The regular meeting of '' the Town Board. of the Town of Ithaca
was held in the Town Offices , 108 E . Green St . , , City of . Ithaca, ,
at 4• : 00 P . M . , March 7 , 1966 :
Board members present were :Supervisor William B . Kerr ,

Board members absent were : Councilmen Harry Baker and A .

Bids were opened at 4 : 00 P . M . for the pwer grader for the

ASSESSOR
Supervisor Kerr announced that Assessor Robert J .Wells was
planning to resign . The Board discussed the possibility of
combining the functions of , Assessor , Zoning Officer and. Enforce-
ment Officer with the City of Ithaca• officials who work in the
same capacity . The Board. authorized. Supervisor Kerr to contact
the City to see if this could be worked out . The Board also is
in favor of investigating the possibility of combining tax
collection functions with the city .

Councilman Mayer offered the following resolution and moved

INSTALLATION OF STREET LIGHTS
Supervisor Kerr offered. the following resolution and moved
Its adoption ;
RESOLVED , that the New York State Electric and Gas Corporation
be authorized to proceed with the installation of street lights
in accordance with the street lighting contract presented by
them to the Town of Ithaca " May 10 , 1965 in the following locations
within the Town of Ithaca

REO.UEST FOR SPEED ZONE
A letter from resident 's of the Bundy goad asked the Town
Board to consider a speed limit on that road . Supervisor Kerr
offered. the following resolution and. moved its adoption .
RESOLVED , that the Town of Ithaca.jointly with the County
of Tompkins request the New 'litork State Traffic Commission to
conduct a study for a lower speed limit on the Bundy goad from
the intersection of Route 96 the Trumansburg Rd . )westerly
about 3300 feet .

POSTING AND PUBLISHING OF NOTICE - WEIGHT LIMITS - TOWN ROADS
Supervisor Kerr offered the following resolution and moved
its adoption .
RESOLVED , that Highway Sup ' t . Marion Morey be authorized to
publish and post the following notice .
NOTICE is hereby given,, pursuant to Article 41 , Section 1660 ,
paragraph 11 of the Vehicle;, a.nd Traffic Law that any Town of Ithaca
black top roads are closed to . a.ny vehicle with a. gross load on
each axle of 2 tons .
This restriction is effective upon erection of signs - on the
highways from which such trucks are excluded . No vehicle includingload ) ' with a gross weight in excess of 2 tons per axle will be
permitted to operate on any Town of Ithaca road so posted .
Exclusion shall remain in effect until such signs are removed a. s
directed by Town Sup to of Highways Marion Morey .

AUTHORIZATION TO ADVERTISE FOR BIDS
Supervisor Kerr offered the following resolution and moved
its adoption :
RESOLVED that Highway Superintendent Marion Morey be authorized
to draw up specifications and. advertise for bids for a snow blower
attachment to be used with an existing loader ; such advertisement
to Call for fall delivery .

PUBLIC HEARING -SLATERVILLE ROAD SEWER DISTRICT
A public hearing for the proposed Sla. terville Road Sewer
District was opened. at . 4 : 30 P . M '. by Supervisor Kerr . Proof of
publication and posting were presented . Supervisor Kerr asked
for questions or remarks from the residents of the area present
for the hearing 12 people were present )

Mr . Blatchley - What is the , cost per unit in this district ?
A . Mr . Dunlap of Lozier - + The unit cost is approximateTy; 579 . 00
a. unit . Mr . Dunlap then explained what constituted a unit .
Mrs . Backner -Snyder Hill Road Will water be extended along
Snyder Hill Rd . ?
A . Mr . Kerr - When districts are extended water is usually desired
first . The extension of sewer makes the extension of water desirable .
It is better to do both together , so I say the answer is that water
will be ' extended also .
Mr . Mills -Since our system is new , how long would it be be -
fore I would have to hook up ?
A . Mr . Kerr -In the northeast we are now saying 10 years unless
of course , the system break's down before then .
Q . Mr . Mills -If the road is widened where will the edge of the
road come in regards to my ,sand filter system ?
A . Mr . Dunlap - The road probably wouldn ' t take more than 33 ft *
from the center . Where is your wall of your filter system ? Mr .
Mills - About 34 ft . from the center of the road .
Mrs . O ' Kane -Snyder Hill Rd , Will new homeowners on Snyder
Hill Rd .who are not in favor have to be in the district . How
long will It be before construction starts .
A . The district will probably include some who don ' t want it .
Construction usually starts, in about 6 mos . It takes time to
get legal work done .
Is the formation of this district subject to referendum?
A . Kerr - Yes , but the Petition for a referendum must contain
a percentage of names of owners of land within the district . Mr .
Buyoucos looked up legal requirements of a petition and told the
group that the petition must be signed by 5%- of land owners with-
in the district .
Mr . Elmer Phillips - As for the question of timing there always
will be someone who has a new home and a new septic system if
the district is formed this year - next year , or 5 years from
now . Mr .Phillips -I ' m speaking now for John Marion who is in
the hospital He is in favor of the district , but questions the
method of assessment . He feels that unit /acre is too high .
Could someone clarify the term acreage ? A . Mr . Dunlap - Land
not actively farmed but undeveloped would be charged at unit
per acre .
Mr . Kerr read a letter from Mr . and Mrs .Lowe in regards to the
formation of the district .
Mr .Phillips - The method of financing - Could it be changed ?
Mr . Buyoucos The assessment has to be on the benefit basis . The
Town Board cannot be bound by decisions made here today .The
same reasons for determination are given as were given last time .
1 )Whether the hearing has been advertised , posted , etc ,
pursuant to law . 2 )Whether all property benefited is included
3 )Whether there are properties benefited not included and 4 )
Whether it is in the general public interest that the sewer
district be foremd . The method of raising money is not a
binding obligation at this time .
Mr . Kerr - The method of financing a district is by - Bond. ing . The
life of a bond is usually 20 or 30 years . The shorter the length
of time means a higher interest rate . A district ca.n operate
on notes up to 5 years . The market is now such that interest
rates are high : .
Mr .Phillips - Can the district be set up other than on a benefit
basis . Could the blending ' of assessed valuation and benefit or
Unit basis be combined ?
Mr . Kerr - To wait five years for more units may not be good .
Construction costs will rise in that time .
Mr . Phillips - The extension of water and sewer to areas nearest
the city are easier . The cost as the lines extend sometimes

become prohibitive .
Kerr - The large landowner feels that the original price is too
much , but actually individulal householders are subsidizing the
landowner , because as the landowner develops the householders
benefit and prices go down . l
Mr . Buyoucos - The only protection for landowners is a charge
based on a benefit basis . In answer to the question about a
permissive referendum , the ',Town Clerk will have petition forms
available . 5% of the owners of property within the district
must sign within 30 days .If no petitions are being circulated
the order must still remain 30 days before the next step is
taken in the formation of the district .

Mr . Phillips The Heaithc° IDep ' t . ma.y issue an order that there is
to be no more building in the area without sewers .I still feel
it will be of benefit to the area .

In the Matter of the Establishment of the ' Slaterville Road
Area Sewer District in the Mown of Ithaca. County of Tompkins ,
State of New York , pursuant! to Article 12 -A of the Town Law .
WHEREAS a map , plan and report relating to the establishment
of the proposed Slatervill4'i Road Area Sewer District , prepared
by Lozier Engineers , Inc . ,a competent engineer , duly licensed
by the State of New York , In manner and in such detail as ha. s been
determined. by the Town Board of Ithaca ,has been duly filed with
the Town Clerk of Ithaca , in accordance with the requirements of
Article 12 -A of the Town Law ,and
WHEREAS , an order was duly adopted by the Town Board of Ithaca
at a special meeting thereof duly called and held on the 21st day
of February , 1966 , reciting the filing of said map , plan and
report , the improvements proposed , the boundaries of the proposed
district , the maximum amount proposed to be expended for such
improvements , the proposed method of financing , the fact that the
map , plan and report describing the same , are on file in the
Town Clerk ' s office for public inspection ,and stating all other
matters required by law to ,Vbe stated , and specifying the 7th
day of March , 1966 , at 4 : 36,, clock P . M . on that day ,as the time ,
and the Town Offices at 10

to consider said map , plan ,and report ,and. to hear all persons
Interested in the subject thereof concerning the same , and to
take such action thereon as is required or authorized by law , and
WHEREAS , such order walls duly published and posted as
required by law , and
WHEREAS , a hearing onlisa. id matter was duly held by said Town
Board on. this 7th day of March , 1966 , beginning at 4 : 30 P . M . of
that day , at the said Town 'Offices at 108 East Green Street in the
City of Ithaca , New York ,and full discussion of the matter havingbeenhad , and all persons desiring to be heard. having been dulyheard ,
NOW ,upon the evid.ence'i given upon such hearing , and upon
motion of Joseph X . Mayer , Jr . , Seconded by William B . Kerr , it is
RESOLVED AND DETERMINED :
a )That the notice ofl hearing was published and posted as
required by law ,and is otherwise sufficient .
b )That all property and property owners within the proposed
district ,are benefited thereby .
c )That all the property and property owners benefited are
Included within the limits of the proposed district .
d )That it is in the public interest to establish such
sewer district .
FURTHER RESOLVED AND DETERMINED that the establishment of a
sewer district ,as set forth in said ma.p , plan and report ,be
approved ; that the Improvement therein ment9:. oned be constructed ,
and. the necessary easementsiand lands be acquired ,upon the
required funds being made a 'Ivailable and provided for ,and such

district shall be known and '' designated as the Slaterville Road
Area Sewer. District in the Town of Ithaca ,and shall be bounded
and described. as set forth Schedule A which is annexed hereto
and made a part hereof .
The boundaries described are intended. to include all property
within said boundaries .
FURTHER RESOLVED that the proposed improvement , including
construction costs , cost of acquisition of lands and easements ,
legal and engineering fees , ; and all other expenses ,be financed
by the issuance of serial bonds of said . Town to mature in such
number of annual installments not exceeding 30 ,as may hereafter bo
determined by the Town Board. of Ithaca. payable in the first
instance from assessments levied on benefited. real property in
said district ; and it is
FURTHER RESOLVED that this resolution is subject to a
permissive referendum as provided in Section 209 - e of the Town
Law .
The adoption of the foregoing resolution was duly put to
a vote and upon roll call , the vote was as follows :

Franklin C . Bishop , Councilman voting aye
The resolution was thereupon declared duly adopted .

WARRANT
Councilman Mayer offered the following, resolution and moved
its adoption :
RESOLVED , that General] Fund Bills # 92 through # 121 in the
amount of , 12 , 375 . 89 and Highway Fund Bills # 65 through #94 in
the amount of $4 , 669 . 20 be ;paid .

REPORT - WEST HILL AREA AND SOUTH HILL AREA SEWER DISTRICTS
Mr . Dunlap reported that the maps , plans and descriptions
of the West Hill and South Hill area server and water districts
were not yet completed . Plans are expected to be ready so that
public hearings may be scheduled at later meetings . A dis -
cussion was held on the extension of the South Hill Water District ,
TV FRANCHISE
A copy of a, petition submitted by residents of the 5 Mile Drive
area. to the Ceracche Television Corp . requesting - an' extension of
12 channel service to their area was presented . The Town Board
decided that they had no authority until the franchise comes up
for renewal Date of expiration of the franchise is . July 1 , 1970 )
CORRESPONDENCE
Supervisor Kerr read a letter from Mr . L . W . Gruenfeld of
219 Tareyton. Dre thanking him for his assistance in settling a
question regarding an insurance claim for damages caused by the
construction of the Northeast Sewer .
A letter from Mr . George Ideman called the Board ' s attention
to increases in property assessments on his property . He requested
consid:era. tions of these increases and also for extension of water
to the Ellis Hollow Road area, a. t the same time sewer is being
extended .
AWARDING OF BID - NEW GRADER
Supervisor Kerr offered the following resolution and moved
Its adoptionli
WHEREAS the Town Superintendent of Highways , did on the 14th
day of February , 1966 , duly, recommend the purchase of certain
highway equipment pursuant to the provisions of Section 142 of
the Highway Law , now therefore
BE IT RESOLVED that the Town Superintendent of Highways ,
Marion Morey is hereby authorized to purchase in accordance with
the provisions of Article 5- A of the General Municipal Law , the
following .
One new Galion T- 500 A grader from Central New York Equip-
ment Company of Binghamton , New York who submitted a . bid of
20t479 . 00 .

CERACCHE TV FRANCHISE
Attorney Walter J . Wiggins wa. s present with Mr . Anthony
Ceracche to request the Board ' s consideration of a request to
renew the franchise with the Town of Ithaca. . Ceracche ' s present
franchise with the town expires in 1970 . Attorney Wiggins stated
that the Television Corp .would increase monthly rates from $ 3 . 50
to $ 4 . 50 per month ;would decrease initial installation charges
from $ 135 . to $ 50 ,and would ask for 25 year franchise .
Councilman McElwee felt that there might be problems involved
if some of the town is served. and some is not and felt that a rate
increase should not come before at least 90 % of the town is beingservedbythecable . Supervisor Kerr stated. that he had no
substantial objections to the plan and that any objections would
be concerning the quality of the signal which he felt should be
better in some instances .
Supervisor Kerr offered. the following resolution and moved its
adoption .
RESOLVED that a Public Hearing be held at 4 : 00 P . M . Monday ,
May 9 , 1966 in the Common Council Room , City Hall , 108 East Green
St . , Ithaca to hear all persons interested in the renewal of a.
television cable franchise with the Ceracche Television Corporation
of Ithaca ,

SPEED . LIMIT - WARREN ROAD
The speed limit on Warren Road has recently been changed. to
40 MPH increased from 35 MPH )and residents. of the area have
registered concern over this speed in the area of the new North -
east School ,Supervisor Kerr offered. the following resolution and
moved its adoption :
RESOLVED that the Town will purchase school crossing signs to
have erected along Warren Road near the Northeast School .
