M . and read the following Notice of Publication : NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board of the Town of Danby on Monday, January 13 , 1997. at 6 : 00 P . M . Danby Town Hall, 1830 Danby Road, Ithaca, New York to consider adoption of a Local Law amending Local Law No . 1 of 1996 . "A. Local Law to Amend the Zoning Ordinance to Modify the Boundaries and Establish a Modified General Site Plan for Planned Development Zone No . 10, Comprised of a Portion of Town of Danby Tax Parcel No. 9 . - 1 -9 . 12, located on the south side of Gunderman Road west of Comfort Road". The proposed new Local Law would extend the deadline from October 1 , 1996 to May 15 , 1997, for bringing certain building features which have a nonconforming side yard setback into compliance . No public appeared to address the public hearing . Susan Beeners reported that she has received a FAX. from. Mr. Tilton (a neighbor) stating that he is II selling a strip of land that adjoins Angelheart Designs, Inc . and that there would be a closing sometime in January 1997 . She said that she would recommend, in consideration of this information, that the Board adjourn making a decision on this proposed local law. Purchase of additional property will bring Angelheart Designs, Inc. into full compliance with the Town of Danby set back requirements . A roll call vote on the motion resulted as follows : Inman Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously 613 1 3 Town Board Minutes January 13 , 1997 PRIVILEGE OF THE FLOOR: Councilperson Schwartz reported that he has consulted with the Property Manager of Lows ' s and presented a draft for the Town Board to review. The Board reviewed and approved Councilperson Schwartz ' s letter to Lowes Stores . Councilperson Inman has been in contact with NYSEG and has scheduled a meeting with two (2) of their engineers to look over the Town Highway Property and the neighborhood regarding the possibility of a Farm Tap to supply natural gas to the area. Supervisor Oltz reported that recommendations for appointments to County Committees for An Alternate on the County Fire and Disaster EMS Advisory Board and the Hillview Road Landfill Citizens Advisory Committee. Councilperson Steiner said that he thinks the Board should advertise all vacancies for committees and boards in both the Danby Area News and the Ithaca Journal so that interested residents may apply for possible appointment. Members of the Public : Chris Gartlein - 350 Hill Road - reported that he thinks the Stop sign on the Corner of Curtis Road and Hill Road. He would like the sign moved so that the traffic going east on Hill Road must stop rather than the traffic on Curtis Road . County Representative Report: Representative Proto responded to the letter drafted by Councilperson Schwartz and said that Tompkins County is promoting tourism and you may want to reference and highlighting Cayuga Lake, the State Forest Lands and other nearby areas . Representative Prom reported the following : 1 ) County Committees - The Board will be getting their new assignments for 1997 at their next meeting . The Board will continue the Budget and Fiscal Policy Committee, combine the Health and Human Services Committee . He will be Vice-chair of the Rural Affairs Committee and will be on the Health and Human Services Committee . There are four standing committees of Governmental Operations, Public Safety, Planning and Infrastructure (the previous Public Works Committee) . He will continue to serve on the Library Planning Committee and the Health Insurance Committee. 2) Insurance - The hospital has made an effort to make everyone who has Blue Cross/Blue Shield of Central New York as their insurance carrier aware that even though a contract is not in place that most of the contracts provide for 100% reimbursement . The employees of the County Agencies, School Districts and municipalities need to be informed that if they need medical help they will still be covered. If Blue Cross/Blue Shield does not pay the bill the hospital is prepared to work out a deal for payment. 3 ) Rural Affairs - Rural Affairs Committee will be re-named to Rural Outreach. 4) Solid Waste Fees - have been placed on the tax bill . There is a procedure in place through the Division of Solid Waste to evaluate overcharges and a grievance procedure . 5) Flooding - there was a notice that Tompkins County was not declared a disaster area for the November flooding. Residents are encouraged to report to FEMA Emergency Management the damage that occurred in November so that it is entered into the system. 6) Environmental Bond Act - there was an Environmental Board Act passed in November and he has been working with Rick Dietrich of the Youth Bureau to obtain funding for County youths to clean up area creeks . He suggested that the Town may want to consider an application to clean up the Danby Pond. 4 Town Board Minutes January 13 , 1997 7) Comfort Road Bridge - is still on the County Agenda to be replaced in 1997 . Councilperson Johnson said that the issue of overcharges of the solid waste fee by the County is very unfair. People should not have to pay first and settle the matter later. She urged Representative Proto to look into means to solve the problem . The Town Clerk reported that the collection process is going smoothly and the solid waste fee has not been questioned. There are many errors in the Tax Roll for owner address and problems with the initial production of the bills . Receipt of the of the Tax Roll was very late and created extra work over the holidays . Councilperson Steiner said that he understands that economic development is a priority of the new Chair of the County Board and it is also a priority in Danby. He would like them to consider the Town of Danby in their future considerations . COMMUNICATIONS : Letter to the Town Board from Allen S . Becker of interest in serving on the Planning Board - dated January 10 , 1997with request to enter communication in the Minutes of Meeting. REPORTS : Highway Report : In December the Highway Department cut brush, changed three (3) driveway pipes on Gunderman Road, installed a turn around for the snow plows on Gilbert Road, graded the lower end of Michigan Hollow Road, hauled scrap from the old highway barns , plowed, cindered, etc . Snow and Ice Contract to Plow/Sand CR. 1. 88 and 187 Highway Superintendent William Hall explained request of Tompkins County to amend the existing Snow & Ice Removal Contract to include the addition of . 43 miles of CR 188 ( Station Road) and 2 . 13 miles of 187 (Hillview Road) . Motion to A ; . rove the Amendment of the Coun /Town of Danb Snow & Ice Removal Contract A motion was made by Councilperson Steiner and seconded by Councilperson Schwartz that based upon the recommendation of the Highway Superintendent that the Town Board of the Town of Danby approve the Amendment of the County/Town of Danby Snow & Ice Removal Contract to include .43 miles on CR. 188 - Station Road and 2 . 13 miles on CR187 - Hillview Road as requested by Ward Hungerford for 1997on a trial basis, and the cost of this project to be monitored by the Highway Department and reported to the Town Board in June . A vote on the motion resulted as follows : Carried Unanimously Code Enforcement Office Report : Susan Beeners reported that she will submit the her December 1996 and an annual report soon. The Code Enforcement Office has sent out several address change letters to residents . She reported to the Board that the Town has not received word on a grant proposal she submitted for a Rural Planning Grant for economic development. The Planning Board has invited Becky Bilderback of Better Homes and County Representative Barbara Blanchard to speak at their regular February meeting, and Charles Slough will speak about agriculture in Tompkins County in March. . She reported that she has received a request from Ric Dietrich to ask the Board for a letter of support to him with a request to obtain information about possible summer work for Danby youth in. coordination with any prospective projects undertaken in coordination with the Youth Bureau. Discussion: Supervisor Oltz said that she thinks it is a good idea but. Mr. Dietrich needs to supply the Board with more information or attend a meeting to explain his request before the Board could endorse a letter requesting information. 6rs 5 Town Board Minutes f , : January 13 , 1997 Councilperson Schwartz said that the Six Mile Creek area is a protected trout stream and would involve permission from the Department of Environmental Conservation for any project undertaken in the creek area. No decision was made by the Board to send a letter to Mr. Dietrich. NEW BUSINESS : Danby Youth Commission Supervisor Oltz reported that there is no report from the Danby Youth Commission but Kathy Lind would like to continue on the Youth Partnership Board . Motion for Appointment - Youth Partnership Board A motion was made by Supervisor Oltz and seconded by Councilperson Schwartz to appoint Kathy Lind of 958 Comfort Road, Spencer, New York to the Youth Partnership Board as a representative from Danby for a three (3 ) year term beginning January 1 , 1997 and ending December 31 , 1999 . RESOLUTION NO . 3 OF 1997 PAYMENT OF BILLS RESOLVED, That the Town Board of the Town of Danby approve a blanket resolution to authorize the Town Supervisor to pay utility bills, freight, postage, contracts and to conduct other normal proceedings such as payroll in advance of audit in order to keep affairs moving on a timely basis . RESOLUTION NO. 4 OF 1997 1996 FINANCIAL REPORT RESOLVED, That the Town Supervisor, in lieu of preparing a financial report under Town Law #29-( 10) shall submit to the Town Clerk by March 1 , 1997 a copy of the report submitted to the State Controller required by Section 30 of Municipal Law. RESOLUTION NO. 5 OF 1997 AUTHORIZATION FOR PURCHASE OF TOOLS, EQUIPMENT , ETC . RESOLVED , That the Town of Danby Highway Superintendent be authorized to purchase tools , equipment, small implements, tires and tubes, etc . in the amount of $5 ,000 at any given time without prior approval of the Town Board . RESOLUTION NO. 6 OF 1997 TOWN OF DANBY OFFICIAL NEWSPAPER AND BANK DEPOSITORY RESOLVED, That the Town of Danby Town board name the Ithaca Journal as the Official Newspaper(because there are no other alternatives) and the Tompkins County Trust Company as bank for the depository of Town Funds . RESOLUTION NO. 7 OF 1997 TOWN OF DANBY ATTORNEY RESOLVED, That the firm of Barney, Grossman, Roth and Dubow be named as the law firm to represent the Town of Danby in all Zoning, Planning Board, and general Town of Danby business . The Town Board reserves the right of seeking other legal aid if it deems necessary. RESOLUTION NO. 8 OF 1997 TOWN MILEAGE RESOLVED , That the Town of Danby Town Board authorize the mileage for Town Business to be paid at thirty-one cents ($ . 31 ) per mile . RESOLUTION NO. 9 OF 1997 VOTING MACHINE CUSTODIANS AND INSPECTORS RESOLVED, That the Town of Danby Voting Machine Custodians Edward M . Roberts and Robert Whittaker will be paid as follows : Mr. Roberts $75 . 00 per service and Mr. Whittaker $60 . 00 per service . Election Inspectors will be paid at the rate of $ 6 . 00 per hour for service . RESOLUTION NO . 10 OF 1997 HIGHWAY IMPROVEMENTS REIMBURSEMENT RESOLVED, That the Town of Danby Town Board be authorized to sign an agreement that monies collected for repairs and improvements of Town Highways in the amount of $ 85 ,000 . 00 (State Aid DA3501 ) be expended upon 71 . 98 miles of Town of Danby highways . RESOLUTION NO. 13 OF 1997 TOWN BOARD MEETINGS RESOLVED, That the Town of Danby Town Board regular monthly meetings be scheduled at 6 : 00 P . M. on the second Monday of each month for the year 1997 . RESOLUTION NO. 14 OF 1997 APPROVAL OF COURT CLERK RESOLVED, That the Town of Danby Town Board approve the appointment of Theresa O'Connor as Danby Court Clerk. RESOLUTION NO. 15 OF 1997 APPOINTMENT OF CODE ENFORCEMENT OFFICER RESOLVED, That the Town of Danby Town Board appoints Susan Beeners as Code Enforcement Officer for the Town of Danby, and be it further RESOLVED, that the position of Code Enforcement Officer has been changed from an annual appointment to an on-going appointment. RESOLUTION NO. 16 OF 1997 APPOINTMENT OF DEPUTY SUPERVISOR RESOLVED, that the Town Board of the Town of Danby appoint Howard Steiner as Deputy Town Supervisor for payment of bills in the absence of the Town Supervisor. A roll call vote on the motion resulted as follows : Inman Abstained Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried PROPOSED PURCHASE OF A ONE TON DUMP TRUCK A Bid Opening was held on January 8 , 1997 to receive bids for the purchase of a 1996 or newer one ( 1 ) ton dump truck with plow. Following the public hearing the bids were reviewed by the Town Highway Superintendent and the Town Board . Superintendent Hall said that he would also like to have a central hydraulic system installed on the 8 Town Board Minutes January 13 , 1997 truck as an option at the time of purchase . The cost of installation of a hydraulic system is an additional $2 , 000 . 00 . It is more cost effective to have a hydraulic system installed at the time of purchase . RESOLUTION NO. 17 OF 1997 AWARD OF BID - 4X4 ONE (1) TON DUMP TRUCK WITH SNOW-PLOW By Supervisor Oltz : Seconded by Councilperson Johnson WHEREAS , the Town of Danby has advertised for sealed bids for a 1996 or newer One ( 1 ) Ton Dump Truck with Snow-Plow, and WHEREAS, on Wednesday, January 8 , 1997 at 6 : 00 P . M. bids received by the Town were opened by the Town of Danby Town Board, and WHEREAS, all bids received were reviewed by the Town Board and the Highway Superintendent, now be it RESOLVED , that the Town Board of the Town of Danby awards the bid for a 4 x 4 One ( 1 ) Ton Dump Truck with Snow-Plow to Robert Green Truck Division, P . O . Box 8002 , Rock Hill , New York, 12775 , for their bid of $28 ,709 . 00 plus $2 ,000 . 00 for an upgrade to the central hydraulic system for a total of $ 30,709 . 00 as the bid that best meets the needs of the Town Highway Department. A roll call vote on the motion resulted as follows : Inman Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously RESOLUTION NO. 18 OF 1997 INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 65 YEARS OF AGE OR OVER WHEREAS, Pursuant to the provisions of Section 467 of the Real Property Tax Law of the State of New York, real property located in the Town of Danby, owned by one or more persons, each of whom is 65 years of age or over, or real property owned by husband and wife, one of whom is 65 years of age or over, shall be partially exempt from taxation by said Town for the applicable taxes specified in said Section 476 based upon the income of the owner or combined incomes of the owners, and WHEREAS, A person otherwise qualifying for such exemption shall not be denied such exemption if such person becomes sixty-five (65 ) years of age after the appropriate taxable status date and before December 31 of the same year, now be it RESOLVED, that the Town Board of the Town of Danby extend Graduated Income Tax Benefit to Senior Citizens as set forth in the following schedule : ANNUAL INCOME OF OWNER PERCENTAGE ASSESSED OR COMBINED ANNUAL INCOME VALUATION EXEMPT OF OWNERS FROM TAXATION Up to and including $ 18 , 500 . 00 50 % More than $ 18 , 500 . 00 but less than $ 19 ,499 . 99 45 % 659 9 Town Board Minutes 4 . • January 13 , 1997 $ 19, 500 . 00 or more but less than $20 ,499 . 99 40 % $20,500 . 00 or more but less than $21 ,499 . 99 35 % $21 , 500 . 00 or more but less than $22,399 . 99 30 % $22 ,400 .00 or more but less than $23 ,299 . 99 25 % $23 ,300 . 00 or more but less than $24, 199 . 99 20 % and be it further RESOLVED, that this partial exemption provided by this resolution shall , however, be limited to such property and persons as meet the conditions, qualification, exclusions and limitations set forth in Section 467 of the Real Property Tax Law of the State of New York, and be it further RESOLVED, that application for such exemption must be made by the owner, or all of the owners of the property on forms prescribed by the State Board of Equalization and Assessment of the State of New York (or any successor agency) to be furnished by the appropriate executed in the manner required or prescribed in such forms, and shall be filed in such assessor ' s office on or before the appropriate taxable status date, and be it further RESOLVED, that this resolution supersedes Resolution No . 19 of 1992 . Discussion : Councilperson Johnson suggested that the Town adjust the exemption to the 10% level allowed by New York State due to the rate of inflation . Motion to Adjust the Sliding Scale A motion was made by Councilperson Johnson and seconded by Councilperson Inman to adjust the Proposed Partial Exemption Resolution No . 18 to the 10% exemption level to include $24,200 or more but less than 25 ,099 . 99 for an exemption of 10% . M . to consider a Local Law Amending the Zoning Ordinance Related to Angelheart Designs . The Board deferred discussion and consideration of the local law pending further information . RESOLUTION NO. 20 OF 1997 NOTICE OF ELECTION OF THE TOWN OF DANBY TO SECURE WORKERS ' COMPENSATION AS A SELF-INSURER By Supervisor Oltz : Seconded by Councilperson Johnson WHEREAS , the Town of Danby has changed insurance carriers for Workers ' Compensation Insurance, and WHEREAS, Election to secure Workers ' Compensation in accordance with subdivision 4a of Section fifty has been duly made and becomes effective January 1 , 1997 , now therefore be it RESOLVED, that the Town of Danby files this notice with the Workers ' Compensation Board in accordance with subdivision 4a of the Workers ' Compensation Law.
