TOWN BOARD MINUTES
JULY 13, 1998
7 : 00 P.M.

Supervisor Kenneth Horst called the meeting to order at 7 : 04 P .M. and led all present to the Pledge
of Allegiance to the American flag.
PRIVILEGE OF THE FLOOR:
Liz Thorndike, a representative of the Cayuga Lake Watershed Network addressed the Board and
public with an overview of the organization. The organization is a group of people around Cayuga
Lake from Seneca, Cayuga and Tompkins Counties that have been meeting since last year so that they
can get a watershed network going. The Cayuga Lake Watershed is spread across 6 counties.
Cayuga Lake is the largest lake and the only one that does not have a watershed-wide organization.
They are working on bi-laws and getting organized at this time . The Town was invited to join the
network and the fee is $35 . 00 .
NYSEG DEREGULATION
Dick Charsky - of NYSEG addressed the Board as part of their outreach program with information
regarding the deregulation of NYSEG service . NYSEG has a five (5 ) year plan in place beginning
August 1 , 1998 for small industrial customers . All consumers will have the opportunity to choose
their supplier. Everyone will be eligible to choose their supplier beginning in 1999 and NYSEG can
provide a list of suppliers. Part of the NYSEG agreement called for the auctioning of seven coal
fired power plants one of which was Miliken Station. .
Revitalization Task Force
Code Enforcement Officer Susan Beeners reported that she is the chairperson of the Revitalization
AFT . •

Task Force . The task force will be reporting to the Planning Board and the Town Board .
Executive Session Requested :
Code Enforcement Officer Susan Beeners requested an executive session of the Board to discuss a
potential litigation matter related to zoning .
Members of the Public :
Judy VanDermark - 1432 Danby Road - Reported that Community Council will publish their first
youth flyer next week. She referred to an article in the Ithaca Journal and is concerned about lack
of trust between Town of Danby Boards .
Councilperson Steiner said that we have heard over the last few months about programs for the
Danby Youth. He would be interested in what kind of efforts were under way within Community
Council programs for all Danby residents not just in the youth.
Esther Dotson - Esther addressed the Board with concern about an article published in the Ithaca
Journal last Saturday and asked the Board to not insist on pursuing these things that we don't think
are in the directions we have in mind.
Pat Woodworth - 305 Gunderman Road reported that she thinks that close communication is
critical between the Planning Board and the Town Board . Concerns expressed by the Town Board
should be addressed .
Supervisor Horst said that he too would make a plea that the boards, which includes Community
Council, the Planning Board, Board of Zoning Appeals, and the Town Board to harmoniously
cooperate, deliberate and to work together because it is only that way that we can really move ahead
as far as doing the business of the Town of Danby .
REPORTS :
County Representative Report
Representative Frank Proto reported on the following:
1 ) Transportation Committee - The bus shelter for the Danby Park and Ride will be installed
by fall .
2 ) Airport Terminal - is not large enough to support two major airlines . There will be one
major airline and commuter lines .
3) County Library - The County Board has not taken a position on the donation from Park
Foundation for the purchase of the Woolworth site for the County Library. The building will
not support a second floor. The County will be working with the City on a plan for that
section of the City.
4) Health Committee - The County is looking into developing a site in Tompkins County to
supply methadone treatment . Counseling for heroin addiction will still be done in Syracuse .
5) Lake Source Cooling Project -- was approved .
6) Farm City Days - The Farm Board Protection Committee are sponsoring a Farm City Day

on Saturday, August 16 , 1998 Lew-Lin Farm in Dryden .
7) Child Assistance Program ( CAP) - substitute for Aid to Dependent Children - (ADCP)
for parents of "Welfare to Work"-- programs a two year pilot project .
8) Biggs Building -- Building is rented to N. Y. S . Troopers for a sub-station.
9) Speeding on Comfort and Gunderman Roads - Sheriff will increase patrols during peitk
traffic times due to requests from residents.
10) Revitalization Task Force -- Town must do planning phase first before applying for funds.
11 ) SARA - Workshop for Records Retention Officers will be held in Enfield this Summer.
COMMUNICATIONS :
1 ) Time Warner Draft Franchise Agreement
2) Treasurer' s Report from Community Council
REPORTS :
EMC - (Environmental Management Council) Robert Roe held a meeting on July 8 , 1998 and the
most significant item on the Agenda is that there will be a State Wide conference September 11 - 13
on the environment. The Town Board should consider sending a representative to the workshop on
the GIS System as it would be helpful to the planning of the comprehensive plan. There will not be
a full meeting of the EMC in August.
Highway Department Report - June 1998 Report Received -- attached with a Report On July 8,
1998 Storm Flood Damage . The Town of Danby suffered flood damage in West Danby on Valley
View road, Tupper Avenue, Maple Avenue, Beech Hill and the culvert on laRue Road at the Empire
Speech and Hearing Clinic was damaged . The Town may be eligible for FEMA funds to help with
the cost of repairs to the washed out areas and culverts. Estimate of damage is $ 135 , 000 .
Senior Citizens - Carol Sczepanski reported that the Senior Citizens had a picnic supper at the
Danby Fire Station in July. The group will attend the Danby Fire Department Chicken Barbecue on
July 8 and travel to Ithaca to the Hanger Theater to see "Forever Plaid" .
Code Enforcement - June 1998 Report - received .
Planning Board Report - Arch Dotson reported that at the July 1998 Planning Board Meeting the
important item on the agenda is the proposed residents survey. The survey is being reviewed by
Tompkins County Planning. The comprehensive plan is progressing according to the work plan.
Water Resources Council - Ted Jones gave an update on the Flood Mitigation Funds that are
available. He suggested that the Town look at the information as there is $37, 000 available in the
County. The Town must establish a flood mitigation standing committee to apply for funds and they
must be matching funds and can be used for anything to stabilize areas to prevent flooding in the
Town . Ted said that he would be willing to chair the committee on a short term basis .

Motion to move to Executive Session
A motion was made by Councilperson Gagnon and seconded by Councilperson Inman to move to
executive session at 8 : 30 P . M. to discuss a potential litigation.

Councilperson Inman reported that there have been several changes concerning the Town Hall
Construction Warrants.
A motion was made by Councilperson Inman and seconded by Councilperson Gagnon to approve the
Building Construction Warrant for July 1998 in the amount of $23 , 112 . 42 .

Danby Area News Publication Guidelines
Liz Roe asked the Town Board to review the Danby Area News Guidelines that she submitted. A
committee has reviewed the guidelines and she has submitted a final draft to the Board. She asked
that the Board consider approving the guidelines tonight .
Councilperson Steiner moved the following resolution:

APPROVAL OF DANBY AREA NEWS PUBLICATION GUIDELINES

WHEREAS, Elizabeth Owens-Roe has submitted a Final Draft dated July 13 , 1998 for the Danby
Area News Publication Guidelines, and
WHEREAS, the Danby Area News Publication Guidelines were reviewed and approved by the
Danby Area News Committee, now be it
RESOLVED that the Town Board of the Town of Danby recognizes and approves the Danby Area
News Publication Guidelines as submitted and dated July 13 , 1998 , and be it further

RESOLVED , that the Danby Area News Publication Guidelines may be reviewed
reviewed by the public for additional input and changes as appropriate.
Discussion :
Councilperson Gagnon said that he would like to review the guidelines again. He reported to the
Board for the recorded that he would like to support these guidelines but is being forced to vote
Councilperson Inman and Councilperson Strichartz said that the guidelines that were submitted reflect
all the items that were reviewed by the review committee. -

Comprehensive Plan Survey
Supervisor Horst said that discussion on the Comprehensive Plan Survey would be limited to one-half

A motion was made by Councilperson Inman and seconded by Councilperson Gagnon to extend the
meeting to 10 : 00 P . M. with no further extensions of the meeting.

Comprehensive Plan Survey Discussion : -
Supervisor Horst said that if time does not permit the Board to complete their review of the survey
that suggestions and comments may be submitted in writing to Bob Roe for consideration or may
attend the Planning Board meeting .

The Town Board reviewed the Draft Survey and discussed the following :
1 ) The methodology -- numbering for tracking and how to reach multiple households.
2) Voter registration list for mailing of the survey ( not representative of all households)
3 ) Use of a scientific sample?
4) What is the purpose of the survey?
5 ) The importance of public participation.
6) Type of sampling frame
7) Geographically -- where residents are located. (north, south, east, west, central, etc . )
Motion to Accept the Recommendation of the Planning Board for Distribution of the Residents
Survey
A motion was made by Councilperson Steiner and seconded by Councilperson Inman that the Town
Board of the Town of Danby accept the Recommendation of the Planning Board that the Danby Area
News be used to distribute the survey to residents and that the Town Board recommend to the
Planning Board that they consider sending more than one survey to each household and that they be
numbered .

Danby Area News Publication Guidelines
Liz Roe asked the Town Board to review the Danby Area News Guidelines that she submitted. A
committee has reviewed the guidelines and she has submitted a final draft to the Board. She asked
that the Board consider approving the guidelines tonight .
Councilperson Steiner moved the following resolution :
RESOLUTION NO. 48 OF 1998
APPROVAL OF DANBY AREA NEWS PUBLICATION GUIDELINES
By Councilperson Steiner: Seconded by Councilperson Strichartz
WHEREAS, Elizabeth Owens-Roe has submitted a Final Draft dated July 13 , 1998 for the Danby
Area News Publication Guidelines, and
WHEREAS, the Danby Area News Publication Guidelines were reviewed and approved by the
Danby Area News Committee , now be it
RESOLVED that the Town Board of the Town of Danby recognizes and approves the Danby Area
News Publication Guidelines as submitted and dated July 13 , 1998 , and be it further
RESOLVED, that the Danby Area News Publication Guidelines may be reviewed
reviewed by the public for additional input and changes as appropriate .
Discussion :
Councilperson Gagnon said that he would like to review the guidelines again . He reported to the
Board for the recorded that he would like to support these guidelines but is being forced to vote
"NO" .
Councilperson Inman and Councilperson Strichartz said that the guidelines that were submitted
reflect all the items that were reviewed by the review committee .

Comprehensive Plan Survey
Supervisor Horst said that discussion on the Comprehensive Plan Survey would be limited to one-
half hours .
Motion to Extend Meeting
A motion was made by Councilperson Inman and seconded by Councilperson Gagnon to extend the
meeting to 10 : 00 P .M . with no further extensions of the meeting .

Comprehensive Plan Survey Discussion :
Supervisor Horst said that if time does not permit the Board to complete their review of the survey
that suggestions and comments may be submitted in writing to Bob Roe for consideration or may
attend the Planning Board meeting.
The Town Board reviewed the Draft Survey and discussed the following :
1 ) The methodology -- numbering for tracking and how to reach multiple households .
2) Voter registration list for mailing of the survey ( not representative of all households)
3 ) Use of a scientific sample?
4) What is the purpose of the survey?
5 ) The importance of public participation.
6) Type of sampling frame
7) Geographically -- where residents are located. (north, south, east, west, central , etc . )
Motion to Accept the Recommendation of the Planning Board for Distribution of the Residents
Survey
A motion was made by Councilperson Steiner and seconded by Councilperson Inman that the Town
Board of the Town of Danby accept the Recommendation of the Planning Board that the Danby Area
News be used to distribute the survey to residents and that the Town Board recommend to the
Planning Board that they consider sending more than one survey to each household and that they be
numbered.

Motion to Adjourn Board Meeting to July 20 , 1998
A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon to adjourn
this meeting to Monday, July 20, 1998 at 7 : 00 P .M. to complete the remaining items on the Agenda
and to continue review of the draft syrvey,
