APPROVAL OF MINUTES
Motion by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that the minutes of the meetings of February 3 , 101
March 10 and March 17 , 1975 be approved as presented .
Unanimously carried .
ACCEPTANCE OF BLACKST014E AVE : AS A TOWN ROAD
Mr . Fabbroni reported that Blackstone Avenue is not com-
pleted as yet to Town specifications , but recommended its accept-
ance based on the conditions outlined in the following resolution .
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,
RESOLVED , that this Town Board hereby accepts Blackstone Avenue
as a Town road subject to the following conditions : ( 1 ) that the
acceptance date is to be the date the road is completed to the `
satisfaction of the Town Engineer and Town Highway Superintendent ;
( 2 ) installation of remaining utilities ; ( 3 ) receipt %of a retainer
as security for the completion of the work and ( 4 ) acceptance of
the deed by the Town Attorney .
Unanimously carried .
REZONING OF SHIPPOS LANDS - SCHEDULE PUBLIC HEARING
Airs . Holcomb reported that the Planning Board held a pub -
lic hearing on May 20 , 1975 to consider a request by Stephen J .
and Marion Shippos to rezone lands at 611 Five Mile Drive ( Parcel
No . 6 - 31 - 2 - 2 ) from Light Industrial to Residential . The Planning
Board by resolution dated May 20 , 1975 recommended to the Town
Board that the lands of Mr . Stephen J . Shippos west of the flood
control channel , but not including the 300 foot strip along Five

Mile Drive presently zoned R- 9 , and being a portion of Tax Parcel
Noe 6 - 31 - 2 - 2 , '' be rezoned from Light Industrial to R- 15 Residential .

RESOLVED , that this Town Board hereby schedules a public hearing
to be °° held on11July7 , 1975 at 6 : 00 p . m . at the Town Offices to

DOG CONTROL ORDINANCE ( PROPOSED )
Supervisorl, Schwan reported that there , had been no in -put
from the citiz'enry '' on this matter since the earlier meetings .
Supervisor Schwan recommended that a public hearing be scheduled
and that in addition to the re '
uired legal notice the Town insert
a box „ad in the Ithaca Journal calling attention to this hearing .
Motion by Supervisor Schwano seconded by Councilman Desch ,
RESOLVED , that, this Town Board hereby schedules a public hearing
which will be held ' on July . 7 , 1975 at 6 : 15 p . m . at the Town Offices
to consider a Dog Control Ordinance for the Town of Ythaca and to
hear all persons for or against such an ordinance .

APPOINTMENT OFD,, DEPUTY TOWN CLERK
j Motion', by Supervisor Schwano seconded by Councilman Powers ,
RESOLVED , that , Gerirude H . Bergen , 127 Pine Tree Road , is hereby
appointed Deputy Town Clerk of the Town of Ithaca , to assist with
the issuance of dog licenses and hunting and fishing licenses ,
and with other ' cler" ical duties .
Unanimously carried .
PURCHASE OF AUTOMOBILE FOR HIGHWAY SUPERINTENDENT
Proof of posting and publication of advertisement for bids
on automobile for Town Highway Superintendent ' s use on official
Town business having been presented , the Town Supervisor reported
that one bid had been received from William T . Pritchard , Inc .
( Dodge ) on a 1975 Dodge Coronet 4 =door sedan for use with regular
gasoline , at a cost of $ 3 , 732 . 46 . ( List price $ 4 , 428 . 04 , less
$ 695 . 58 trade- in allowance on 1968 Ford ) .
Motion ; by Supervisor Schwan ; seconded by Councilman Desch ,
RESOLVED , that ',, this Town Board hereby accepts the bid of William
To Pritchard , Inc . ',':: ( Dodge ) for a 1975 Dodge Coronet 4 -door sedan
for use with regular gasoline , in the amount of $ 3 , 732 . 46 , same
to be used by the Town Highway Superintendent on official Town
business

SALARY - HIGHWAY SUPERINTENDENT
Supervisor Zchwan reported that the Town Board has before
it consideration of an increase in the Town Highway Superintendent ' s
salary , in the amount of $ 1 , 000 . 00 . The Town Attorney indicated
this may be done provided the position is an appointive one and
that there arelfund''s available , the authority for this being
Section 27 , subdivision l , . of the Town Law , Supervisor Schwan

said the Highway Superintendent is appointed and the money is
available in the contingent fund and Town-Wide General Fund # that
it is available in the Town -Wide budget .
Motion by Supervisor Schwan # seconded by Councilman Powers ,
RESOLVED , that this Town Board hereby increases the salary of the
Highway Superintendent from $ 11 , 100 . 00 to $ 12 , 100 . 00 effective
June 1 , 1975 , Ithe Town Board having made the determination that
there are sufficient funds available for this purpose .
Unanimously carried .
PARK POLICY
Mrs . Holcomb reported that no further changes had been
recommended for the Park Policy which was presented to the Town
Board for its consideration in March and which was reviewed at
a working session last week , at which time a suggestion was made
to stipulate. that trees and shrubbery shall remain " as determined
by the Planning Board . " Mrs . Holcomb noted again that this is a
policy - - not a plan . It is a policy on which a plan will be
built
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,
RESOLVED , that this Town Board _ accepts the Park Policy for the
Town of Ithaca; as prepared by the Planning Board , with the under -
standing that ;it is a policy ( not a plan ) , a policy on which a
plan will be built ` (which policy shall be made a part of these
minutes . )
Unanimously carried .
The statement of policy ( Park and Open Space ) follows .
A . The Town o'f Ithaca recognizes the need for and encourages the
development of ; parks and open space .
1 . The Town shall strive to preserve unique natural features
and resources .
20 The Town recognizes the value of open space as well as
developed recreational areas .
3u ! Town makes a firm commitment to reserve and acquire
11 open space ' for future recreational use .
B . The Town accepts the fact that a firm financial commitment is
necessary to the development of parks and open spaces in the
Town and recognizes the possibility of utilizing State and
Federal funds for this purpose .
C . The Town intends to require from every subdivision developer

the - setting aside of up to 10 % of the land to be developed
within a subdivision for parks , or money , in lieu of land , at
fair market value , to provide open space areas in each popula -
tion center ( Town Law , Sec . 277 ) .
Money given by developers in lieu of land will be placed
in a general fund to be used for acquisition of land , equip-
ment , or maintenance of parks in that neighborhood in which
the development stands ( see Town Law , Seca 277 ) .

b . To serve residents up to one -half mile of the site .

e . The Planning Board shall recommend acceptance or

( ii ) Provide parking areas as needed .

4 . Undeveloped Open Space
a . May be designed to preserve wooded areas , to pro-
vide a buffer area , to preserve an area of particu-
lar natural beauty , etc .
b . Site shall be discretionary with the Planning Board .

c . Planning Board shall recommend acceptance or pur-
chase, to the Town Board ,
E . Recognizing that the need for funding for park acquisition
and maintenance will vary from year to year , and , recogniz -
ing that the need by individual ; parks for . equipment .and
facility maintenance will vary from year to year , the follow-

ing procedure for budgeting and allocating Town monies for
park purposes 'is established .

budget for the . Town , the Planning Board shall receive

purposes in the . next fiscal year and shall submit
to the Town Board a list of proposed acquisitions ,
improvements ; repairs , etc . , in order of priority .
301, The Town Board s designate in the Preliminary
Budget the amount to be expended in the coming fiscal
year for park purposes .
4 ; The Planning Board and the Town Board shall seek to
11 acquire any available State and Federal funds for park
purposes .
LIGHTS FOR ELLIS HOLLOW ROAD APARTMENTS
ij
Supervisor Schwan read a letter dated May 15 , 1975 from
Mr . Maurice Ae Dusky , Agent for Groff Associates , requesting that
the Town install two pole lights at the entrance and exit of
Ellis , Hollow Road Apartments . It is the policy of the Town of
Ithaca to light intersections of accepted Town roads . The Ellis
Hollow Road Apartments situations does not fit into this category ,
The New York State Electric & Gas Corporation has had a policy of
not c '' ntracting with private individuals . It was suggested , how-
ever , that the New York State Electric & Gas Corporation be con -
tacted to determine if Groff Associates can have these lights in -
stalled privately .

Motion by Councilman McElwee ; seconded by Supervisor Schwan ,
RESOLVED , that the New York State Electric & Gas Corporation be
contacted to determine whether a private arrangement can be made
between Groff ' Associates and the New York State Electric & Gas ,
Corporation for the installation of pole lights at the entrance
and exit of the Ellis Hollow Road Apartments ; and if such an
arrangement is possible , recommend it to Groff Associates .

REPORTS OF TOWN OFFICIALS
Mr . Fabbroni reported he is engaged now primarily in pre -
paring for the Town -wide sewer project , checking ; out ' some engineer -
ing problems and trying to work out the force main agreement with
Masciarelli Construction Co . so that the force main can be installed
in conjunction with the Bolton Point project . A , target date for
bidding the project depends on receiving maps from the engineers
( Lozier Engineers , „ Inc ) which are expected by June 16 , 1975 . Mr .
E . L *Trowbridge will be working on acquiring the necessary ease -
ments
Mr . Fabbroni reported that he is attempting to get from
the surveyor a finished deed for Williams Glen Road . An agreement
will b'ie reached soon with the City of Ithaca to do the work on the
portion of Williams Glen Road which is within the City of Ithaca .
Mr . Fabbroni reported that he is preparing an " as built ”
for th°e Coddington , Road water extension .
Mr . Reynolds Metz ,. Assistant Building Inspector , reported
16 building permits issued = - 10 family and 6 single , for $ 262 , 000 .
Last year it was 8 permits for $ 126 , 0000 It appears the Town of
Ithacay' is in good economic shape in this respect .
Mrs . Barbara Holcomb , Planning Board Chairwoman , reported
it had been pointed out to her that there is an acoustical problem

n thellBoard room . ! People cannot hear clearly what is said at the
Board ',table . The Board will look into this ,
Mrs . Holcomb reported that the County has developed a
series of 35 maps for the entire County , showing such things as
drainage , soil conditions , slopes , etc . The Planning Board recom-
mendedl; buying a set of these maps , using Planning Board funds . The
maps are $ 140 each .
Mrs . Holcomb reported that the Planning Board has given
conditional final approval for a subdivision north of Burleigh
Drive for Otto Schoenfeld ( part of the Williamsburg Park subdivi -
sion. ) . I
Mrs . Holcomb reported conditional final approval was given
to Mr . '' Walter Wiggins for a cluster housing development of his barn
at 1152 Danby Road , approving three apartments rather than four .
Mrs . Holcomb recalled that back in November the Planning
Board "advised the Town Board that they would make a recommendation
beforeY, the first of July on the opening or closing of Sandra Place .
Pars . Holcomb requested a delay in the recommendation until October
1 because Mr . Fabbroni agreed to do a traffic study for the North-
east and the Planning Board would like to have that in hand before
a meeting with '' the '' Northeast Civic Association . The Board granted
the delay in recommendation .
Town ; Board Minutes Now 8 - June 9 , 1975
Mrs . Holcomb reported that site plan approval was granted
to Jehovah Witnesses Church at the corner of Compton Road and Danby
Road .
Mrs . Holcomb reported that two
p public hearings are sched -
uled for June 17 , 19750* ( 1 ) consideration of the site plan for a
Church and School for the Church of the Seventh Day Adventists on
. their property at 1217 - 19 Trumansburg Road ( Parcel No . 6 - 26 - 4 - 42 ) ,
and ( 2 ) consideration of preliminary subdivision plan for the Eddy
Hill Farm ( formerly the Marshall Farm ) on Mecklenburg Road , ( Parcel
No . 6 - 28 - 1 - 26 . 2 ) .
Mr . Robert Parkin , Highway Superintendent , presented for
signing by the Town Board members the " Agreement to Spend Town
Highway funds " in the amount of $ 50 , 175 . 00 for general repairs of
35 : 50 miles of town highways . ( The signed agreement is made a
part of these minutes . ) 14re Parkin reported that in 19,74 there
were 35 . 97 miles of Town roads . The addition of Harwick Road ,
Happy " Lane , Strawberry Hill Road , and Wildflower Drive bring the
total for 1975 to 36 . 27 miles .
ROOF 11
REPAIRS - TOWN OFFICES
Supervisor Schwan reported that three estimates had been
received for repair of the roof of the Town Offices building at
126 E ., Seneca , Street . The low bid was received from Wissing Const .
& Bldg . Services Corp . in an amount not to exceed $ 11075 . He noted
also that Norman R . Jordan , President of Wissing , recommended the
replacement of all gutters and downspouts ( installation of baked
on aluminum seamless gutters and downspouts ) in the amount of
$ ° 83 . 30 .
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,
RESOLVED , that this Board hereby accepts the bid of Wissing Const .
& Bldg . Services Corp . to remove the vine from the Town Offices
building and to repair the roof of the building for a sum not to
exceed $ 1 , 075 ,1'1 and further , to accept the recommendation to replace '
all gutters and downspouts for $ 583 . 30 .

COGGSHALL EASEMENT
Motion by Councilman Powers ; seconded by Councilman McElwee ,
RESOLVED , that this Board does hereby authorize the commencement
of an ' action to condemn an easement or other interests in land for
purposes of a water transmission main for the Southern Cayuga Lake
lntermunicipai Water Project , across lands of Archie L . and Vera C .
Coggshall in the Town of Ithaca , northerly of Slaterville Road , as
shown ° on the map made by Thomas G . Miller and Lozier Engineers , Inc .
dated August 26 , 1974 ; and further authorizes the commencement of
an action for the same purposes across lands of Jere D . and Sharon
F . Haas ; giving full power to the Southern Cayuga Lake Intermuni -
cipall, Water Commission and their Counsel to take whatever steps
may be required in order to effectuate the foregoing .
The Town Board of the Town of Ithaca further ratifies an y
and all offers and negotiations heretofore made by the Southern
Cayuga Lake Intermunicipal Water Commission or its Counsel in order
to acquire said easements or any other interests in said lands .

REVENUE SHARING - PLANNED USE REPORT
Supervisor Schwan noted it was necessary to adopt a reso -
lution of intent regarding use of revenue sharing funds for the
period July 1 , .. 1975 through June 30 , 1916 ; $ 20 , 750 . 00 to be allot-
ted to the new Town Hall and $ 64 , 524 : 00 for the Highway Barns and
Highway equipment , - for a total of $ 85 . 274 . 00 . -
Motion by Councilman Desch ; seconded by Supervisor Schwan ,
RESOLVED , that this Town Board hereby signifies its intent to use
revenue sharing , funds ( in accordance with Planned Use Report No . 6
of the Office of Revenue Sharing , Washington , D . Ce ) , in the amount
of $ 85 , 274 . 00 for the entitlement period July 1 , 1975 through June
30 , 1976 as follows o $ 20 , 750 .. 00 for the new Town Hall and $ 64 , 524 . 00
. for the Town Highway Barns and equipment .
Unanimously carried .

REPORT, OF COUNTY REPRESENTATIVE
Mrs . Beverly Livesay reported that the County Board of
Representatives had approved the location of the hospital addition .
She said it will actually be built free standing , it will not con -
nect to any existing structure . Mrs . Livesay asked if the Town
Board wanted to see the plans . Mr . Fabbroni said only the site
plan in , relation to the proposed Corridor . Mrs . Livesay said it
standi clear of either of the proposed highway corridors and the
access is good from both : Supervisor Schwan said Mr . Fabbroni
should' look into where it is to be located in relation to the sewer
line . Mrs . Livesay said it is above and behind the Nurses Residence ,
Mrso Livesay reported that the Intergovernmental Relations
Committee of the Board of Representatives is considering adopting
a resolution on a study of intergovernmental cooperation or con -
solidation . She said this has been " in the wind " much longer than
the suggestion, that sewer service should be made intermunicipal
rather than County-wide , but that it would address itself to that
matter at the same timer that is , where is it better to be inter-
municipal and where is it better to go County-wide , etc . ? Mrs .
Livesay said she would send. a copy of the proposed resolution to
the Town Board for its information , in -put , and comment .

Mrs . Livesay reported that a meeting of the Ad Hoc Youth
and Recreational Services Committee had been held on May 28 , 1975 ,
and that material gathered by the Technical Advisory Committee was
distributed to the members to take back to their Boards for veri -
fication of what is being done in this field . If it is not a cor -
rect picture it can be corrected . The material also includes in
Appendix " A "" four questions which the Committee hopes will produce
input from the Boards who appointed the Committee members . The
four questions are ; ( 1 ) What needs exist in the County for youth
programs ? ( 2 ) what needs exist in the County in the area of recrea-
tion progrzLmming ? ( 3 ) what needs exist in the County for recreation
and youth facilities ? , and ( 4 ) in what ways can these needs be met ?
Mrs . Livesay inquired about the FBC sign and what action
the Town intends to take . Supervisor Schwan said that the Board
felt the blank panels are part of the structure of the building .
Mrs . Livesay noted that the panels were put up after the building
was completed . Mro Buyoucos said that does not mean . they are not
a part, of the structure , in law . Mrs . Livesay said the obvious

reason for the panels being there was for the sign ; they were not
there for architectural beauty . She said they ought to be removed .
Councilman Desch said the sign structure is , in fact , attached to
the building . ' Supervisor Schwan said in that case they ought to
be removed . Mr . Desch agreed saying he had changed his opinion .
based on- the fact that the panels are not a part of the structure .
Councilman McElwee said he was not convinced the panels were not
a part of the structure . Councilman Desch stated emphatically that
the panels are not a part of the structure .
Motion - by Councilman Desch ; seconded by Supervisor Schwan ,
RESOLVED , that, this Town Board finds that the panels which formerly
carried the letters FBC are not a part of the building structure ,
that the panels are illegal ( non -conforming ) o that the Town Engineer ,
therefore , is authorized to arrange for the removal of the said
panels and is further authorized to take any and all steps necessary
to notify the owners eof the :panes as - to rahen : the -- panels .must be
remov 'e'd .
Carried .
( Councilman McElwee abstained from the vote . )
Mrs . Livesay inquired about the status of the Eastern
Heights Park . Firs . Holcomb said this is now an Eastern- Heights
responsibility since Mr . William Stein of Stein Builders , Inc . of
Endicott no longer has an interest in the proposed park portion of
Eastern Heights . Mrs . Holcomb has been having difficulty arranging
a meeting with Attorney Thaler , but will write him another letter
to arrange a meeting to settle the matters
APPROVAL OF TOWN OF ITHACA T47ARRANTS
In the course of reviewing the warrants , Councilman Desch
said the matter of employee parking for the Town Offices had to be
resolved , to find the most inexpensive parking arrangements .
Motion by Councilman Descho seconded by Councilman Powers ,
RESOLVED , that the warrants dated June 9 , 1975 be approved as pre -
sented , in the following amounts

APPROVAL OF BOLTON POINT WARRANTS

Motion by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that the Bolton Point warrants , having been reviewed and
recommended for payment by the Southern Cayuga Lake Intermunicipal
Water ' Commission , are , after review by the Ithaca Town Board , here -
by approved for payment in the amount of $ 199 , 273 . 22 .
ADJOURNMENT Unanimously carried .
The meeting was adjourned at 6x15 p . m . to June 23 , 1975 .
