Y . Board. members present were : Supervisor William B . Kerr , Councilmen Joseph N . Mayer , Jr , A . W . McElwee , Harry Baker and Franklin C . Bishop . Also present were : James Dunlap , Harry Gordon , Anthony Ceracche , Attorney Walter Wiggins , Sam Peters , Highway Supt . Marion Morey , Attorney for the Town James Buyoucos , Jerry Langd'on of the Ithaca Journal , Town Clerk Evelyn Fuess . Also present for the hearing called at 5 : 00 P . M . were a.bou.t 55 res - idents of the South Hill Area , BUILDING INSPECTOR AND ZONING OFFICER - APPOINTMENT Supervisor Kerr offered : the following resolution a-nd. moved its adoption : RESOLVED , that Anselm Soyring of 847 Taughannock Blvd , be employed. as Enforcement Officer and Zoning Officer for the town at a rate of $ 2500 , per year! and BE IT FURTHER RESOLVED 'that Mr . Soyring be requested to have office hours at least twice a week and to attend all Zoning Board of Appeals meetings . li Seconded by Councilman Bishop Ayes - Kerr , Bishop , Ba^ker , = Mayer. andfr: McElwee Noes - 0 Carried , PUBLIC HEARING - CERACCHE T ( FRANCHISE Supervisor Kerr opened the public hearing on the renewal of the Ceracche TV Franchise at 4 : 00 P . M . Proof of publication and posting were presented. fil Supervisor Kerr stated that the present franchise does not expire at this time . ( expires in 1970 ) The Village of Cayuga Heights officials plan to meet tonigjh ( the evening of May 9th ) and Mr . ; Kerr stated that they would like to Investigate with the town more fully regarding the quality of signal , change in rates etc . . Mr.. Kerr read letters from citizens Interested in the franchise , but all opposing a renewal to last twenty - five years . Councilman Baker questioned the amount of revenue returned to the town . He said the national average seems to be about 2% . 11 Mr . Sam Peters stated that he felt . the $ 1 . 00 increase in rate was substantial , and felt before this new rate becomes effective there should ` be a. 'lneed shown for the increase . Mr . Ceracche stated that he had been replacing cables all over town and that the $ 1 . 00 increase in rate would help to provide for new 12 channel television . Mr . Peters once again questioned the fact that town residents are required to pay more than city residents and asked why the increase in price . Supervisor Kerr stated that in some communities companies are required to have books audited and to submit reports with their payments each year . Mr . Ceracche stated that the increase in the town was warranted because the homes per mile are so few that the charge needs to be greater . At the present price of $ 3 . 50 the cable can ' t be extended for instance to Mr . Peters . The question was asked. , as to how quality can be controlled . Mr . Ceracche replied that quality can be controlled by replacing outmoded equipment and they were trying to do that right now . • Councilman McElwee said the town board should consider the fact that Mr . Ceracche might sell and felt something should be written into an agreement that would guarantee some measure of quality control . Mr . Ceracche replied that without quality they would not have subscribers . , Mr . Harry Gordon stated- that his worry owas that the hands of future town boards would " be tied and that if Ceracche would sell future boards would belhelpless . He questioned a. 25 year extension of the franchise . Councilman Mayer stated that a new contract could askEfor re - negotiating in case of a new owner . Councilman Baker asked Mr . Ceracche if he had plans for selling advertising time and Mr . Ceracche stated that he was opposed to it and would not reuse programs without permission . Mr . Peters :4stated that the FCC is about to take steps to prevent advertising and felt that the town should be aware of what 25 years of time means . He felt that the right kind of 9 franchise is the importatnt thing - not who owns the business . Councilman McElwee stated that he thought agreement should come either from a committee ;listudy or from a meeting of board members and Mr . Ceracche and. lhis la=wyer . Supervisor Kerr stated that he would like to m=eet with Village officials also . Both Mr . Ceracche and Mr . Wiggins stated that their concern was to hook up the residents ''l'lin the town as soon as possible to a 12 channel cable . Other towns in the county have signed Identical franchises . Mr . Ceracche felt the resident°., of the town were not represented at ;ithis hearing and that further work in the town would have to be held up until the Town Board. tells them what to expect . Supervisor Kerr said that the decision of renewing the present franchise does not have to come at this public hearing . He felt the questions of what control the , t ,own ha. s over quality and rate should be answered ,first . Mr . Peters stated that the fact that Mr . Ceracche says he won ' , t extend lines without a new franchise indicates that controls are needed . Supervisor Kerr orderedlllthe public hearing closed at 5 : 00 P . M . Councilman McElwee was excused . PUBLIC HEARINGS - SOUTH HILLiIIWATER AND SOUTH HILL SEWER DISTRICTS Supervisor Kerr opened the public hearing on the South Hill Water District # 2 and the South Hill Sewer District which would Include all property owners within. the present South Hill Water Districts and the proposed South Hill 'Water District #2 at 5 :, 00 o ' clock P . M . Proof of publication and posting were presented . About 55 area residents wereipresent for the hearing . Mr . Kerr explained the two ways of forming a, district - by the petition method and by hav2ngr�� the district mandated by the Town Board . In case the district is mandated as theseeuddstr. icts are a 30 day period must elapse between the time the resolution to form a. district is passed dlland the time the application is fonwarded to the State Dep ' ta of Audit and. Control for their approval . During this time the residents of the area have a right to petition for a permissivelreferendum . Mr . James Dunlap of Lozier , Engineers , Inc . of Rochester was present to explain the outlines of each district and to explain the costs involved . A petition containing 42 names of residents in the Coddington Rd . , Penna. . Ave . area of the ' town was filed all expressed favor and only two persons in the area felt the cost would make the district prohibitive , Mr . Dunlap showed maps and described the outlines of both the Sewer and dater Districts . He said plans call for a double sewer line to extend on Goddington and Danby Roads , but where feasible the line would go through back yards on the lower side of the Danby Rd . Each home owner would be charged for the benefit derived . 1The first year estimated costs for the i sewer district would be a high of $77 . 00 and a low of $59 . 35 plus the cost that would be paid to the City ofiIthaca as a sewerage treatment charge . The extension of the Water District to cover the same area as the above Sewer District would mean a first, year cost of approximately $61 . 75 ( high estimate ) and a possible low estimate of $55 . 75 . Question - Mr . Gotanian -- Does the district go to the 'Middle of the road ? Answer - Mr . Dunlap -- The line will be brought to the property owner ' s line in each instance . Mr . Yengo -- I live south of King Rd . on the Danby Rd . I have a I have a petition from people in that area who would like to be included in the district . We feel it is important now because of the widening 'lof Rt . 96 Be A . - Mr . Kerr -- I would prefer that this district go first . Q . - Mr . Yengo -- But if more houses were added wouldn ' t that lower costs ? A . - Mr . Kerr -- The overall price might change and as in past experience with the Slaterville Rd , district it would be better to proceed with the original district and then extend to include you . Couldn ' t this be done , Mr . Dunlap , so that construction could all take place at one time? A . - Mr . Dunlap - The time would not vary that much - perhaps by 2 mos . Q . - Mr . Reas - I live on the King .d.d . I know there are about 6 houses along King Rd . and 5 along Danby Rd * that need services now . If the water line is being extended by the homes on King Rd * can-Lt we connect on? • I 98 A . - Mr . Dunlap -- The city will provide water and sewer services together , but there are not quite enough units to keep prices as quoted . Richard LaFave - Danby Rd !! -- We are interested in sewers now as the petition indicates . Can ' t something be done to include - us . A . - Mr . Kerr - We can go . ahead with the extension of - the present district , but I would like to see this district formed right array. Q . Mr . Wurzel --- We will be faced with adding expensive sand filters in the near future . The The of the Danby' Rd . will take our septic tanks . ''! There will be a need for repairs or replacements to an estimated 20 to 25 of them . Q . Mr . James Lacy -- How many units are involved for my land A . Mr . Dunlap -- The unit price for acreage is 2 unit per acre . Q . Mr . Corson - Northview Rd . I own a corner lot . What will my charge be ? A . Mr . Dunlap - There is 150 ft . exemption on a ' corner - lot , so you would not be charged for all of the front footage . Q . What would the charge be on lots on Northview Rd . that are pie shaped - often with more frontage ? A . Mr . Kerr - We would try to treat equally and would probably take average widths . Q . Mr . Hoefer - Northview ° Rd . - How is the charge ' deermined by the City : An Mr . Kerr - The charge is based on water consumption and is usually about a rate and a half what the City residents pay . Q . Mr . Carey -- Could the line ',;be extended to include those homes along Coddington Rd . just beyond Troy Rd. intersection . A . Mir . Kerr -- Some owners on- the opposite side from you do not want to be included . I would prefer that the district go as is and then we could extend later . Mr . Kerr determined that everyone had been heard that desif:ed to be heard and the hearing was closed at 6 : 30 P . M . RESOLUTION FOR ESTABLISHMENT OF SOUTH HILL SUVE-1 DISTRICT FOLLOWING PUBLIC HEARING In the !Matter of the Establishment of the South Hill Sewer District in the Town of Ithaca , County of 4,Tompkins , State of New York , pursuant to Article 12—A of the Town Law . WHEREAS a map , plan and report relatiimg to the establishment of the proposed South Hill Sewer District , prepared by Lozier Engineers , Inc . a competent engineer , duly licensed by the State of New York , in manner and in such detail as has been duly fliled with the Town Clerk of Ithaca , in accordance with the requirements of Article 12—A of the Town Law , and WHEREAS , an order was duly adopted by the Town Board of Ithaca , at a apecial meeting thereof duly callled and held on the lltih day of April , 1966 , • reciting the filing of said map , ''Ilan and report , the improvements proposed , the boundaries of the proposed district , the maximum amount proposed to be expended for such improvements , the proposed method of financing , the fact that the map , plan and reporlt describing the same , are on file in the Town Clerk ' s Office for public inspection , and stating all other matters required by law to be stated , and specifying the 9th day of May, 1966 , at 5 : 00 o ' clock P . M . on that day, as the Ijime , and the Common Council Room, in the City Hall , 108 East Green Streetlin the City of Ithaca , New York as the place where the said Town Board would meet to consider said map , plan and report , . and to hear all persons interested in the subject thereof concerning the same , and .to take such action thereof as is required " or authorized by law , and WHEREAS , such order was duly, published and posted as required by law , and I WHEREAS , a hearing on said matter was duly held by said `town Board on this 9th day of May, 1966,,, beginning at 5 :00 o ' clock P .M . on* that day , at the said Common Council Room in �lthe City Ball at 108 E . Green Street in the City of Ithaca ; New York , and full discussion of the matter having been had , and all persons desiring ''; to be heard having been duly heard , NOW , upon the evidence given upon - such hearing , and ' upon motion of Supervisor William B . Kerr , { seconded by Councilman Joseph N . Mayer , Jr , it is RESOLVED DETERMINED * T at the no of hearing was published and posted as required by law , and is otherwise sufficient . ( b ) That ' all property and property owners within the proposed district , are benefited thereby . ( c ) That all the property and property owners benefited are included within the limits of the proposed district . ( d ) That it is in the public '';linterest to establish such sewer district . . FURTHER RESOLVED AND DETERRIZED * that the establishment of a ' sewer district as set forth in said map , 'I plan and report , be approved ; tYat` the improvement therein mentioned be constructed , and the necessary easements and lands be acquired , upon the required funds being made available and provided for ; and such district shall be known and designated as the South Hill Sewer District in the Town ofj •Ithaca , and shall be bounded and described as set forth in Schedule A which i's annexed hereto and made a part hereof . The boundaries described are 'li.ntended to include all property within said boundaries . FURTHER RIESOLV D that the proposed improvement , including construction costs , , cost of acquisition of land's and easements , legal and engineering fees,, and all other expenses , be fpinanced by the issuance of serial bonds of said Town to mture in such number of annual installments not exceeding , 30 , as may hereafter be determined'' by the Town Board of Ithaca payable in the first instance from assessment's levied on benefited real property in said district ; and it is FURTHER RESOLVED that this resolution is subject to a permissive referendum as provided in Section '1209-e of the Town Law . The adoption of the foregoi.n" resolution was duly put to a vote , and upon roll call the vote wasIr as follows : William B . Kerr , Supervisor voting aye Joseph N . Seconded by Councilman Bish°op Ayes - Kerr , Bishop , Baker and Mayer Noes - 0 Carried . SCHOOL CROSSING GUARD Supervisor Kerr offered thelfollowing resolution and moved its adoption : • RESOLVED , that Mrs . Doris Covey of 118 E . York St . be employed as crossing guard on Warren Road near the Northeast School to replace Mrs . Shirley Wilkinson and BE IT FURTHER RESOLVED that', Mrs . Covey be paid at the rate of $4 . 00 per day . Seconded by Councilman Bishop i Ayes - Kerr , Bishop , Baker "and Mayer Noes - 0 Carried , WARREN ROAD SPEED LIMIT Residents along Warren Roadi' have objected to the increased speed limit along their road and Supervisor Kerr offered the following resolution and moved its adoption : RESOLVED , that the Town tog i'ether with TompkinsCounty once more apply to the N . Y . State Traffic Commission for a new study of speeds along Warren Road ' it lot and a request that - it be lowered . Seconded by Councilman Baker Ayes - ' Kerr , Baker , Bishop and iiv4ayer Noes , ,m 0 Carried . RESOLUTION - SLATERVILLE ROAD AREA SL14ER DISTRICT In the Matter of the Establishment of Slaterville Road Area Sewer District in the Town of Ithaca , County of Tompkins , State of New York , pursuant to .Article 12-A of the Toxin Law : WHEREAS the Town Board of Ithaca has this day adopted a resolution pursue t to Section 209-e of the Town Law approving the establishment of the Slaterville Road Area Sewer District , be it RESOLVED that the Supervisor be 'ilauthorized and directed to make application to the Department of Audit and Control , pursuant to Section 209-f ' of the Town Law , for permission to create said Sewer District . This resolution shall take • effect immediately . The adoption of the foregoing resolution was duly put - to a vote , and upon roll call , the vote was as follows : William B . Kerr , Supervisor voting aye Franklin C . Bishop , Councilman Voting aye Larry U . - Baker , Councilman voting aye Joseph N . Mayer , Jr . , - Councilman voting aye The resolution was thereupon declared duly adopted . RESIGNATION - MEMBER OF THE ZONING B4(QARD OF APPEALS Mr . William Scott notified the ',Board that he could no longer serve on the Zoning Board of .Appeals . Supervisor, Kerr stated that he would ask the Zoning Board for a recommendation before appointing a replacement for Mr . Scott . MOSQUITO CONTROL Supervisor Kerr read a letter from Mr . Richard F . Pendelton requesting a renewal of his contract for mosquito control in the town . Councilman Mayer offered the following resolution and moved its adoption : RESOLVED , that the contract for mosquito control be renewed with Mr . R . F . Pendelton for the currerf year at a price of $900 . 000 Seconded by Councilman Baker Ayes - Kerr , Bishop , Mayer and1j1jBaker Noes - 0 Carried . EXTENSION OF WATER TO TOWN OF DRYDEN Supervisor Kerr offered the following resolution and moved its eoption : WHEREAS the Town of Dryden has !linformed the Town of Ithaca that it is con- sidering the formation of a water district in that portion of the Town of Dryden immeditely adjacent to the Northeast, Water District in the Town of Ithaca and WHEREAS the Town of Dryden , inllevent such district is formed , intends to apply to the 'sown of Ithaca for permission to connect the facilities of said water district with the existing facilities of the Northeast Water District and the Town of Dryden has requested from the Town Board of Ithaca an expression of attitude in respect to this matter it is RESOLVED that the Town of Ithaca will consider favorable - apy such application from the Town of Dryden provided that an equitable arrangement can be made for the payment of such sums as the Town of Ithaca may reasonably require for such connection and providing that such connection will in no way interfere with the normal use and operation of facilities of the Northeast Water District and pro- vided further that satisfact6ryrarrangements can be made with the Gity of Ithaca or other municipality affected for this purpose . This resolution is intended as � an expression of intention of the Town of Ithaca to cooperate with the Town of Dryden . Seconded by Councilman Mayer Ayes - Kerr , Mayer , Bishop and Baker Noes - 0 Carried BOND - ROCCO LUCENTE Supervisor Kerr offered the following resolution and moved its adoption : WHEREAS a contract Bond #52521602 , dated May 10 , 1960 issued to Rocco Lucente by the Aetna Casualty and Surety Co . to cover construction of roads in the Winston Drive , Salem Drive arealof the town is no longer needed it is :RESOLVED , that the Robert S . Boothroyd Agency be advised that this bond is no longer needed . Seconded by Councilman Bishop Ayes - Kerr , Mayer , Bishop and Baker Noes - 0 Carried . NORTHWEST AREA WATER AND SEWER DISTIRICTS Supervisor Kerr stated that petitions for the formation of water and sewer districts in the northwest area of 1Ithe town would be circulated as soon as they 1 ® 2 are prepared . Area residents have indicated their desire for the extensions of these services and have expressed a willingness to circulate petitions . EXTENSION OF WATER - SNYDER HILL ROAD AREA Mr . Dunlap stated that he expected to have cost estimates for a new water tank within the Town of Ithaca on Snyder Hill Road at the next meeting . _WARRANT Councilman Mayer offered the following resolution and moved its adoption : RESOLVED that the following bills be paid : General Fund Bills #172 through #202 in the amount of $3 , 066 . 58 ; Highway Fund Bills #124 through #153 in the amount of '4 , 203 . 66; ' Ellis Hollow Road Sewer District #9 through #12 4in •the;, amount of 018 , 013 . 40 ; and Northeast Sewer District #12 through #14 in the amount of $40 , 668 . 43 . • Seconded by Councilman Bishop Ayes - Baker , Kerr , Bishp and Mayer Noes - 0 Carried . ZONING ORDINANCE BOOK AND MAP The Town Board has requested that the Planning Board bring the Zoning Ordinance Book and Map up to date so that new ones may be printed . TV FRANCHISE The Town Board expressed a desire to wait to see what decisions the Village of Cayuga Heights makes and to meet with them in regards to the renewal of the TV cable franchise . Members expressed once more their concern over the increase in rate and the fee paid to the Town . Supervisor Kerr offered % the motion for adjournment at 7 : 25 P . M . Y . 14845 Blower Supervisor Kerr offered the following resolution and moved its adoption : WHE11EAS , the Town Superintendent of Highways did , on the ,7th day of March , 1966 , duly recommended the purchase of certain machinery pursuant to the provisions of Section 142 of the Highway Law , NOW , THEREFORE , BE IT RESOLVED that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways is hereby authorized to purchase , in accordance with the provisions of Article 5-A of the General Municipal Law , with the approval of the County Superintendent of Highways , the following :
