PUBLIC HEARING Tanner Treacv. Applicant/ Reputed Owner (dba TMT Lawn Mowing) - 1031 Cortland Road - TM #28.-1-3.2 - Site Plan for Proposed Pole Barn The Public Hearing was opened at 7:30 p.m. by Chairman Mark Baxendell; the Board Secretary read aloud the Legal Notice as duly published. Proof of Publication has been placed on file for the record. Chairman Baxendell recognized the applicant who explained to everyone present that he was seeking approval to construct a 40 ft. by 80 ft. pole barn on the subject parcel, to be used to store and maintain equipment of his business, TMT Lawn Mowing. His business will also sell bulk mulch, topsoil, stone, and firewood to the public from 8 a.m. thru 5 p.m., April 15tH until 1 November. From 2 November until 14 April, hours will be 8 a.m. until 1 p.m. Chairman Baxendell asked if there was anyone present who wished to comment on the application; there was no one. With everyone heard who wished to be heard, Chairman Baxendell closed the Public Hearing at 7:31 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Mark Baxendell at 7:32 p.m. APPROVAL OF MINUTES - 20 APRIL 2017 A motion was made by Member Lisa Maloney Hahn to approve the Minutes of the 20 April 2017 Planning Board meeting, as submitted. The motion was seconded by Member Ed Neuhauser, with the vote recorded as follows: Motion carried. Ayes: Chairman Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Absent: Member Wyllie Member Brockway This becomes Action #36 of 2017. Applicant/ Reputed Owner (dba TMT Lawn Mowing) - 1031 Cortland Road - TM #28.-1-3.2 - Site Plan for Proposed Pole Barn Chairman Baxendell asked if anyone had any questions regarding this application; no one did. With no further discussion, a motion was made by Member Barbara Clark that the Town of Groton Planning Board hereby declares itself Lead Agency under SEQRA. The motion was seconded by Member Leon Brockway, with the vote recorded as follows: Ayes: Chairman Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Absent: Member Wyllie Member Brockway Motion carried. This becomes Action #37 of 2017. Member Leon Brockway, Jr., then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Monica Carey that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Neuhauser, with the vote recorded as follows: Motion carried. Ayes: Chairman Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Absent: Member Wyllie Member Brockway This becomes Action #38 of 2017. Chairman Baxendell acknowledged receipt of a letter from the Tompkins County Department of Planning & Sustainability, returning this application to the Board for local determination. He also advised everyone that there had been nothing further received from the NYSDOT. Member Clark commented that the State had no problem with the previous business that was at this location. With no further discussion, a motion was then made by Member Carey to approve the Final Site Plan for the proposed pole barn, as requested, contingent upon no negative review by the NYS Department of Transportation. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Absent: Member Wyllie Member Brockway Motion carried. Page 2 of 4 (T) Groton Planning Board Minutes of Public Hearing & Regular Meeting NEW BUSINESS 18 May 2017 Robert & Lvnette Eckert, Applicants/ Reputed Owners - 213 Pleasant Valley Road - TM #35.-1- 19 - Proposed Minor Subdivision Chairman Baxendell recognized Lynette Eckert who was seeking approval for a Minor Subdivision comprised of two parcels, instead of what was formerly three parcels, by eliminating the property line as shown on the portion of the tax map accompanying the application. CEO Rick Fritz stated that what was being proposed was satisfactory and complies with the Code. Board members saw no problem with the subdivision requested. With no further discussion, a motion was made by Member Maloney Hahn that the Town of Groton Planning Board hereby declares itself Lead Agency under SEQRA. The motion was seconded by Member Neuhauser, with the vote recorded as follows: Motion carried. The applicant was advised to bring in their survey map to the Code Enforcement Officer. Lockwood, Applicants/ Reputed Owners - 710 Old Stage Road - TM #s 20.-1- 12 & 13 - Boundary Line Change Chairman Baxendell recognized the Geri Lockwood who explained that she would like to remove the boundary line between the two tax map parcels as shown on the map accompanying the application. Board members present saw no problem with what was being proposed. With no further discussion, a motion was then made by Member Carey to approve the Boundary Line Change, as requested. The motion was seconded by Member Neuhauser, with the vote recorded as follows: Ayes: Chairman Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Absent: Member Wyllie Member Brockway Motion carried. This becomes Action #43 of 2017. OTHER BUSINESS • Chair Baxendell commented that he had received a phone call from someone residing on Bossard Road whose house is assigned the same number as another on the same road; this has effected the owner's application for a STAR Exemption. Duplicate numbers are an "old problem" on this road, and he asked CEO Fritz to look into this (from Spring Street through to the Dead End) and come up with a numbering plan that would please everyone. CEO Fritz agreed to check this out. • The unveiling of a plaque at 2 p.m. on 20 May with an Ice Cream Social was announced by Member Baxendell who also distributed a flyer for "Treasures of Groton's Past," set for 10 June 2017. ADJOURNMENT At 7:55 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Maloney Hahn, with all members present voting in favor.
