An Executive Meeting was held by the Zoning Board of Appeals, of the Town of Cortlandville, on January 21, 1993 at 7:00 p.m. at the Town Hall, 15 Terrace Rd., Cortland, New York, for a variance to allow for a ground sign with the height greater than eight (8') feet. The conditions are: 1) Mr. Kuck will permit unannounced inspection of his business by Zoning Board Members or the code enforcement officer. 2) If a violation is found, operation will cease until the violation is corrected. 3) The variance is for Mr. Kuck only; if the property is sold or used for a business other than Mr. Kuck's.machine shop, the variance is cancelled. Chairman Plew explained to Mr. Dimorier that the variance will permit only his son to live in the proposed apartment during the time he is attending college. He added that once Mark Dimorier has ceased to attend college, for whatever reason, the apartment must be vacated and revert to storage use. THEREFORE, a motion was made by Member Thomas Bilodeau, seconded by Member John Finn, to grant the application of Larry Dimorier for a variance to allow for a second residence for property located at 3776 McGraw Marathon Road, with conditions. The conditions are as follows: 1.) The proposed apartment is for the use of Larry Dimorier's son, Mark Dimorier, only. 2.) Mark Dimorier is to reside in the f41, Thursday, May 20, 1993 Page 2 apartment only while he is attending college. 3.) Within two months of leaving college, Mark Dimorier is to vacate the apartment. Mr. Mahler pointed out that his application was based on financial hardship. Discussion ensued regarding the establishment of an economic hardship. Chairman Plew stated that other applications for mobile homes under financial hardship were usually for temporary use. No further comments or questions were heard. THEREFORE, a motion was made by Chairman David Plew, seconded by Member John Finn, to DENY the application of Edward Mahler for a variance to allow for a second residence for property located at 2197 Greenwood Road. EXECUTIVE MEETING DAVID YAMAN (TOFFOLO) - 274 TOMPKINS ST. - APPEAL 96.09-01-42.000 An Executive Meeting was held by the Zoning Board of Appeals of the Town of Cortlandville on June 9, 1993 at 7:40 p.m. at the Town Hall, 15 Terrace Rd., Cortland, New York, for an appeal to a determination of the Code Enforcement Officer . Members present: Chairman, David Plew John Finn Thomas Bilodeau Joann O'Rourke Patrica Wright Absent: Secretary, Julie Ray Others present were: CEO Bruce Weber, David Yaman, Attorney James Baranello, and Clemente Toffolo. Chairman David Plew called the Executive Meeting to order. ' Chairman Plew stated that the Board does not wish to over -rule the determination of Code Enforcement Officer Bruce Weber that the proposed use of the former Cortland Tile and Terraz0 building by Royal Care Pharmacy Inc. is an industrial use. He asked if the board may rule that the business of Cortland Tile and Terrazo as conducted by Clemente Toffolo was a non- conforming industrial use. CEO Bruce Weber answered that the Board could do SO. The proposed use by Royal Pharmacy would then be a pre-existing non -conforming use. This use would transfer with the property. Chairman Plew asked if the new occupant could apply for a variance for an industrial use in a business district so that its occupancy would no longer be classified "non -conforming." CEO Weber answered that this could be done, but the variance would not be needed because the occupancy would be a permitted use. A variance would be needed if the occupant wished to add on to the building or enlarge the use. Wednesday, June 9, 1993 No further comments the Board members. ,_�_o Page 2 or questions were heard from THEREFORE, a motion was made by Member Joann O'Rourke, seco.nded by Member John Finn, that the Zoning Board of Appeals of the Town of Cortlandville recognize that the business conducted by Clemente Toffolo as Cortland Tile and Terrazo at 274 Tompkins Street was a pre-existing industrial use and that the business proposed to locate in that building, Royal Care Pharmacy, Inc. is a continuance of that industrial use. All voting aye, the motion was carried.
