The Public Hearings were opened at 6:42 p.m. by Chairman David Plew, who read aloud
the Legal Notice published in the Cortland Standard on 14 January 2011, as follows:
Notice is hereby given that a Public Hearing before the Zoning Board of Appeals of the
Town of Cortlandville will be held Tuesday, January 25, 2010, at ' 6:45 p.m. at the
Raymond G. Thorpe Municipal Building, 3577 Terrace Road, in the Town of Cortlandville,
New York to consider the following application pursuant to the 1986 Zoning Law:
1. In the matter of the application of John Bishop for property located at 1217
Bell Drive, Tax Map No. 76.14-01-16.000, for a variance in the terms and
conditions of Article IV, Section 178-17 B2, for a shed closer to property line
than allowed.
2. In the matter of the application of the Cortlandville Fire District for property
located, at 999 Route 13, Tax Map No. 96.09-02-05.000, and property
located at 3757 Route 11, Tax Map No. 97.02-01-05.200 for a variance in
the terms and conditions of Article XVN, Section 178-111-K, for an
animated sign.

Chairman Plew recognized the applicant who explained to everyone present that he needed a
variance to allow his existing shed (installed in September '10) to remain closer to the property
line than allowed. He .had received a letter from the Tom Williams, the Town's Code Officer
asking him to either move the shed to :bring it into compliance or apply for a variance. The
shed sits a distance of 29.3 feet from his property line on NYS Route 281, wherein a 50 -foot
setback is required. Chairman Plew stated that he had visited the site and could hardly see the
shed.
Chairman Plew asked if there was anyone from the public who wished to speak on the proposed
variance; there was no one present at this time.
With everyone having been heard who wished to be heard,
Chairman Plew closed the Public Hearing at 6:47 p.m.
DISCUSSION /DECISION
After a brief discussion, a motion was made by Member Joann O'Rourke to grant the
variance for the shed closer to, the property line than allowed, as requested. The motion
was seconded by Member Tom Bilodeau, with the vote recorded as follows:

Motion passed.

PUBLIC -HEARING #2
Cortlandville Fire District. Applicant/ Reputed Owner - 999 NYS Route 13. TM #96.09-02-
05.000 & 3757 US Route 11 (Polkville), TM #97.02-01-05.200 -Animated Sims
Chairman Plew recognized Scott Roman, representing the applicant, who was seeking a
variance to have animated signs placed at both of the above, locations. Chairman Plew read
aloud the relevant sections of the Code regarding animated signs. The Fire District has many
messages that the signs will display; only the Route 13 sign is activated at this time.. Chairman
Plew commented that he did not want.any personal messages displayed, e.g., Joe Q. Public is
49 -Today! In addition, he felt that the sign flashed different messages so fast that they cannot
be read as one travels by it; he felt it was a traffic safety issue. Emergency messages, however,
he felt were okay. The frequency of the sign changing its message was too fast and should be
slowed ,down. Mr: Roman stated it is presently changing every minute and there are a total of
ten messages.
The Board suggested that perhaps a given message should be "fixed" on the sign for a specific
time, more than a minute. This was discussed. Member John Finn suggested trying a certain
_ period to see how it would work. PZO Weber advised that the Board could give conditional
approval for a message every . XX minutes, except for emergency situations. The message
should be of some putlic nature, not birthdays, weddings, etc.

` . The Polkville sign was discussed briefly; it will be 6 inches taller than the Route .13 sign. .
Chairman Plew felt the Polkville sign was too low. -
Chairman Plew asked if there was anyone from: the public who wished to speak on the proposed
variance; there was .no one ,present who wished to do so.
With everyone having been heard who wished to be heard,
ChairmanTlew closed the Public.Hearing at 7:16 p.m. .
DISCUSSION/ DECISION
After a short discussion, a motion was made by Member John Finn to grant' a Conditional:
Variance to allow the animated signs to have four (4) message changes per hour, except
for emergencies; if. no appeal made within six months, thenthis motion_ stands. -The
motion was seconded by Member Joann O'Rourke, with the vote recorded as follows:

Morgan Jones, Avi icant/Stephen & Anne Farrell, Reputed Owners - NYS Route 41
(McGraw) - TM #88.16-01-05.120 - Mini Storage Facility in an Ag District
Chairman Plew recognized the applicant who explained to everyone present that he needed a
variance to allow mini self -storage units on the subject property containing just under 2.5±
acres. The proposed location, which is vacant,- has been on the market for about two years..
The topo to the rear of the lot is steep and wooded, not conducive to building of any kind. In'
front of this area, is a wet area/natural stream, 350± feet. from the roadside edge of the
property. In a narrative, accompanying the variance application, Mr. Jones stated that the
property may not be suitable for a residential dwelling because,the water table may be too high

which would require a raised bed leach field and may prevent the installation of a full
foundation. Unlike a residence, these mini storage units only require a slab foundation.
Mr. Jones stated he was proposing to construct the units in phases: Phase One would be two
storage units, each measuring 30 feet wide by 100 feet long and containing 20 units, for a total
of 40 units. He would meet the required setbacks. No utilities would be needed as there would
be no office. He would have a second phase only if needed.
Chairman Plew .asked what would be the hardship if a variance was not granted. Mr. Jones
responded that, as stated in his narrative, he would be unable -to realize a reasonable return on
the property. The lot, as stated before, has been on the market for two years, and he believes
that if a variance .is not granted, the property will remain undeveloped and continue to be a tax
burden. He stated he has looked for other properties, but they are cost prohibitive. Member
John Finn asked the applicant if he would have any kind of=a buffer to keep visibility of the
planned project to a minimum, and Mr. Jones responded that the original hedgerow would
remain. Member Joann O'Rourke asked how he would monitor the storage of any hazardous
materials, and the applicant answered he would ascertain what the procedure is from other
similar storage facilities to see how they prevent/monitor same. Chairman Plew stated that
once the unit is rented, the owner has no control over what is stored in there.
Chairman Plew asked if there was anyone from the public who wished to speak on the proposed
variance; The following persons spoke:
James Miller - 4401 NYS Route 41 - It's ag land and he's not the property owner right
now. Applicant looking at it as commercial venture and will put it into the residential
neighborhood. What about security? Opposed to the storage units. It will be an
eyesore and degrade the property values and it's not the place for a commercial
facility.
Tom Uhlemann - 4469 NYS Route 41 - Submitted a petition signed by 25 area
residents in opposition to the proposed storage unit facility. He requested not to
change the zoning from Agriculture to Commercial. PZO Weber clarified that the
subject property is zoned Agriculture and the request is NOT to change the zoning but
to have a use that is not permitted in an Ag District. Mr. Uhlemann was opposed to
granting the variance. Chairman Plew read aloud the petition, a copy of which has
been placed on file for the record.
Shannon Westmoreland - 4477 NYS Route 41 - Concerned about increased traffic.
She will not be secure at night. There will be strangers in the middle of the night. She

drawing accompanying the application. PZO Weber stated that the sign size is satisfactory, but
a variance is needed for the illumination. Member Joann O'Rourke asked what the store hours
will be, and Mr. Wescott stated that he did not know at this time.

Member Finn brought up the Board's concern with the removal of the trees on this property
which was not supposed to have occurred. Whatever happened to this? PZO Weber reported
that the Town Board has not chosen to do anything about this violation. PZO Weber offered to'
look back in the file to see what has transpired over the years, but if the ZBA wants to have the
Town Board pursue the matter, then the ZBA should have a motion to that effect.

Cortlandville Crossing. LLC. Applicant/Reputed Owner - NYS Route 13 (south of
Avolebee'si - TM #95.10-02-06.000 - Sian Variances
When the hearing was opened, there was no representative present; however, PZO Weber
informed the Board that a rep was planning on being here at 7 PM. Therefore, in the interim,
the Board discussed what was being proposed. PZO Weber explained what he thought the
applicant was proposing, based on the information submitted along with the application. He
stated that there were to be north, south, and west elevations. The applicant is requesting
three signs along Route 13 and directional signs within the parking area. They are also
proposing to move one of the signs to the driveway. Member Finn asked why the proposed
Aspen Dental sign couldn't be incorporated in one of the other signs.
Within a few minutes, Adam Heindel of Excel Engineering, representing the applicant, arrived
to further explain what was being requested. The requested signs were numerous and
explained to the Board. Member Finn felt that what was being requested amounted to "sign
pollution."
Chairman Plew asked Mr. Heindel what would be the hardship if the requested variances were
denied. Mr. Heindel responded that there are so many businesses located at this mall, but the
Code only allows two signs per lot; therefore, the business could not be easily located without
additional signage.
At the conclusion of the Board's questions, Chairman Plew asked if there was anyone from the
public who wished to speak on the proposed variance; there was no one.
With everyone having been heard who wished to be heard,
Chairman Plew closed the Public Hearing at 7:15 p.m.
DISCUSSION /DECISION
Member Finn thought three of the signs were okay. Member Joann O'Rourke did not believe
they needed directional signs and further thought the illuminated signs should be lit from 7 AM
to 10 PM only.
After a very extensive discussion, a motion was made by Member Finn to grant/deny the
requested variances as follows: (1) size of two building -mounted signs shall be in
compliance with the Code, but they may be illuminated only from 7 AM until 10 PM, (2)
variance for signs A & B, as shown on the overall Site Plan dated 3/11/11, which
accompanied the variance application, is granted, and (3) all other requested variances

02.000 - Lot Area Less Than Allowed
Chairman Plew recognized Attorney David Alexander, representing the applicant who was
seeking a variance to subdivide her land as shown on the aerial photo attached to the
application; one of the three parcels in this subdivision would be smaller than the required one
acre. This smaller lot would maximize preservation of'the existing farmland.
Also enclosed with the application was a 23 February 2011 letter to the applicant from the
Cortland County Health Department agreeing that the proposed subdivision will provide
sufficient land area to allow 100% replacement of the septic system and well, therefore the
Department "finds the proposed subdivision acceptable." No new construction would be
involved. Chairman Plew remarked that he did not see why this smaller lot could not be made
to conform to the requirements, since it is being subdivided from the applicant's 134± acre
parcel. Attorney Alexander responded that the buyer for this smaller parcel does not want to
maintain anything larger.
At the conclusion of the Board's questions, Chairman Plew asked if there was anyone from the
public who wished to speak on the proposed variance; there was no one.

Snyder, representing the applicant who was seeking a variance to allow a light industrial use in
a B-2 District. Chairman Plew noted that the applicant has been granted previous approvals,
but nothing has been done; will there be something forthcoming? Mr. Beebe responded that
there would be as they have now come up with the "best plan."
The ZBA acknowledged receipt of the Cortland County Planning Department's 13 May 2011
report to the County Planning Board. The representatives for the applicant agreed that they

Interuretation
Chairman Plew recognized Attorney Matt Neuman, representing the applicant who was seeking
the Board's Interpretation regarding a "pre-existing non -conforming use." In his letter to this
Board, Attorney Neuman stated that "it is our position that the Code Officer is incorrect in his
interpretation that there is no pre-existing non -conforming use." (CEO Tom Williams had
noticed all the trees and shrubs on the property, which initiated this Interpretation.)
Attorney Neuman stated that the previous use (trucking business/ terminal) was a non-
conforming use. Mr. Sachetti wishes to operate a commercial/ residential landscaping business
from this site; he's been in business for 23 years and has six employees. Instead of tractor -
trailers, Mr. Sachetti will have trees and shrubs.
Chairman Plew acknowledged that although a landscaping business would be better, it's still a
change in use. Also, why not apply for the variance and a Conditional Permit instead of
starting out with an Interpretation? Member O'Rourke added that "when you purchased the
property, did ou think you would have no problem?"
Member Tom Bilodeau stated he agreed with PZO Weber's interpretation as he knows the Code;
he would like to see the applicant go through the variance process and obtain a Conditional
Permit. Member Kevin Whitney reiterated the same, as did Member John Finn.
At the conclusion of the Board's questions, Chairman Plew asked if there was anyone from the
public who wished to speak on the proposed Interpretation; there was no one.
With everyone having been heard who wished to be heard,
Chairman Plew closed the Public Hearing at 7 p.m.

Louis Sachetti. Applicant/Reputed Owner - 3403 Kelloae Road - TM #97.00-04-07.000 &
97.0 }-02-03.000 - Use Variance for LandscavineE Business in R2 District
Chairman Plew recognized both the applicant and his attorney, Matt Neuman. Mr. Sachetti
explained that he had purchased the subject property in November 2010; it was the site of a
former trucking company who had occupied the property for the past 30 years. The trucking
business was a non -conforming use, as is the proposed use. Therefore, a use variance needs to
be obtained.
Planning & Zoning Officer Bruce Weber reported that last month the applicant requested an
interpretation of his decision regarding this matter; this Board upheld the PZO's decision that a
use variance was required.
Mr. Sachetti stated that he did not realize he needed a variance when he purchased the
property. Member John Finn acknowledged the Board's receipt of the Cortland County
Planning Board's Resolution No. 11-23 of 20 July 2011, which recommended approval of the

application contingent upon five (5) items as stated therein. Mr. Sachetti stated he agreed
none of the items posed a problem for him.
When asked by Acting Chair O'Rourke what his hardship would be if the requested variance
was denied, Mr. Sachetti responded that he believed he could operate his business there
because it was a business use when he purchased the property, so he has now established his
business there. Also, he has tried other locations, but none of the worked out. Not being able
to use the subject site, he stated, would affect his business greatly.
Acting Chair O'Rourke asked if there was anyone from the public who wished to speak on the
proposed variance; there was no one.
With everyone having been heard who wished to be heard,
Acting Chair O'Rourke closed the Public Hearing at 7:06 p.m.
DISCUSSION/ DECISION
Acting Chair O'Rourke agreed that it was easy for the applicant to think that his landscaping
business would be a permitted use, since the site was previously utilized for a trucking
business.
After a brief discussion, a motion was made by Member Tom Bilodeau to grant the variance
for a landscaping business in an R2 District, incorporating Items 1 thru 5 of the Cortland
County Planning Board's Resolution #11-23 of 20 July 2011. The motion was seconded
by Member Kevin Whitney, with the vote recorded as follows:

Chairman Plew recognized the applicant who was seeking a variance to construct a 10 ft. by 20
ft. storage building on a vacant parcel located in. an Ag District; a variance is required because
there is no residence on the site. Mr. Wescott stated he purchased the property in December,
and needed the building to house his lawn furniture, gas grill, mower, ATV, etc.; he uses the
property for recreational purposes at present, but would like to build a home there eventually.
He also leases the property to a farmer for crops.

Chairman Plew acknowledged that neither the applicant nor his representative was present. In
response to the Board's questions, PZO Weber stated that the subject lot size was 65 by 202
feet, as shown on the map accompanying the application. He stated he spoke with the
applicant and advised that someone needed to come before this Board. Board members agreed
that they had questions regarding the application.
Member Finn felt the requested building to be erected was quite large, 18 feet by 40 feet. The
Board also talked about the handicapped ramp in the front and back, along with the fence, and
trash which littered the front. PZO Weber also stated that there may be Building Code issues,
too.
Chairman Plew asked if there was anyone from the public who wished to speak on the proposed
variance; there was no one.

purpose he stated, was because he wants a place to put a rocking chair to enjoy in his
retirement. Chairman Plew commented that he had visited the location and tried to line up the
front of the subject home with adjacent homes; he could not 'as they are "all over the place."
The proposed porch would fall 39 feet from the edge of the right-of-way. No one else on the

would be changed from time to time, but would stay within the sizes given. He stated they may
not be able to display them in the winter. They will not be lighted in any manner, and the
signs/banners will not be permanent. The signs, as shown, will be hung between the store
porch's front columns utilizing twine.

to construct a, 5 ft.. by 6 ft. wheelchair lift/pad at the location shown on the sketch.

allowed. Mr. Bufano explained that although there was a side door, it opens into the laundry
which is so narrow it would not accommodate a wheelchair, passing through. After conducting

- Outside Storage of Commercial Equipment in Residential District_
Chairman Plew recognized the applicant who. was appearing before the Board as a result of
notification by PZO Weber that it was a violation of the Code to store commercial equipment
outside in a Residential District as the applicant -is currently doing. Some of the equipment is
covered with tarps. Mr. Riccardi stated he had gathered 10± signatures from his neighbors
who do not object to having the equipment where it is. Also, he stated, it cannot be viewed -

from the street. Chairman Plew, in answer to Member Finn's .question, stated there were three
trucks, a bulldozer, skid steer, etc. on the property.
Chairman Plew stated he had visited the subject site and the property looks "like a junk yard."
Adjacent neighbors have their lawns mowed and neat; the applicant's property. was not. In
addition, it appeared .the commercial vehicles had not been "out of there in awhile.". Mr.
Riccardi responded that he used the vehicles "periodically," but he did not use them every day.
Chairman Plew stated he did not have.a problem with keeping the trucks "back there," but the
property should be cleaned up. Members Finn and O'Rourke commented that they had not
visited the site, but would like to have that opportunity.
In response to Member Finn's question, the applicant stated there were three trucks on the
property, and the cars were actually on the City portion of his property. All vehicles were
registered, including the equipment trailer; the bulldozer and skid steer did not require
licenses. There was also a large boat there.
Chairman Plew then stated if he visited the site and saw "just the dog pens, and just the
vehicles, lined up neatly like you have them, and nothing else, he would have no problem." But
the way it looks is a mess. If everything was stored in a pole barn, there would .be no
problem. Mr. Riccardi stated he would do whatever it takes to "getyid of whatever you think is_
bad."
PZO Weber explained that the applicant had been cited almost a year ago and has now made
application for the requested variance; any proceedings against the applicant have been stayed
pending the results of this application. Had the applicant responded to earlier requests to
address the issue, PZO Weber commented, then there would have been no Notice of Violation

11 PUBLIC HEARING # 1
Carlos & Helene Karam. Applicants/Reputed Owners - 3740 Lv_ ncort Drive - TM #95.06-
01-11.000 - Front Yard Less Than Allowed
Chairman Plew stated that he had visited the site today, and that when the Karams purchased
the home there were steps there with a wrought iron railing in bad repair. They have removed
that and now wish to put a front porch on the property which would bring them closer to the
road than allowed.
Member John Finn asked how much closer to the road was it than the previous porch?
Chairman Plew answered that it was approximately six inches farther to the road than the
concrete slab. PZO Bruce Weber explained that the proposed deck with roof is to be the full
length of the house; he was not replacing what was there. The proposed "porch" was a "six-foot
wide deck with a roof, and then the stairs will go beyond that, so the deck itself will be 28 feet 6
inches, approximately, from the property line and 50 feet is required." The home itself was
constructed a distance of 35 feet from the road which was okay at that time.
Chairman Plew asked if there was anyone from the public who wished to speak on the proposed
variance. The following persons were recognized:
Dick Tupper - 3741 Lvncort Drive - The Karams have greatly improved their house.
Adding the requested porch will improve its curb appeal. Lots in area are large and
deck/porch will not be noticed. Had no objection to granting of the variance.

Chairman Plew commented that there is very little traffic on this street.

Chairman Plew stated he had visited the subject site today, and he asked if the new porch is
going to cover cement block and sidewalk. Mr. Cavellier said it would, being 10 feet in width; it
will extend one foot on either side of that. It would then come out seven feet.
Chairman Plew then asked the applicant what was his hardship. The applicant responded
"none."

PUBLIC HEARING #3
JM Murray. Applicant/Reputed Owner - 823 NYS Route 13 - TM #95.00-10-11.200 -
Front Yard Less Than Allowed
Chairman Plew recognized Tedd Couchman, representing the applicant who was seeking a
variance to increase the height of their existing sign at this location to 18 feet (it is now 10 feet)
and decrease the current 16 -foot width to 10 feet, as shown on the photos accompanying the
application. The sign, he stated, will begin with eight -feet high posts, topped by a 10 ft. by 10
ft. sign. The existing sign sits on the front lawn along NYS Route 13, which is at a higher
elevation. Raising the sign height would increase visibility, he stated. Trucks visit this facility
all of the time and have difficulty locating the building. Member O'Rourke asked if they would
be removing the bushes which are currently obstructing portions of the sign; Mr. Couchman
stated this "would not be part of it" but may occur at some point. He also explained that JM
Murray had a new logo and wanted the sign redesigned to reflect that; he showed the Board an
example.
PZO Weber, in response to Member Finn's question, stated that a variance was needed because
an 18 -foot high sign exceeded the maximum 8 -foot high requirement for pole signs. The
Walmart sign was questioned; PZO Weber explained that the Walmart sign sits on top of an 8±
foot berm which makes their sign look considerably higher.
Member O'Rourke suggested that the applicant get rid of the bushes to make the sign more
visible; Member Bilodeau agreed. Member Kevin Whitney asked details of construction, which
Mr. Couchman explained; he also stated the sign would be skirted and illuminated. Member
Whitney stated he liked the new logo and had no problem seeing the present sign, but felt the
proposed size of the sign was not proportional like the one that is there.

Chairman Plew closed the Public Hearing at 6:54 p.m.
DISCUSSION/ DECISION
Chairman Plew commented that the bushes were a big problem, and an 18 -foot sign was not
needed. Member O'Rourke felt that a sign with a height of 18 -foot was "way too high." Member
Finn agreed. PZO Weber reminded the Board members about snow being 3-4 feet deep at the
sign location, potentially putting the bottom of the sign four feet from off the ground.

- Outside Storage of Commercial Eauivment in Residential District
(At the September 2011 meeting of this Board, the Public Hearing was held and closed. The
Board concluded with a motion to postpone this appeal until the 26 October 2011 meeting to
allow time for ZBA members to visit/observe the site. Reference is made to the 9/27/11
Minutes for details.)
DISCUSSION/ DECISION
Member O'Rourke stated that she had not visited the subject property this time. Member
Bilodeau stated he viewed the property from the street. Member Whitney stated that he passes
by the property all of the time and was surprised to see "all of that out there." He stated that
he thought it was in the City of Cortland at first. He also felt that having commercial
equipment stored on the subject property would set a precedent if it was allowed. Member Finn
added that he had made notes of what items were on the property: white truck w/ CT
registration which had expired, blue dumptruck w/registration about to expire, snowmobile
trailer w/no plates, white/orange truck w/inspection sticker which expired last January,
covered boat trailer (license not visible), along with several other pieces of equipment. PZO
Weber read from the appropriate section of the Code.
Member Finn stated that if all of this was stored inside a building on the property, there would
be no problem. Chairman Plew added that there was a lot of "stuff' out there, including 4-5
tires, and if he was a neighbor, he would object to the condition of the property. Member Finn
stated one of his concerns was that there was a lot of property there and, conceivably, more
acquired equipment would end up there. Chairman Plew commented that "everything is all
lined up."
Mr. Riccardi responded by saying that he had a lot of that stuff there for 7 or 8 years, and it
had never been a problem. PZO Weber advised the applicant that he had received a complaint.
Town Attorney Folmer added that the Town Code Enforcement Officer had, in response to an
anonymous complaint, inspected the property and confirmed that it was not in compliance with
the Code. The Town is trying to enforce the Code. Mr. Riccardi then applied for a variance.
Member O'Rourke then asked the applicant what he would do if the requested variance was
denied; the applicant responded, "sell everything." He stated he also had a full-time job.
Member O'Rourke asked him if it was possible to put everything "under cover." PZO Weber
stated that the applicant would need a Building Permit to build a structure meeting the
Building Code. Mr. Riccardi responded "it's not worth it to do that." He uses the equipment
occasionally. Chairman Plew asked he applicant if he had explored storing everything
elsewhere; he responded that he would then have to worry about vandalism. Member Finn
concluded by stating that commercial equipment was being stored outside in a Residential
District and that's not permissible.

Chairman Plew recognized the applicant who was seeking a variance for a new sign to be placed
too close to the property line and also at a greater height than allowed, all as depicted on the
sketch and sign cut` accompanying the application, along with the applicant's narrative. The
proposed sign would have a height of 17 ft. 8 inches, and only 8 feet is allowed. The distance
from the side property. line setback is proposed at 10 feet. Mr. Braun explained that, since the
widening of Route 281, they do not have enough depth to their property to place the sign in

front of the restaurant; .therefore, he was proposing to situate the sign on the south side of his
property,. as shown on the sketch.
Chairman 'Plew asked the applicant why he couldn't put the sign where his Doug's truck is
now. He then suggested a conforming sign, but a variance for the setback only. Mr. Braun
responded that the height was desired as his restaurant property is lower than the road.
Chairman Plew asked if there was anyone from the public who wished to "speak on the proposed
variance; there was no one.

DISCUSSION/ DECISION
PZO Weber suggested the Board may want to consider is the peak portion of the sign, as
depicted; it is about two feet higher than the actual sign itself. Maybe change the dimensions
of the sign, e.g., making -it more rectangular. If sign reduced in height, the support members
would not have to be'as large. The applicant stated he did have another option from the sign
company, and showed it to .the Board; the option was an 8 -foot high sign by 5 ft. 5 in. It was
then suggested to use the second sign, but add the peak from the first sign.
At the conclusion of an extensive discussion, a motion was made by Member Kevin Whitney
to grant the variance for a sign height of eight (8) feet plus the proposed peak of up to
two (2) feet over that, and placed closer to the property line on the north side of the
building. The motion was seconded by Member Joann O'Rourke, with the vote recorded
as follows:

DISCUSSION/ DECISION
After a brief discussion regarding the hours of sign illumination, a motion was made by
Member O'Rourke to grant the variance for building -mounted sign(s) to be illuminated, as
requested, with illumination to be from 7 a.m. to 9 p.m. The motion was seconded by
Member Kevin Whitney, with the vote recorded as follows:

Manufactured Home w/Length Less than Allowed
Chairman Plew opened the Public Hearing which had been postponed from November as there
was no applicant nor representative present to answer the Board's question. Mr: Wilcox, the
applicant was seeking a variance to place a 26 ft. 8 in. by 44ft. manufactured home on this
7.76± acre parcel of land; the requirement is 23 ft. by 48 ft. which is a length less than allowed.
Member O'Rourke stated she had no problem with what was requested. Member Kevin
Whitney asked the applicant why he couldn't conform to the requirements; Mr. Wilcox
responded that a larger home was not financially possible, and he wanted to be able to afford a
new home.
In answer to the Board's questions, the applicant stated that the home was a 2005
Redman/New Moon double -wide, and it would have a crawl space. Chairman Plew asked Mr.
Wilcox if he had a photo of the home; he did, but did not have it with him.
Chairman Plew asked if there was anyone from the public who wished to speak on the proposed
variance; there was no one.

Chairman Plew closed the Public Hearing at 7:14 p.m.
