RESOLVED , that the Ithaca Journal is hereby designated as the
official newspaper of the Town of Ithaca for the year 1976 .

DESIGNATION OF DEPOSITORIES OF TOWN FUNDS
Motion by Supervisor Schwani seconded by Councilman Powers ,
RESOLVED , that the Tompkins County Trust Company , the First
National Bank of Ithaca , New York , and Marine Midland Bank in
Ithaca , New York , be and the same hereby are designated as
depositories for all monies coming into the hands of the Super-
visor , the Town Clerk , and the Receiver of Taxes .

TOWN BOARD MINUTES - 2 -- December 31 , 1975
APPOINTMENT OF DEPUTY SUPERVISOR FOR 1976
Motion by Supervisor Schwan , seconded by Councilman Del Rosso ,
RESOLVED , that Councilman Andrew W . McElwee be appointed Deputy
Supervisor of the Town of Ithaca for the year 1976 .

RE-APPOINTMENT TO PLANNING BOARD
AND DESIGNATION OF CHAIRMAN
Motion . by Councilman Powers ; seconded by Councilman Desch ,
,
RESOLVED , that Barbara P > Holcomb be re -appointed to the Town
of Ithaca Planning Board for the term January 1 , 1976 (through
December 31 , 19820 and it is further resolved that she" shall
act as Chairwoman of said Board .

APPOINTMENT OF TOWN OFFICIAL TO
REPRESENT TOWN AT ASSOCIATION OF TOWNS MEETING
Motion by Councilman Descho seconded by Councilman Powers ,
RESOLVED , that this Town Board hereby designates Walter J . Schwan ,
Town Supervisor , to attend the Annual Business Session' of the
Association of Towns of the State of New York , to be held at
New York City , on February 18 , 1976 , and to cast the vote of
the aforesaid Town , pursuant to Section 6 of Art . III ',of the
Constitution and By -Laws of said Association .

The Board recommended that in addition to Supervisor
Schwan , a member of the Planning Board , a member of the Zoning
Board of Appeals , and6Mr . Lawrence P . Fabbroni , Town Engineer/
Building Inspector , should attend this meeting .
TOWN MEETING DATES FOR 1976
Motion by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that Town Board meetings be held on the first Monday
after the first Tuesday of each month for the year 197 „6 , except
as the Town Board shall otherwise authorize or as mandated by
Town Law .
Unanimously carried .
There followed a brief discussion of the time Y ( hour )
meetings are held . This has been a recurring problem . ” Meetings
have habitually been held at 5 : 00 p . m . . Supervisor Schwan noted
that if the hour is changed to 7 or 7 : 30 p . m . and a meeting runs
for three hours , it makes for a late finish , and , as noted by
Councilman Powers on several occasions , diminished mental effec -
tivenesse Councilman Desch suggested a cut ° off time could be
established and then the meeting could be adjourned . 'Mrs . Raffens -
perger suggested that the more public part of the meeting might
start at 7 : 30 p . m . Councilman Powers said that media people who
attend many town meetings apart from Town of Ithaca meetings have
said that the Town of Ithaca seems to have better attendance at .
its 5000 p . m . meetings than the 7330 p . m . meetings elsewhere . He
said the best attendance is the only criteria for selecting a
meeting time .

TOWN BOARD MINUTES - 3 - December 3, 1 , 1975
MZrs . Raffensperger suggested , since a number of people
have expressed great distress over the . 5a00 p . mo time because it
comes at dinner time , that the Board might try 7 .oW or 7 .o30 P . M .
for several months as an experiment . . Councilman Del Rosso agreed ,
except that for the time being 5 : 00 p . m . should remain the formal
time . It was finally agreed to retain 5 ° 00 p . m . as the formal
time , and experiment with 7o. 00 or 7030 p . m . for three or four
months beginning in March .
HIGHWAY PAY SCALE , FOR 1976
Motion by Supervisor Schwan , seconded by Councilman Powers ,
RESOLVED , that . the Town Board of the Town of Ithaca hereby
establishes for the year 1976 an upper limit of $ 5 . 55 per hour
for Highway Department employees .
Unanimously carried .
AUDITS OF RECORDS OF TOWN OFFICIALS
The Town Board reviewed the accounts and records of
the two Town Justices , the Town. ;. Building Inspector , and the
Town Clerk .
Motion by Councilman Desch , seconded. by Supervisor Schwan ,
RESOLVED , that the Town Shard , having reviewed the accounts and
records of the two Town Justices , the Town Building Inspector ,
and the Town Clerk , hereby approves the same , copies of said
accounts and records being attached hereto and made a part of
these minutes .
Unanimously carried .
APPOINTMENT TO LOCAL BOARD OF ASSESSMENT REVIEW
Motion by Supervisor Schwan , seconded by Councilman Desch ,
RESOLVED , that Councilman Powers be appointed to the Local Board
of Assessment Review , the said appointment to include the entire
Board should the volume of inquiry require it .
Unanimously carried .
APPLICATION FOR STATE AID FOR YOUTH - 1976
Motion by Councilman Desch , seconded by Councilman Powers ,
RESOLVED , that the Supervisor be authorized to execute Applica -
tion to New York State Division for Youth for reimbursable State
Aid for recreation and youth development programs for the calen®
dar year 197.6 .
Unanimously carried .
ATTORNEY FEES - 1975
Motion by Councilman Desch , seconded by Councilman Powers ,
RESOLVED , that the Attorney fees of Buyoucos & Barney „ for the
year 1975 as itemized and presented be approved , in the amount
of $ 15 , 860 . 13 .
Unanimously carried .
Councilman Powers recommended that the itemized list
ought to be studied in a work session so that the items might
be categorized and evaluated , and the dollar amount be computed
as a percentage of the total tax levy , For . Barney agreed that
it would be advisable to do that . Councilman Desch recommended
that the Town Attorney furnish quarterly billings in the future .
TOWN BOARD MINUTES - 4 - December 31 , 1975
Mr . Barney felt the work session would be more useful than the
quarterly billings . Nevertheless , it was the sense of the Board
that quarterly billings ought to be submitted .
Motion by Councilman Desch ; seconded by Councilman Del 'Rosso ,
RESOLVED , that the Town Attorney is hereby required to submit an
itemized invoice for services rendered , such invoice to be sub-
mitted on a quarterly basis .
Unanimously carried .
ELECTRO RUST - PROOFING SERVICES CONTRACT
Supervisor Schwan noted a letter from Wallace & Tiernan
Division , Pennwalt Corporation , advising that the Town ' s Electro
Rust-Proofing contract would expire on December 31 , 1975 , and
requesting that the Town indicate acceptance of the new contract
proposal . The new contract amount is $ 268 . 00 .
Motion by Supervisor Schwan , seconded by Councilman Desch ,
RESOLVED , that that Town of Ithaca accept the new Wallace & Tier -
nan Division , Pennwalt Corporation , contract proposal for Electro -
Rust -Proofing services for the 500 , 000 gallong reservoir ( System
No . 3153 ) in the amount of $ 268 . 00 , and that the Supervisor be
authorized to execute said contract .
Unanimously carried .
RESIGNATION FROM YOUTH BUREAU
Supervisor Schwan reported he had a letter from Mr . Herbert
A . Mahr that he would be on a sabbatical leave for a period of
eight months and that the Board might wish to consider a replace -
ment or that he would continue to serve on his return to Ithaca .
The Board felt that since Mr . Mahr would be gone for as long as
eight months a replacement should be found . Councilman Powers
indicated that Mr . Robert Julian , 203 Salem Drive , had ,; expressed
an interest serving on the Youth Bureau Board . Supervisor Schwan
said he would write to Mr . Mahr and accept his resignation and
that the Board would be glad to receive suggestions as to who ,
in addition to rlr . Julian , might be interested in serving on the
Youth Bureau Board , and that a selection would be made ' at a later
date .
TOWN AUDIT FOR 1975
Motion by Councilman Desch , seconded by Supervisor Schwan ,
RESOLVED , that a Certified Public Accountant be hired to prepare
an audit of the Town ' s financial records for the year 1975 .
Unanimously carried .
ENVIRONMENTAL QUALITY REVIEW (Article 8 )
{ Supervisor Schwan reported that a letter from Louis J .
oil Lefkowitz , Attorney General , State of New York , had been received
advising that the State Legislature at the past Session had enac -
ted Article 8 of the Environment Conservation Law , which requires
every agency of state and local government to consider the environ -
mental impact of its decisions and to prepare environmental impact
statements for any decisions which may have a significant effect
upon the environment . This includes the issuance of any license
or permit , or the construction of any building , road or other
facility , which may have such an effect . A copy of the act was
enclosed with the letter . Lawrence P . Fabbroni , Town Engineer ,
drafted a letter expressing his sentiments with regard ' to Article
8 recently enacted . Although the Board as a whole was not in
total agreement with the sentiments expressed in Mr . Fabbroni ' s

letter , they were in complete agreement with the general thrust
of his letter that Article 8 would be counter - productive to the
Town and the State in the short and long term . ( Air . Fabbroni ' s
letter is attached to and made a part of these minutese� ) The
Board felt 14r . Fabbroni ' s letter ought to be forwarder? 'ito the
Department of Environmental Conservation , together with a resolu -
tion recommending the repeal of Pzticle 8 of the Environment Con-
servation Law . k
Motion by Councilman Desch ; seconded by Councilman Powers ,
RESOLVED , that the Town Board of the Town of Ithaca recommends
the repeal of the State Environmental Quality Review Act ( Article
8 of the Environment Conservation Law . )
FURTHER RESOLVED , that the Town Board endorses the sentiments
expressed by Lawrence P . Fabbroni , Town Engineer of the Town of
Ithaca , in his letter of December 31 , 1975 , addressed to Terence
P . Curran , Director , Office of Environmental Analysis , ' Department
of Environmental Conservation , Albany , New York .

TOWN OF ITHACA WARRANTS
Motion by Councilman Deschl seconded by Councilman Del ' Rosso ,
RESOLVED , that the Town of Ithaca warrants dated December 31 , 1975 ,
in the following amounts , be approved

REPORTS OF TOWN OFFICIALS
Barbara Holcomb , Planning Board Chairwoman , reported on
1975 activities of the Planning Board as follows °
The Planning Board approved two subdivisions : (111111 ) Rocco
Lucente ' s subdivision on Pinewood Place and Sycamore Drive , and
( 2 ) Otto Be Schoenbeld ' s subdivision on lands north of Burleigh
Drive ( Williamsburg Park Subdivision ) , Lexington Drive . !
The Planning Board approved the site plan for two new
churches - - Jehovah Witnesses and the Seventh Day Adven!'tists .
It recommended to the Town Board approval of Ridley ' s Graphic
Arts Building on Ellis Hollow Road .
The Planning Board has dealt with preliminary approvals
of sign applications . The Planning Board has also recommended
amendments to the Sign Ordinance ( in February ) , which amendments
are still pending . They have recommended , based on rec",ent dis -
cussions of signs , that the whole Sign Ordinance needsto be
reconsidered . The Planning Board has this on its agenda.
A Park Policy has been developed and adopted byl'I' the Town
Board . The Summer Planning Intern , Miss Sue Blumenthal" , prepared
a Park and Open Space Plan which has been received by the Planning
Board and the Town Board which should be the basis for l,action in
the future .
A Bikeway Study has been done for the joint use' of the
Town of Ithaca and the City of Ithaca . The Village of Cayuga
Heights cooperated in this study . The study was supplemented
by the activity of the Circle Greenway group which involves some
of the same areas as the Bikeway Study and both should be studied
together .
TOWN BOARD MINUTES - 6 - December 31 , 1975
Mrs . Holcomb referred to the new law on Land Mining
Operations which seems to cover all the problems which were
foreseen in the gravel pit operation and the Planning Board
had contemplated adopting these regulations as a portion of
the Town ' s regulations for that sort of activity in the Town .
However , in spite of the law being on the books , there is no
money to fund it , and none of the regulations are being carried
out because there is minimal personnel at the State level to do
so . Mrs . Holcomb recommended , therefore , that the Town should
adopt its own land mining ordinance with its own enforcement
policy .
A traffic study was done in the Northeast . Lengthy
discussions were held with respect to opening Sandra Place or
allowing it to remain closed . The Planning Board recommended
opening Sandra Place but the Town Board rejected that recommen -
dation .
The Planning Board held discussions regarding the estab-
lishment of a walkway from Ellis Hollow Road Elderly Housing
Project to the East Hill Plaza shopping center . They proposed
a reasonable plan for a walkway , but it proved to be illegal to
act upon the plan , according to an opinion rendered by the Con -
troller General of the State of New York .
A great deal of time and effort was spent on the Mitchell
Street problem - - stop signs and a walkway for the children to
and from Belle Sherman School . A plan was agreed upon and stop
signs were put up . However , the County ordered the signs removed
on the basis of the State Department of Transportation ' s interpre -
tation of the Uniform Traffic Code which says it is illegal to put
the signs where they were placed ( not at an intersection ) . It
appears it is also illegal to put a walkway in for the children .
This means the children must come down either side of the road
or cross where there are no signs . Therefore , at this point there
was brief discussion with regard to hiring a crossing guard . It
was agreed to have further discussions at the January board meet -
ing about a crossing guard and the legal problems which have aris -
en .
Three other items came up during the year which are still
unresolved :
( 1 ) Subdivision of Eddy Hill land on Mecklenburg Road
and Plest Haven Road , which is now " in limbo . "
( 2 ) Stephen Shippos application to the Planning Board
for re - zoning . Mrs Shippos has not followed up on this .
( 3 ) Eastern Heights Park , five acres , still to be worked
out with Attorneys Thaler & Thaler .
Regarding the Eastern Heights Park , Supervisor Schwan
said the Town is entitled to the park as a condition of the sub-
division .
Mrs . Holcomb recommended that the Town Board members
attend a Planning Board meeting which will be held at the Tompkins
County Hospital on January 6 , 1976 at 7 : 30 p . m . to discuss the
plan for the Tompkins County Hospital ,
Mrs . Holcomb brought to the attention of the Board a
resolution adopted by the County establishing a Greater Ithaca
Area Governmental Relations Study Committee . She read the reso -
lution in full . The. Committee is composed of 13 people : The
intent is that local units of government will advise this Committee
what subjects or projects they would like to have studied . Then
graduate students and staff of four Cornell University departments
will do some of the work that needs to be done , large and small
projects which seem to require some sort of cooperation or

interaction between the various levels of government . " Council -
man Desch asked if the Committee is expecting in-put from the
Town or is the Town to expect information from them . Mrs .
Holcomb said the Committee itself is empowered to investigate
problems which they recognize as important , but that it is an
open - ended Committee which is broadly based . The Committee
Ott! could look into such things as the Ceracche TV .franchise , the
Octopus problem , and other problems which may be bogged down
for lack of time or expertise . Mrs . Holcomb said the advantage
of such a Committee is that .there is available a resource group
to draw upon in four disciplines ( four Cornell University depart °
ments ) ; that manpower is available on a very economic basis .
Councilman Desch said he would like to have a copy of their
charter and the resolution .

prepared written report was distributed to the members of the
Board for their consideration . ( This report is appended to
these minutes ) .

AND .PVTLDING INSPECTOR - 1975
( A ) MUNICIPAL6PROJECTSt STATUS
( 1 ) Completed :
a . Federal Flood Insurance Program . Town entered
program , made necessary amendments "to Zoning
Ordinance ; maps are being updated by HUD .
b . Bolton Point , Towns completed construction
road to lakeside January 31 to meet February 1
construction deadline . Site clearing for water
treatment plant and appurtenances was completed
in March . Intermittent contractor demands for
fill , grooming of slopes and ditches have been
- fulfilled and accomplished through summer and
fall .
c . Bus Service - Ellis Hollow . . City , ,Town , Groff
Associates and Office for the Aging collaborated
to supply transportation on a limited experimental
basis to East Ithaca , primarily Ellis Hollow Apart -
ments and Ithacare , Expenses in terms of deficits
have increased over the eight month 's , leaving all
parties concerned convinced people- . would-._be --better
and_=more efficiently- served by -- demand�respons=ire
type- -system like - a- taxi .= After _-expiration Hof :-City-- ._ = °Offe Agnsbus . run ; = ig in itating a

a -ride_ system run by . - volunteers with vehicles
rented - from =Red Cross , G . I . A . C , . -Youth Bureau - and - EOC ,
d . Campbell Avenue , Was completed with oil and
stone, and landscaped .
e . Williams Glen Road . Was designed , . constructed
and completed with oil and stone this fall . This
project was done by the Town for both City and .
Town portions . Agreements were reached with the
City whereby all Town costs were reimbursed .
f . Water line on the second ( South ) Forest Home
bridge was re - wrapped .
y g . Approaches to the second ( South ) Forest Home
bridge were reconstructed in cooperation with
County upgrading of bridge construction .
h . Drainage . Northeast . After several severe storms
and flooding -in Brandywine area , it was found that
culverts along Brandywine were not 'sufficient in
view of intense peaked run-off aggravated by BOCES
new on - site storm sewers . A dam was built at the
culvert under Warren Road with County permission ,
which will retain approximately 50 , 000 gallons
during peak run -off . Also proper sized culverts
were installed under draveways along Brandywine .
i . Parks . Park Policy was adopted , Town -Wide
Comprehensive Open Space and Recreation Plan
was written by Sue Blumenthal and adopted as
working document . A capital reserve fund of
$ 130 , 000 has been established for implementation .

j . Transit Studies . A transit study was done
of East . Ithaca by the East Ithaca Civic
Association . Town has summarized this data
and we hope - to - expand study to consider the
entire Town needs .
k . Sewer Projects . March work has gone on
to change completed design plans to make
them compatible with topographic or foliage
features . About half of easements are in
hand .
1 . Kennilworth . Planting Strip . Curb was in -
stalled , damaged plants replaced at cost ,
one tree replaced at no cost , and remainder
of escrow returned to managers of East Hill
Plaza .
m . Bikeway Study . A City -Town bikeway report
was prepared by the Landscape Architecture
class at Cornell University .
no Northeast Traffic Study . The traffic of
the northeast area was studied . Summaries
were presented to both boards with a more
thorough-- .report still-to come .__
