APPROVAL OF MINUTES
Motion by Councilmanl;', Powerso seconded by Supervisor Schwan ,
RESOLVED , that the minutes of the meetings of December 8 and 31 ,
1975 be approved , as ,' presented .

APPROVAL OF NEW POLLING PLACES
Motion by Supervisor ` Schwan ° seconded by Councilman Powers ,
RESOLVED , that this Board hereby approves change of Polling Place
in Election District ', No . 1 from the Nurses ' Recreation Room at
the Tompkins County Hospital to the Hermann M . Biggs Memorial
Building , Room 114 ,
Unanimously carried .
Motion by Supervisor , Schwano seconded by Councilman McElwee ,
RESOLVED , that this Board hereby approves change of Polling Place
in Election District ' No . 4 from Riley Robb Hall at Judd Falls Road
to Ellis Hollow Apartments , Community Room , at Ellis Hollow Road .
Unanimously carried .
REIMBURSEMENT FOR ZONING BOARD OF APPEALS
MEMBERS AND MEMBERS OF THE PLANNING BOARD
Mr . Fabbroni ° noted that the decisions made by the Zoning
Board of Appeals are ' ery important in terms of Town zoni
� v ng and
the effect on communities . The members of the Board often visit
sites in question in "' making their decisions in addition to attend -
ing meetings , and they are most conscientious in their work . In
view of the importance of the work done by the Zoning Board of
Appeals , Supervisor Schwan recommended that the reimbursement be
changed to some amount per meeting attended . Councilman McElwee
recommended $ 25 . 00 per meetin' ended ° Supervisor Schwan said

there is sufficient money in the budget under Planning and Zoning
to cover an increase ,, and there are contingency funds as well .
The Town Board received a resolution from the Zoning Board of
Appeals ( dated March ' 3 , 1976 ) requesting that each member of the
Zoning Board of Appeals of the Town of Ithaca receive $ 25 . 00 per
meeting attended . After some discussion the Town Board settled
on $ 20 . 00 per meeting attended for Zoning Board of Appeals members
and Planning Board members , and acted as follows .
Motion by Supervisor ; Schwan , seconded by Councilwoman Valentino ,
RESOLVED , that remuneration for each . member of the Zoning Board
of Appeals and for each member of the Town Planning Board shall
be increased from $10 . 00 a month to $ 20 . 00 for each scheduled
meeting attended .
Unanimously carried .
CERACCHE TV FRA14CHISE

Councilman Powers said it appears the Town has whatever
information it will get from the State Television Franchise Com-
mission . He read a letter dated February 19 , 1976 addressed to
the Town Clerk . Supervisor Schwan said the letter refers to
another letter which4ndicates as far as the Wew York State Cable
Commission is concerned , a municipality with a franchise with a
television cable supplier may negotiate with the supplier for an
increase in the remuneration under the franchise agreement , may
negotiate changes in ; the contract , or negotiate an extension
policy for low density areas , but no matter what the Town Board
does , it does not become effective until the Commission has ap -
proved it .
It was agreed the Board would have a work session to
organize all available information , and come to a decision with
regard to revising the Ceracche Television franchise agreement .
Home box comes under the same agreement which is subject to ap -
proval by the Cable Commission . Councilman Powers recommended
that before a work session is scheduled , Mr . Ceracche ' s proposal
for extensions in low density areas ought to be studied by one or
two Board members , taking into account recommendations on hand
from the Cable Commission , so there is something coherent to work
with . The Board agreed it is difficult to interpret the Ceracche
proposal which requires close study and raises several questions .
It was agreed that Councilmen Powers and McElwee would make a pre -
liminary study of the Ceracche proposal prior to a work session .
TRANSFER OF FUNDS
Supervisor Schwan furnished the Board with a list of pro -
posed 1975 year - end transfers of funds . He noted that the reason
for the large number„ of State Retirement transfers was that two
years of State Retirement were paid in one year inadvertently .
The purpose of the transfer of funds is to balance the year - end
accounts .
After brief discussion , the Board acted as follows ,,

Town Board Minutes 4 -- March 8 , 1976
BOND ANTICIPATION NOTE RENEWALS
Supervisor Schwan advised the Board that BondAnticipa -
tion Note renewals ( renewal . date March 3 , 1976 ) for water and
sewer systems constructed in the Town of Ithaca at 7 % interest
have been executed by him on behalf of the Town of Ithaca , He
requested that the Board approve such renewals at the new interest
rate and , further, that the Board approve and rati :`. y all actions
he has taken with respect to such renewals . There � ore , the Board
acted as followso
Motion by Councilman:: Powers ,o seconded by Councilman McElwee ,
RESOLVED ; that Bond 'Anticipation Notes of the Town of Ithaca ,
heretofore executed by the Town of Ithaca , in the amount of
$ 700x500 . 00 pursuant to provisions of resolutions authorizing
the construction of ''sanitary water systems to serve East Ithaca
Water District , . Snyder Mill Road Water District , Second South Hill
Water District ( Note # 1 ) , Second South Hill Water District ( Note
# 2 ) , Second South Hill t^eater District ( Ext . No 1 ) , Second South
Hill Water District ( Ext . No . 2 ) , and Coddington Road Water Dis -
trict Extension ; and that Bond Anticipation Notes of the Town of
Ithaca , heretofore executed by the Town of Ithaca , in the amount
of $ 1 , 862 , 000 , pursuant to provisions of resolutions authorizing
the construction of ''sanitary sewer systems to serve Ellis Hollow
Road Sewer District , ' Northeast Sewer District , Slaterville Road
Sewer District , South Hill Sewer District ( Note #r` 1 ) , South Hill

tion with current renewals ; and the Supervisor is hereby authorized
to have executed such renewals and such other instruments and to
have taken such other steps as may be legally required to effect
such renewals , and , further , this Board hereby approves and rati -
fies any actions taken by the Supervisor to effect such renewals .

INSURANCE REVIEW
Mr . Robert L . Boothroyd , Jr . of Robert S . Boothroyd Insur �
ance Agency appeared' before the Board and distributed prepared
material for the Board ' s review . ( Copy is available at the Town
Offices . ) Mr . Boothroyd reviewed the Town ' s insurance coverage
in all categories , As follows *
Public Employees Blanket Bond . There was some question
whether the Town Supervisor ought to be bonded for more than
$ 345 , 000 . 00 in view of his serving as Treasurer of the Southern
Cayuga Lake Intermunicipal Water Commission . Mr . Boothroyd thought
$ 345 , 000 . 00 was adequate , considering the controls in effect .
Mr . Boothroyd suggested that the $ 5 , 000 limit for all employees
should be reviewed . 1i He recommended that a minimum of $ 25 , 000 of
.delity. • coverage should be carried . He said he would look into
the . cost of higher coverage .
Workmen ' s Compensation . The Board thought some of the
premiums were a bit heavy in classifications under Workmen ' s Com-
pensation , particularly " Street Work " . The Board felt that the
rate should be adjusted between " Street Work " and " Other Municipal
Employees " . fir . Parkin will look into this with the advice of Mr .
Boothroyd . It was suggested that some of the work now budgeted
as " Street Work " could be moved into the category " Other Municipal
Employees " which carries a lower rate per hundred .

Package Policy . Councilman ; Actlwee wondered if the
valuations of the Coddington Road Pump House and the Troy Road
Pump House were on the high side . Mr . jBoothroyd said he would .
re - check these . It was agreed that unjer Sections I and III all
properties and equipment will be re ®appraised . .

Mr . Boothroyd noted that any written contract for services ,
purchase agreements , ',' contracts for maintenance and construction ,
and the like should be sent to the insurance comparv . He said the
Bolton Point project ' is covered . The sown of Ithaca is named as
an insured in all the Bolton Point policies . There is a specific
insurance policy for the Bolton Road . Bolton Point insurance cov-
ers whatever the Town ' s insurance does not cover .
Vehicles . Mr . Boothroyd will check on whether Town . em�
ployees using their own cars on Town business are covered . He
recommended increasing collision" deductible to $ 500 , because the
insurance is very expensive °
Protective Liability . Mr . Boothroyd said he would look
into what it would cost if the bodily injury and property damage
limits were raised .
Blanket , Excess Liability . PJr . : Boothroyd stated that wher -
ever there is basic coverage , the secoaid layer of coverage ( up to
$ 5 , 000 , 000 ) applies . ' The excess policy carries a $ 10 , 000 deductible
feature . Mr . Boothroyd said he would check to see if $ 500001000
excess liability is enough . If the deductible is raised to $ 25 , 000
the premium savings is $ 200 a year .
Statutory Disability . Mr . Boothroyd did not recommend pur -
chasing this type of insurance at this time .
Federal Flood Insurance . Mr . Boothroyd said he had mixed
feelings about purchasing flood insurance , but noted that the Town
is not eligible for Federal aid in the event of a flood to the ex-
tent that it could have purchased flood insurance .
In connection with a question raised earlier in the meet -
ing as to whether the Town should look into comparative prices of
insurance from other agencies or companies , Mr . Boothroyd noted
that his agency retains 550 of the commissions on Town insurance
and distributes 45 % equally. with other agents in the area who quali -.
fy .
REPORTS OF COU11TY REPRESENTATIVES
Mrs . Livesayi, reported that the Sheriff ' s request for
additional staff was ; cut to two and that these two were approved .
The Sheriff still feels this is insufficient , however . It will
not permit giving present employees the time off they have earned .
They will simply work less overtime .
Mrs . Livesayllasked if the Town had made any decisions
regarding a Town constable or contracting with the Sheriff ' s
department for a deputy just for the Town of Ithaca . Mrs . Live -
say said the Town , in effect , would be " buying " the person , pay®
ing his expenses , but would save the cost of office space . She
said it could be worked out on a contractual basis . Councilwoman
Raffensperger noted that such a person may have restricted duties ,
i . e . traffic control ,! etc . There was some question whether such
a contractual arrangement could be worked out legally . No action
was taken on this matter at this time .
Town Board Minutes - 6 - March 8 , 1976
Mrs . Livesay !' reported that an Airport contract raising
landing fees was approved this morning . The contract sets 18 cents
per thousand pounds , retroactive for all the time there has been
no contract . Next year it will be 22 cents and then 25 cents ..
Mrs . Livesay reported that the matter of paid parking at
the Airport will be discussed again at the meeting on April 12 .
The Negotiating Committee has committed itself to persuading the
Board of . Representatives to approve paid parking . Mrs . Livesay
asked if the Town Board had any recommendations in this connection .
Councilman Desch said he was against it , since it is already diffi -
cult to induce people to use the Airport .
BEAUJOLAIS RESTAURANT - PARKING
There was another long discussion about parking at the
Beaujolais Restaurant , Mr . O ' IVI& lley contended he could manage
the parking except for customer parking on Friday and Saturday
when no more than five or six customer cars would be parked across
the road . Although the Planning Board had suggested that some cats
could be parked across the road , if the area were lighted , this was
only considered a temporary solution and was never intended to be
a long term solution . Supervisor Schwan was opposed to the idea
of parking across the road , even if lighted , as that might tend to
make that a permanent part of the restaurant . The Board as a whole
is still opposed to parking across the road and advised Mr . O ' Malley,
that this is in no way a satisfactory solution . Mr . O ' Malley was
again urged to consult the new Professional Engineer at the Tomp-
kins County Health Department , Mr . Joseph Vasilli , to determine
whether he would make a new determination with respect to parking
over the septic field . Mr . O ' Malley was also urged to negotiate
with Millbrook Bread for some of their space for parking . The
Board made it clear to Mr . O ' Malley that parking across the road
is not acceptable , whether lighted or not . There is too much of
a hazard involved .
The sense off' the Board was that Mr . O ' Malley ' s application
will be continued for further study and report in view of his pre -
sentation . Mr . O ' Malley will report to Mr . Fabbroni on his efforts
with the local Professional Engineer and negotiations with Millbrook
Bread .
REPORTS OF TOWN OFFICIALS
Mr . Buyoucos . Town Attorney , reported he had received
from Mr . Fabbroni papers .. with respect to Lexington Drive ( Schoen=
feld ` s land ) . He ( Buyoucos ) said he approved the deed and recom-
mended recording it and having the abstract extended .
t-ire Buyoucos reported that Mr . Fabbroni is preparing sub-
division regulations ; matters of procedures in accepting titles
to easements for roads . Procedures will be drawn up so that
developers will know ';!, what to present . This will be done before
the spring rush . Mr Buyoucos said better monumenting at certain
key points is needed ° This is something to be discussed and work-
ed out with Mr . Fabbroni ,
AIr . Buyoucos reported that a brief had been received in
the Franciamone matter and this will be argued in the Appellate
Court .
Town Board PZinutes - 7 - March 8 , 1976
Mr . Buyoucos " reported that he is filing the appeal papers
in the Munchmeyer medical clinic matter .
Mr . Fabbroni , reported on the follovting r.►atters r
Transit and accessories . Mr . Fabbroni noted that $ 1 , 200
is in the budget for this item . The one he is considering would
cost about $ 700 , plus $ 75 for accessories . Mr . Fabbroni requested
authorization to look into this further . The Board had no objec -
tion. to Mr . Fabbroni proceeding with this within the budget .
Aerial Photographs . Mr . Fabbroni reported he had made
inquiries of four firms for prices to do aerial photographs of
the Townp shot at 2 , 000 ft . The photographs would be blown up
to 400 ft . to the inch . . Photographs were done in 1954 , 1964 and
1968 at 400 fte to the inch . There have been great changes since
1968 , particularly in the east . There is some urgency to have
this done now because there are very few times of the year that
are considered favorable for flying aerial photography because of
the sun angle , foliage , etc . One of these ideal times is the end
of March or the first two weeks in April . Mr . Fabbroni said he
had a preliminary estimate for the 2 , 000 ftb scale , a 6 , 000 fto
mosaic , and the 400 ft . blow-up of $ 1 , 100 to $ 1 , 200 . The Board

Motion by Supervisor Schwan9 seconded by Councilman Desch ,
RESOLVED , that the Town Engineer is hereby authorized to have
aerial photographs of the Town of Ithaca taken , as indicated ;
at a cost not to exceed $ 1 , 500 .
Unanimously carried .
Mr . Fabbroni '',reported that the Town is in the process of
doing some park studies . Mr . Dennis Colliton has presented a pro -
gress report to the Planning Board , as part of his master ' s thesis
in Landscape Architecture at Cornell University , on his work on
Coy Glen . Essentially this will be a complete inventory of the
area as to the physical characteristics of the Glen . Mr . Colliton
will report again with specific recommendations as to the use of
the Glen , in particular its preservation . When this work is com-
pleted , i=fir . Fabbroni ,,said the Town would have as good an . inventgry o :
the area or site plan as could be prepared by any consultant .
Mr . Fabbroni reported that Cornell University has a class
- - what they call " Consultant in the Field " - - and that two students
in that class have come forth and expressed an interest in develop-
ing site ideas for the Northeast park areas , one at the end of
Tareyton Drive and the one deeded by Rocco Lucente . The Northeast
Civic Association have also expressed ideas for these two areas .
The students are developing those ideas into concrete plans for
the sites . They will also test what they have against the ideas
of the Northeast Civic Association . Mr . Fabbroni said he would
report further on this later . Supervisor Schwan noted that the
site at the end of Tareyton Drive is Cornell University land . He
said the record or minutes ought to be checked on the old Northeast
walkway to see what it says about the agreement with Cornell Uni -
versity .

Forest Home . A meeting was had with the Forest Home
Civic Association to discuss sewers and possible implementation
of a one -way street ., The .group did not favor the one -way system .
They wanted' to explore other ways . They want to work with Cornell
University further to see if the administration at Cornell Univer -
sity can do anything before they make a neighborhood commitment
to a one -way system . The matter is held in abeyance pending fur -
ther word from the Forest Home group .
With regardjto the sewering of Forest Home , Mr . Fabbroni
said he had advised the Forest Home Civic Association that the
time table has fallen back , the financing problems - - particularly
the 7 . 8 % interest rate in effect on another project - - and the
possibility that the interest rate on . the sewering project could
be higher , and how this affected the feasibility of the project .
Mr . Fabbroni said he had pursued the matter of Federal
funding . Information from the State is rather negative with
respect to State funding . Mr . Fabbroni said he had the impres -
sion that the Town would have to establish a plan to upgrade a .
sewage treatment plant before any legislative funding pools would
be available to it . Supervisor Schwan felt that bonds should be
sold between now and the middle of June to determine what long -
term interest rate might be and - then make a . decision about whether
to go ahead with the sewering project without waiting for " so -callp
ed free money " . He said Mr . David Allardice ( Bernard P . Donegan ,
Inc . , financial consultants ) , had advised that the Town is not
eligible for FHA funds : There was some discussion as to whether
only some of the sewer extensions ought to be done , and making
an effort to get Federal or State funds for the others . Super -
visor Schwan said the cost/benefit ratio does not work out .
Councilman Desch said it is necessary to sewer the area which
needs it the most - - and that is Forest Home , and economically
Forest Home is the most expensive . Supervisor Schwan suggested
that local people might be interested in subscribing to bonds to
get tax exempt interest income .
Supervisor Schwan said there is a possibility that Peat ,
Marwick , Mitchell will be hired to do an audit of the Town of
Ithaca , the Town of 'Lansing , the Town of Dryden , and the Village
of Cayuga Heights ( in connection with the Bolton Point project ) .
Financial institutions will not buy Bolton Point bonds without
an audit . It may be necessary to invest $ 121000 • to $ 15 , 000 in an
audit just to make the issue a little more marketable . Municipal
bond insurance is also being investigated . If the project quali -
fies for insurance , bond brokers will be asked to bid on the issue
with and without insurance . Then an evaluation can be made as to
whether the insurance is worthwhile . It would cost $ 10 to $ 20
per thousand df - - bonds sold .
Mr . Fabbroni' was urged by the Board to continue to push
for Federal funding and for 75 % State funding in. connection * with
the sewer project . Meanwhile the Town will go ahead with plans
to sell about $ 2 million of bonds .

Mr . Fabbroni' referred to the Transportation Survey
Questionnaire which was distributed to a portion of East Ithaca
area in connection with establishing travel needs and traffic
patterns in the Town of Ithaca on as anonymous a basis as possible .
Councilwoman Raffensperger said she had had a number of
calls from the Northeast and Forest Home about the questionnaire .
The questionnaire was characterized as having problems in make -up ,
i . e . , there was no room for husband and wife listings ; that who -
ever made it up did not understand the . complexity of family trans -
portation patterns in the Town of Ithaca ; that the words ` regular -
ly scheduled " leaveslout a large percentage of trips , that the

questionnaire should " be. distributed ; by the Town in an organized
fashion , mailing it . to , a certain . ,4' iiber of households in each part
of the Town . Most of . the comments ; :_, said Councilwoman Raffenspergerb
were with respect ao ' tihe " Plannin bepartment Survey " portion of
the form . Among the ' questions was .. " ; . 4_ rho made up the form ? Defi -
nition of " taxpayers `° ? , There was complaint that there was no in -
dication of how many dollars per tho- usand of assessed valuation

in the Town of Ithag" no indication of what $ 1 . 00 /M would buy in
each category ; that � tkore is an assumption that to provide new ' or
increased services In any . Category '° t4ould , necessitate a tax increase

desire for reduction , in some SeryiceS ( to provide increases in
others or to reduce taxes . )
Mr . Fabbron , ? noted that the Irranspor_tation Survey was in -
tended to be filled viii by each person , ( not husband and wife to -
gether ) ; that the civic associations presidents assigned a block
captain to distribute the forms and make sure they were returned .
Councilman Desch recommended that a supplement .. to the questionnaire
be sent out which would include the various tax rates so that
people would have something to relate to . Mr . Fabbroni agreed to
distribute a supplement which would satisfy some of the objections ,
clarify some ambiguities , provide yardsticks , and , in general , make
the survey more useful .
Highway Superintendent Parkin requested authorization to
sell the old air compressor to the highest bidder .
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,

to advertise for the " sale of the old Air Compressor , Identifica -
tion No . 270524437 , and to sell same to the highest bidder °

. Parkin requested authorization to advertise for bids
on a new Power Broom . ' The present one is an old magneto start
which is giving many mechanical problems . Whether the old broom
is kept would depend on what can be obtained when the new one is
bid .
Motion by Supervisor ,Schwan ; seconded by Councilman Powers ,
RESOLVED , that the Highway Superintendent is hereby authorized to
advertise for bids on a new Power Broom .

Mr . Parkin requested authorization to advertise for bids
on a used rubber -tired roller which will be used for surfacing ,
oiling and stone . He' said before the old one is traded in he
would see how the rubber-tired one works on the compaction and
road building . Pair . Parkin advised the Board what he thought such
a roller would cost ( a used one ) . He said a new one costs about
$ 30 , 000 . He said a roller two to four years old ought to be in
good shape and that the prospects of buying a good used one look
good . There was some discussion of the possibility , of renting a
roller when one is needed ( rather than buying one ) . Mr . Parkin
noted the inconveniences involved in renting - = timing and schedul -
ing work , possibility of bad weather immediately after renting .
Councilman Powers suggested that . bids might be taken with and with-
out a trade - in . After the discussion , the Board acted as followso

BOLTON POINT WARRANTS
Motion by CouncilmanlDescho seconded by Councilman McElwee ,
RESOLVED , that this Town Board , after having reviewed the Bolton
Point warrants , and upon the recommendation of the Southern Cayuga
Lake Intermunicipal Water Commission that the said warrants are in
order for payment , hereby approves same for payment in the amount
of $ 741 , 125 . 05 .

NEW EXPERIMENTAL TOWN BOARD MEETING HOUR

The Board agreed to begin the regular meeting on April 12 ,
1976 at 7 : 30 p . mo rather than 5 : 00 p . m . , on an experimental basis ,
the meeting to be terminated not later than 10030 p . m . The Board
r also agreed to conduct a work session at noon on Monday , April 5 ,
to discuss , among other things , the Dog Control Law .
