December 30, 1996 PRESENT : Supervisor Mary Oltz Councilpersons : Edward Inman, Joseph Schwartz, Howard Steiner ABSENT : Councilperson Rosa Lee Johnson (Excused) Others Present: William Hall - Highway Superintendent Carol Sczepanski - Town Clerk Members of the Public : William Farrell The meeting was called to order at 6 : 02 P . M . by Supervisor Mary Oltz. The Town Board audited Warrants No . 13 of 1996 for approval . After discussion the Board did not approve General Fund Voucher No . 372 for a maintenance/service contract for the copy machine . APPROVAL OF WARRANTS West Danby Water District Fund Warrant No. 13 of 1996 - Approved A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve West Danby Water District Fund Warrant No . 13 of 1996, voucher numbers 50-52 in the amount of $757 . 23 . A roll call vote on the motion resulted as follows : Inman Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Highway Fund Warrant No. 13 of 1996- Approved A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve the Highway Fund Warrant No . 13 of 1996, voucher numbers 180- 181 in the amount of $3 , 361 . 66 . A roll call vote on the motion resulted as follows : Inman Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously General Fund Warrant No. 13 of 1996 A motion was made by Councilperson Inman and seconded by Councilperson Steiner to approve the General Fund Warrant No. 13 of 1996 voucher numbers 369 - 391 less Voucher No . 372 for a total of $4,061 . 66 . V7 2 Town Board Minutes December 30, 1996 A roll call vote on the motion resulted as follows : Inman Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Approval of Town Supervisor' s November Report A motion was made by Councilperson Schwartz and seconded by Councilperson Steiner to approve the town Supervisor ' s November Report as submitted. A roll call vote on the motion resulted as follows : Inman Aye Schwartz Aye Steiner Aye Carried Unanimously PRIVILEGE OF THE FLOOR: Councilperson Schwartz reported on the following : 1 ) It is possible that Lowe Discount Stores may be interested in locating a store in the Ithaca Area. If this area is being considered , he would like the Board to send a letter asking them to look at the Danby Area as a possibility . 2) He would like to Board to consider the changing the annual appointment of the Code Enforcement Officer a hired position . 3 ) Seneca Depot often sells Government Surplus to non-profit organizations . He asked the Highway Superintendent to look into how to be placed on the mailing list Councilperson Steiner requested an Executive Session of the Board to discuss a real estate issue . Town Clerk Carol Sczepanski reported to the Board that the 1997 Tax Roll and Warrant did not arrive until today (December 30, 1996) at 2 : 30 P . M . It was necessary to have the copies of the tax bills reprinted due to errors . The Tompkins County Division of Assessment printed the Tax Roll and have reported that the errors were due to a computer software problem . The 1997 Tax Bills will be mailed on December 31 , 1996 and it is hoped that they have been printed correctly. Highway Superintendent William Hall reported that he needs additional funding for office support . The $ 1 ,500 . 00 allotted in the 1997 budget is not sufficient for his needs. Setting up the program and input for the Highway Department will be time consuming. Members of the Public : William Farrell addressed the Board and said that under New Business on the December 30, 1996 Agenda, Item No . 2 - Possible Resolution - Appointment of Architect and it was his understanding that an architect would not be chosen until Councilperson Johnson returned from vacation so that the full Board was present . Supervisor Oltz said that she has consulted with Councilperson Johnson and that she understands that we must proceed. It is impossible to predict whether a full Board will be present at any Meeting of the Board in advance of a meeting . Supervisor Oltz reported that there will be a Tompkins County Home Builders Association Luncheon on January 2 , 1997 at the Airport Ramada Inn . Ithaca City School District Superintendent, Judith Pastel will be the guest speaker and members of the public are invited . 3 Town Board Minutes December 30, 1996 COMMUNICATIONS : 1 ) Transmission to Board - Proposed Local Law No . 1 of 1997 - "A LOCAL LAW AMENDING LOCAL LAW NO . 1 OF 1996 RELATED TO ANGELHEART DESIGNS , INC . " 2) Hillview Road Landfill Monitoring Report - 1996 3rd Quarter Report - On file . Motion to adjourn to Executive Session : A motion was made by Councilperson Steiner and seconded by Councilperson Schwartz that the Board adjourn to Executive Session to discuss a real estate issue at 6 : 30 P . M . ft" Carried Unanimously Meeting Reconvened The special meeting of the Board reconvened at 7 : 40 P . M. OLD BUSINESS : Councilperson Steiner reported that he would like to have a resolution to change the Senior Exempt Income Eligibility for Town of Danby Taxes placed on the January 1997 Agenda. NEW BUSINESS : Supervisor Oltz reported that the Town of Danby and the Town of Ithaca have equipment of equal value that they would like to trade and introduced the following resolution. RESOLUTION NO. 68 OF 1996 HIGHWAY EQUIPMENT TRADE By Supervisor Oltz : Seconded by Councilperson Steiner WHEREAS,the Town of Ithaca Highway Department and the Town of Danby Highway Department have rendered assistance to one another by trading the non chargeable use of a John Deere Flail Mower (Ithaca' s), and a Road Widener (Danby' s), and WHEREAS, the Highway Superintendent' s of both towns have identified the main use of both pieces of equipment on a more regular basis by each other, and Town of Ithaca Flail Mower 25 % Town of Danby Flail Mower 75 % Town of Ithaca Road Widener 75 % Town of Danby Road Widener 25 % WHEREAS, , both Highway Superintendent ' s have determined that the value basis of both pieces of equipment are equal to $600 . 00, and both feel the equipment is needed more by each other; now therefore be it RESOLVED, based upon the recommendation of the Town of Ithaca and Town of Danby Highway Superintendent ' s the Town Board of the Town of Danby does hereby agree to exchange the said equipment; and be it further RESOLVED, the title of each piece of equipment shall be passed to each other town. A roll call vote on the resolution resulted as follows : Inman Aye Schwartz Aye Steiner Aye Oltz Aye (Councilperson Johnson absent) Carried Unanimously 4 Town Board Minutes December 30, 1996 TOWN HALL BUILDING RENOVATION/ADDITION PROJECT RESOLUTION NO 69 OF 1996 ARCHITECTURAL FIRM OF HUEBER, HARES and GLAVIN - RETAINED FOR TOWN HALL RENOVATION/ADDITION PROJECT By Councilperson Inman : Seconded by Councilperson Steiner WHEREAS, the Town of Danby has solicited proposals to provide architectural services for the alterations, additions, and demolition work for the Town Hall Project recently approved by the voters of the Town, and WHEREAS, after reviewing the proposals received and interviewing several architects, the Town of Danby Town Board is of the opinion and recommends that the architectural firm of "Hueber, Hares and Glavin" of Syracuse, New York be the architect for the renovations and the proposed addition to the Town Hall, now therefore, be it RESOLVED, that the Town of Danby retain the architectural firm of Hueber, Hares, and Glavin of Syracuse, New York, to perform all of the architectural services for the Town in connection with its Town Hall Project on a "full-services" basis at a total cost to the Town not to exceed $23 ,000 . 00 for all phases of the work ; and it is further RESOLVED, that the Town Supervisor be and she hereby is authorized to enter into a contract on behalf of the Town of Danby with said architectural firm, said contract to contain such provisions as the Town Supervisor, with the advice and assistance of the Attorneys for theTown, deems appropriate or necessary to protect the Town and provide for an adequate contractual relationship between the Town and such firm ; and it is further RESOLVED, that the Town Supervisor, Attorney for the Town, and Town Clerk be and each hereby is authorized to take such additional steps and to execute such further documents as may be necessary or appropriate in order to effectuate the forgoing resolutions . A roll call vote on the resolution resulted as follows : Inman Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously (Councilperson Johnson absent) The Town Clerk was requested by the Town Supervisor to send a letter to Hueber, Hanes and Glavin notifying them of the Town Board decision to accept their proposal and letters to the architects not selected thanking them for their proposals and the Board decision. She requested the letters be sent as soon as possible . RESOLUTION NO. 70 of 1996 CLERK OF THE WORKS APPOINTMENT By Councilperson Steiner : Seconded by Supervisor Oltz WHEREAS, the Town of Danby has undertaken a renovation and addition of the Town Hall , and WHEREAS, a "Clerk of the Works" will be required for this project, and WHEREAS, Ed Inman has experience with this type of project and professional background, now be it RESOLVED, that the Town Board of the Town of Danby appoints Ed Inman as "Clerk of the Works" for the Town of Danby Town Hall Renovation/Addition Project, and be it further RESOLVED, that the Town of Danby Town Board provide a stipend for this service . 5 Town Board Minutes December 30, 1996 A roll call vote on the resolution resulted as follows : Inman Abstained Schwartz Aye Steiner Aye Oltz Aye Carried • • Other Business Councilperson Steiner expressed concern that the Town Highway Superintendent is proposing to hire another part time person for clerical services .
