PRESENT : Supervisor Mary Oltz Councilpersons : Mary Lou Hardesty, Edward Inman, Joseph Schwartz (arrived at 6 : 15 ) ABSENT : Councilperson Howard Steiner (excused) Others Present : Carol W . Supervisor Mary Oltz called the meeting to order at 6 : 05 P . M and reported that this is the year-end meeting of the Board scheduled to pay the end of the year bills and resolutions relating to the 1997 business transactions . RESOLUTION NO 82 of 1997 SALARY ADJUSTMENTS FOR 1998 BUDGET By Councilperson Hardesty: Seconded by Supervisor Oltz WHEREAS, it was the intention of the Town Board to increase salaries of the Town Justice , Court Clerk, Town Bookkeeper and the Deputy Town Clerk by (3 %) three percent for budget year 1998 , and WHEREAS, no motion was made to that effect at the time the budget was adopted and the increase for these positions was not shown as a part of the adopted budget, now be it RESOLVED, that the salaries be increased as follows : A1110 . 100 Town Justice P . S . from $ 8 , 522 . 00 to $ 8 , 820 . 00 A1110 . 110 Court Clerk P . S . from $ 3 , 070 . 00 to $ 3 , 162 . 00 A1220 . 110 Bookkeeper P . S . from $ 7 ,426 . 00 to $ 7 , 649 . 00 A1410 . 110 Deputy Town Clerk from $2 ,273 . 00 to $2 , 341 . 00 Total $ 21 ,291 . 00 to $21 , 972 . 00 the total increase in thee 1998 budget by making these changes will be $681 . 00 (Six hundred eighty- one dollars) , and be it further RESOLVED , that $ 681 . 00 (six hundred eighty one dollars) be taken from the Year-end Fund Balance and added to the above accounts . A roll call vote on the resolution resulted as follows : Hardesty Aye Inman Aye Oltz Aye (Councilperson Schwartz absent) Carried Unanimously 2 Town Board Minutes Year End Meeting December 29, 1997 RESOLUTION NO. 83 of 1997 SALARY INCREASE OF 3 % FOR OFFICE ASSISTANT TO THE CODE ENFORCEMENT OFFICER FOR 1998 By Councilperson Hardesty : Seconded by Councilperson Oltz WHEREAS, it was the intention of the Town Board to increase the salary of the Office Assistant to the Code Enforcement Officer by (3 %) three percent for budget year 1998 , and WHEREAS, line item A8010 . 13 , Office Assistant to the Code Enforcement Officer already shows more than a (3 %) three percent increase to accommodate an additional salary increase if a new job title for this position is approved, now be it RESOLVED, upon approved job title change the additional salary increase shall be determined by the Town Board of the Town of Danby with the recommendation that the Town Board review Resolution No . 50 of 1992 and Resolution No . 27 of 1997 and any other pertinent information necessary. A roll call vote on the resolution resulted as follows : Hardesty Aye Inman Aye Oltz Aye (Councilperson Schwartz absent) Carried Unanimously RESOLUTION NO. 84 of 1997 BONUS FOR TOWN JUSTICE HERSON By Supervisor Oltz : Seconded by Councilperson Inman 1 WHEREAS , the Town of Danby normally has two (2) Town Justices that handle court cases . Justice Lyndon Bennett resigned midyear due to ill health . A replacement was not appointed to fill this vacancy leaving Justice James Herson to manage all of the court work alone, and WHEREAS, the Town Board, in recognition of the additional work done by Justice James Herson, has agreed to pay him the salary that was available to pay a second justice, now therefore be it RESOLVED , that a check be issued to Justice James Herson in the amount of $2 , 000 . 00 (two thousand dollars) . A roll call vote on the resolution resulted as follows : Hardesty Aye Inman Aye Oltz Aye (Councilperson Schwartz absent) Carried Unanimously , i RESOLUTION NO. 85 of 1997 ENCUMBER FUNDS TO PAY BILLS FOR 1997 NOT RECEIVED UNTIL 1998 AS WELL AS FUNDS DESIGNATED FOR A SPECIFIC PURPOSE NOT USED IN 1997 By Supervisor Oltz : Seconded by Hardesty WHEREAS, several bills for anticipated expenditures in 1997 have not been received and are expected to be received in 1998 as well as grants received for specific projects that have not been completed. Funds from the 1997 budget must be encumbered to pay these bills and complete these designated projects, and WHEREAS, the following is a list of bills and projects and the amounts to be encumbered : S 1 1 3 Town Board Minutes Year End Meeting December 29, 1997 Sharp Electronics Corporation - Copy Machine $4 , 505 . 00 Celebration Fund Award/Mapping Project $ 1 ,642 . 00 NYS Council on the Arts Grant - Historic Danby Survey $ 5 ,930 . 00 Bicentennial - Balance of Account $ 683 . 63 Senior Citizens - Balance of Account $ 535 . 00 T . Millers - Town Hall Phones $ 949 . 75 Total $ 14 ,245 . 38 now, therefore be it RESOLVED, that $ 14,245 . 38 be encumbered from the 1997 fund balance to pay 1997 bills and to complete 1997 projects . RESOLUTION NO 86 . Of 1997 APPROVAL FOR SURPLUS MONIES TO BE ADDED TO TOWN MACHINERY AND EQUIPMENT RESERVE FUND By Supervisor Oltz : Seconded by Councilperson Schwartz WHEREAS, a capital reserve fund was established by Resolution No . 56 of 1995 entitled "TOWN MACHINERY AND EQUIPMENT RESERVE FUND OF THE TOWN OF DANBY FOR PURCHASES OF FIFTY THOUSAND DOLLARS ($ 50 ,000 . 00) OR MORE" under Section 6c of the General Municipal Law, and WHEREAS, there are surplus monies now on hand and not otherwise appropriated for use in 1998 in the amount of Forty Thousand Dollars ($40 , 000 . 00) , now therefore be it RESOLVED , that these surplus monies be added to this capital reserve fund established by Resolution No . 56 of 1995 . A roll call vote on the resolution resulted as follows : Hardesty Aye Inman Aye Schwartz Aye Oltz Aye Carried Unanimously RESOLUTION NO . 87 of 1997 APPROVAL FOR SURPLUS MONIES TO BE ADDED TO TOWN BUILDING RESERVE FUND By Supervisor Oltz : Seconded by Councilperson Inman WHEREAS, a capital reserve fund was established by Resolution No . 57 of 1994 entitled "TOWN BUILDING CONSTRUCTION , REPAIR OF FACILITIES AND COMPLIANCE WITH AMERICANS WITH DISABILITIES ACT RESERVE FUND OF THE TOWN OF DANBY" under Section 6c of the General Municipal Law, and WHEREAS, there are surplus monies now on hand and not otherwise appropriated for use in 1998 in the amount of $ 800 . 00, now therefore be it 4 Town Board Minutes Year End Meeting December 29, 1997 RESOLVED, that these surplus monies be added to this capital reserve fund established by Resolution No . 57 of 1994 . A roll call vote on the resolution resulted as follows : Hardesty Aye Inman Aye Schwartz Aye Oltz Aye Carried Unanimously RESOLUTION NO. 88 of 1997 APPROVAL TO ENCUMBER 1997 FEMA FUNDS By Supervisor Oltz : Seconded by Councilperson Hardesty WHEREAS , the Town of Danby has received FEMA Funds in 1997 , and WHEREAS , $27 ,000 . 00 (Twenty-seven Thousand) dollars in FEMA funds for 1997have not been expended in 1997 , now be it RESOLVED, that the Town of Danby Town Board encumber $27 ,000 . 00 FEMA funds to be used by the Highway Department in 1998 to complete their FEMA projects . APPROVAL OF WARRANTS West Danby Water District Fund Warrant No . 13 of 1997 - Approved A motion was made by Councilperson Hardesty and seconded by Councilperson Schwartz to approve the West Danby Water District Fund Warrant No . 13 , of 1997 as reviewed and audited by the Town Board . A roll call vote on the motion resulted as follows : Hardesty Aye Inman Aye Schwartz Aye Oltz Aye Carried Unanimously Highway Fund Warrant No. 13 of 1997 - Approved A motion was made by Councilperson Schwartz and seconded by Councilperson Inman to approve the Highway Department Fund Warrant No . 13 of 1997 as reviewed and audited by the Town Board. A roll call vote on the motion resulted as follows : Hardesty Aye Inman Aye Schwartz Aye Oltz Aye Carried Unanimously . . 813 5 Town Board Minutes Year End Meeting December 29, 1997 General Fund Warrant No. 13 of 1997 - Approved A motion was made by Councilperson Schwartz and seconded by Councilperson Hardesty to approve the General fund Warrant No . 13 of 1997 as reviewed and audited by the Town Board . A roll call vote on the motion resulted as follows : Hardesty Aye Inman Aye Schwartz Aye Oltz Aye Carried Unanimously APPROVAL OF MINUTES : Councilperson Hardesty questioned on page 3 paragraph 3 of December 15 , 1997 - title for Office Assistant/Secretary to the Supervisor . The Town Clerk reported that is the approved official title for that position as established by the Town Board . Approval of the December 8 , 15, and 22 of 1997 Town Board Minutes A motion was made by Councilperson Schwartz and seconded by Councilperson Inman to approve the Town Board Minutes of December 8 , 15 and 22 of 1997 as published . A member of the public addressed the Board and reported that the Town of Danby should update their library reading room by purchasing additional books from the Tompkins County Library Annual Book Sale.
