Councilman McElwee ,
RESOLVED , that the Town Board hereby accepts . the bid of the Grounds
Division , Department of Physical Plant Operations , Cornell Univer-
sity , in the amount of $ 456 . 00 , same being the highest bid for
One ( 1 ) 1944 GMC Air Compressor , Identification No . 270524437 , as
advertised for sale .
Unanimously carried .
LIGHTING FOR SESAME STREET
Mr . Parkin reported a request from residents on Sesame
Street for a street light on Danby Road ( Leonardo Subdivision ) .
Since It is the policy of the Town to ' light intersections '--of
accepted Town roads ; the Board acted as .follows .
Motion by Supervisor Schwan ; seconded by Councilwoman Raffensperger ,
RESOLVED , that the New York State Electric & Gas Corporation be
authorized to install a 7 , 000 lumen street light at the intersec
tion of Sesame Street and Rt . 96B ( Danby Road ) .
Unanimously carried .
BOLTON POIPJT WARRANTS
The Board reviewed the Bolton Point warrants dated April
12 , 1976 .
Motion by Supervisor Schwan seconded by Councilman McElwee ,
RESOLVED , that the Town Board , after having reviewed the Bolton
Point warrants dated April 12 , 1976 , and upon the recommendation
of the Southern Cayuga Lake Intermunicipal Water Commission that
these warrants are in order for payment , hereby approves same for
payment in the amount of $ 699 , 541 . 48 .

TOWN OF ITHACA WARRANTS

Motion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board hereby approves for payment Town of
Ithaca warrants dated April 12 , 1976 in the following amounts .*

. . Parcels 59 - 212 and 59 - 2 - 1761 in the name of Richard R .
and Jeannette B .. knight , . having been formally combined as one tax
parcel ' by the Tompkins County Assessment Division ( 113 Clover Lane ) ,
the sense of the Board was that a refund of $ 98 . 00 is due to the
Knights , as agreed in the minutes of January 12 , 1976 . The amount
of $ 98900 represents one water unit ( $ 48 . 00 ) and one sewer unit
( $ 50 . 00 ) .
Motion by Councilman McElwee ; seconded by Councilwoman Raffensperger
RESOLVED , that a refund in the amount of .08600 , representing one
water unit ( $ 48 . 00 ) and one sewer unit ( $ 50 . 00 ) , be made to Richard
R . Knight and Jeannette Knight , 113 Clover Lane , based on the com-
bining of Tax Parcels 59 - 2 - 12 and 59- 2 - 17 . 1 into one lot by the
Tompkins County Assessment Division .
Unanimously carried .
Supervisor Schwan reported that in view of the fact that
a utility right of way 'runs through Parcel 45 = 2 - 14 owned by Edward
and Barbara Jones , on Troy Road ,, that they are entitled to a re -
fund of. 2 / 10 of a unit for waterll ( $ 9 . 60 ) based on the customary.
reduction in unit cost ( based on acreage ) , the acreage 'reduction
being one half the acreage comprised in the utility right of way .
Pgotion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
RESOLVED , that $ 9 . 60 be refunded to Edward and Barbara Jones ,
Troy Road , Parcel 45 - 2 - 14 , based on a reduction of 2 / 10 of a
water unit for the reason that a utility right of way traverses
the parcel .

CONTRACT WITH SOUTHERN CAYUGA LAKE
INTERiIMUNICIPAL WATER C0101IISSION
The Town Attorney recommended adopting a resolution
authorizing the Supervisor to contract with the Southern Cayuga
Lake Intermunicipal Water Commission to provide services for the
operation and maintenance of the Bolton Point water project and
confirming the designation of the Town of Ithaca as " Employer "
of the personnel who will operate , maintain , and administer the
Bolton Point system . The other municipalities involved in the
project have adopted resolutions designating the Town of Ithaca
as " Employer " . Supervisor Schwan noted that the Southern Cayuga
Lake Intermunicipal Water Commission , as a commission , is not per -
mitted by law to be the " employer % The Social Security adminis -
tration will not accept TA funds or Federal or State withholding
from a Commission . A commission is not a municipality and has no
status with them . Councilman Del Rosso suggested that the Town of
Ithaca might withdraw from the Social Security system and set up
its own private pension system . He said this could be done at
less expense and provide better coverage . This suggestion was not
pursued at this time . The Board acted as follows .
Motion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
Pursuant to the request of the Southern Cayuga Lake Inter -
municipal Water Commission and the understanding heretofore had
between the Town of Ithaca representatives on the Commission and
the other members of the Commission relating to the provision of
administrative , technical , clerical and other services for the
Southern Cayuga Lake Intermunicipal Water Commission water project ,
IT IS HEREBY

RESOLVED , that the Tovvin Board hereby authorizes the
Supervisor to contract with the Southern Cayuga Lake Intermuni -
cipal Water Commission for the purpose of providing services for
the operation and maintenance of the Southern Cayuga Lake Inter -
municipal dater Project facilities and for administrative , cleri -
cal , and fiscal services in connection therewith , provided that
appropriate provision is contained in such contract for the reim-
bursement in full of the Town of . Ithaca for all costs and expenses
incurred in connection with the foregoing , including salaries and
fringe benefits for employees and clerical expense ; and the Super -
visor is hereby authorized to hire such employees as may be re -
quired to provide such services , ° including plant manager , plant
operators , meter readers , maintenance personnel ; bookkeepers ,
clerks , and such other personnel as may be deemed necessary , and ,
subject to the foregoing , the Town Board hereby confirms the desig -
nation of the Town of Ithaca as " Employer " for the aforesaid per -
sonnel and the Town Board further ratifies and confirms all steps ,
procedures , and acts , including any employment of such personnel
which has heretofore taken place ,, including the payment of salaries
and all incidental benefits °
