August 21 , 1996 Walker Subdivision PRESENT : • Chairperson Kenneth Horst Planning Board Members : Gerald Catlin, William Farrell , Mary Lou Hardesty, Nancy Weitzel ABSENT : Arch Dotson (Excused) Ralph Wilbur (Excused) Others Present: Applicants - Ruth and Richard Walker Secretary - Carol Sczepanski Code Enforcement Officer - Susan Beeners Members of the Public : Charles Cole, Hannah, Cole, Karen Anderson, Nancy Law, Earl and JoAnn Ekdall Chairperson Horst declared the Public Hearing open at 7 : 30 P .M . and read the following Notice of Publication : "NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Planning Board of the Town of Danby on Wednesday, August 21 , 1996 at 7 : 30 P .M. , Danby Town Hall , 1830 Danby Road, Ithaca, New York, 14850 . Purpose of hearing is to consider Approval of the Proposed Subdivision of Town of Danby Tax Parcel No . 4 . - 1 -6 . 2 , 112 . 35 acres total into four (4) lots of 2 . 85 +/- acres, 2 . 90 +/- acres, 2 . 95 +/- acres, and 103 . 65 +/- acres each. Property is located on the south side of Coddington Road west of German Cross Road . Richard and Ruth Walker owners . All interested parties will be given the opportunity to be heard either in writing or in person. By order of the Planning Board Chair Carol W . Sczepanski , Town Clerk Dated : August 13 , 1996 " Affidavit of Neighbor Notification received August 14 , 1996 . Ruth Walker reported that they would like to have the Board consider the "Preferred Plat" , showing three (3) lots with a sixty (60) foot right of way . Members of the Public : ® Nancy Law - 1030 Coddington Road - does not have a problem with the proposal but new development in the area near her property has created a drainage problem . She would like to make sure that further development will now cause further drainage problems in the area. JoAnn Ekdall - 19 Makarainen Road - owns property on the back side of the proposed subdivision. She is concerned with "subdivision" and wanted to be sure that this proposal was for only single family homes . Susan Beeners said that there would be single or two (2) family homes as the Walker' s would be developing the frontage and retaining sixty (60) feet for the back acreage . Hannah Cole - 1000 Coddington Road - would object if a mobile home were placed on the property. c 9 8 Planning Board Minutes Public Hearing - Walker 2 August 21 , 1996 Karen Anderson - 1030 Coddington Road - reported that the roadside area is very wet and wonders where the water runoff will be directed . She asked if it were something that was the responsibility of the property owners or something the Town of Danby needs to oversee . Richard Walker said that the water can only flow north into the County road ditch. There is a culvert on the east corner and one further down the road . The culvert on the east corner is very adequate . Ruth Walker said that the drainage problem in the area of 1030 Coddington Road is a different issue and does not pertains to this subdivision proposal . • Public Hearing Declared Closed : Chairperson Horst declared the public hearing closed at 8 : 57 P . August 21 , 1996 PRESENT : Chairperson Kenneth Horst • Planning Board Members : Gerald Catlin, William Farrell, Mary Lou Hardesty, Nancy Weitzel ABSENT : Arch Dotson (Excused) Ralph Wilbur (Excused) Others Present : Applicants - Ruth and Richard Walker Secretary - Carol Sczepanski Code Enforcement Officer - Susan Beeners Members of the Public : Charles Cole , Hannah, Cole , Karen Anderson, Nancy Law, Earl and JoAnn Ekdall Chairperson Horst called the meeting to order at 7 : 58 P .M . and asked the Board to consider the Walker Proposal as the first item of business . Walker Subdivision Proposal Ruth Walker addressed the Board and reported that they would like the Board to consider the Preferred Cluster Subdivision Plat showing a three (3) lot subdivision with a sixty (60) foot right of way to the back parcel . Susan Beeners explained the hypothetical plan showing a conventional subdivision plan of four (4) lots that have the minimum required frontage . The Walkers prefer the Preferred Cluster Subdivision Plat which is three (3 ) lots along the road frontage and a 112 +/- acre lot with seventy (70) feet of road frontage . Susan asked that the record show that drainage and the location of the culverts was discussed by the Board and did not seem to be an issue for this particular subdivision proposal . Chairperson Horst said that the drainage issue expressed at the public hearing did not pertain to this particular development or area. In the drainage information presented on the proposal it states that it is stated that no significant drainage or land impacts are expected with three (3 ) new house sites . Applicant Ruth Walker said that with the larger size lots there is more than sufficient room for drainage . IP RESOLUTION NO. 24 of 1996 SEQR DETERMINATION - PROPOSED WALKER SUBDIVISION By William Farrell : Seconded by Nancy Weitzel WHEREAS , this action is to Consider Approval of the Proposed Subdivision of Town of Danby Tax parcel No 4 . - 1 -6 . 2 , 112 . 35 +/- acres total into four (4) lots of 2 . 85 +/- acres, 2 . 90 +/- acres , 2 . 95 +/- acres and 103 .65 +/- acres each; located on the south side of Coddington Road, west of German Cross Road; Richard and Ruth Walker, owners ; and WHEREAS, this is an Unlisted action for which the Planning Board is acting as Lead Agency in environmental review; and WHEREAS, the Planning Board, at and following Public Hearing on August 21 , 1996 has reviewed 400 2 Planning Board Minutes August 21 , 1996 the Environmental Assessment Form and draft environmental review prepared by the Code Enforcement Officer, now be it RESOLVED, that the Town of Danby Planning Board, acting as Lead Agency in environmental review of this Unlisted action, makes a negative determination of environmental significance for this action . A roll call vote on the resolution resulted as follows : Catlin Aye • Farrell Aye Hardesty Aye Weitzel Aye Horst Aye Carried Unanimously RESOLUTION NO. 25 of 1996 WALKER SUBDIVISION - Approved By Nancy Weitzel : Seconded by William Farrell WHEREAS , this action is to Consider Approval of the Proposed Subdivision of Town of Danby Tax parcel No 4 . - 1 -6 . 2, 112 . 35 +/- acres total into four (4) lots of 2 . 85 +/- acres, 2 . 90 +/- acres, 2 . 95 +/- acres and 103 . 65 +/- acres each; located on the south side of Coddington Road , west of German Cross Road ; Richard and Ruth Walker, owners; and WHEREAS, this is an Unlisted action for which the Planning Board on August 21 , 1996 , acting as Lead Agency in environmental review, has made a negative determination of environmental significance ; and WHEREAS, the Planning Board, at and following Public Hearing on August 21 1996 has reviewed maps entitled " Site Plan : Conventional Plat (5 lots) , Walker Subdivision - Town of Danby", and "Site Plan: Preferred Cluster Plat (4 lots and right of way), Walker Subdivision - Town of Danby", by Thomas Niederkorn, August 1996 ; now therefore, it is RESOLVED,that the Planning Board, upon review of the above maps, finds that the property could be conventionally subdivided into a total of four lots with frontage along Coddington Road; and it is further RESOLVED , that the Town of Danby Planning Board grants Preliminary and Final Subdivision approval to the proposed subdivision as shown on " Site Plan : Preferred Cluster Plat (4 lots and right of way), Walker Subdivision - Town of Danby", by Thomas Niederkorn, August, 1996 subject to the submission of a final survey map for such subdivision, suitable for filing, for approval by the Planning Board Chairperson . Carried Unanimously Approval of Planning Board Public Hearing and Adjourned Public Hearing Minutes - CNG A motion was made by Nancy Weitzel and seconded by Gerald Catlin to approve the Planning Board Yc9 / 3 Planning Board Minutes August 21 , 1996 Public Hearing Minutes for June 19, 1996 for CNG and the continuation of the Adjourned Public Hearing of July 17 , 1996 as published. Carried Unanimously Approval of Planning Board Minutes of July 17, 1996 A motion was made by Mary Lou Hardesty and seconded by Nancy Weitzel to approve the Planning Board Minutes of July 17 , 1996 as published . Carried Unanimously Other Reports : Tour of H & E Machinery Chairperson Horst reported that three Planning Board members visited H & E Machinery for a tour of the facility and was impressed with the industry. He said it is very complementary for the Town of Danby to have a company like H & E located here . They are expected to double their production within the next two (2) years. H & E Machinery also has a new plant in Indonesia and expect to have a sales operation in Brazil in the near future . Nancy Weitzel said that the group toured the plant and it was very clean. She was amazed by all of the upscale equipment that is used in the plant. H & E also has a department that manufactures their own tools . Chairperson Horst said that H & E Machinery was happy to be in Danby and that they were treated fairly by the Town. Mr. Locker said that the only problem he could foresee for future development in Danby was water. He said a bank in the area would be very helpful . Code Enforcement Officer Report Planning Federation Grant Application - Susan Beeners reported that she is going to apply for a Planning Federation Grant this September for $4,000 . 00 . The request is for funding to do a business survey, community business directory and some funds for assistance in developing a new Comprehensive Plan. She has ordered materials and publications related to comprehensive planning that should be available at the next meeting . Comprehensive Plan Revisions Discussed Susan asked the Board to review our Comprehensive Plan before the next meeting and to think about revisions to the plan. She suggested the Board look at the Town of Ithaca Comprehensive Plan to give them ideas of what they could consider. The Board discussed planning for future development needs for the Town with the trend in the area of Cornell University, Ithaca College and businesses in the area cutting back growth, services and staff Also discussed is the needs of the increasing population of over fifty (50) age group and their future needs. Placement of Town of Ithaca water districts and towers near the Town of Danby might make it possible for the Town to consider future water towers and districts for future development Nancy Weitzel said that the Board should consider advertising topics of discussion in advance of meetings so that interested persons can participate and give input. Jan Jerkowitz from Tompkins County Planning will be invited to attend the October Planning Board Meeting at 8 : 15 P . M . ADJOURNMENT : On a motion the meeting adjourned at 10 : 05 P .
