ZONING ORDINANCE BOOK AND MAP The Town Board has requested that the Planning Board bring the Zoning Ordinance Book and Map up to date so that new ones may be printed . TV FRANCHISE The Town Board expressed a desire to wait to see what decisions the Village of Cayuga Heights makes and „ to meet with them in regards to the renewal of the TV cable franchise . Members expressed once more their concern over the increase in rate and the fee paid to the Town . Supervisor Kerr offered'% the motion for adjournment at 7 : 25 P . M . Seconded by Councilman Baker Ayes - Kerr , Mayer and Bakker Noes - 0 Carried APPOINTMENTS OF ELECTION INSPECTORS AND CUSTODIANS AND DESIGNATIONS FOR REGISTRATION DAYS The Board decided to combine polling places for Registration Days on6 October 6 and October 9th , 1966 as follows : Districts 1 and 2 - Tompkins County Hospital (H Building ) District 3 • - National Cash Register Cafeteria Districts 4 and 5 - Cayuga Heights Fire Station • Districts 6 , 7 and ;8 - Cayuga Heights School Only two election inspectors from each of the combined districts would be needed each day, thus cutting in half the number employed . RENT OF COPY MACHINE • Supervisor Kerr offered the following resolution and moved its adoption : WHEREAS , the City of Ithaca has made available to the Town of Ithaca the use of an AB Dick copy machine at the cost of $10 . 00 per month minimum fee ( any charge over this amount at the price of $ . 07 per copy up to 500 and $ . 045 in excess of 500 ) , now therefore , BE IT RESOLVED that the Town agrees to pay the City of Ithaca for the use of the copier at the above rate , and BE IT FURTHER RESOLVED that this agreement shall be in effect until cancelled by either the City or the Town . Seconded by Councilman Mayer Ayes - Kerr , Baker and Mayer Noes - 0 Carried . d Councilman McElwee arrived . RESIGNATION - COUNCILMAN BISHOP Councilman Franklin C . Bishop notified the Board that because he is moving to Riverhead , L . I . ' he was resigning his post as Councilman . I 1 ® 4 Supervisor Kerr offered the following resolution and moved its adoption : RESOLVED , that the Town Board accepts with regrets the resignation of Councilman Franklin C . Bishop effective July 1st , 1966 . Seconded by , Councilman McElwee Ayes - Kerr , Mayer , Baker and McElwee Noes - 0 Carried . Following a discussion of the appointment of a successor for Councilman Bishop it was decided that each Board member should present a * list of possible replacements . An appointment by the Town Board would be for a term to expire December , 31 , 1966 and the appointed Councilman would then run for election in Nov . 1966 for a term to expire at the same time Councilman Bishop ' s term would have. expired ( Dec . 31 , 19691 . SOUTH_ HILL WATER DISTRICT AND SOUTH HILL SE19M DISTRICT EXTENSIONS Mr . James Dunlap of Lozier Engineers , Inc . presented tb. the Board • the proposed extension to South Hill Water District #2 and to the South Hill Sewer District . Residents of the area at the corner of the Danby Road and King Rd . E . have asked' to be included in both districts . Some of the residents of the Ridgecrest Road have expressed a desire to be included also , and the figures Mr . Dunlap presented included both of these areas . The extension of the Sewer District would included 121 units as follows : Frontage Units - 57 Excess frontage equivalent units - 25 Acreage units served by sewers - 39 Total equivalent units 121 The total cost would be $190 , 000 . and the first year total cost would be $12 , 125 . 00 or $100 . 20 per unit . This cost would include monies reserved for rock excavation and contingencies and if all of this money is not necessary the first year unit cost could be reduced to approximately $78 . 00 . The extension of the South Hill Water District #2 would involve the same number of units ( 121 ) . The cost of the extension in this district would be $36 , 000 . As proposed by Mr . Dunlap the annual unit cost would be based on two cost figures comprising monies needed to amortize the cost of the bond issue and an annual entrance fee to be paid to the South Hill Water District No . 2 . The entrance fee requirement is due to the sharing of facilities constructed by the South Hill Water District No . 2 . The first year unit entrance fee is estimated at $42 . 35 which will make the estimated first year unit cost $61 . 75 . Councilman Mayer questioned the unit costs of the districts because at the time the costsof the districts were first figured the addition of this area resulted in a lower water district cost and a higher sewer district cost , but the combination overall was lower . Councilman Mayer felt he could not vote in favor of the extension of the water district if it meant that an entrance fee in the amount quoted would have to be added . Mr . Robert Regala who lives at 139 Ridgecrest Road told the Board that he felt there would be opposition to the extension of the districts at the unit prices indicated . After discussion it was decided to change the data to the degree that the unit cost of the extension of water and sewer together would not be greater than the original district plus a nominal amount ( $1 . 00 entrance fee ) for an entrance fee and if by combining the districts would benefit mutually. Petitions would be circulated to obtain the wishes in regards to the extension of these districts . RESOLUTION - SUPERVISOR TO APPLY TO AUDIT AND CONTROL ( SHWD #2 ) • In the Matter of the Establishment of the South Hill Water District No . 2 in the Town of Ithaca , County of Tompkins , State of New York, pursuant to Article 12-A' of the Town Law . WHEREAS the Town Board of Ithaca has this day adopted a resolution pursuant to Section 209-e of the Town Law approving the establishment of South Hill Water District No . 2 , be it RESOLVED that the Supervisor be authorized and directed to make application to the Department of Audit and Control , pursuant to Section 209-f of the Town Law , for permission to create said Water District . This resolution shall take effect immediately . The adoption of the foregoing resolution was duly put to ' a vote , and upon roll call , the vote was as follows : William B . Kerr , Supervisor voting aye Joseph N . Mayer , Jr . , Councilman voting aye Andrew W . McElwee , Councilman voting aye Harry U. Baker , Councilman voting aye . The resolution was therupon declared duly adopted . 1A RESOLUTION - SUPERVISOR TO APPLYILTO AUDIT AND CONTROL ( SHSD ) In the Matter of , the Establishment of the South Hill Sewer ' District in the Town of Ithaca , County of '', Tompkins , State of New York , pursuant to Article 12-4 of the Town Law . WHEREAS the Town Board of Ithaca has this day adopted a resolution" pursuant to Section 209-e of the town Law approving the establishment of South Hill Sewer District , be it RESOLVED that the Supervisor be authorized and directed to make application to the Department of Audit and Control , pursuant to Section 209-f of the Town Law , for permission to create said Sewer District . The resolution was thereupon declared duly adopted . SLATERVILLE ROAD SEWER DISTRICT METHODS OF ASSESSMENTS DISCUSSED Mr . Robert Sweet , 1403 Slaterville Road , was present to talk with the Board in regards to the method of assessment in the Slaterville Road Area Sewer District. ' Mr . Sweet made the following points : ( 1 ) In reference to sewer assessments , the general method of deriving units has a basic flaw . ' Of the 141 units within the district , 113 would derive immediate;, benefit , but 213 ' s would be unit charges on vacant land . ( 2 ) My land is outside the !, East Sate St . Ext . Water District and should not be included in the sewer district . ( 3 ) The unit charge now indicates an equal charge for an apartment and a living unit ( house ) . I don ' t feel the apartment has the same benefit . ( 4 ) As to the benefits derived , the front footage charge is not equitable . The large lot owner needs the sewer less and the small lot owner needs it more . Unless enough extra fromt footage adjoins there is no benefit derived . ( 5 ) There should be some way residents could offer recommendations when districts are being formed and when assessment rolls are prepared . Supervisor Kerr stated that11, the only function of the Town Board is to determine how the money is ', to be raised to finance a district . The money must come from the district . People within a class - resident- ial , commercial etc . must pay equitably . We are at least two years away from the first bill to property owners , but at the time the district is completed and the costs are figured. the representatives from the district should figure the costs and apportionments. Mr . Sweet stated that he felt that 2/3 of the costs of the sewer should not be raised from unoccupied land . Attorney Buyoucos stated that persons who voted for or against the formation of the district could say they were mislead if formulas are changed now . Councilman Baker also questioned the assessment as it applies to apartments . He felt the extra unit assessed for an apartment was too high . Mr . Sweet told the Board that he would write to the President of the Civic Association in their, area and ask him to call a meeting so the members • could let the Town Board know whether or not they wished to prepare the assessment rolls each year . APPROVAL, OF MINUTES Councilman Mayer offered the following resolution and moved its adoption : RESOLVED that the minutes of the May 9 , 1966 meeting be approved. as mimeographed . BY-PASS .ROUTE - FOREST HOME Both Councilman McElwee and Planning Board Chairman Desch recommended that a feasibility study be done in regards to a road to by pass the Forest Home area . CORRESPONDENCE A letter from Noel Desch , Chairman of the Town Planning Board recommended that the Town Board take appropriate action to enforce the terms of the March 1 , 1957 stipulation that the Village of Cayuga Heights • would provide screen plantings for their Village sewage treatment pland along East Share Drive , Frank Liguori of the Tompkins County Health Department wrote to the Board concerning 6 property owners who have not yet connected to the Renwick Heights Sewer System . The Town Board stated that the ten year time limit should apply to them as well as to the new districts now being formed and that unless they need to replace present systems they should not be forced to hook up until the ten years have expired . Supervisor Kerr reported that there are some property owners who live in the Village and have portions of their backyards in the Renwick Heights Sewer District that are now hooking up to that district . Councilman Baker questioned the building of houses on the lower and of Indian Creek Road since that portion of the road has never been accepted as a town highway . Supervisor Kerr said that Mr . Mann had had the approval of the Planning Board before his building permit had been issued . SOUTH HILL WATER AND SEWER DISTRICTS It was the sense of the Board that National Cash Register Co . could not be charged as a part of the new South Hill Sewer District , but that the assessment should be included to figure the total assessment within the district when making application '' to Audit and Control . TV FRANCHISE Supervisor Kerr reported that the Village of Cayuga Heights Bmtd planned a meeting for the evening of June 13 End that he planned to confer with their members further to discuss the renewal of the TV franchise . NORTHEAST SCHOOL TRAFFIC PROBLEMS Supervisor Kerr reported that he had suggested that the State Traffic Commission be contacted through the Northeast School PTA in regards to traffic problems , especially speed limits , near the school . HIGHWAY PROGRESS REPORT Supt . of Highways Marion Morey reported that the base is complete on Sapsucker Woods Rd . and Winston Dr . TOWN CLERK RESIGNATION AND APPOINTMENT Mrs . Evelyn Fuess , Town Clerk , submitted her resignation as an elected official of the Town of Ithaca effective July 1 , 1966 . As of that date she will no longer be a property owner within the Town . Supervisor Kerr offered the following resolution and moved its adoption : • RESOLVED , that the resignation of Mrs . Fuess as an elected official be accepted and that she be appointed as Town Clerk effective July 1 , 1966 . Seconded by Councilman McElwee Ayes - Kerr , Mayer , Baker "and McElwee Noes - 0 Carried . ELLIS HOLLOW ROAD SEWER DISTRICT - CHANGE ORDER Councilman McElwee offered the following resolution and moved its adoption : RESOLVED that a change order in the Ellis Hollow Road Sewer District be authorized so that a boring can be made under Mitchell St . to serve Mr . George Ideman who plans further development in the area of the bowling establishment and the P & C Market . Seconded by Supervisor Kerr Ayes - Kerr , Mayer , Baker and lAcElwee Noes - 0 Carried . 107 WATER DISTRICT EXTENSIONS - SNYDER HILL AREA Mr . Dunlap reported that a preliminary study of the cost of extending water lines so that improved facilities would be available for Ideman ' s and Artificial Breeders as well as the East Ithaca district would involve a cost of about $30 , 000 . as well as a cost of about $125 , 000 , for the construction of a new tank on Snyder Hill . The district would be extended to make it contiguous with the Slaterville Road area Sewer District now planned . A unib charge would be approximately $92 :00/unit . The Board felt that this charge would be reduced considerably if the Backner land is sub-divided . TOUR OF NORTHEAST SEWER AND ELLIS HOLLOW ROAD SEWER DISTRICTS Mr . Dunlap asked the Town Board members to tour the newly constructed • districts in the northeast area of the town on July 7 , 1966 at 4 : 00 P . M . Dunlap of Lozier Engineers , Inc . the progress being made in the sewer and water districts under construction and contemplated in the town . BOYNTON SUB- DIVISION PLANS Mr . Ben Boynton presented sub- division plans for property located off the Elmira Road. . He stated. that he is interested in the extension of water and sewer services to the area and. the development of the area will depend on these services . The - Board. suggested that the plans be presented to Planziing Board at their • meeting on July 12th . ORDINANCE - PARTIAL TAX EXEMPTION The Town Board requested that Attorney Buyoucos prepare an Ordinance to allow for partial tax exemption for certain persons over 65 years of age and having limited income .
