ADJOURNED BOARD MEETING
At an adjourned meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town of Ithaca Offices at 108
East Green Street , Ithaca , New York , on the 24th day of October , 1974 ,
at 5 . 00 p . m . , there were

WHEREAS , pursuant to the provisions of Article 12mC of the
Town Law and more particularly a resolution of this Town Board dated
April 9 , 1973 , the Town of Ithaca , Tompkins County , New York , has
heretofore established a benefited area in and for said Town to be
known as the Town Wide Water Supply Benefited Area ( Bolton Point
Intermunicipal Project ) , and has authorized the providing of a water
improvement for said area ; and
WHEREAS , the maximum amount proposed to be expended for such
water improvement , as statedin the notice of public hearing called
for purposes of considering the establishment of such Benefited Area
was $ 41150 , 000 ; and
WHEREAS , the aforesaid proceedings provided that the proposed
improvement would constitute a comprehensive water improvement for
use as an intermunicipal water supply facility for the Towns of Dryden ,
Ithaca and Lansing and the Village of Cayuga Heights for their joint
use and operation pursuant to an Agreement of Municipal cooperation
and pursuant to which the share of the costs to be allocated to the
Town of Ithaca was estimated to be $ 2 , 551 , 000 . and

WHEREAS , because of inflationary factors and economic condi �
tions generally upon the opening of bids for the construction of the
aforesaid improvement it novr appears that the maximum estimated cost
must be increased to $ 6 , 070 , 000 . 00 , an increase of $ 1 , 920 , OOOo00a and
WHEREAS , pursuant to the formula set forth in the aforesaid
Agreement of Municipal Cooperation the share of the costs to be allo -
cated to the Town of Ithaca is now estimated to be $ 3 , 342 , 445 . 50 ; and
WHEREAS , it is now desired to call a public hearing in conned
tion with such increase , NOW , THEREFORE , BE IT
ORDERED , by the Town Board of the Town of Ithaca , Tompkins
County , New York , as follows °
Section le A meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New Yorkp shall be held at 108 East Green Street ,
Ithaca , New York (Town Offices on third floor ) , on the 8th day of
November , 1974 , at 50000 o ° clock p . m . , for the purpose of conducting
a public hearing on the proposed increase in the maximum amount to be
expended for the water improvement to be provided in the Town Wide
Water Supply Benefited Area in said Town , as aforesaid , at which time
and place said Board will hear all persons interested in the subject
matter thereof .
Section 2 . The Town Clerk is hereby directed to give notice
of said public hearing by causing a copy of this order to be published
once in the Ithaca Journal , the official newspaper of said Town , and
by posting a copy thereof upon the signboard maintained by him pur ®
suant to Section 30 of the Town Law and in the manner provided by the
provisions of subdivision 3 of Section 209 �q of the Town Lawe
Section 3 . It is hereby determined that the newly estimated
total cost of the aforesaid improvement including the increase in the
maximum amount to be expended therefor exceeds one °tenth ( 1/ 10 ) of
one per cent ( 1 % ) of the full valuation of the taxable real property
in the area of the Town of Ithaca outside of any villages , and there -
fore the increase in the maximum amount' herein proposed may not be
ordered by this Town Board unless the Comptroller of the State of New
York shall have made subsequent to the public hearing herein called ,
an order approving such increase ° The Supervisor is therefore author =
ized and directed to execute and file an application with the State
Comptroller for such approval ,
Section 4 . This order shall take effect immediately .
The question of the adoption of the foregoing order was duly
put to a vote on roll call , which resulted as follows *

The order was thereupon declared duly adopted .
