Scheffler MOVED by Supervisor Morey, seconded by Councilman Randall, to approve the minutes of the May meeting as presented. Ayes - Sovocool, Scheffler, Randall, Clark, Morey. General Fund Claim Numbers 148-177 of the in the amount of $9,358.88 were presented for audit. MOVED by Councilman Scheffler, seconded by Councilman Sovocool, to approve the General Bills for payment. Ayes - Sovocool, Scheffler, Randall, Clark, Morey. Highway Fund Claim Numbers 98-115 of the in the amount of $67,385.21 were presented for audit. MOVED by Councilman Clark, seconded by Councilman Sovocool, to approve the Highway Bills for payment. Ayes - Sovocool, Scheffler, Randall, Clark, Morey. Special Grant (HUD) Fund Claim Numbers 241-243 of the in the amount of $1,647.16 were presented for audit. MOVED by Councilman Scheffler, seconded by Councilman Randall, to approve the HUD bills for payment. Ayes - Sovocool, Scheffler, Randall, Clark, Morey. Town Board Meeting Page 2 June 11, 2002 Supervisor Morey invited privilege of floor. John Norman, Republican candidate for Town Justice introduced himself and his wife, Chris, to the Town Board. Elizabeth Brennan, Bookkeeper – Submitted her monthly report for the Board’s review. Richard C. Case, Jr., Highway Superintendent – Reported that the new mowing tractor had been received and put into service. He described work that had been done on Wickham Road, Cemetery Lane and Townline Road. The Town’s bulk storage tanks have been reregistered and certified with an expiration date of June 2007. Summer employee, Will Casolara, has started work. Town employees have reviewed safety materials from the Cornell Road Program and Mr. Case has attended the NYS Association of Towns Highway School. Recent storm damage consisted of downed trees, which have been mostly cleaned up, and erosion problems, the worst of which was Jacob’s Ladder. The road tour was scheduled to take place the next day at 9:30 AM. Mr. Case presented quotes for the guide rail project on Old Stage Road in accordance with the Town Procurement Policy: 1.D.H. Smith Inc. – Did not respond 2.Elerlee, Inc. – (Tom Bartusick) $15,436.80 3.Cable Guide Railing, Inc. – (Chris Hubble) $14,606.00 RESOLUTION #69 – APPROVE CONTRACT WITH CABLE GUIDE RAILING, INC. MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED, that the Town Board does hereby approve the contract with Cable Guide Railing, Inc., for the supply and installation of the cable guide railing for Old Stage Road Bridge area for the sum of $14,606.00 April L. Scheffler, Town Clerk/Tax Collector – Presented her Town Clerk’s Report and final Tax Collector’s report for the Board’s review. She reported that her new Deputy Clerk, Kris Strickland, was doing a good job in the office. Clerk Scheffler had previously provided the Board with information about marriage officers and copies of the Public Relations Law. She asked the Board if they would make a resolution to appoint her. Clerk Scheffler explained that she felt that it was a nice service to provide, that there would be no cost to the Town and all that was needed was a resolution from them. Councilman Scheffler thought it would be one-stop-shopping and was concerned that everybody in Town would then want to do it. Councilman Clark felt that they had enough going on right now with the upcoming election. Consensus of the Board was that it was not necessary. Councilman Randall made a motion with no second. The Clerk was told that she could bring it up again at a later date. Town Board Meeting Page 3 June 11, 2002 MOVED by Supervisor Morey, seconded by Councilman Sovocool to open a Public Hearing for the purpose of reviewing Local Law #1 of the Year 2002 at 7:47 PM. Ayes - Sovocool, Scheffler, Randall, Clark, Morey PUBLIC HEARING LOCAL LAW #1 FOR THE YEAR 2002 Clerk Scheffler read the Public Notice, which was duly published in the Groton Independent on May 29, 2002, with same being posted on same date at the Town Hall, Village Hall, and Groton and McLean Post Offices. Letters were received from the Tompkins County Department of Planning and the Cayuga County Department of Planning and Development. Neither department had concerns. There were no comments from the Public. Supervisor Morey read the local law. MOVED by Councilman Randall, seconded by Councilman Scheffler to close the Public Hearing for Local Law #1 of the Year 2002, at 7:51 PM. Ayes - Sovocool, Scheffler, Randall, Clark, Morey Attorney Casullo led the Board through Part I of the Short Environmental Assessment Form RESOLUTION #70 – APPROVE PART I – SEQRA MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED , that the Town Board does hereby approve Part I of the State Environmental Quality Review, Short Environmental Assessment Form as stated. Attorney Casullo then led the Board through Part II of the SEQRA. All questions from A. to E. were answered “NO”. Town Board Meeting Page 4 June 11, 2002 RESOLUTION #71 – DECLARE NEGATIVE DECLARATION MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED , that the Town Board of the Town of Groton, as lead agency, has determined that the propose action, elimination of the Low Intensity Industrial District located on Locke Road, is a Type I action and will have no significant effect on the environment. RESOLUTION #72 – ADOPTION OF LOCAL LAW #1 – 2002 ELIMINATE LOW INTENSITY INDUSTRIAL DISTRICT MOVED by Supervisor Morey, seconded by Councilman Scheffler ADOPTED by ROLL CALL VOTE: Ellard L. Morey………..Aye RESOLVED, that the Town Board does hereby adopt a Local Law amending the Town of Groton Land Use & Development Code. BE IT ENACTED by the Town Board of the Town of Groton as follows: Section 1. The Town of Groton zoning law is hereby amended by this Local Law as follows: All properties situate on Locke Road in the Town of Groton and currently zoned and designated as being located in a Low Intensity Industrial District (I) are herby rezoned and designated Rural- Agricultural District (RA) and are subject to all regulations created and established relative to such a district. The Town of Groton Zoning Map shall hereby be amended to show this district change. Section 2. Repeal All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed. Section 3. Effective Date This Local Law shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law. Town Board Meeting Page 5 June 11, 2002 Councilman Donald Scheffler as Recreation Coordinator – Problems with the school have been straightened out and they now have their computer. The Joint Recreation Committee will be receiving a United Way grant of $1,753.58 with $500.00 earmarked for the skateboard park on Route 38 and some of the remainder to be used for programs and events in McLean as well as operating expenses. Two United Way Council positions need to be filled if anyone is interested. Summer Concert, July 6, for 7-9 PM at the Elementary School. Plans are being made for fall events. George R. Senter, Sr., Code/Fire Enforcement Officer – 14 Building Permits issued for May with one modular home and one mobile home. Life Safety Inspections are up to date and violations are being resolved. RESOLUTION #73 – APPOINTMENT CHAIR & VICE CHAIR TO COMPREHENSIVE PLAN COMMITTEE MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED , that the Town Board does hereby appoint Lyle Raymond as Chair and Mary Gloster as Vice Chair of the Comprehensive Plan Review Committee. RESOLUTION #74 – APPOINT STEVE THANE TO COMPREHENSIVE PLAN COMMITTEE MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED, that the Town Board does hereby appoint Steve Thane to the Comprehensive Plan Review Committee to fill vacancy left by resignation of Duane Randall. Notice had been received from the State Comptroller’s Office concerning a retirement incentive benefit program. One employee would qualify for the program at this time. Discussion was held on the subject and it was agreed that the Board desired to pass a Local Law electing to provide the incentive program. Town Board Meeting Page 6 June 11, 2002 RESOLUTION #75 – TOWN BOARD DESIRES TO PASS LOCAL LAW TO PROVIDE RETIREMENT INCENTIVE PROGRAM MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED, that the Town Board desires to pass a propose Local Law #2 for the Year 2002 electing the retirement incentive program authorized by Chapter 69, Laws of 2002 for the eligible employees of the Town of Groton. RESOLUTION #76 – SET PUBLIC HEARING DATE FOR LOCAL LAW #2 MOVED by Supervisor Morey, seconded by Councilman Randall Ayes - Sovocool, Scheffler, Randall, Clark, Morey RESOLVED , that the Town Board does hereby set a Public Hearing to review Local Law #2 of the Year 2002 on July 9, 2002 at 7:45 PM at the Town Hall on Conger Boulevard. It was decided to table discussion on Real Property Tax Exemptions until August or September. Announcements: th Groton Planning Board Meeting Town of , June 20 @ 7:30 PM Highway Departmentvacation will be closed for the first two weeks in July. Coit Property – Buyer has indicated that he wishes to repair the house. George Senter will contact the buyer before the Town takes any further action. Health Insurance Consortium – Tompkins County supervisors attempting to join together and get insurance coverage at a lesser cost. th Tompkins County Farm City Day – Saturday, August 10, 11 AM – 4 PM at the Hardie Farms in Lansing. th Municipal Officials Association – June 18, 6 PM at Lehigh Valley House.
