DECEMBER 125 1966
The following are minutes of a Regular Meeting of the Town
Board held in the Town Offices 108 East Green Street , City of
Ithaca , at 4 : 00 P . M , on Monday , December 12 , 19660
BOARD MEMBERS PRESENT : Supervisor William B . Kerr ; Councilmen
Harry Baker , Harry Gordon , Joseph N . Mayer , Jr . and Andrew W .
McElwee ,
ALSO PRESENT : Highway Superintendent Marion Morey ; Planning

RESOLUTION 1 - - WARRANT
VOTED to approve the warrant dated December 12 , 1966 in the
following amounts :
Highway Fund - Bill 353 thru 388 inclusive - $ 5 , 566 . 69
General Fund - Bill 506 thru 552 inclusive - $ 11 , 669 . 67
Ellis Hollow Road Sewer District -# 21 - $ 1 326063
Northeast Sewer District - # 29 - 65 . 98
RESOLUTION 2 = ASSOCIATION OF TOWNS MEETING
VOTED resolved to authorize Town Officials to attend the Association
of Towns Meeting in New York City February 6 , 7 , 8 , 19670

RESOLUTION 3 - APPOINTMENT - Deputy Town Clerk
VOTED resolved that Marjorie Hagin , 15 Muriel Street , be appointed
as Deputy Town ' Clerk during the period of tax collecting period
at an ' hourly rate of $ 1 . 60 per hour .

RESOLUTION 4 - APPOINTMENT - Town Planning Board
VOTED resolved that Daniel Baker , Bostwick Road , be appointed to
fill the vacancy caused by the resignation of Frank Liguori ,
effective December 13 , 19660

RESOLUTION 5 - MAILING 1967 TAX BILLS
VOTED resolved by the Board that the 1967 tax bills should be
mailed no earlier than December 14th and no later than January
1 , 1967 .

RESOLUTION 6 - AUDITING RECORDS AND BOOKS OF
TOWN OFFICIALS
VOTED resolved to schedule regular meeting for auditing records
and books of Town Officials on Friday , December 30 , 1966 at
10 o ' clock , at the Town Offices .

RESOLUTION 7 - AUTHORIZATION FOR INSTALLING
LIGHTS
Mr . James Lacy of New York State Electric and Gas Corporation
requested authorization for the installation of lights as
recommended by the Town Planning Board at the entrance to Ithaca
College ; intersection of King Road and at the walkway inter -
section of Warren Road . Upon motion duly made and seconded
authorization was granted for lights to be installed at King
Road and at the Walway intersection of Warren Road .
RESOLUTION 8 - INLET VALLEY - WATER AND SEWER
VOTED resolved to retain Lozier Engineers to prepare inform -
ative cost estimates for providing sewer and water to Inlet
Valley section which includes the area along Elmira Road and
Five Mile Drive ,
RESOLUTION 9 - SECOND SOUTH HILL WATER
DISTRICT 19
Upon motion duly made and carried , William B . Kerr , Supervisor
was authorized to sign all necessary petitions and to take such
other steps as may be necessary to obtain approval of the project
from the Water Resources Commission of the State of New York ,
JUNIPER DRIVE
There was discussion whether or not the Town should accept
Juniper Drive as a town road . Noel Desch , Chairman of the
Town Planning Board said it was not acceptable in its present
condition as it has no gravel base nor had a profile been
approved for the development of this area . The Board instructed
Mr . Morey , Highway Superintendent to investigate the conditions
of the drive and report at the December 30th meeting - whether
it would. be feasible to accept it in its present condition .
SWIMMING POOLS
Mr . Desch reminded the Board of a past resolution recommending
a change in the Zoning Ordinance which would restrict swimming
pools to the requirement of accessory buildings and give the
Zoning Officer control of enforcement . It was discussed and
a ' Public Hearing will be scheduled on this request .
WATER LINE ALONG JUDD FALLS AND PINE TREE ROADS
A letter was read from John E . Burton , Vice President , Business
Cornell University stating Cornell ' s objection to the extension
of a 10 " water line along Judd Falls and Pine Tree roads , as
the extra charge levied for cost of installation would not
substantially benefit the University . Further discussion and
study will ensue before any conclusions are made regarding the
extension of the water line .
LFINAL ORDERS FOR SOUTH HILL SEWER DISTRICT AND SECOND SOUTH
l HILL WATER DISTRICT were presented to the Board for their approval .
WATER AND SEWER EXTENSIONS
Ridgecrest Road and Danby Road Petitions asking for extensions
along Ridgecrest and Danby Roads were presented . There were
some discrepancies on the Danby Road petition . People in that
district are to reaffirm another petition for the next board
meeting . Richard LaFave who lives in the district will check
the petition for accuracy and see that all property owners who
wish may be benefited . Public Hearings will be scheduled at a
later date .

NORTHEAST SCHOOL BUS TRANSPORTATION
A small group from the Northeast school district appeared at
this ''meeting to voice opinion regarding the town furnishing
bus transportation to the Northeast school from the Salem -
Tareyyton -Muriel Streets area after the discontinuance of this
service by the Board of Education . Upon completion of a walk -
way from this area to the school , the Board of Education set
November 28 , 1966 as the final date for bus transportation .
Parents of small children became concerned by the enforcement
of this decision particularly at this time of year with the
hazards involved with the inclimate weather which will arise .
The group opposing the continuance of bus transportation by
the town maintained that it is unfair for one area to benefit
. and not others where the same sort of unsafe conditions prevail .
A group of parents obtained an injunction to have bus transport -
ation continued until. December 8 , 1966 . In the interim between
November 28th and December 8 , Supervisor Kerr consulted with a majority
members of the Town Board and they agreed, to assume the financing
for the continuance of bus transportation until the close of
the school year in June 1967 . The question of legality was
raised by Board Members but Supervisor Kerr stated " the safety
and life of a child is more important than the cost involved
to furnish bus service for !l, the remainder of the school year
and it is the only humanitarian thing to do . "
Following the discussion the following resolution was adopted .

RESOLUTION 10 - NORTHEAST BUS TRANSPORTATION
Upon° motion made by Supervisor William B . Kerr , seconded by
Councilman Harry Gordon , the Town of Ithaca will subsidize
bus transportation for the ,, safety of the children from the
Tareyton - Salem -Muriel Streets area to the Northeast School
until June 1967 at an estimated cost of $ 1850 .
The following votee were cast : Ayes : Kerr , Gordon , Mayer
Noes : McElwee

Abstained : Baker
SIDEWALK DISTRICT
During the discussion with ? the Northeast group the question
of a ' sidewalk district was raised . Supervisor Kerr informed
the group this was strictly a decision to be made by the
residents of the area and suggested the circulation of petitions .
Mr . Walter Schwan speaking ,', for the group said the residents
were " 10 to 1 against sidewalks " . Discussion concluded at
this „ point .
BOARD MINUTES
Staring January 1967 minutes of Town Board. Meetings will no
longer be mailed to other than Board Members unless specific
requests are made to the Town Clerk ,
PUBLIC HEARING - - Talandis Rezoning
• The public hearing to heariall persons interested in the
rezoning of the Talandis property located off Warren Road
next ' to the Northeast Elementary School opened at 6 o ' clock
PsM * 11 Mr . Gerald Talandis requested a rezoning from residential
to multiple residence so that he may erect ten - 18 unit dwellings
on an 18 . 1 acre site .
Members of the Board. discul"ssed the possibility of a drainage
problem which might cause com rn to the Village of Cayuga
Heights , but the opinion in general was that a problem of this
type . ", could errupt even though there wasn ' t such a development
in the area . Mr . Desch suggested that a possible storm sewer

in the future might be necessary to correct the problem , should
it occur . Aside from this, one possible interference Mr . McElwee
said it was a good location and a well buffered area for this
type of development . Three area residents were heard and ' they
voiced opinion in the matter without any sharp criticism or .
objection . _
The public hearing adjourn led at 6 : 40 P . M .
RESOLUTION 11 - TALANDIS PROPERTY
Following the hearing the 'Board took the following action :
Councilman Mayer offered the following resolution and moved
its adoption - -
" The Gerald Talandis ,property off Warren Road be rezoned
from Residential 15 to Multiple Residence . "

The Zoning Ordinance and the Zoning Map of the Town of Ithaca
was amended as follows :
The following is rezoned from Residence R 15 to Multiple

THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca
County of Tompkins and State of New York bounded and described
as follows : BEGINNING at la point situated in the cneter line of
the Warren Road at the northeast corner of premises formerly
owned by J . Dall , Jr . , Inc , . said point being also in the
south line of premises conveyed to Charles H . 'Gardner by deed
recorded ,., n the Tompkins County Clerk ' s Office in liber 149 of
Deeds at page 426 ; thence running west along an old fence and
hedge 1400 feet to an iron, pipe set in the east line of lands
formerly owned. by Cornell ,,Taylor Farms , Inc . ; thence running ,
north along a wire fence 11386 feet to the north line of the
township of Ithaca , said point being one foot north of an angle
iron post set in concrete ; " thence running east along - . the
north line of the township: of Ithaca , 1126 feet to an iron pipe
set in the west line of Warren Road ; thence continuing 25 feet
to the center line of said road ; thence running south 880 feet
along the center line of Warren Road ; thence running southeasterly
590 feet along the center line of Warren Road to the place of
beginning .
The above description is in accordance with a survey of said
parcel made by Carl Crandall , C . E . dated June 15 , 1944 and
filed Spetember 29 , 19660
Being the premises conveyed to Walter C . Heasley , Jr . and
Katherine Ziegler Heasley by deed. dated June 19 , 1940 and recorded
in the Tompkins County Clerk ' s Office in Book 256 of Deeds at
page 378
EXCEPTING THEREFROM the . premises described in a deed from
Walter C . Heasley , Jr . and Katharine Ziegler Heasley to the
City School District of th;e City of Ithaca dated and delivered
concurrently herewith , described as follows : BEGINNING at an
old pipe marking the southwest corner of premises conveyed to
Walter C . Heasley and Katharine Z . Heasley by Rose C . Gardner '
et al dated June 19 , 1940 and recoreded in Tompkins County
Clerk ' s Office July 10 , 1940 in Liber 256 of Deeds at page 378 ,
and running thence North 7010 ' East along an old fence , 650 feet
to an iron stake ; thence North 70 East along an old. wire fence ,

consulting engineer , dated ; Septembor 3 , 1966 and filed September
29 , 1966 .
Mr . Kerr did not vote as he represents the developer .
