HIGHWAY PAY SCALE FOR 19751 Motion by Supervisor Schwan ,o seconded by Councilman Del Rosso , RESOLVED , that the Town Board of the Town of Ithaca hereby establishes for the year 1975 an upper limit of $ 5 .. l per hour for Highway Depart- ment employees . Unanimously carried . AUDITS OF RECORDS OF TOC1N OFFICIALS The Town Board reviewed the accounts and records of the two ' Justices , the Town Clerk , and Town Building Inspectors . Motion by Supervisor Schwan ,e seconded by Councilman Powers , RESOLVED , that the Town Board , having reviewed the accounts and records of the two Town Justices , the Town Building Inspectors , and the Town Clerk , hereby approve the same . Unanimously carried . BEACON HILLS DEVELOPMENT -lotion by Councilman Desch , seconded by Councilman Powers , RESOLVED , that in view of the length of time which has elapsed since final approval of the Beacon Hills Project was granted , and in view .,of the fact that no progress on construction has taken place since January 1 , 1974 , and since the building permit for construction has expired , the Town Board authorizes the Supervisor to inform the owner , King Road Realty , of the Town ' s desire that they restore the site 1 ( Tax Parcel 44 - 14 . 31 ) to its original condition . Unanimously carried . APPOINTMENT TO LOCAL BOARD OF ASSESSMENT REVIEW In view of the recent re -appraisals of all properties in Tompkins County it appeared necessary to make appointment to the Local . Board of Assessment Review to hear persons who might wish to inquire . about the new assessments . i i Minutes m 3 December 31 , 1974 Motion by Councilman Desch ; seconded by Councilman Powers , RESOLVED , that Supervisor Schwan and Councilman McElwee , be appo .1114- ed to the Local Board of Assessment Review , the appointmze;^. t to include the entire Town Board should the volume of inquiry require 1 -I Unanimously carried . BID ON PICK-UP TRUCK The Board discussed the matter of the one bid received on the Pick -Up Truck which bid was rejected at the meeting of December 16 , 1974 bw - cause it was the only i bd�. ' Mr . Morey ( former Highway Superintendent ) , however , recommended acceptance of the bid based on the difficulty of getting bids on this type of . equipment . Councilman Powers , nevert.he - , , less felt that the equipment should be rebid . Mr . Parkin , Highway e Superintendent requested that if the Board did accept the bid they do so with the proviso that the bid be accepted ' without the trade - in allowance so that the old pickup could be retained ( possibly for future sale ) . Motion by Supervisor Schwan ` seconded by Councilman Desch , RESOLVED , that the resolution rejecting the bid of Cayuga Ford , Inc . in the amount of $ 47364 . 74 less trade in of 1966 P100 Pickup in . the amount of . $ 200 be rescinded ( resolution on .December 16 , 1974 ) and that . , ' the bid be accepted with the stipulation that the bid is accepted without the trade in allowance , making the price to the Town of Ithaca r $ 4 , 364 . 74 , on an P150 Supercab Styleside Pickup , 138 . 8 inch Wheel Base . The resolution was duly adopted , Councilman Powers , however, casting a Nay vote . ' The Board then went on to discuss advertising for bids on a new 1975 Cab and Chassis ( 24 , 000 lbs . GV10 . This would be a replacement for a 10 �year old unit . In order to avoid having only one bid , the members of the Board felt that specifications should be sent to likely bidders , together with notice that bids will be received , an indication to be retained in the files that such specifications and notice had been sent . Motion by Supervisor Schwan , seconded by Councilman Powers , RESOLVED , that the Town of ' Ithaca advertise for bids on a new 1975 Cab and Chassis , 24 , 000 lbs . GVTq , in accordance with specifications prepared by the Town Highway Superintendent and with the stipulation that the Town Highway Superintendent furnish the Town Clerk with the names of dealers likely to ', bid on this equipment so that copy of notice to bidders and specifications may be sent to them with . request that they submit a bid . Unanimously carried . . Motion by Supervisor Schwan ; seconded by � Councilman Powers , RESOLVED , that the Town of Ithaca advertise for bids on a Material Spreader and Body Hoist in accordance with specifications prepared by the Town Highway Superintendent . Unanimously carried . STATE AID FOR YOUTH Supervisor Schwan reported that it was necessary at this time It o make application to the State of New York Division for Youth for State Aid for Youth Recreation and Development Programs for ' the year 1975 . After a brief discussion of the contract between the City of "Ithaca and the Town of Ithaca with respect to State Aid the Board acted as followso 4 Minutes e 4 v December 31 , ' 1974 Motion by Supervisor Schwan ° seconded by Councilman Powers , RESOLVED , that the mown Board authorizes the Supervisor to make appli - cation to the State of New York Division for Youth for S -tatemZPAid for Youth Recreation and Development Programs for the year 1975 ; and , fur _— they , that the Town will apply for additional State �Aid on overmatched funds for the year 1974 , and , further that the contract with the Cit�,� of Ithaca will only provide for a total amount of $ 16 , 622 . 50 ( the arnoun, budgeted in 1974 ) in the year 1975 , plus whatever additional State �Aid the Town receives for the! year 1975 , since the Town of Ithaca did not agree to increase that appropriation ( $ 16 , 622050 ) with any additional monies from Town of Ithaca funds . LIGHTING AT INTERSECTION IoN oF CAMPBELL AVENUEaHOPKINS PLACE � ROUTE 96 Mr . Fabbroni reported that the Campbell Avenue improvement was completed . Supervisor Schwan :suggested , then , that lighting ought to be furnished at the intersection of Campbell Avenue ®Hopkins Place ® Route 96 . Minutes - 5 _ December 31 , 1974 Motion by Supervisor Schwan ; seconded by Councilman .McElwee , RESOLVED , that New York State Electric & Gas Corporation `e autizcs !• . zed to install 7 , 000 lumen street lighting at the intersection of Campbell Avenue°Hopkins Place - Route 96 , and that the road be designated . as " Campbell Avenue . Unanimously carried . REPORTS OF TOWN OFFICIALS Mr . Lawrence P . Fabbroni , Town Engineer , reported on the following items * . Kennilworth . The planting strip is completed and they are now working on getting the ° curbing installed . Williams Glen Road . Will be completed in the spring . Subdivisions . There have been some major approvals for developments the Schonfeld Subdivision in the Northeast , for the ' remaining land , bordering roughly the Town of Lansing -Village of Cayuga Heights line and Burleigh Drive . Lounghouse received approval for 12 clusters on 11 . 8 acres on Elm Street Extension . Chase development on South Hill off Ridgecrest Road is under consideration . Air . Fabbroni noted the following projects for 19756 ( 1 ) Northeast Traffic �• Study . ( 2 ) Sign Ordinance enforcement Supervisor Schwan noted here that the Town ought to order several dozen signs which would be posted along places where the Town has acquired a right -ofmway . The sign might read " Right -of -way for future Town Road " or the like . Councilman Desch rioted that billboards are scheduled to come down in :May , in accordance with the sign ordinance , and that letters ought to be written to owners of property and signs reminding them of the deadline . Mr . Fabbroni continued his report * The matter of having the FBC ( Family Bargain Center ) sign removed is in process , 1111re Metz , Assistant Building Inspector , has been in touch with the present owner of the property . The Town highway map must be kept up-dated on a continuing basis , because of the proposed cross -town road and other things .. The or papers on the Flood Plain Program must be com- pleted quite soon 1 . • The Zoning Ordinance must be completed very soon . Action must be taken to modernize the Town Highway barn . The Board agreed to meet on SaLturday , January 4 , 1975 , at 10 : 00 A . M . at the Highway Barn to study this matter on the premises . A procedural system must be firmed up with regard to road specifications , bonding regulations , in short , a . complete check list of procedures which a developer must followo and ` a detailed methodology with regard to cluster - type residential areas , PUDs . fluch of this , Mr . Fabbroni said , is part of site plan approval . Minutes - 6 - December 31 , 1974 Councilman Powers suggested that projects which the Town is currently investigating and working on ought to have mope publicity ® - such items as mass transit: , elderly housing m0 perhaps more press re � leases so the people know what projects the Town is looping into . Councilman Desch said a walkway is needed in the Ellis Hollow Elderly Housing project to the shopping center . Mrs . Holcomb , rlanninq _ Board Chairwoman , noted that the Planning Board is looking into this matter ➢ a culvert is needed and the Town would be going across the re - mainder of the commercial property . Mr . Fabbroni requested that the Board authorize his attendance at the Conference of the Transportation Research Board in Washington , D . C . He said this conference is .one of the best ways to learn what direction funding programs are taking for all types of transportation , highways , bikeways , and energy conservations . Represented on the Trans • . portation Research Board are construction people and research people . The Conference will be held January 13 , la , and 15 , 1975a Motion by Councilman McElweea seconded by Councilman Powers , RESOLVED , that Lawrence P , Fabbroni , Town Engineer , is authorized to attend the Transportation Research Board Conference in Washington , D . C . , expenses to be paid by the Town of Ithacan and , .further , that officials authorized to attend such conferences should present to the Board a brief summary of the highlights of the meetings . Unanimously carried . I� Motion by Councilman Desch. n , seconded by Councilman Powers , RESOLVED , that Walter J . Schwan , Town Supervisor , is appointed as L delegate to represent the Town of Ithaca at the meetings of the Associ - ation of Towns to be held in New York on 'February 9 , 10 , 11 , and 12 , 1975 . Unanimously carried . Supervisor Schwan reported that he will be presiding at four sessions of Association of Towns meetings on February 11 , 1975 , hope4 fully with the assistance of Town Attorney Buyoucos . They are expec - ted , particularly , to cover the matter of dissolving water and sewer districts . Councilman Powers suggested that the sessions of the Associa � tion of Towns might be useful to members of other Boards - � Planning Board , Zoning Board of Appeals , etc . It was agreed that the Board could , on request , authorize other Town officials to attend . REVISED MEETING DATE Motion by Supervisor Schwana seconded by Councilman Desch , RESOLVED , that the Town Board meet on the 3rd day of February , 1975 , at 5a00 p . m . rather than on the regular meeting date of February 10 , lI 1975 . Unanimously carried . The change of scheduled meeting was- made so that the Supervisor could be present , since on February 10 , 1975 he would be at the Association of Towns meetings . CLERK OF THE WORMS - BOLTON POINT The Board discussed at some length the possibility of having Mr . Fabbroni , Town Engineer , act as Clerk of the Works for the Bolton Point Water Supply and Distribution Project . Supervisor Schwan report - ed that the Southern Cayuga Lake Intermunicipal tauter Commission had approved Mr . Fabbroni as Clerk of the Works contingent on the Town Board approving same . Minutes - 7 - December 31 , 1974 Councilman Powers said he would favor it only if someone else were able to pick up the work that Mr . Fabbroni would necessarily have to forego doing insofar as other Town matters are concerned . Councilman McElwee felt the Clerk of the Works position for Bolton Point was a full time job ; that it would not be fair to Mr . Fabbroni to expect him to carry the Clerk of the Y77orks job and Town of Ithaca work . Councilman Desch noted there would be a lot of resi - dent inspectors on the job . Councilman Del Rosso asked for a delineation of the responsi - bilities of a Clerk of the Works . Councilman Desch said the Clerk of the works would be essentially an auditor ,* he would monitor the men provided by the engineers , not the men the contractors provide ; he would work with the resident engineer in preparing the monthly esti - mates for payment ; he would be the owner ' s representative and would have no direct responsibility with respect to contractors , if he were to detect that a contractor was not following the specifications he would make it known to the resident engineer and if the engineer . should not respond he would make it known to the Southern Cayuga Lake Inter ® municipal Commission . After some further discussion , it was generally agreed , with the projects which are known to be contemplated for 1975 , particularly the sewering of five areas of the Town , and other projects which can - not be predicted at this time , and the general feeling that the Clerk of the Works for the Bolton Point project could well be a full - time job , that k1r . Fabbroni should not be asked to take on the job of Clerk of the Works . k1r . Desch said he wanted the record to show that the - Board feels that the owner ' s representative should be a person quali - fied in the field and one who can spend full time monitoring the pro - ject . Motion by Councilman Del Rosso ,* seconded by Councilman Powers , RESOLVED , that the Town Board of the Town of Ithaca , feeling that the Clerk of the Works or owner ' s representative for the Bolton Point Water Supply and Distribution System is a full time job , does not approve the appointment of ILZr . Lawrence P . Fabbroni as Clerk of the Works or owner ' s representative , in view of the other important re - sponsibilities he has to the Town of Ithaca . Unanimously carried . Barbara Holcomb , Planning Board Chairwoman , reported that in 1974 the Planning Board held 28 meetings , eight of which were devoted to the Zoning Ordinance . She reported that the only active subdivision at this time is the Longhouse subdivision - 12 units . Final approval was given to Arthur Prince ' s St > Catherine ' s Subdivision . Preliminary approval has been given with respect to land of Otto Schoenfeld ,* and preliminary discussions have been had with Chase about land off Ridgecrest ; and preliminary approval has been given to Willis Hilker for land off Coddington Road , The Eastwood Commons project is well under way . The Ellis Hollow Road Elderly Housing Project ect has been com- Monkemeyer Is building " Springwood " in the King Road area . Minutes m 8 - December 31 , 1974 Mrs . Holcomb reported that there are four items that the Planning Board has no authority to finally resolve and so recommenda - tions were referred to the ,Ithaca Town Boardo , 1 . Extension of Professional Building on Trumansburg Road . 2 . Bell ' s Grocery ,Store . 3 . NCR Office Expansion . 4 . The O ' Malley Restaurant ( Beaujolais ) . 4tU Mrs . Holcomb reported that the PlanningA spent half their time in 1974 on street and traffic problems and it will probably contir6,*e that way in 1975 . Town roads have been discussed - - primary , second - ary , and tertiary , as yet . Updating of the highway map has not been officially approved Traffic problems in the Northeast have been discussed , and out of the discussion came an ad hoc committee which is meeting more and more often . The Committee now includes planners from the Village of Cayuga Heights , Lansing , Town of Ithaca , the County , Cornell Univer - sity , and the City of Ithaca . This Committee has evolved into a con - tinuing group which will look into , among other things , the loop road . The Committee has no authority , but it does gather and organize infor - mation and appears to be effective . A lot of time has been spent on Route 96 and that effort will continue through the Octopus Committee ( Schwan , Desch , Fabbroni and Holcomb are on this Committee ) . Some time has been spent on identifying " no parking " areas , including no parking on the shoulders . The Planning Board has had very time - consuming meetings on the circumferential ( loop ) road . Mrs . Holcomb noted that considerable time had been spent in reviewing applications and interviewing candidates for the position of Town Engineer and making a final selection . She reported that the Planning Board in 1974 had investigated various options for a ' Town Hall and , fortunately , that problem has been resolved with the purchase of the Security Mutual Insurance building on Seneca Street , Mrs . Holcomb reported that negotiations have begun on the Eastern Heights Park . Meetings have been had with sir . Thaler , attorney for Eastern Heights . Various miscellaneous items have engaged the Planning Board ' s attention , including the Ithaca College Chapel , Seventh Day Adventists on Trumansburg Road , possibility of re - zoning lands and problems with the Marshall Farm , Mrs . Holcomb reported that the following items will be follow- ed up in 1975 ( 1 ) Zoning Ordinance completion , including actual Wording ; the zoning map and zoning schedule on the back of map which will take considerable .time . ( 2 ) Revision of subdivision regulations so that when the new Zoning Ordinance goes into effect developers can comply with the new ordinance . t Minutes _ 9 m December 31 , 1974 ( 3 ) Amendment of the Sign Ordinance ° Enforcement is a major problem in 1975 ° ( 4 ) Development of a park policy . ( 5 ) Development of a gravel extraction ordinance and its relation to environmental protection , ( 6 ) Traffic study in the Northeast . ( 7 ) Continuing work on the circumferential road , the Octopus , and Route 96 problems . ( � ) Continuing problems with Beacon Hills . ( 9 ) Solution of Eastern Heights problems - - drainage and roads , ( 10 ) Development of joint park in the Inlet Valley area with the City of Ithaca in the Flood Plain area . It appears that because of the topography it makes sense to coordinate efforts so the land can be utilized to the best effect . ( 11 ) A crew of landscape architects at Cornell University are doing a special study on bikeways for the Town of Ithaca and the City of Ithaca ° This report will be available in 1975 and will be used as a basis of discussion and possible action by the Planning Board . ( 12 ) Underground drainage ditches in connection on with ( 11 ) Mrs . Holcomb reported that there were two vacancies on the — Planning Board . Mr . Christianson is willing to serve again . Mr . Arnold Albrecht will be resigning . She noted that Mrs . Liese Bronfen- brenner might be willing -to serve , Motion by Supervisor Schwan ° seconded by Councilman Desch , RESOLVED , that Robert Co Christianson be appointed to a new seven ®year . term on the Planning Board effective January 1 , 19750 Unanimously carried . tgra Robert Ea Parkkin , Highway Superintendent , recommended that the Town of Ithaca pay for the removal of the elm tree on Orchard Street . He said he had reviewed the bill from General Arborists and it appears to be in order . The price is not out of line , the tree was very large , four feet in diameter , and it was in the Town ' s right- of -way , Motion by Supervisor Schwan , seconded by Councilman Desch , RESOLVED , that the billing from General Arborists , Inc . for removal of tree on Orchard Street be included for payment in the warrants dated December 31 , 19740 Unanimously carried , Mre- Parkin submitted to the Board a list of tools he would like to purchase in the amount of $ 425 , 66 , It appeared that former Highway Superintendent Morey did not want to sell his tools . Motion by Supervisor Schwan , seconded by Councilman Desch , RESOLVED , that the Highway Superintendent be authorized to purchase tools for use at the Highway Department from Tioga Auto Parts in the amount of $ 425 ° 66 , in accordance with the list submitted . Unanimously carried , Minutes _ 10 _ December 31 , 1974 Mr . Fabbroni , Town Engineer , requested that the Board adopt a resolution that the Town enter into a save and hold harmless agree ° ment with Cayuga Crushed Stone in connection with loading donated waste base for the Bolton Point project . Motion by Supervisor Schwan : seconded by Councilman Desch , RESOLVED , that the Town of Ithaca enter into a save and hold harmless agreement with Cayuga Crushed Stone , Inc . in connection with loading donated waste base for the .Bolton Point project , subject to clarifica � tion of the Town ' s insurance coverage . r Unanimously carried . The case of Rocco Lucente is to be in Court in February 1975 , Reynolds Metz Assistant Building Inspector December 31 , 1974 . �, - We , the undersigned , have been residents of the Town of Ithaca for the past eleven years , living in Varna , on South Hill , and . now on West Hill . Although our present location is very attractive , it is undesirable because of barking dogs at all hours . In our attempts to remedy the situation , we have gotten many. explanations regarding the owner justifying the barking and a few follow . 1 . " As long as the dog ' has food and water there is nothing else I can do . " . 2 . " The barking doesn ' t bother me and as long as the dog is chained it shouldn ' t matter . " 3 . " My dog isn ' t barking ' so you ' ll have to voice - your concern to someone else , after_ all , there are a lot of barking dogs in . this neighborhood . " There is) also the problem of the dog who is turned out for 15 . minutes each hour so he can take care of his natural body functions , one of which seems to be barking . This problem is not unique in the Town of Ithaca , one can hear people complain indirectly , yet they will not speak out no matter how annoyed they get . The town of Ithaca has experienced a great deal of growth in the past eleven years, but the dog population has increased at a much .faster rate . The people with the barking dogs ( untrained ) are a minority which rule the majority of the fellow man . We have had relatives , friends , as well as our previous and present tenants complain about this noisy neighborhood , they are amazed that the barking is allowed . As residents , we are immensely displeased and would not recommend that any of our acquaintances settle in the town . There is even no law - pro - tecting the concerned , which train their dogs , from the obnox - ious . Yet there are people all over , which work night shifts and have to sleep during the day , only to have their rest inter - rupted quite frequently . You might want to note that we are dog owners and have been for the past 8 years . And believe me , ours has a functioning voice box too -. We- understand that there wile -be some barking occasionally but it is the excessiveness which we find aggravating . How miserable it can be to have to listen to them for hours on end when working outdoors in spring or while reading by the fire on a cold winter night .
