The regular meeting of I! the Town Board of the Town of Itha.ca.
was held at 4 : 00 P . M . , Monday , August 8 , 1966 at the Town of
Ithaca Offices , 108 E . Green! ,- Itha.ca , N . Y .
Board members present Were : Supervisor William B . Kerr ,
Councilmen Harry Baker , A . W . McElwee , and Joseph N . Mayer , Jr .
Also present were : Hi � hwa ,y Supt . Marion Morey , Mr . James
Dunlap , Mr . Regala , Mr ,, Va.nEpps , Attorney James Buyoucos and
Jerry Langd. on of the Ithaca Journal . Absent was Town Clerk Mrs . •

SLATERVILLE ROAD AREA SEWERIDISTRICT - FINAL ORDER
In the Matter of the Establishment of the Slaterville Road
Area Sewer District in 'ithe Town of Ithaca , County of Tompkins ,
New York .
if
WHFREAS a map , plan and report relating to the establishment .
of the proposed Slaterville ! Road Area Sewer District , prepared by
competent engineers , duly licensed by the State of New York , was
duly presented to and filediiwith the Town Board and an Order was
duly adopted by the Town Board on the 21st day of February , 1966
for the hearing of all persons interested in the matter on the
7th day of March , 1966 at 4130 o ' clock P . M . on that day at the
Town Offices in the City of Ithaca. , Tompkins County , New York ,
and a hearing by the said Board haveing been duly held at such
time and place and it having been duly resolved and determined ,
on the 7th day of March , 1966 , following such hearing that
the Notice of Hearing was published and. posted. as required by law
and was otherwise sufficient and that all the property and
property owners within the proposed district were benefited there -
by , and that all of the property and property owners benefited
are included within the limits of the district and thpt the
establishment of such district was in the public interest and
itc:- au ng been further resolved and determined that the establish-
ment of a sewer district , as set forth in the aforesaid map , plan
and report be approved , and that the improvement therein mentioned
be constructed , and the boundaries of the district having been
then and there finally determined. and set forth and described in
the said Resolution , and it ` having been further resolved that said
Resolution was subject to alpermissive referendum as provided in
Section 209 - e of the Town Law , and
A Petition having been 'Ipresen:ted end filed with the Town Clerk
of the Town of Ithaca pursuant to .Article 7 and 12 - A of the Town
Law , requesting a referendum on the adoption of the aforesaid
Resolution , and the Town Boardf. , having duly adopted a Resolution_ on
the 11th day of April , 1966 ; designating the hours and place of
holding the election and setting forth in full the proposition to
be voted upon , and the Town 'II� Clerk having duly posted notice of such
special election and caused such notice to be published on the
21st day of April , 1966 , and. the proposition haveing been sub-
mitted to the qualified voters in the said district , and the •
referendum held , at the special election held on the 4th day of
Nay , 1966 , and t U he proposition having been approved by the
affirmative vote of a majority of the owners of taxable real
property situate in the proposed district and shown upon the
latest completed assessment +; roll of the Town voting on such pro -
position , and
Application having been thereafter and on the 9th day of May ,
1966 , duly made in duplicate to the State Department of Audit and
Control at Albany, New York , for permission to create such district
as more fully provided for by Article 12 - a, of the Town Law , and the
State Comptroller having duly made an order in duplicated dated
July 6 , 1966 , granting permission for the creation of the district ;
and one copy of such order having been duly filed in the Office

of the State Department of Audit and Control at Albany , New York ,
and the other in the Office of the Town Clerk of this Town on the
12th day of July , 1966 , and
The Town Clerk having filed his certificate with the County
Clerk of the County of Tompkins and the Office of the Department of
Audit and Control at Albany , New York stating that a petition for a.
referendum was filed and that a referendum was held pursuant to
the provisions of Section 209 ::- e of the Town Law and certifying
the result of the vote on the proposition submitted at such referendum ,
it is hereby
ORDERED , that a, sewer district be established in the sp. id Town
of Ithaca , Tompkins County , New York , as described in the order of the
State Controller aforesaid , to be designated as the Slaterville Road
Area Sewer District of the Town of Ithaca , Tompkins County , New York ,
• and it is further
ORDERED , that the maximum amount proposed to be expended for
the said improvement and for the acquisition of the necessary lands
and easements is Five Hundred , Twenty Thousand Dollars ( $ 520 , 000 , 00 ) ,
and it is further
ORDERED , that the said district be of the following description
and boundaries , to wit : ( See pgs . 77 and 78 for description )

APPOINTMENT OF DEPUTY TOWN CLEaK
Supervisor Kerr offered the following resolution and moved its
adoption :
RESOLVED , that Mrs . Jane Cowan be appointed Deputy Town Clerk .
Seconded by Councilman McElwee
Ayes - Kerr , Baker , Mayer and McElwee
Noes - 0 Carried .
DRAINAGE PROBLEM - SLATERVILLE ROAD
A discussion of the drainage problem on Slaterville Road on the
Victor Burgess property was held. . No action was taken as both the
Highway Superintendent and Harry Baker stated. their familiarity with
the problem and said that it did not arise from any action the town
took in replacing a culvert on the Snyder Hill Road .
APPOINTMENT TO THE ZONING BOARD OF APPEALS
Supervisor Kerr offered the following resolution and moved its
adoption :
RESOLVED that Loran Marion be appointed to the Zoning Board of
Appeals to fill the vacancy caused by the resignation of William
Scott . The appointment is to effective to October 5 , 1968 .

AUTHORIZATI°ON FOR T0WN OFFICIALS TO ATTEND MEETINGS
Supervisor Kerr offered. the following resolution and moved its
adoption :
RESOLVED that Justice Fred. Hartsock be authorized to attend the
New York State Magistrates Conference on Long Island in September
and that Highway Superintendent Marion Morey be authorized to attend
the Highway Sup ' t . s School at Lake George in September .

SCHEDULING OF PUBLIC HEARINGS FOR SEPTEMBER 12 , 1966 MEETING
Supervisor Kerr offered " the following resolution and moved its
adoption .
RESOLVED that the following public hearings be ordered for the
September 12 , 1966 meeting of the Town Board :
AT 4 : 00 O ' CLOCK P . M . Daylight Saving Tiem - A Public Hearing
to hear all interested persons for or against a proposed ordinance
to provide for the PARTIAL TAX EXEMPTION of real property owned by
certain aersons with limited income who are 65 years of age or over
in accordance with Section 467 of the Real Property Tax Law ( added
by Chapter 616 , Laws of 1966 )
AT 5 : 00 O ' CLOCK P . M . Daylight Saving Tiem - A public hearing
to hear all interested persons for or against the following amend -
ment to the Zoning Ordinance :

AT 5 : 45 O ' CLOCK P . M . Daylight Saving Time - A Public Hearing
to hear allilnterested persons for or against a rezoning of a section
of parcel 48 - 1 -4 &5 as shown on the Tax Maps on file in the Town
of Ithaca offices . The proposed rezoning of subject parcel would
rezone a section 264 feet along Coddington Road and 300 feet deep .
from residential to multiple residence .

APPROVAL OF WARRANT
Councilman Mayer offered the following resolution and moved •
its adoption :
RESOLVED that the following bills be paid : General Fund
Bills.:- #316 ,, through #351 in the amount of $3 , 578 . 91 and Highway
Fund Bills # 225 through # 251 in the amount of $ 6 , 112 . 43 .

The regular meeting of the Town Board of the Town of Ithaca
was held at the Town Office , 108 E . Green St . , City of Ithaca, at
4 : 00 o ' clock P . M ,. on September 12 , 1966 .
Board members Presemt were : Supervisor William B . Kerr ,
Councilmen Harry Baker , Joseph N . Mayer , Jr . and A . W . McElwee .
Also present were : Highway Sup t . Marion Morey , Attorney
James Buyoucos , Harry Gordon , Loran Marion , James Dunlap , Noel
Desch , Jerry Langdon , Robert Regala and Town Clerk Mrs , Fuess .
Also present were six persons interested in the public hearing
on Tax Exemption .
PUBLIC HEARING - PARTIAL TAX EXEMPTION ORDINANCE
Supervisor Kerr opened the Public Hearing on an Ordinance to
provide for partial tax exemption f. or certain persons with limited
income who are 65 years of age or over at 4 : 00 o ' clock P . M . . Proof
of posting and publication were presented .
There were six persons interested in the ordinance present .
The question was asked concerning where the blanks to file for the
tax exemption would be obtained and Supervisor Kerr explained that
they would be provided by the State . All present were in favor of
the ordinance . The hearing was closed at 4 : 10 P . M .
Supervisor Kerr offered the following resolution and moved •
its adoption :
RESOLVED that the following ordinance be ad optchdn
AN ORDINANCE PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY
OWNED BY CERTAIN PERSONS WITH LIMITED INCOMF WHO ARF 65 YEARS OF
AGE OR OVER *
SEQ—TTON I . Pursuant to the provisions of Section 467 of the
Real Property Tax Law ' ( added by Chapter 616 , Laws of 1966 ) , real
property , located in the Town of Ithaca , used exclusively f'or
residential purposes , and owned by one or more persons , each of
whom is sixty - five ,years of age or over , shall be exempt from
taxation by said Town to the extent of fifty per centum of the
assessed valuation thereof . This- exemption , however , shall be
limited to such property and persons as meet the conditions , qual -
ifications , exclusions , and limitations set forth in said Section
467 of the Real Property Tax. Law and shall be in accordance with
and comply with said Section of the Real Property Tax. Law as now
adopted and as it may be amended .
