The regular meeting of the Town Board of the Town of Ithaca
was held at the Town Office , 108 E . Green St . , City of Ithaca at
4 : 00 o ' clock P . M *, on September 12 , 1966 .
Board members Presemt were : Supervisor William B . Kerr ;
Councilmen Harry Baker , Joseph N . Mayer , Jr . and A . W . McElwee ,
Also present were : Highway Sup t . Marion Morey , Attorney
James Buyoucos , Harry Gordon , Loran Marion , James Dunlap , Noel
Desch , Jerry Langdon , Robert Regala and Town Clerk Mrs , Fuess ,
Also present were six persons interested in the public hearing
on Tax Exemption ,
PUBLIC HEARING - PARTIAL TAX EXEMPTION ORDINANCE
Supervisor Kerr opened the Public Hearing on an Ordinance to
provide fora partial tax exemption for certain persons with limited- 0
income who are 65 years of age or over at 4 : 00 o ' clock P . M . , Proof
of posting and publication were presented ,
There were six persons interested in the ordinance present ,
The question was asked concerning where the blanks to file for the
tax exemption would be obtained and Supervisor Kerr explained that
they would be provided by the State , All present were in favor of
the ordinance . The hearing was closed at 4 : 10 P , M . i
Supervisor Kerr offered the following resolution and moved

RESOLVED that the following ordinance be adepted.:i
AN ORDINANCE PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY
Ok"IIED BY CERTAIN PERSONS WITH LIMITED INCOME WHO ARE 65 YEARS OF
AGE OR OVER ,
SEC17ON I . Pursuant to the provisions of Section 467 of the
Real Property Tax L.aw ' ( added by Chapter 616 , Laws of 1966 ) , real
property , located in the Town of Ithaca , used exclusively fbr
residentia.l , purposes , and owned by one or more persons , each of
whom is sixty - five years of age or over , shall be exempt from
taxation by said Town to the extent of fifty per centum of the
assessed valuation thereof . This exemption , however , shall be
limited to such property and persons as meet the conditions , qual -
ifications , exclusions , and limitations set forth in said Section
467 of the Real Property Tax Law and shall be in accordance with
and comply with said Section of the Real Property Tax Law as now
adopted and as it may be amended ,
SECTION II , Application for such exemption must be made by
the owner , or all of the owners of the property , on forms to be
furnished. by „ the Town of Ithaca assessor ' s office and shall furnish
the information and be executed in the manner required or prescribed
In such forms , and shall be filed in such assessor ' s office at least
ninety days before the day for filing the final assessment roll .
SECTION III . . Any conviction of having made any willful false
statement in ' the application for such exemption , shall be punishable
by a fine of not more than one hundred dollars and shall disqualify
the applicant or applicants from further exemption for a period of
five years .
SECTION , IV . This ordinance shall become effective immediately .

APPROVAL OF MINUTES
Councilman Baker offered the following resolution and moved
its adoption :
RESOLVED that the minutes of the July 11 and the August 8th ,
1966 Town Board meetings be approved .

RESIGNATION FROM GREATER ITHACA REGIONAL PLANNING BOARD
Supervisor Kerr notified the Board that he had received the
resignationof Robert Mueller from the Greater Ithaca Regional Planning
Board ,
Councilman McElwee arrived .
CERACCUE TV ' FRANCHISE
Supervisor Kerr told the Board that he had received a letter
from Attorney Walter Wiggins on behalf of the Cera.cche TV Corporation
requesting consideration of a renewal of the TV Franchise . The
Board decided. to delay decision until the Village of Cayuga Heights
renews their contract .
EXTENSION OF WATER AND SEWER TO RIDGECREST ROAD
Supervisor Kerr read a letter from Robert Regala in regards
to the extension of water and sewer services to the Ridgecre: st Road
area . In answer to Mr . Regal_ a ' s request for a legal petition to
circulate , Supervisor Kerr stated that they have been prepared by
the Attorney and that cost estimates have been prepared by the
Engineers , but until such time as the parent district has received
approval. of N . Y . State Dep t . of Audit and Control neither would be
available .
LIBRARY REQUEST
A letter from lair . Courtney Crawford , Chairman of the Cornell
Library Finance Committee asked the Town to consider an appropriation
of $ 18 , 330 . 00 for the town ' s share of the 1967 expenses of the
library . The Board will consider the request when drawing up the
new budget .
• PLANNING BOARD REQUESTS
A letter from Noel Desch , Chairman of the Town of Ithaca Planning
Board asked the Town Board to consider a budget for 1967 that would
allow money for the hiring of an experienced. planning consultant ;
money for Planning Board expenses and also salary for a Town Engineer .
Supervisor Kerr said he was not certain the town wants to do
this , but felt they might consider contracting with a licensed planner
for certain jobs . Each Town Board member was given a copy of Mr .
Desch ' s request .
DRAINAGE PROBLEMS - NORTHEAST
Councilman Baker felt the Board. should. be aware that drainage
problems now exist in the northeast area of the town where Mr .
Lucente is now building homes . In many cases the drains are below
the road ditch levels and water is stagnant in them . After dis -
cussion of the controls a town can have over such problems , Councilman
McElwee asked Engineer Dunlap for his advice: Mr . Dunlap said he felt
the town well soon need a Sup ' t :. of Public Works , The Town may need

to consider storm sewers in the near future . He stated thet some towns
have developers plans reviewed by an Engineer and in some cases
require each developer to deposit money until building .requirements
are met . �
CORRESPONDENCE - KOPPERS CO .
A letter from W . B . Jackson , Vice President and General Manager
of Koppers Co . , Inc . advised Supervisor Kerr that the Company
is working on a plant layout for a relocation of their facilities
and tha.nkedilhim for his ' assistance .
EAST ITHACP.iIWATER DISTRICT
Mr . Barnes who owns property at the corner of Judd Falls and
Ellis Hollow Rds , desires to have water extended to his property .
Mr . Dunlap ';said the pressure and volume of water should be increased
to serve the Bowling Alley also and once more recommended the addition
of another water tank on Snyder Hill ,
NORTHEAST SEWER DISTRICT
Mr . Dunlap reported that the final estimate of cost of construct -
ion of the Northeast Sewer District is $357 , 941 . 41 . He recommended
to the Board that 5% be reserved for one year .
Supervisor Kerr offered the following resolution and. moved its
ad opt) i on :
RESOLVED that the amount of 9" 17 , 879 . 04 be retained for one
year from the final payment of $36 , 563 . 67 now due the contractors ,
Howard and Sprague .

A discussion followed concerning the financing of the North-
east district for next year and the Board decided that a special
district assessment roll should be prepared for the Northeast Sewer
District so that the sewer charge can be includ. ed. '. with the 1967 Town
and County Tax Bill ,
PUBLIC HFARING - AMENDMENT OF ZONING ORDINANCE
A public hearing to hear all persons interested in an. amend -
ment to the ' Town of Ithaca Zoning Ordinance was held at 5 : 00 o ' clock
P . M . Noon.e , was present to be heard and Councilman Mayer offered. the
following resolution and moved its adoption :
RESOLVED , that the Zoning Ordinance of the Town of Ithaca shall
be amended as follows .
ARTICLE IV - Residence District R- 15 . Add a. new paragraph 10
to Section 11 to read as follows .

ASSESSOR
Supervisor Kerr was authorized to contact Don Franklin to
determine the date he would. be able to begin work as the Town ' s
Assessor .
• RETIREMFNT PLAN - NON- CONTRIBUTORY
The Town Board discussed whether or not the Employees ' Retire -
ment Plan should be changed. to a. non- contributory plan . It was
decided that the contributory plan now in effect is more advantageous
and no change will be made .
LIBERMAN REQUEST FOR REZONING
Mr . Leonard Liberman was present to ask the Town Board to
consider rezoning of a portion of his property to commercial and
a portion from residential to multiple residence . The Board asked
Mr . Liberman to present his proposal first to the Town Planning
Board and after receiving their recommendation the Town Board
will consider the rezoning at the October meeting .
REZONING OF FARRELL PROPERTY ALONG CODDINGTON ROAD
The public hearing to hear all persons interested in the
rezoning of property belonging to William Farrell along the Coddington
Road was called by Supervisor Kerr at 5 : 45 ' o ' clock P . M . Proof of
posting and publication were presented . Noone was present to speak
for or against the rezoning and Councilman McElwee offered. the
following resolution and moved. its adoption :
RESOLVED that a portion of parcel designated on the Town of
Ithaca tax maps as parcel 48 - 1 -4 &5 'and measuring 264 feet along
Coddington Road and 300 feet deep be rezoned from residential to
multiple residence . ( See complete description as recorded in Zoning
Ordinance Book )

PUBLIC HEARING FOR REZONING REULEIN PROPERTY
Councilman McElwee offered the following resolution and moved
its adoption :
RESOLVED , that a Public Hearing be held at 4 : 00 o ' clock P . M .
( Daylight Saving Time ) on October 3 , 19.66 to consider the rezoning
of a parcel of property more particularly described as follows :
Being property located at the 1100 block of the Trumansburg
Road and having road frontage of approximately 629 feet , and depth
of 436 feet ; and being the - same premises presently owned by Seville
Reulein , as ,conveyed by deed recorded in the Tompkins County Clerk ' s
Office , and designated as parcel 26 - 4 - 33 on Tax Maps now on file in
the Town of Ithaca. offices . The proposed rezoning would be from
residential to multiple residence .

TOWN CLERK ' S RESIGNATION
Mrs . Fuess asked the Town Board to consider hiring a replace -
ment so that she can resign effective December 1 , 1966 . The Board
will consider applications and set up interviews for the October
meeting .
RESOLUTION - BIRTHDAY GREETING& TO MRS . HANSHAW
Supervisor Kerr offered the following resolution and moved
its adoption :
RESOLVED that this Board hereby extends hearty congratulations
to Rachel Hansha.w , former Town Clerk of the Town , on this her 83rd
birthday and wishes her continued years of health and happiness .

APPOINTMENT - TOWN COUNCILMAN
Councilman Baker offered the following resolution and moved.
its adoption :
WHEREAS , a vacancy exists in the office of Councilman in the
Town of Ithaca , County of Tompkins because of the resignation of
Fra.nklin C . Bishop who was elected November 2 , 1965 for a term of
four years from the first day of January , 1966 ,
NOW THEREFORE , in pursuance of the power vested in us by
Section 64 , Subdivision 5 of the Town Law , we , the duly elected
members of the Town Board of said Town , do hereby appoint Harry
N . Gordon of said Town to fill the vacancy existing in such office
of Councilman . Such appointment is effective immediately and the
said Harry N . Gordon shall hold such office until December 31 , 1966 ;
Seconded by Councilman Mayer . •

The special meeting of the Town Board of the Town of Ithaca
was held at 4 : 00 o ' clock P . M . , Monday , October 3 , 1966 at the
`town of Ithaca Offices , 108 E . Green St . , Ithaca , N . Y .
Board members present were : Supervisor William B . . Kerr ;
Councilmen Harry Baker , Joseph N . Mayer , Jr . , Andrew W . McElwee
and Harry N . Gordon .
Also present were : Highway Supt . Marion Morey , Justice
Fred Hartsock , Planning Board Chairman Noel Desch , Attorney
Walter Wiggins , Mr . Reulein , Mr . Vasse , Town Clerk Mrs . Fuess and
eight persons interested in the rezoning of the Reulein property .
PUBLIC HEARInTG - REZONING OF THE REULEIM PROPERTY
The public hearing on the rezoning of the Reulein property
along the Trumansburg Rd , was held at 4 : 00 o ' clock P . PC . Supervisor
Kerr called the hearing to order . Proof of publication and
posting were presented .
Present were Mr , Reulein , Mr . Wiggins , Mr . Vasse . and eight
residents of the area interested in the rezoning .
Mr . John Vasse opened the hearing by explaining the location .
The property to be rezoned. is on the lower side of Rt . 96 ( the
Trumansburg Rd . ) across from the interesOotion of the Bundy Rd .
It is a lot containing- a.pproximately 5 . 87 acres . The basis for
rezoning is hardship . There is a sewer line running across the
property diagonally and the property is on a side hill . This prop -
osal would mean the construction of 22 story garden type apartments .
The apartments would be built so that the view would not be cut
off in any apartment . The buildings will be around the sewer line •
and the builder will build a new sewer pump '. house on the lower
corner of the development and connect back to the line .
Attorney Walter Wiggins presented the plot plan . The develop -
ment would include approximately 84 units or 11 buildings with 7
units each with some capable of being added to . The two story
construction would not conflict with the tenor of the neighborhood .
S . Carolyn Marsh of 1129 Trumansburg Rd , said she was anxious
to have the „ area remain residential . She said she approved of this
type of development more than the high rise , but even this type of
development would bring more cars , more traffic , etc . . She said
she was here to listen , but she did want to keep the area resident -
ial
Mrs . Sanders who lives at 1201 Trumansburg Rd. . ( immediately
adjacent to the property in question ) asked why the zoning should
be changed . She objects to the development and said that she had
counted the cars on Rt . 96 that day for a period from 7 : 30 to 7 : 45
AM going only one way and counted 182 cars . Traffic would be a
problem , she said .
