Lewis Cartee , Councilman McElwee offered the following resolution and moved its adoption : RT SOLVED that Mrs . Myrtle Hewitt of 17 Muriel St . , Itha.cce , be appointed Deputy Town Clerk effective November 1 , 1966 and i Town Clerk effective December 1 , 1966 at the rate of $4800 . per year provisional . Seconded by Councilman Baker • Ayes = Kerr , McElwee , Baker and Gordon Noes - 0 Carried . The Annual Budget meeting will be held November 10 , 1966 at 4 : 00 o ' clock P . M . Fuess Town Clerk November 10 , 1966 The regular meeting of the Town Board of the Town of Ithaca was held at the town offices , 108 E . Green St . , City of Ithaca, at 4 : 00 o ' clock P . M . on Thursday , November 10 , 1966 . Board members present were : Supervisor William B . Kerr ; Councilmen Harry U . Baker , Harry N . Gordon , Joseph N . Mayer , Jr . , and Andrew W' , McElwee . Also present were . Highway Superintendent Marion Morey , Planning Board Chairman Noel Desch , Attorney James Buyoucos , Engineer James Dunlap , Jerry Langdon , Mrs . Hewitt and Mrs . Fuess . RHWD CHARGE Supervisor Kerr stated that the City had forwarded a bill for the work involved in extending the lines in the Renwick Heights Water District , Mr . Kerr will confer with members of the Renwick Heights Association to determine the most feasible method of borrowing the money to finance the improvement . 4 : 00 PUBLIC HEARING - ANNUAL BUDGET Noone was present to be heard at the public hearing on the Annual Budget which was called by Supervisor Kerr at 4 . 00 o ' clock P . M . Proof Lof -publication and posting were presented . The hearing was closed and Councilman Mayer offered the following resolution and moved its adoption . RESOLVED , -that the Town Board of the Town of Ithaca. does hereby adopt the Preliminary Budget as the Annual Budget for the fiscal year beginning the first day of January , 1967 , and BE IT FURTHER RESOLVED , that the Town Clerk of this town shall prepare and certify duplicate copies of such Annual Budget adopted. pursuant- to Section 202 - a of the Town Law , and. deliver one copy thereof to the Supervisor of the Town to be presented by him to the Board of Supervisors of Tompkins County . Seconded by Councilman Baker Ayes - Kerr , Mayer , Baker , Gordon and McElwee Noes - , 0 Carried . ROAD IMPROVEMENT - THE BYWAY 4 Highway Superintendent Marion Morey reported on expenses for repair work completed on the Byway in Forest Home . A discussion 122 followed regarding the assuming of this expense by the Town . The residents of the Byway had indicated that they expected to pay any charges since the Byway is not an accepted Town road . Mr . Kerr felt that a. town has in essence accepted. a road after working on it , although it is not officially accepted by the Town . Sup ' t . . Morey stated that the town ' s insurance does not cover men working on unaccepted roads . Neither can building per- mits be issued for. property along unaccepted roads . . Councilman McElwee felt the town has an obligation to help persons living on this type of road - especially those roads that can never meet the specifications required to be accepted by the town as a road . Supervisor Kerr offered the following resolution and moved its adoption : : . RESOLVED that each property owner along the Byway be charged a payment of - tt1 : 00 and that the Town of Ithaca pay the bills for improvements constructed ( $ 485 . 25 , materials ; - 161 . .00 , labor ) , Seconded by Councilman McElwee Ayes - Kerry -McElwee , Baker , Gordon end Mayer Noes - 0 - Carried . SPECIAL DISTRICTS PUBLIC HEARINGS Noone was present to be heard at any of the public hearings held on the ° special district assessment rolls . Mayer Noes - 0 Carried , APPROVAL OF MINUTES Councilman Mayer offered the following resolution and moved Its adoptionl, RESOLVED that the minutes of the October 10 , 1966 meeting be approved . - 4 Seconded - by- Councilman Baker Ayes - Kerr , Baker , Mayer , Gordon and McElwee Noes - 0 Carried SAVEY SUB- DIVISION The Board. will notify Building Officer Anselm Soyring that no more building permits are to be issued in the Savey sub -division unless sub - division plans have been approved the the Town Planning Board . Also -Mr . - Savey must sign an agreement that as soon as the Sewer District now proposed for this area is completed these new houses will be connected to that sewer . SIDEWALKS - CODDINGTON ROAD Supervi°sor Kerr reported that residents of the Coddington Road are interested -in. sidewalks . The children are required. to walt to school bus stops along the road and the parents are concerned for their safety:. No decision was made by the Town Board at this , meeting . LIBERMAN REQUEST FOR REZONING Mr . Leonard. Liberman was present to ask the Board to schedule a public hearing for -, rezoning of his property along E . Shore Drive , Mr . Liberman stated that his site plan is ready except for showing buildings and- that he ' did not intend to build any buildings , but would sell the property as soon as it is rezoned . Mr . Desch said he felt that the Planning Board should know the density that would go on this property ; ; where interior roads would go ; how the use of the site would blend in the area etc . He siad. he felt the area is suited for multiple residence , but the map Mr . Liberman presented does not specify enough detail . Mr . Desch said he felt any developer would be 123 willing to spend. the money to prepare plot plans . . Mr . Liberman asked why zoning from residential to multiple residence was different from rezoning from residential to commercial . Mr . Desch answered that in zoning to multiple residence the question of density must be consider - ed . Mr . Liberman agreed to present a more detailed plan to the Planning Board. , MULTIPLE RESIDENCE ENFORCEMENT A discussion of the enforcement of the Mitchell Law followed . . It was decided that the Building and Zoning Officer , Mr . Soyring be asked to become familiar with the law and make inspections for compliance . Councilman McElweeiialso asked that the Assessor do inspections on new property for such compliance . SOUTH HILL SEWER DISTRICT AND SECOND SOUTH HILL WATER DISTRICT iThe Town Clerk presented, copies of the orders of the State Comptroller granting the applications for permission to establish the South Hill Sewer District and the Second South Hill Water District , Attorney Buyoucos was authorized to prepare the final order establishing these districts . APPOINTMENTS - REGIONAL PLANNING BOARD AND SCHOOL CROSSING GUARD Supervisor Kerr offered the following resolution and moved its adoption . RESOLVED that Noel Desch be appointed as town representative to the Regional Planning Board and BE IT FURTHER RESOLVED that Mrs . Bhagwadi : Mitruka , 540 Warren Road. be appointed to serve as school crossing guard near the new walkway on Warren Rd . ; such service to be compensated at $ 4 . 00 per day . , . FIRE PROTECTION CONTRACTS - PUBLIC HEARINGS Noone was - present- to be heard at the public hearings : held on the fire protection contracts. between the' City of Ithaca. and the . Town , and between the Village - of Cayuga Heights and the Town . . Proof of publication and posting were presented . _ The public hearing on , the City Contract was held at 5035 P . DELINQUENT BILLS Councilman McElwee offered the following resolution and moved Its adoption:!'.) RESOLVED that the delinquent bills in the Forest Home Water District , totaling $ 98 . 20 be added to the tax roll for the year 1967 . ti Seconded by Councilman Mayer Ayes Kerr , Mayer , Baker , McElwee and Gordon Noes - 0 Carried: 125 EAST ITHACA WATER DISTRICT Mr . James Dunlap of Lozier ;, Engineers , Inc . was present with plans for the " improvemnt of services in the East Ithaca Water District . The proposal calls for a 10 inch diameter wa:termain in Pine Tree Rd . and Judd Falls Rd . to connect to a - 6 inch existing main in Pine Tree Rd . now belonging to the East State St .-Ext . Water District . The total. estimated. cost is approximately $ 38 , 000 . It is proposed to finance the improvements with the sale of Serial Bonds to be retired over a period of ' 38 years , " Based on an Interest rate of 4% the first - year total payment would be approx - ima tely $ 2 , 500 , Attorney Buyoucos wil.1 prepare the necessary papers for. petitions to be circulated among the residents who will benefit from these improvements . • NORTHWEST WATER AND SEWER DISTRICTS Progress is reported. • to be slow on the circulation of petitions for the formation of the Northwest - Water and. Sewer ' Districts . Re - quests for additions or deletions from the proposed. new districts have been received and Supervisor Kerr feels that the district boundaries may need to be redrawn and. then the district can be man- dated by the ,Town , Board . APPOINTMENT RECEIVER OF TAXES AND ASSESSMENTS Supervisor Kerr offered the following resolution and. moved its adoption . RESOLVED that Mrs . Myrt .l-e M . Hewitt who is to be Town Clerk effective December 1 , 1966 , a.lso be appointed Receiver of Taxes and Assessments . Seconded by Councilman Gordon Ayes - Kerr , Baker , Mayer , Gordon and McElwee Noes - 0 Carried . DRAINAGE - NORTHEAST Mr . Desch stated that the drainage problems are beginning to be reported in the area. of the northeast where Mr . Lagra.nd Chase has been developing . ( The area adjacent to the new NE school ) PUBLIC HEARING - REZONING OF REULEIN PROPERTY The public hearing to hear all persons interested in the rezoning of the Reulein property along the Trumansburg Road opened at 6 : 00 o ' clock P . M . . Because of the number of people present the meeting was adjourned to the Common Council Room in the City Hall . Proof of publication and posting were presented . Present were Attorney Walter Wiggins , John Vasse , Mr . • Reulein , Mr . Petito , and about 12 residents of. the immediate area interested in the rezoning . Councilman Harry Gordon presented a petition signed by those property owners owning property within 100 feet of • the proposed rezoning . The petition was in -the form of a protest against the rezoning . Mr . Reulein asked what the objections are . To open ' .the hearing Attorney Wiggins submitted the site plans and explained that the plans had changed so that there . are now 77 units . Attorney Buyoucos then explained Section 265 of Town Law • which states that a. protest must be signed by owners of 20% or more of the area included in such a proposed change , or of ' that immediately adjacent extending one hundred feet therefi! om. or : of that. rdirectly opposite thereto , extending one hundred feet from the street frontage of such opposite land . If a change is to be made there must be a. favorable vote of at least four members of the town board . Supervisor Kerr said that the purpose of the hearing is to hear- peop3e for or • aga. inst other • than those who signed petitions . In answer to the question regarding the petition that had been- signed a year ago , Supervisor Kerr stated - that the petition that was signed at the time this property was proposed for hi -rise stated that the -petitioners were against hi - rise development , but did not oppose multiple residence . The following people spoke : Mr . William Hooten - 1235 Trumansburg Rd . - I am against this rezoning . The nursing home was forced upon us , and my property is now worthless because of it . Mr . McOmber - Are you going to put low income houses in here? If you are , I am against it . 126 Mr . Wiggins stated that the apartments would rent for $ 135 • to $ 169 . per month and are - not intended for low - income housing . ' Mr . Sanders - I an opposed . My wife ' s name is on the petition . This is . not in harmony with the area. . It is in a. hazardous traffic area . . Mr . Richard Perry - I own the land. across the road. andCam neither for or against at this time . If people are voting against toey are voting for something they know - nothing about . I ' ve seen plans submitted to the Planning Board and feel this '-would be a good use for the land . This use would add to the tax roll . Mr . Reulein - . I ' ve tried for 35 yeq.rs to sell this property and can ' t due" to the sewer running across it . Mr . Perry - For those - people who object to. an increase in traffic traffic mayyincrease anyway . I _ A resident of Hillcrest Drive asked if the traffic •would use Hillcrest Dr . for an exit . _ Mr . Desch answered that the developer has to guarantee that there will be a cul - de - sac . Mr . , Kerr; stated that to make Hillcrest - Dr . a4town road would require acquisition. . of land now belonging to Mrs . Mereness and the cutting away of the bank toward. the - Trumansburg Rd. . Mr . ;Fisher - I have talked to the developer . tyying - fo get an , objective point ©f . view . I thought that after the last meeting the rezoning was turned down . What is the legality for reconsidering this ? When I moved here I couldn ' t find• - a - decent °apartment for $ 175 . per month and I wonder what quality these will be . S . Carolyn Marsh - I live at 1125 Trumansburg .Road and J also represent Miss Finch who is. opposed . This is my third trip to oppose this construction. We like the protection of zoning . If zoning is changed for this , it may snowball -. Miss Riggs - 1129 Trumansburg Road - If you let down the bars for multiple residence , you ' ll :then have commercial coming next . With more people - and the possibility of multiple residence at � the Perry farm and then farther up the road commercial this use of the land will . grow and grow . The argument that the land doesn ' t sell Isn ' t correct . Why hasn 't it sold? Mr . Reulein '- Ther is a 30 ft . right of way diagonally across the lot for a sewer line . Mr . Wiggins - There is an additional problem here in that the sewage will all have to be pumped back up to the line and that will mean that a pump station will have to be constructed . Mr . McElwee ' - The history of this line involves ownership by the state of N . Y . at the time of Biggs Hospital . Mr . , Wiggins - To respond to one concern voiced that zoning will be cga.nged in many places — When the zoning ordinance was written the authors decided that rather than -decide then where multiple housing should go that they would let each -decision rest on its own merit . This plan has gone to the PlanninglBoard and. the request is only for zoning to multiple residence . There is -no thought on the part. of the planning Board to open this area- for gas stations etc . Mr . Desch of the Town Planning Board also stressed that there are no plans now for anything beyond a multiple residence zone and emphasized that each area to be rezoned is considered on its own . merit . Mr . Va.sse - I have had this property for sale 18 years - relatively few building . permits are issued for construction along main roads In the Town of Ithaca and this property won ' -t sell for housing . Mr . Hartsock - My land adjoins this lot . This is now a fire hazard as it stands . This project will go to the Town of Ulysses if not here . This will be an asset - for - the town and I am for it . Mr . Hooten - = - Why is the sewer line where it is ? I live next door to the Nursing home - . it is far behind my property - does it come up nearer the road. here ? ( In answer Mr . Wiggins showed a map of the sewer location . ) Question addressed to Mr . Wiggins - Where are the parking •lots ? Answered , by Mr . Wiggins by showing of - a. ma.p-. Question - Where will Rt . 96 go ? And what is considered rent for low income housing ? Answer to first question by Mr . Kerr - We don ' t know the location . To 2nd question by Mr . Wiggins - $$ 70900/ month . A resident answered this question by saying he had rented an apartment for a number of years for $ 100 . and felt he had never had paupers live therO; .- in fact he had had nice people . Mr . Gordon - I still say No - Our petition is against it . Dr deProsse asked me to speak for him and he is against it . Capt . Fisher - How many hearings are involved to decide this ? Attorney Buyoucos - No limitations - Mr . Kerr - Limitations only in the # voting for it . 127 The public hearing was adjourned at 7 : 30 P . M . After the hearing the Board discussed the need . for such type of housing . Councilman Gordon felt there should be control over multiple housing . Supervisor Kerr offered the following resolution and moved its adoption : WHEREAS , the Planning Board of the Town of Ithaca has recommended to the Town Board that subject parcel - be changed from a residential zone to a multiple Residence Zone and WHEREAS , the Town Board duly called a public hearing to hear 'all persons interested in such a change in zoning and WHEREAS , said public hearing was held by - this Town Board - on Nov . 10 , 1966 beginning - at 6 : 00 . o ' clock P .
