At an Adjourned Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 108 East Green
Street , Ithaca , New York , on the 15th day of November , 1974 , at 5 : 00

AUTHORIZATION OF INCREASE IN MAXIMUM AMOUNT
TO BE EXPENDED FOR BOLTON POINT WATER SYSTEM
(WATER SUPPLY PROJECT I )
Supervisor Schwan noted that this meeting is concerned with
adopting a resolution authorizing an increase in the maximum amount
to be expended for the Bolton Point Water Supply System ( Project I ) .
The Town Board deems it to be in the public interest to do so . The
approval of the State Comptroller for the increase has been received ,
under date of November 14 , 1974 . The resolution proposed to be adopted
is subject to permissive referendum . It was noted for the record that
the approval of the State Comptroller for the increase was filed in
the office of the Town Clerk on November 15 , 1974 prior to this meeting .
Town Attorney Buyoucos read the proposed resolution in full .

WHEREAS , pursuant to an order adopted by this Town Board on
October 24 , 1974 , a public hearing was duly held on November 8 , 1974
at 5 : 00 o ' clock P . M . , to determine whether or not it is in the public
interest to increase the maximum amount to be expended for the water
improvement to be provided in the Town Wide Water Supply Benefited
Area in the Town of Ithaca from the sum of $ 4 , 150 , 000 to $ 6 , 070 , 000 ;
and

WHEREAS , proceedings heretofore taken provided that the pro-
posed improvement would constitute a comprehensive water improvement
for use as an intermunicipal water supply facility for the Towns of
Dryden , Ithaca and Lansing and the Village of Cayuga Heights , for
their joint use and operation pursuant to an Agreement of Municipal
Cooperation and pursuant to which the share of the costs to be allau
cated to the Town of Ithaca is now estimated to be , in view of the
aforesaid increase , $ 3 , 3420445050 , an increase of $ 1 , 057 , 249 ; and
WHEREAS , subsequent to said public hearing , the Comptroller
of the State of New York made an order approving the increase of such
maximum amount as stated in the said notice of hearing , such order
being dated November 14 , 1974 , and having been filed in the office
of the Town Clerk of the Town of Ithaca ,* and
WHEREAS , at said hearing all persons interested in the sub
ject matter , thereof were given a full opportunity to be heard and due
deliberation having been had thereon ; NOTI , THEREFORE , IT IS HEREBY
ORDERED ; by the Town Board of the Town of Ithaca , Tompkins
County , New York ®i as follows :

Section to It is hereby determined on the evidence given at
said hearing , that it is in the public interest and necessary to in �
crease the maximum amount proposed to be expended for the improvements
for the Town Wide Water Supply Benefited Area described in the pre -
ambles hereof , which newly estimated maximum , cost is now $ 3 , 342 , 445 . 50
pursuant to Section 209 � q ( 5 ) of the Town Law ,
Section 2e Pursuant to subdivision 5 and ll ( a ) of Section
209 �q of the Town Law , this order is adopted subject to permissive
referendum .
A roll call vote was taken with the following results :
Councilman Desch , voting Aye
Councilman Del Rosso , voting Aye
Councilman Powers , voting Aye
Supervisor Schwan , voting Aye
The resolution was , thereupon , duly adopted .
It was agreed there would be a meeting of the Board on
December 16 , 197V at 12 : 50 p . m . and at 1 : 00 pemo the Board plans to
award contracts for the construction of the Bolton Point System ,
representatives of Lansing , Dryden , Ithaca and the Village of Cayuga
Heights to be at the Town of Ithaca Offices .
