The Public Hearing was opened at 7 p.m. by Chairman David Plew, who read aloud the Legal Notice published in the Cortland Standard, as follows: Notice is hereby given that a public hearing before the Zoning Board of Appeals of the Town of Cortlandville will be held Tuesday, January 23, 2007, at 7 p.m. at the Raymond G. Thorpe Municipal Building (Town Hall), 3577 Terrace Road, in the Town of Cortlandville, New York to consider the following application pursuant to the 1986 Zoning Law: 1. In the matter of the application of Drumm Construction (Baljinder Singh) for property located on Raphael Drive, Tax Map No. 76.00-05-04.110, for a t variance in the terms and conditions of Article IV, Section 178-17 Al, of such Zoning Law to allow for a building height greater than allowed. David Plew, Chairperson Dated: January 10, 2007 Zoning Board of Appeals PUBLIC HEARING Drumm Construction Corp., Applicant/Baljinder Singh, RO - Raphael Dr. (Lots 3, 4, 5, 61 - Building Height Greater than Allowed Chairman David Plew recognized Mark Drumm, owner's representative, who explained that he was the general contractor for the construction of a new home for Mr. Singh. Architect's drawings depicting the various elevations of the home accompanied the application. Mr. Drumm explained that the maximum height of the home was 40 feet, and the home, due to the configuration/topo of the site, and utilizing a walk -out basement, would actually be at an average height of 43 feet. Chairman Plew asked Mr. Drumm if he had talked with the Town CEO to determine the height restrictions. He said he had, but there was some miscommunication and he thought the home was in compliance—until the plans were submitted to the Town. Chairman Plew then asked the applicant what the hardship would be if the height was allowed to be only 40 feet. Couldn't the owner go back to the architect and have the plans conform to Page 1 of 3 (T) Cortlandville Zoning Board of Appeals MAR 2 " 26p 23 January 2007 height restriction, 36 ft. 6 in. to the highest point of the house. The lot slopes up and the owners want a walkout basement at the rear of the home. As a result, the mean natural grade of the home makes it exceed the required height. If not doing the excavation required for the walkout basement, there would be no problem. It was noted that a letter in support of granting the variance was received from a neighbor, Edmund J. Hoffman Jr. Mr. Hoffman stated that other neighbors he had spoken with were likewise in support of the application. The requested expansion was 6 feet more than what presently exists. Chair Plew stated he had visited the site and the existing homes on the street were all the same distance from the road; the proposed addition would bring this home closer to the road. Mr. Stiles agreed and then produced a letter from the Bell Drive neighbors stating that they approved of the owner's request for a variance. A copy of this has been placed on file for the record. The property was constantly being trespassed upon and was looking for some way to "buy a little time to get the operation going." Joshua Hodgson asked what the height limit in Cortlandville was, and CEO Weber responded it depended on what zoning district the parcel was in; the subject parcel is in a Residential District, so the maximum height limit for an accessory use is 15 feet. The height of the proposed wind turbine is 66 feet. Mr. Anthonson has pine trees on his 1.3t acre property that are higher; only those necessary will be removed for the windmill. Member O'Rourke stated that her neighbor had a windmill and they could neither see it nor hear it. Board Member John Finn asked Town Attorney John Folmer if the Town Board was, at present, looking into regulating wind turbines. Attorney Folmer responded that there is a rough draft of a proposal for legislation regulating wind turbines/farms being circulated among the Boards; comments will probably be made at the Town's next Board meeting on 6 August. In order to adopt a Local Law of this type, the Town Board will be holding a Public Hearing, and referral will also have to be made to County Planning. No time frame for doing this has been set as yet. Mr. Cole stated that the proposed wind turbine will be erected 70 feet away from any property line. II APPEAL DECISION OF CEO — CONT'D 11 Appeal Decision of Code Enforcement Officer Regarding Requirement for a Special Permit (At the 8 July 2008 Public Hearing for this case, it was the consensus of the Board to continue this Appeal until this meeting of the Zoning Board of Appeals. Reference is made to those Minutes for details.) Chairman Plew stated he would allow Attorney Scott Chatfield, representing Joseph Armideo, Chris Calabro, and Keith Pace, and Town Code Enforcement Officer Bruce Weber, each fifteen minutes to speak regarding this matter. Attorney Chatfield's clients are appealing the decision of Code Enforcement Officer Bruce Weber regarding the Cortland College Suites application Page 5 of 8 0 C T 012000 (T) Cortlandville Zoning Board of Appeals 29 July 2008 for a Site Plan Review/ Conditional Permit without being required to file an application for an Aquifer Protection District Special Permit at the same time. Chairman Plew recognized Attorney Chatfield who stated that the Board members/ involved persons should have received a memorandum, dated 15 July 2008, from him regarding this Appeal. The issue presented to the Board is "what is the appropriate meaning of the phrase residential development? This, he felt, is what defines the need for an Aquifer Pollution Prevention Permit. He then clarified his comments. CEO Weber's interpretation, he stated, "is technically correct." However, the regulations, he felt, were designed to create an additional layer of protection for the residents. Examples of "residential" were included in the memorandum, but the issue was simply "what did the Town Board mean when it used that phrase, residential development? He felt they used it the way a lay person would. He then continued on with various comparables. He concluded that the ZBA should exercise its discretion in favor of being more cautious and protective of the environment and the sole - source aquifer. Chairman Plew then recognized CEO Weber who referred to Attorney Chatfield's memorandum of 15 July 2008, wherein he talked about the technical correctness of the interpretation. CEO Weber read the definition of technical. Intent of the regulations was read aloud, "A state of mind with which an act is done." CEO Weber stated that, in 1988, it is known why the regulations were inacted; two events—pollution from an industrial source, and pollution from septic/well separations. The Town Board, in 1988, enacted the regulations in response to these. Regulations, he stated, are adopted in response to events that happened. He gave examples of causes of later regulations: big box application resulted in big box regulations, windmill application is now resulting in windmill regulations, etc. The College Suites application has been submitted to the County Coordinated Review Committee (Health Department, Highway Department, County Planning, County Soil & Water, and NYSDEC). The !�. Stormwater Regulations deal with runoff, water quality issues, and Planning Board approval is required. CEO Weber stated he had spoken with John Helgren of the Health Department and, after explaining to him why the Aquifer Permit was not required, John said he understood why. CEO Weber gave the Town's definition of an apartment house, "a family living in a dwelling unit in a multi -family structure." That, he said, is what this is, based on the definitions within the Town Zoning Ordinance. Anderson's Zoning Law looks at residential uses and looks at multi- family housing as residential uses. He then read the Town's definition of multi -family housing, "one or more dwellings on a single lot containing separate dwelling units for occupation by three or more families." "There's no definition within the Town Zoning Law that limits how many dwelling units in a multi -family dwelling," CEO Weber stated. He then read aloud the intent of the R-3 District, which included residential development. Next, he read the intent of the Business District, which also permitted residential development. All this was to demonstrate that "multiple -family dwellings are residential uses as considered by this document." CEO Weber stated that Mr. Chatfield "says that I would classify an assisted living facility as a residential use." CEO Weber stated "I have not done that." In fact, Walden Place, was classified as a nursing home; it doesn't have the heading, residential, so the interpretation was not that it was a residential use and, therefore, it would require an Aquifer Protection District Permit. Same, he stated, with Country Inns and Suites, so an APDP was required. CEO Weber then asked "would the ZBA, Planning Board, and Town Board want me to have people applying for permits when they are not needed?" The Zoning Law, he stated, is required to be strict construction. My interpretation is based on the Zoning Law. Regulations can only be changed by the Town Board. Two comments made by Attorney Chatfield were then addressed by CEO Weber. (1) When referencing the applicants applying for a Special Permit, he asked "what are they afraid of." CEO Weber said "this would seem to apply that they may have influenced my decision regarding the need for a permit. At no time did I ever request a Special Permit Application, and Page 6 of 8 0 C T 012000 (T) Cortlandville Zoning Board of Appeals 29 July 2008 they have supplied all information the Planning Board has requested. (2) Attorney Chatfield's assertion that CEO Weber "make the decision and call it a day." CEO Weber stated, "I've been doing this job for 22 years, and I have never called it a day; I've been here every day and I take this charge seriously. I ask the Board to uphold my interpretation that this is a residential development. It does not meet any of the criteria within Article X of the Zoning Code to require a Special Permit, and the applicants have not shown anything, they have not given you any indication in the regulations that this use requires a Special Permit." Attorney Chatfield then asked for "rebuttal." Chairman Plew deferred to Town Attorney Folmer who affirmed that the Chairman had established the ground rules at the opening of this appeal and the Chair could adhere to that if he wished to. Chairman Plew wanted to adhere to the established rules. Attorney Chatfield stated he agreed to the Chair's wishes that he speak first because "he didn't want to play the game." But he felt that CEO Weber had raised a couple of points to which he wanted to respond. Chairman Plew denied the request, and Attorney Chatfield asked that this be noted on the record. Chairman Plew asked if there was anyone else present who would like to make a comment. He then recognized Brian Tobin, City of Cortland Alderman, who read a letter from the Cortland City Common Council, a copy of which has been placed on file for the record. The letter concerned increase runoff/flooding in City creekbeds and its concern with construction over the City's sole -source aquifer. CEO Weber attempted to respond to the City's letter, and Attorney Chatfield rose from his chair and shouted "No, you cannot make any comments if I can't make any comments. Let's make it fair here, let's make it fair here; if I don't have the right to speak again, he doesn't either!" Town Attorney Folmer politely diffused the situation and assured Attorney Chatfield that CEO N Weber was responding to "a letter from the City of Cortland." CEO Weber continued by saying that any concerns with the flooding situation were taken care of by the Stormwater Regulations which are now under review for this project. Chairman Plew attempted to close the Public Hearing, and Attorney Chatfield objected. Attorney Folmer stated Attorney Chatfield did only utilize 12 minutes of his allotted speaking time, so Attorney Chatfield was given an additional three minutes. He stated that the term "residential use" was not the term that's in consideration before the ZBA. He conceded that the application was for a residential use, technically, under the statute. The issue, he stated, is "what is meant by residential development?" CEO Weber, who had used only 13.5 minutes of the allotted 15 minutes, responded that in 1988, when the regulations were adopted, a single-family residence can be looked at as a residential development within the Town's definitions. Attorney Folmer asked CEO Weber, for the clarification of the Board, "when was this application filed? Was it filed prior to or subsequent to the adoption of the present Local Law #1, the current Zoning Ordinance?" CEO Weber answered that the application was filed in January, so it's under the new regulations, so it's a B-3 Zone. Chairman Plew then closed the Argument of the Appeal at 7 p.m. DISCUSSION /DECISION Chairman Plew asked the ZBA members for their comments. Member O'Rourke said that she understands where Attorney Chatfield "is coming from," but after her review of all the arguments presented, she felt CEO Weber's interpretation was substantiated. Member Bilodeau stated he had no problem with the CEO's interpretation, and felt that since the housing project would be served by municipal water and sewer, and that the runoff would be covered under the Stormwater Regulations, why would an Aquifer Permit be needed for Page 7 of 8 0 C T 012008 (T) Cortlandville Zoning Board of Appeals 29 July 2008 something which he felt was very well taken care.of. He agreed with CEO Weber. Member ' Wright also stated she agreed with CEO Weber as to the intent of the law. In fact, she experienced the pollution in 1988 which caused the enactment of the Local Law #1. Board Member John Finn also commented that he agreed with CEO Weber's interpretation as well, but asked why not have the applicant request an APDP and make things easier. CEO Weber responded that if the applicant had to apply for this Permit, then they would have to go through that process. The Town Planning Board, at their meeting immediately after this one, is ready to undergo the SEQR review and they have all of the information that they have requested; there is the potential for the Planning Board to act on the Conditional Permit. Attorney Folmer stated that if this was required, the Town Board would be required at their next meeting to fix a date for a Public Hearing; there's a five-day notice to publish the legal notice. Once the Public Hearing has been conducted, the potential then exists for the Town Board to grant the Aquifer Protection District Permit. If the Town Board decided on 6 August to do this, it would add another month or so to the process. Member Finn stated he had no further questions. After a brief consultation with Board members and the Town Attorney, a motion was made by Member Finn that the Town of Cortlandville Zoning Board of Appeals upholds the Code Enforcement Officer's interpretation of the Town's Zoning Code relating to Residential Development. A Variance request by a former resident resulted in vengeful actions to the residents on the opposite side of the street because neighbors rebelled against the Variance: Since those neighbors have moved away, we were left with an open eye sore in the neighborhood because no door was ever installed to conceal the ever growing collection of stored items. Shortly after the above mentioned situation, another front line variance was requested by a builder. Because we neighbors had such an unpleasant experience with the first situation, we collectively agreed not to attend the Variance Public Hearing. The construction did not affect neighboring properties. We are hopeful that in the future the Town of Cortlandville Zoning Board will request Building Permits and Plot Plans before construction begins followed by enforcement with inspections from the Code Enforcement Officer. We are grateful that our neighborhood consists of friendly, supportive people and we wish to keep it that way. Unfortunately, I will be out of town tending to an ill family member in Pennsylvania and will not be able to attend the meeting. The meeting announcement, however, does provoke a number of questions that come to mind regarding the variances listed in the document. As I read the listing, these variances for which exceptions to zoning codes are being sought appear to be for conditions that "already exist" at the specified locations... at least it is true of Item No. 3 which is in close proximity to my own home. How do these conditions arise to begin with? Doesn't an individual have an obligation by law to seek a permit from the Zoning Board before construction or installation of structures on a property? What .is the purpose of zoning codes if they are flagrantly disregarded? What is the responsibility of the officer in charge before the condition presents itself as a "variance?" I recall only too well a variance requested by a former resident on the opposite side of the street from my property whose installed carport was in violation of zoning codes. We neighbors rebelled at an appeal meeting, resulting in a threat to my safety from the appealing resident. Since that couple has moved away, the threat no longer exists. But the decision of the Zoning Board to have the carport moved and turned around to face the street has resulted in an open eyesore in the neighborhood since no door was ever added to conceal the growing collection of items stored inside. The consequent unpleasant view is a constant irritant to all neighbors living on the opposite side of the street. So what could be the result of the appeal for the listed variances? Would a structure already in place with foundation and walls be subject to be moved? Not likely. It appears that rather than exceptions to the zoning codes, what is needed is tightening up of adherence to the codes before conditions arise and scrupulous compliance to codes by all individuals responsible for carrying them out. In spite of the cranky tone of this letter, my desire to reside in a harmonious and peaceful neighborhood with residents who share similar concerns of our common environment rates very highly on my own list of codes to follow. I am very pleased and grateful to have friendly, supportive neighbors whose interchange is a valuable asset to me in having chosen to live in Cortlandville. Reputed Owner - Starr Road - TM #96.10-01-35.000 - Storage Building in R-2 District Chairman Plew recognized Michael Buchalla who was seeking a variance to construct a 40 ft. by 80 ft. storage building on this property which he plans to purchase if the variance is granted. He planned to store supplies and equipment for his roofing/ siding business in the proposed building. When asked by Chairman Plew to describe his hardship, the applicant stated the subject property was convenient to his home on Lamont Circle and land was "tough to come by." He planned to construct the building "within the next two years." Price was also a factor. In discussing a timeline, CEO Weber advised the applicant that he had 60 days to file for a Building Permit after a variance is received, and then have the building completed within one year. If not completed, the variance would be null and void and the applicant would have to start the process all over again. Also, if the variance is granted, the applicant would have to appear before the Planning Board for a Conditional Permit. Board Member Tom Bilodeau asked the applicant how often he would be visiting the storage building if it was constructed, and Mr. Buchalla estimated about twice a day. A 40 -foot setback is required and the addition would have a setback of 29 feet. Chairman Plew asked if there was anyone present who wished to speak regarding the proposed variance request; comments were received as follows: Tim Carmodv - 27 Isabel Drive - Directly behind subject property. Size of existing building is very large—well over 5000 SF. It's two stories on a double lot. Rest of homes are much smaller. Questions why a 600± SF addition is required. Applicant responded that the second floor was "all barn"—one big room. There's a woodshed on the first floor which is considered part of the barn. Member O'Rourke asked the applicant if she could expand into the first -floor barn area where the furnace is. The applicant stated this would not be feasible as it would "wreck the whole place." When asked if someone used the woodshop area, the applicant responded no, but there was a workbench and odds and ends of tools in there. Roughly, this area is about 60 ft. by 20 ft., and the unoccupied upstairs "barn area" is roughly 30 ft. by 60 ft., all of which is not being used. The upstairs portion has no headroom. CEO Weber added that the second floor may not be able to be used for habitable space. Chair Plew asked the applicant the reason for not being able to use the area where the furnace is, and she responded that they would have to tear out the entire kitchen. Member O'Rourke asked if she wouldn't have to remove a wall to construct the addition, and Ms. Hulbert responded yes. Chairman Plew suggested using a door. Chris Mott - 25 Isabel Drive - Purchased his home 1.5 years ago. Had problem with accumulated trash on subject property: farm machinery, trailers, 55 -gal. barrels containing ???; piles of debris, broken fences, old sheds recently hauled there and covered with tarps, etc. There are three separate entrances, 2 down, 1 up, on subject building. According to National Grid, up until 1999 the subject property had three separate meters; there's addition upon addition upon addition. It's a fire hazard. Strongly opposed to addition considering amount of space they have; they could utilize what they have. She was concerned that storage buildings would come into the residential area. Proposed building should look like residential garage and not a "big old Morton building." Applicant stated it would not look any different than what is in the area now, and would be three tones of gray. She's okay with building as long as it looks residential and not commercial, and is for his own personal use and not to be rented. CEO Weber asked what the height of the building would be, and Mr. Gardner stated he did not know at this time. He stated it would have to be at least 10 feet to accommodate his boat, and would probably have a 12 -foot door. Chairman Plew asked the applicant to explain what hardship there would be if he did not receive the requested variance, and Mr. Jackson stated that the lot is 89 feet wide by 462 feet deep, which would prevent its use "because I couldn't dispose of the property as nobody else can do anything with it." When asked who owned the property next door (#53, a woodlot), he replied that it was owned by his son and daughter. CEO Weber explained that the subject is an existing lot and, conceivably, a home could be constructed there.
