An Executive Meeting was held by the Zoning Board
of Appeals of the Town of Cortlandville on Tuesday,
January 11, 1994 at 7:26 p.m. at the Town Hall, 15
Terrace Rd., Cortland, New York, for a variance to allow
for a building -mounted sign to be illuminated and for a
free-standing sign with greater area and height than
allowed.

Others present were: CEO Bruce Weber, Ken Teter.
Chairman David Plew called the Executive Meeting to
order.
Chairperson Plew and Member John Finn stated that
the signs requested are not excessive and that the
planned removal of the "Food Store" sign is commendable.
No further comments or questions regarding this
application were heard.
THEREFORE, a motion was made by Member John Finn,
seconded by Member Thomas Bilodeau, to approve the
application for variance as submitted by ALDI, Inc. for
two illuminated building -mounted signs, and a free-
standing sign 28 feet high, with the condition that the
"Food Store" portion of the free-standing sign be
removed three years from time of installation. This
variance is granted for the ALDI Food Store to be
constructed on Rte. 13 at the junction of Rte. 281. All
voting aye, the motion was carried.
This becomes RESOLUTION ##1 OF 1994.

Because Mr. Ferris was not present, Chairman Plew
suggested that this application be tabled. Board
members concurred.
THEREFORE, a motion was made by Chairman David
Plew, seconded by Member John Finn, to table the
application for variance as submitted by Richard Ferris
for an illuminated building -mounted sign for property
located at Cortlandville Crossing. All voting aye, the
motion was carried.
This becomes RESOLUTION -#2 OF 1994.
With no further comments or questions heard, a
motion to adjourn the meeting was made by Chairman David
Plew. The meeting was adjourned at 7:12 P.M.

April 26, 1994 at 7:07 p.m. at the Town Hall, 15 Terrace
Rd., Cortland, New York, for a variance to allow for
establishment of a business office and used car sales in
an agricultural zone.

Member Bilodeau stated that he would prefer to have
the area re -zoned business, and then grant a use
variance for the riding stable, than to approve the
variance for used car sales in an agricultural zone.
Chairman Plew stated that the area in question will
be built up in years to come and that Mr. Staley is in a
position to request the appropriate zoning change.
CEO Weber stated that the riding stable, an allowed
use in an agricultural zone, could be grandfathered if
approved by the planning board before a change of zoning
to commercial occurs.
No further comments or questions regarding this
application were heard.
THEREFORE, a motion was made by Chairman David
Plew, seconded by Member John Finn, to DENY the
application for variance submitted by Doug Staley for a
business office and used car sales in an agricultural
zone. All voting aye, the motion was carried.

application for variance should have been presented to
this Board before the unit was built. He stated that
appeasing local residents by granting the variance with
the assertion that "never again" would another such unit
be allowed is not an alternative because a future
applicant WILL use this variance as a precedent.
Members Finn, Bilodeau and O'Rourke concurred that the
hardship involved is self-inflicted and that granting
this variance would set an undesirable precedent.

Chairman David Plew asked if the County Planning
Department is making a legal request. CEO Bruce Weber
replied that it is, and explained exactly what is being
asked. He stated that simply sending a copy of the
minutes of the meeting will suffice, provided that the
resolution made for any application for which the ZBA
votes contrary to the County include the reasons for
disagreeing with the County. Board members concurred
that there is no reason not to comply with this request,
and agreed that a copy of ZBA minutes be sent to the
County Planning Department.
With no further comments or questions heard, a
motion to adjourn the meeting was made by Member
Patricia Wright. The meeting was adjourned at 7:05 P.M.
