December 11, 1995 PRESENT: Supervisor Mary Oltz • Councilpersons : Roger Hile, Rosa Lee Johnson, Joseph Schwartz, Howard Steiner Others Present: Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Frank Proto - County Representative Sgt. Roberts, Bill Farrell, Mary Lou Hardesty, Joel Gagnon, Joe Rorick, Laro Sheppard, Jim Houghton, Bonnie Tyler Supervisor Oltz called the meeting to order at 8:00 P .M. and led all present to the Pledge of Allegiance to the American flag. Approval of Town Board Minutes: November 8, 1995 Public Hearing, November 13, 1995 Public Hearing and Regular Town Board Meeting- Approved A motion was made by Councilperson Hile and seconded by Councilperson Steiner to approve the November 8, 1995 Public Hearing Minutes ( 1996 Preliminary Budget), the November 13 , 1995 Public Hearing Minutes (Local Law No. 2), November 13 , 1995 Town Board Minutes as published. A roll call vote on the motion resulted as follows : Bile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Special Town Board Meeting November 20, 1995 Minutes - Approved A motion was made by Councilperson Hile and seconded by Councilperson Johnson to approve the November 20 , 1995 Special Town Board Meeting Minutes as published. • A roll call vote on the motion resulted as follows: Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Privilege of the Floor Councilperson Johnson asked that the Board acknowledge our appreciation for all the years of service that Edw. Roberts has given the Town. She said he has given us a tremendous amount of time and has decided to retire. Tonight will also be Councilperson Hite ' s last night with us and she said that she appreciates this last four (4) years that he has been on the Town Board. . , X14 2 ' To '�tt- lihfiiietx••• December 11 , 1995 Councilperson Steiner said he would also acknowledge his appreciation to Councilperson Rile and Ed Roberts for their service to the Town. New York State Police - Ithaca Barracks The Town Board meeting was attended by Zone Sgt. Tom Habel and Sgt. Station Commander Tim Rudd from the N. Y. S . Police, Ithaca Barracks. Sgt. Habel addressed the Board and residents in attendance and said that the State Police have undertaken a new policy to make themselves more available to residents on a local level through town board meetings . Sgt. Rudd is in charge of the Ithaca State Police Station and would be the person to contact with questions, concerns and problems. • The New York State Police are a full service police agency. County Representative Report Representative Proto reported on the following: 1 ) Human Services Building - The County Board has voted to approve moving the Human Services building to a location in downtown Ithaca. The program that was approved was for $ 10,000,000 for the Capitol building but they have not approved of bonding. The number of parking spaces and location for employees and clients has not been determined. He thinks that continuing with satellite sites throughout the County using available sites such as the town halls, reading rooms, and libraries as dispensing centers. 2) Airport - Baggage carts have not been provided for the airport for individuals to get their luggage into the airport terminal but will be available the first of the year. 3 ) Review of Agriculture District No. 1 - a public hearing was authorized on the review of Agriculture District No. 1 . Half of Danby is in the revision and there were fewer than ten ( 10) requests to be removed or added to the district. The hearing is scheduled for December 19, 1995 at 5 :30 P. M. 4 ) 1996 Budget Hearings - Additional money was requested for the rural libraries and $ 3 , 000 . 00 was approved for each of the four (4) sites. $2 ,000 . 00 was approved for the reading centers . 5) Industrial Development Agency Committee - approved the H & E Machinery bonding. 6) Mortgage Tax Distribution - Danby' s share of the Mortgage Tax Distribution has been distributed for the months of April - December 1995 in the amount of $ 11 ,240. 00. 7) Unpaid Solid Waste Fee Added to 1996 Tax Rolls - The unpaid solid waste fees for 92 parcels in the Town of Danby have been added to the 1996 Town and County Tax Roll for collection. 8) Environmental Management Council - The Town of Danby Zoning Revisions received favorable review from the EMC. NYSEG Proposed Pipeline Route • Jim Houton of 1560 Coddington Road addressed the Board and reported that he represents a group of residents who live in the Coddington Road area where NYSEG has proposed to place a pipeline route. They object to the route and would like NYSEG to use one of two (2) other alternate routes. Mr. Houton gave a brief description of the proposal and the Residents opposing the preferred route have retained then services of an preferred environmental lawyer to represent them. Mr. Houton asked the Town Board to issue a letter to the Public Service Commission and Governor Pataki in support of the petition for a rehearing the Coddington Road group has filed against the proposed pipeline route and the members of the Board to consider attending the Public Hearing on December 19, 1995 at the Candor Fire Station. Bonnie Tyler - 1114 Coddington Road addressed the Board with concerns of the proposed NYSEG 51 ` 3 Town Board Minutes December 11 , 1995 Pipeline. She said that the issue of whether you can drive across the pipeline after it is installed is of great concern for landowners who may want to develop back acreage in the future . Reports: Supervisor Oltz reported that the Board met with representatives of Danby Youth Commission and Community Council on December 6, 1995 . Community Council members are looking at locations for a new location for a community center. • Town Board Year-end Meeting Date: Supervisor Oltz set the Year-end Meeting Date for the Town Board for Thursday, December 28, 1995 at 6 : 00 P .M. No Board member objected. , Small Cities and Counties Application Fee Supervisor Oltz said that the County application fee of $3 ,000 is not charged for the preparation for the Small Cities Community Development Block Grant Application at the time it is submitted. The $3 ,000 . 00 is reimbursed through the grant if awarded or at the time we find we are disapproved. Highway Department Report: Highway Superintendent William Hall reported that in November 1995 the Highway Department raised and widened the intersection of Sylvan Lane, patched potholes, changed crossover pipe on Marsh Road,. and installed deteriorated driveway pipes. The trucks have been readied for cindering and plowing. The highway crews cut trees that were damaged and knocked down from a November snow storm All department employees attended a drug and alcohol testing informational meeting. William Hall, Highway Superintendent, reported that Les Palmer has retired from the Town Highway Department after 21 years of service. West Danby Water District - Report Plant Manager Roy Casterline reported that the assistant plant operator George Armstrong passed away last week. He has appointed Carl Seamon as his assistant plant operator to fill the vacancy. He said the Water District should have a third person that is certified as a plant operator as a backup in case of an emergency and suggested that personnel from the highway department be considered. Voting Machine Reconditioning Voting Machine Custodian Edw. M. Roberts reported that two (2) of the voting machines have been sent to Sequoia Pacific for reconditioning. The service is guaranteed for parts and service for five ( 5) years . Code Enforcement Office Report Susan Beeners reported that the 911 readdressing has been slow. Change of address letters will be sent to a few residents on Comfort Road explaining the need to change house numbers. There are approximately 150 residents that will require address change . Motion to Change Board Meeting Time - Approved A motion was made by Councilperson Johnson and seconded by Councilperson Steiner to schedule the January 3 , 1996 Town Board Agenda Meeting for 6 : 00 P .M. and the January 9 , 1996 Town Board Meeting for 6 :00 P .M. A roll call vote on the motion resulted as follows: Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously 1 516 4 Town Board Minutes December 11 , 1995 BOARD AND COMMITTEE APPOINTMENTS : Danby Youth Commission Appointment A motion was made by Councilperson Schwartz and seconded by Supervisor Oltz to appoint John Webster to the Danby Youth Commission for a three (3 ) year term. The term of appointment will begin January 1 , 1996 and will expire on December 31 , 1998 . Board of Zoning Appeals Supervisor Oltz reported that Edward Inman has resigned from the Board of Zoning Appeals due to his newly elected position as Councilperson for the Town of Danby. She would like to schedule • interviews for persons interested in serving on the Board of Zoning Appeals. No Board member objected. Town Insurance Contracts Supervisor Oltz reported that she has received quotes from Ithaca Agency and from Wood Insurance to be considered as insurance carriers for the Town of Danby. She reported that Ithaca Agency has been the insurance carrier for the Town for a number of years. She is very satisfied with their service. APPROVAL OF WARRANTS General Fund Warrant No 12 of 1995 - Approved A motion was made by Councilperson Hile and seconded by Councilperson Schwartz to approve the General Fund Warrant No. 12 of 1995 , voucher numbers 328 through 356 in the amount of $9,766. 23 . Voucher No. 339 for MCI Residential Service in the amount of 14 cents was pulled and to be included in their next billing. A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye 1 Schwartz Aye Steiner Aye Oltz Aye Carried Unanimously Highway Fund Warrant No 12 of 1995 - Approved A motion was made by Councilperson Schwartz and seconded by Councilperson Hile to approve Highway Fund Warrant No. 12 of 1995, voucher numbers 138 through 154 in the amount of $ 17 ,932 .46 . A roll call vote on the motion resulted as follows : Hile Aye Johnson Aye Schwartz Aye Steiner Aye Oltz Aye Carried. Unanimously • West Danby Water District Fund Warrant No. 11 of 1995- Approved A motion was made by Councilperson Hile and seconded by Councilperson Steiner to approve the West Danby Water District Fund Warrant No. 11 of 1995 , voucher numbers 44 through 48 in the amount of $9, 153 . 10 .
